GVR Building for Facilities by GVR Planning Committee Member

This picture above is the current plan for the building at the community garden. This design is subject to change and is not yet final.

Your GVR Metro District is presently in the design phase of a new facility at the site of the Community Garden located at 4000 Argonne Street. We have a preliminary design and are in the process of obtaining permits for this project. The Metro District is responsible for maintaining the common areas of the GVR community. In order to perform our maintenance responsibilities, gardening, landscaping and snow removal equipment is required. Presently, this equipment (and supporting material) is located outside of the community. To access and recover these assets require additional time and travel by District staff. If we could relocate material and equipment to a location within the community, we would be able to save the costs of off-premise rental space as well as lost travel time and additional fuel. These cost savings would result in greater efficiencies that would reduce financial burdens to all homeowners. We have chosen a contractor that has helped us create a building design to complement our neighborhood and provide an attractive and functional structure to serve our community for many years to come. The community garden will remain on this property and continue to be an valuable amenity for the community.

2016 Annual Meeting of HOA Districts to Elect Delegates by Peggy Ripko, HOA Supervisor

GVR HOA is setup differently than most Associations in that it is separated into 26 districts. The homeowners of each District elect

a Delegate, and that is the person who casts the votes for that District. They’re the people who elect the Board of Directors, as well as performing other vital tasks such as updating outdated governing documents like the Bylaws. Unfortunately, at this time, we only have 11 Districts out of the 26 Districts represented. This means that when the votes are cast, only 1982 of the 4600 homes in the community are represented. How can we fix that? By getting more Delegates! The 2016 District Annual meetings were held on September 28th and no District had the quorum required to conduct business. However, that can be remedied! If you are interested in serving as a District Delegate please contact the office at [email protected]. The Board is committed to getting Delegates and will therefore conduct reconvened meetings to get Delegates elected!

FENCES – Whose, Whose?

As spring is coming, so are the winds. And the fences in the community are fighting a valiant battle against the wind. And in some cases the fences are losing. We have had many, many phone calls asking how to tell who a fence belongs to and who is responsible for fixing it. So here is some information about fences!

Whether you have the ‘good’ side or the ‘bad’ side of the fence (posts visible or not) does not indicate ownership of the fence. A lot of folks think that the ‘good’ side (no posts visible) indicates that house owns the fence. This is not necessarily true.

The trick to knowing who is responsible for fixing a fence lies with knowing exactly where the fence is located. However, our attorney has told us is that. A fence is typically on one property or another- they are typically not exactly on the property line. And whoever’s property the fence is on is the house responsible for maintaining it. How can you find that out? If you have the legal description of your house it should say how many feet back from the street your property line is. Or you can hire a surveyor to mark the edge of the property line. Once this has been established, you know who owns the fence! However, most people do not have this information nor the money to hire a surveyor. The good neighbor way to it is to split the cost between the two homes that share use of the fence. Is this a rule? No. Is this enforceable by the Association? No. This is just our recommendation. However, as I have told many homeowners over the past several months, this only works if everyone agrees. I had to fix both of my side fences a few years back. We approached both neighbors and asked them to split the cost. One neighbor did but we never heard from the other neighbor. However, the fences were broken and we had a dog and small children and it had to be fixed, so we paid half for one and the entire amount for the other. If a fence is down, the Association has no way of knowing where the fence is located unless a homeowner provides a surveyor report. So if there is a broken fence both homes will be sent a violation. It is up to the homeowners to work out between them who will fix the fence. A reality of home ownership is that there are repairs. And, yes, this can be expensive and typically (at least for me) comes at the worst possible moment. But that is simply a reality of owning a home. And if your fence is broken is must be fixed.

SNOW REMOVAL By Karen Councilman, HOA Assistant

GREEN VALLEY RANCH HOMEOWNER’S ASSOCIATION: Snow on Sidewalks

Per the Residential Improvement Guidelines and Site Restrictions, Section 3.82, Page 25, Snow & Ice Removal-Homeowners/residents must remove snow from homeowners’ sidewalks (including areas around mailboxes) within twenty-four (24) hours of the conclusion of snow fall. Homeown-ers’ must make reasonable efforts to keep sidewalks clear of ice. Due to the safety concerns re-garding snow and ice, homeowners who are sent to Hearing for snow removal will also be reported to the City & County of Denver Code Enforcement. As a senior or handicapped individual you can contact the City of Denver to obtain information on how to get assistance. For individuals that are going to be out of town, please make arrangements to have snow removed while you are away. Being out of town does not excuse you from not removing snow from your sidewalks. Speak to a neighbor or hire a contractor to assist you. The Association does not own any property within the community. DENVER: Plowing Schedule

Snow Predicted: Magnesium Chloride ("mag chloride") is applied to main streets when conditions permit to prevent snow from bonding to the pavement and forming ice.

Weather conditions must be right for anti-icing to be successful. The pavement temperature must be below freezing with low humidity for anti-icing treatment to be effective. If there is rain mixed with snow, anti-icing is not effective as the mag chloride will simply wash off the pavement.

Snow Begins to Fall: A de-icing material is applied only to main streets to prevent the snow from accumulating and turning into ice, and main streets are plowed by heavy plows. Depending on the location, either Ice Slicer (a dry material that looks like sand but is a naturally mined mix of sodium chloride, potassium chloride and magnesium chloride) or liquid magnesium chloride may be used to de-ice. Major Snow Event: When 12 inches of snow or more, accompanied by freezing temperatures are predicted between November 15 and March 15, main streets will continue to be plowed by heavy plows and a de-icing material will be applied, and residential streets are addressed by light plows to prevent deep rutting.

Pushing snow onto sidewalks and driveways is an unfortunate consequence of plowing any street. We apologize for any inconvenience and ask everyone to work together to clear neighborhood walkways. Plowing Routes

Main streets are the priority for Public Works and our largest plows 

Most main streets have stripes – that’s a good way to identify them 

These are the streets that carry most of the city’s traffic as well as emergency vehicles and public transportation.  They also plow around schools each morning and afternoon to provide safe zones for school children whenever possible. Snow Routes There will no longer be additional parking restrictions on “Snow Routes” – just follow the posted parking rules, even during the worst storms. If your car is parked legally, you will not receive a ticket. Continued on page 4

Parking Concerns by Peggy Ripko, HOA Supervisor

We are contacted several times a week regarding parking issues in the community. As we have said to all of these folks, the Association’s ability to address parking concerns is extremely limited. The reason is that we can only enforce the rules of the community, and most of the issues that we are contacted about are not against the rules of the Association. The only parking issues that are a part of the Association’s rules are:

1. Parking on the yard/rocks on either side of the driveway. 2. Blocking the sidewalk.

The parking issues that are brought to us that are not covering in our rules include:

1. People parking in the street blocking driveways 2. People parking in front of another homeowner’s house. While this is not in our rules, we can

tell you that there is no guaranteed parking on the streets. Parking on the street is first come, first served.

We understand the frustration; however, the Association does not have the legal ability to address those issues.

Snow Removal: continued from page 3

City Owned Property Denver Parks & Recreation performs snow removal on park property and select sidewalks, such as bridges and underpasses within the city. During normal snowfall, the snow will be removed as usual, including around recreation centers. Recreation Centers will also be plowed and shoveled for Saturday and Sunday hours as needed. Icing in the curb and gutter Each winter, the City and County of Denver receives calls regarding snow-plow operations and ice accumulation in the gutters along the streets. The Department of Public Works responds to these inquiries in several ways. While the Street Maintenance Division is directly responsible for snow and ice removal, these situations can also be an indication of other infrastructure issues, which can involve internal cooperation and coordination with several Divisions within the Department of Public Works.

Snow on Sidewalks Denver requires property owners to clear their walkways so that everyone has safe access throughout the city. Pedestrians, including senior citizens, people with disabilities, parents with strollers, and mail carriers depend on clear walkways.

Homeowners: Once snow has stopped falling, residences have twenty-four (24) hours to remove snow and ice from public sidewalks adjacent to their property. 

Businesses: Once snow has stopped falling, businesses have four (4) hours to remove snow and ice from public sidewalks adjacent to their property. 

 Report A Problem: Please contact Denver 3-1-1 to provide the address of the sidewalks that were not shoveled.

3.80 Political Signs do not require ARC approval. One sign per candidate or ballot issue per residence is allowed. Signs may not be displayed more than 45 days prior to an election and must be removed no later than seven (7) days following the election. Signs must comply with City Code and State Regulations.

Community Association Living: By Any Other Name

Source: CAI (Community Associations Institute) “Community association” is a generic term that encompasses many names used around the world to describe common-interest housing. A few examples include: Common-interest community (CIC) is used by the National Conference of Commissioners on Uniform State

Laws. Common-interest realty association (CIRA) is the term preferred by the American Institute of Certified Public

Accountants. Common-interest development (CID) is used by the California Department of Real Estate. Condominium association refers to units like apartments, townhouses or other private units that are part of a

single structure or group of structures. Homeowners association (HOA) is often synonymous with “common-interest community” and usually

describes a community of single-family homes. Property owners association (POA) can refer to a residential community or a group of offices or other

non-residential property. Strata title is a term used in Australia, New Zealand, and British Columbia that describes individually owning

part of a property, such as an apartment, and sharing ownership in the property’s common or public areas. In France and some parts of Quebec, condominiums are called copropriété divisée (divided co-property). The traditional term in Spanish-speaking countries for a common-interest community is propiedad horizontal. Condominio is the term used in Italy. Regardless of the name, most community associations in the U.S. are incorporated and subject to state statutes that govern nonprofit corporations. Remember, membership in an association is not voluntary; you become a member when you purchase a home in the community.
