Foreword from the ChairThis report covers the period 1st April 2005 to 31 March 2006.
During this time theBoardhasmet formally three times, andheld three teleconferences.
Boardsubcommitteescontinuedtheirbusinessbyteleconferenceandelectronic-mail.
ThispastyearhasseenclosureonanumberofissuesthathaveoccupiedtheBoardfor
someyears.
These include: the enactment of a restricted activity (under section 9 of the Health
PractitionersCompetenceAssuranceAct2003)thatprotectsthepublicfromtheprescribing
ofanopticalapplianceorophthalmicmedicaldevicewithoutfirstadiagnosisbeingmade
byahealthpractitionerqualifiedtomakethatdiagnosis;andtheenactmentofregulations
undertheMedicinesAct1984topermitappropriatelyqualifiedoptometriststoprescribe
22prescriptionophthalmicmedicinesandallofthepharmacyophthalmicmedicines.
In addition, the framework has been established (which includes a contract with the
AssociationofDispensingOpticiansofNewZealand)torecordContinuingProfessional
Development (CPD) for optical dispensing, which means that compulsory CPD for
dispensingopticianswillbearealityinthenextAnnualPractisingCertificateround.This
followsthealreadysuccessfulcompulsoryCPDprocessestablishedforoptometrists.
Standards of clinical competence, ethical conduct and cultural competence are now
completedandpublished.Ashasbeenpreviouslystatedandreiteratedagainlaterinthis
report, thesedocuments are livingdocuments and canbe changedwithdueprocess.
Ifyouhaveanycomment tomakeonthem, theBoardwillbehappyto receive those
commentsandrespondtothem.
SomeBoardbusinessrelatingtoprocessesnowinplaceundertheHealthPractitioners
CompetenceAssuranceAct2003areunfinished.Notably theBoardawaitsa response
fromCityandAngliaUniversities intheUKonthecoursesthathavebeenprovidedto
theiroptometrygraduatesinDiagnosticPharmaceuticalAgents,despiteremindersfrom
theBoardtotheGeneralOpticalCouncilforthisinformation.
OfconsiderableconcerntopractitionersandpublicalikeisPHARMAC’sdecisiontodeny
patients who are prescribed “retail pharmacy-specialist” prescription medicines by a
designatedoptometristprescriber,accesstothesubsidiesapplicabletothosemedicines.
MedicineslistedinthePHARMACPharmaceuticalScheduleas“retailpharmacy-specialist”
medicines requireaprescriptionthat iscountersignedbyavocationalspecialist, in this
caseanophthalmologist,inorderforthepatienttoqualifyfortheapplicablesubsidy.
TheBoardwillultimatelychallengethedecisionmadebyPHARMAC.
Inaddition,competencereviewprocesses (based largelyonthoseusedbytheMedical
Council)arestillbeingdevelopedandarenowatthestagewheretheBoardislookingfor
theprofessions’andeducationinstitutions’inputbeforetheprocessispiloted.
Fromthecompetencyreviewprocesswillevolve“BacktoWork”programmesforthose
whotakeasignificanttimeawayfromwork,andtheself-auditquestionnaire(designed
toenablepractitionerstoself-audittheircompetencystatus).

Atthe lastmeetingof theyear (31stMarch) I stooddownasBoardChair.Thepast3
yearsasChairhavebeenintensebutneverburdensome.IfeelthatIhavebeenprivileged
tohavebeeninapositionwhereIcouldservetheprofessionsofoptometryandoptical
dispensingata timeof significant change.Thesechangeshaveundoubtedlybeen for
thebetter.TheBoardhas respondedwell to thechallengesandopportunity thatnew
legislationinvariablybrings.
IwouldliketoacknowledgethevaluableinputintoBoardaffairsbyVivianEdgar,Deputy
Chair.Vivianhasledthedevelopmentofthecompetencyreviewprocess.AnnetteKeleher
has chaired the Optometrists CPD Accreditation Committee and was instrumental in
developing the cultural competencies document; Joanne Ryan has become the Chair
oftheDispensingOpticiansCPDAccreditationCommittee.MichaelBlackman,Michael
Firmston, John McLennan, Hywel Bowen, Carrick Lewis and George Lazaridis have all
contributedinthegeneralrunningofBoardaffairs,alongwithSashiMeangerwhowas
alsoinvolvedinthedevelopmentoftheculturalcompetenciesdocument.
IwouldalsoliketospecificallyacknowledgeDeniseNelson,Registrar(untilherresignation)
andJennyLee,DeputyRegistrar(appointedRegistraronthelastdayofthisfinancialyear)
fortheirhardworkandcommitment.

Board StaffThisyearunfortunatelysawtheresignationofDeniseNelsonasBoardRegistrar.Denise’s
importantcontributiontotheBoardoveraverybusytimeisnotedandwewishherwell
inhernewappointmentwiththeNursingCouncil.
Under the Health Practitioners Competence Assurance Act 2003, Jenny Lee has been
appointedthenewBoardRegistrarhavingpreviouslybeenitsDeputy.Jennyhasthefull
supportof theBoard in this stepup.Mike Fitzgeraldhasefficientlyfilled inasActing
Registrarovertheinterimperiod.
Membership of the BoardAsat31March2006,theBoardmembershipcomprised:

• Threeregistereddispensingopticians
• Threeotherpersons(noneofwhomisaregisteredoptometristorregistered
dispensingoptician)
TheMinisterofHealthappoints themembersof theBoardbynoticepublished in the
Gazette.BoardmembersattendmeetingsandundertakeBoardactivitiesasindependent
personsresponsibletotheBoardasawhole.Membersarenotappointedasrepresentatives
ofanyprofessionalorganisation,butfortheirexpertiseandgeneralexperience.TheChair
andDeputyChairarerequiredbytheActtobeelectedbytheBoardatitsfirstmeeting
ofeachcalendaryear.

New Board MembersThisyearhasseentheappointmentoftwonewoptometriststotheBoard,JohnMcLennan
andHywelBowen
JohnbringsawealthofexperiencetotheBoard.HeisapastPresidentoftheNewZealand
AssociationofOptometristsand,mostrecently,wasanoptometryrepresentativewith
theAlliedHealthStandards8171workinggroup.Thisgroup,promotedbyStandards
NewZealandandsponsoredbyACC,determinedcombinedhealthstandardsforall
alliedhealthprofessionals.
Hywelqualifiedasanoptometrist inWales,workingintheUKandAustraliabefore
settingupapracticehere.HehasbeenanassociatelectureratAucklandUniversity,
donevolunteerophthalmicworkinthePacificandmorerecentlyworkednationallyas
alocum.
The Health Practitioners Competence Assurance Act enables the Board to determine
the remuneration, allowancesandexpenses tobepaid tomembersof theBoardand
itscommittees.TheBoardconsidersthatmembersshouldnotcontributetheirtimeto
Boardbusinessfornorecompense,butthisneedstobebalancedagainsttheelementof
voluntarycontributioninherentinservingontheBoard,withremunerationataratefairly
reflectingthatbalance.

LegislationTheBoardcontinuesasanauthorityundertheHealthPractitionersCompetenceAssurance
Act2003,whichcamefullyintoforceon18September2004.
Activities of the BoardBoard functions
ThepurposeoftheBoardistoprotectthehealthandsafetyofthepublicbyproviding
mechanismstoensurethatoptometristsanddispensingopticiansarecompetentandfit
topractisetheirprofessions.
TheBoardhasfourareasofspecificresponsibility
1. Itmustsetstandardsofclinicalcompetence,culturalcompetenceandethicalconduct.
Itmustprescribequalificationsforthescopesofpracticeithassetandforthatpurpose
itmayaccreditandmonitorteachinginstitutions
2. ItmustmaintainaregisterandconsiderapplicationsforAnnualPractisingCertificates
3. Itmustreviewandpromotethecompetenceofoptometristsanddispensingopticians
includingpromotingeducationandtraining
4. Itmustreceiveandactoninformationaboutthecompetenceofhealthpractitioners
especiallywherethatpractitionerposesariskofharmtothepublic
Health Practitioner Competence Assurance Act implementation activities
• Standards of clinical competence, cultural competence and ethical conductOver the past year the Board has completed and published standards of cultural
competencetobeobservedbytheprofessions.Thesecompetenciesalongwiththe
publishedstandardsofclinicalcompetenceandethicalconductareavailableonthe
Board’s website and able to be downloaded. They are considered to be “working
documents”–i.e.theyremainopentocommentandreview–ifyouhaveanycomment
tomakeatanytime,pleasecontacttheBoardoffice.

• QualificationsOverseas qualifications: The outcome of the Cole Report, commissioned by the
Board, indicated that itwasno longerappropriate for theBoard toacceptwithout
assessment UK trained optometrists. The Optometry Council of Australia and New
Zealand(OCANZ)carriesouttheassessmentofoverseastrainedoptometristsonthe
Board’sbehalf(notingthatthisfunctionisoneofthetwokeyfunctionsthatOCANZ
has). The Board recognises through its consultation processes, particularly with the
NewZealandAssociationofOptometrists,thatthewrittencomponentoftheOCANZ
competencyassessmentprocessisonerous.TheBoardsoughttodiscusstheseissues
with OCANZ and this resulted in the written component of the assessment being
madeavailableintheUKandSouthAfrica.Further,theassessment,bothwrittenand

practical,havebeenmadeavailabletwiceayear.TheBoardcontinuestodebatethe
lengthandcontentofthewrittenpaperswithOCANZandisoptimisticofareasoned
outcome.
• RecertificationDiagnostic Pharmaceutical Agent Recertification Programme: The Board, has in
negotiationwiththeDepartmentofOptometryandVisionScienceoftheUniversityof
Auckland,establishedthedidacticcomponentoftheprogramme.Whileithastaken
sometimetofillthefirstintakeintothecourse,ithashappenedwith34enrollingin
thefirstcourse
• Continuing professional development (CPD)Optometrists:TheBoard’sOptometristCPDAccreditationCommitteehasestablishedrobust
protocolsfortheaccreditationofCPDactivities.Asithasthroughouttheyear,thecommittee
remainsresponsivetocommentthatcanprovidetherefiningoftheseprotocols.
Dispensing Opticians: The Board has established a contract with the Board’s CPD
recorders (the Association of Dispensing Opticians of New Zealand), established an
DispensingOpticiansCPDAccreditationCommittee,andprovidedrobustprotocolsfor
theaccreditationofCPDevents
• Competence reviewTheBoardhas formulated its competency reviewprocess andestablished the tools
required to implement these processes. These documents are due to go out for
consultationwiththeprofessionsandotherrelevantparties.Fromtherethecompetence
reviewprocesswillevolve:aself-auditprocessforcompletionbyeverypractitionerat
therenewaloftheirAnnualPractisingCertificate(with20%ofpractitionerself-audits
auditedbytheBoardeachyear);andBack-to-Workprogrammesforthosewhotake
significanttimeawayfromtheirprofessions.
• Restricted activitiesTherestrictedactivitiesenactmentprocessundersection9oftheHealthPractitioners
Competence Assurance Act has been completed. Of particular relevance to the
optometryandopticaldispensingprofessionsisthattheprescribingofanophthalmic
or optical appliance or medical device intended for remedial or cosmetic purposes
orforthecorrectionofadefectofsight,isoneofsixrestrictedactivities.Itservesto
protectthehealthandsafetyofthepublicbyensuringthat,first,adiagnosis takes
placebeforeamemberofthepublicisprescribedaremedyforavisualproblem.
• Optometrists prescribing therapeutic agentsRegulationsmadeunder theMedicinesAct1981werepassed inOctober2005and
authoriseoptometristswhomeetspecifiedrequirementsforcompetence,qualifications
andtrainingtoprescribecertainprescriptionmedicines.
HealthPAC has implemented changes in its software so that the subsidies paid on
optometrists’prescriptionsarerecognised.Therecordingofthisdatashouldenablethe
Boardtomonitoroptometristprescribing.
Thereremainsaproblem in that thepatientsofoptometristprescribersdonothave
accesstosubsidiesfordrugslistedinthePHARMACPharmaceuticalScheduleas“retail
pharmacy-specialist” medicines. These prescriptions need to be countersigned by a
vocationalspecialist,inthiscaseanophthalmologist,ifthepatientwishestoclaimthe
subsidy.

PHARMAC’s decision to deny those patients access to those subsidies when an
optometrist prescriber prescribes those medicines is a decision the Board will
challenge.
• Council of Optometry Registration Authorities (CORA)CORA(whichincludesrepresentativesoftheoptometryregistrationauthoritiesinNew
ZealandandAustralia)meetsyearly.KeyissuesstillfacingCORAthisyearhavebeen
theincorporationofCORAandtheformalisationofCORAfundingagreementsthat
willthenenabletheNewSouthWalesBoardtobecomeafundingmember.Upuntil
nowtheNewSouthWalesBoardhasnotbeenaparticipantinthefundingofCORA
becauseofitsrelationshipwiththeHealthAdministrationCorporationinthatState,so
exposingtheNewSouthWalesgovernmenttoliability.
• Health Regulatory Authorities of New Zealand
HRANZ meets twice a year. Its membership includes representatives of all health
registrationauthoritiesinNewZealandandprovidesaforumformattersofcommon
interestaswellascapacitytomakerepresentations.
