S18 Amended Locksmith License Act Reads as follows and has been sent to the House for a vote and is expected to go in effect by October, 2013 January 31, 2013 *S18-v-1* A BILL TO BE ENTITLED 1 AN ACT AMENDING THE LOCKSMITH LICENSING ACT, EXPANDING THE 2 AUTHORITY OF THE LOCKSMITH LICENSING BOARD TO REGULATE 3 INSTITUTIONAL LOCKSMITHS, AND RAISING THE CEILING ON CERTAIN FEES. 4 The General Assembly of North Carolina enacts: 5 SECTION 1. G.S. 74F-3 reads as rewritten: 6 "§ 74F-3. Licenses required. 7 No person shall perform or offer to perform locksmith services in this State unless the 8 person has been licensed under the provisions of this Chapter. No person shall possess any 9 locksmith tools as defined under G.S. 74F-4(6), unless the person is licensed as a locksmith 10 under this Chapter or exempt from the provisions of this Chapter. Every person providing 11 locksmith services as defined under G.S. 74F-4(5) to buildings containing medical records, 12 pharmaceutical records, educational records, criminal records, voting records, tax records, legal 13 records, or personnel records, including any person providing locksmith services who is 14 employed by or working for a school, college, university, hospital, company, institution, 15 government facility, or multi-family unit, such as an apartment or condominium, shall be 16 licensed in accordance with the provisions of this Chapter. A violation of this section is a Class 17 31 misdemeanor unless the conduct is covered under some other provision of law providing 18 greater punishment for the first offense. Any subsequent offense is a Class I felony." The General Assembly of North Carolina enacts: 5

SECTION 1. G.S. 74F-3 reads as rewritten: 6

"§ 74F-3. Licenses required. 7

No person shall perform or offer to perform locksmith services in this State unless the 8 person has been licensed under the provisions of this Chapter. No person shall possess any 9 locksmith tools as defined under G.S. 74F-4(6), unless the person is licensed as a locksmith 10 under this Chapter or exempt from the provisions of this Chapter. Every person providing 11 locksmith services as defined under G.S. 74F-4(5) to buildings containing medical records, 12 pharmaceutical records, educational records, criminal records, voting records, tax records, legal 13 records, or personnel records, including any person providing locksmith services who is 14 employed by or working for a school, college, university, hospital, company, institution, 15 government facility, or multi-family unit, such as an apartment or condominium, shall be 16 licensed in accordance with the provisions of this Chapter. We believe quality education is necessary for the growth and promotion of our industry. All courses will meet the North Carolina Locksmith Licensing Board requirements for continuing education as required by North Carolina law.

We intend to keep the yearly dues low to make it affordable to all locksmiths.
