"fish" it~cludes oysters, crabs, shrimps, turtles, turtle eggs, coral and any species of other marine fauna;

"fisllery" means any one or more stoclts of fish, wilicll can bo treated s s n unit for tho purpose of conservation nnd mnnagement, and which are identzed on the basis of geographical, scientific, technical, recreational nnd economical characteristics, and includes any fishing for any such stoclrs;

"fishing craft" means n vessel, aircraft, hovercraft or other craft of whatever size nrld ho~vever propelled that is capable of being used for fishing and is operated for financial remnrd or other material gain, scientific research or processing, storage or carriage of fie11 a n d includes ariy vessel used in support of or arlcillary to fishing operations, but does not include a vessel transporting fish or fish products as part of its general cargo ;

"forcigrx Gsling craft" mcans a fishing craft flying the flag of a foreign State or registered in a foreign State;

r r foreign ship" means n vessel in which less than fifty-one per ccnt of the ownership is vested in nationals of Trinidad and Tobago;

r l master" mearu ally person having command of a ship;

(3) Such passage shall be continuous and expeditious a u d includes stopping and anchoring but only in so far ns they are illcidentil to ordinary navigaLion or are rendered necessary by l o ~ c e n ~ a j e u r e or clistress or for the purpose of rendering assistance to persons, sllips or aircrafts irl

clanger or distress.

12. (1) Passage is innocent so long as i t is not prejuclicial ;;;$$ ;:ssngo

to the peace, good orcler or security of Trinidad and Tobngo and is in co11forlniLy with the provisions of the Collverltioll a n d such otller relevant rules of international law.

(2) Tho passage of a foreign ship shall be considered preju&cial to the peace, good order or security of Trinidad and Tobago where it engages in the archipelagic waters, in the follo~ving activities:

( a ) any threat or uso of forco against tile sovereignty territorial integrity or political inrlepcndcnco of Trillidad and Tobago or any violation of the principles of international law embodied in the Charter of the United Nations ;

(b) any exercise or practice with weapons of any hid ;

(c) any act aimed nt collecting information to tlls prcjudics of the defence or security of Trinidad and Tobago;

(d) any act of propaganda aimed a t affecting the defence or security of Trinidad and Tobago;

(e) tllo launclling, landing or taking on board of any aircraft ;

(f) the lal~nclling, landing or taking on board of any military device;

(g) tlio loading o r unloading of any commoclity, currency or person contrary t o the customs fiscal, immigration or sanitary laws and rcgulations of Trinidad and Tobago;

( h ) any act of wilful and serious pollution contrary to the Convention;

(i) any fistung activities without the consent of the Minister;

(j) the carrying out of research or survey activities mi thout the consent of the Minister;

(7;) any act ai1ncc1 a t interfering wit11 ally systems of communication or any other facilities or installation of Trinidad and Tobago;

(l) any other activity not having a b e c t bearing on passaqe.

Suqpenslon of lonoccnt passage

13. (1) 'rho President may by Proclamation suspend. temporarily, in specified areas of the archipelagic waters, tlie innocent passage of foreign sliips, where such suspension is essential for the protection of its security.

(2) Such suspensiorl sllall take effect only after clue publication.

Licences for foreign fisldng

26. ( l) No foreign fishing craft nor the ma,ster ancl c r d t and crew members of the crew of s foreign fishing craft Inny engage to flsh Ln exc~us iveeconom~c in fishing in the exclusive economic zone, the territorial zone. territorial sea. and the sea and tile srchipelagic waters ~vithout a licence issueci by archipelagic watem the Minister to whom responsibility for fisheries is assigned.

(2) The Minister to .vvhom responsibiliky for fisheries is assigned may, on payment of tho prescribed fees issue licerlces in respect of-

( a ) a foreign fi~lling craft; and ( b ) the master ancl members of the crew of a

foreign f i s lhg craft.

( 3 ) A licencc issuetl in rcsl;>ect of a foreign fislling crafb shall state the crafts specifications and operating conditions.

(4) A licence issued in respect of the nlaster and mernbors of the crew of a foreign f i s l ~ l g craft sllnll state their-

(a) names and addresses;

(c) fisllerlnan registration numbers ; (d) identification numbers; and ( e ) experience in fishing activities.

( b ) the total catch by all foreign fishing craft of any one State does riot exceed the apportion- ment prescribed for tha t State.

28. (1) The persons referred to in subsection (2) are Survelllancc the exclusive econornlc empowered in the exercise of their oficinl functions tb, terrrtor~d sea nnd the

( a ) stop nnd board, inspect, seize and detain n a r d t p c l n g l c

forsign fishing craft, waters

( b ) seize any fish and equipment found on board the foreign fishing craft, a.nd

(c) arrest the master and crew of any foreign fishing craft,

in the exclusive economic zone, the territorial sea and the nrcllipelngic waters, and may also institute such crirninal proceedings against them, as mny be necessary to ensure compliance with the Act and the Regulations.

(2) The persons to whom subsection (1) npplies are- ( a ) members of the Trinidad and Toba.go Coast

Guard ; ( b ) members of the Police Service; (c) Fisheries OIGcers of the Mi~listry responsible

for fisheries ; ( d ) Custorns Oficers ; (e) the I3arbour Master; and (f) any other person authorised in ~vriting by the

Minister.

29. (1) rrlio provisions of section 2G shall not npply to a Exemption

foreign iisl-ling craft or to the master and members of the crew of such craft-

( a ) in wliich a t least fifty-one per cent of the ownership thereof is vested in citizens of Trinidad and Tobago ; or

( b ) owned by a company incorporated in 'rrinidacl and Tobago in which a t least fifty-one per cent of the shares is vested in citizens of Trinidad and Tobago.

(2) The Minister to whom responsibility for fisheries is assigned 1 i l a~ issue a Certificate of Exemption to every such foreign fishing craft referred to in subsectiorl (1).

(3) The Certificate of Exsmption sliall be carried on board the foreign fislli~~g craft, and shall be tendered for jnspection nt the request of any one or all of the persons referred to in section 28.

oncrlces 30. (1) Any foreign fisliing craft o.nd the ~naster and members of tho crew of a foreign fishing craft who, in breacll of section 2G-

( a ) fish in tlre exclusive economic zone, the territorial sea or the arcllipelagic waters ~vitllout a Licence;

( b ) fail to co~nply with the terrus of a Licence; or ( G ) obstruct a person empowered to urldert~lie

surveillance in the exclusive economic zone, the territorial sea or the archipelagic waters in the performance of 1Gs duties,

is guilty of an offence and liable on summary conviction in tho cass of an oKence in tllo oxclusivo ecoriomic zone to a fino of fifty tllouaand dollars and in the case of a n offence in the territorial sea nrld the nrchipelagic waters to a fine of ten Lhousanrl dollars nnd imprisonment for six rnonths nnd ill addition in all cases to suspension or carlceUation of the licence, forfeiture of the craft, equipment and all the fish found on board.

(2 ) A n y foreign ship and the master and members of its crew that pn.ss th.roug11 the archipeln.gic waters of 'Trinidad and Tol~ngo corltrary to scction 11 or 13 is guilty of nn offence and is liable on summary conviction l;o a fine of twenty-five thousand dollars and to imprisonment for six montlls.
