NEW DELHI, Apr 15:

The National InvestigationAgency (NIA) today argued in acourt here that Delhi Police wastrying to "frustrate" their ongo-ing probe against IndianMujahideen (IM) operatives byseeking further custody of topIM men Tehsin Akhtar and Zia-ur-Rehman alias Waqas.

The tug of war between thetwo probe agencies was seen inthe court after the Special Cellof Delhi Police sought 25 dayspolice custody of Tehsin andWaqas in connection with a caseregarding the conspiracy of IMand Lashkar-e-Toiba (LeT) tocarry out terror strikes in thenational capital.

The NIA told the court thatthe Special Cell was again seek-ing remand of these two accusedto "frustrate the investigation sofar done by the NIA with respectto accused in different FIRs."

The NIA also said theirprobe into these cases were"held up" due to want of interro-gation of these accused.

The Special Cell, however,countered the NIA's submis-sions saying their probe into thecase regarding the conspiracy ofIM and LeT to carry out terror

strikes in Delhi was going on.It also argued the interroga-

tion of these two accused wasnecessary to "verify the nexusbetween LeT and IM".

The court, after hearing thearguments, remanded both theaccused to custody of the SpecialCell for 20 days while brushingaside the contentions of the NIAseeking its permission to formallyarrest and interrogate these twoaccused in connection with theFebruary last year Dilsukhnagarblasts in Hyderabad.

"It was the Special Cell DelhiPolice who arrested the accusedfirst and they have completed theinvestigation with respect to caseFIR no 54/11 (regarding illegalarms factory here). However, theyare yet to complete investigationin respect of case FIR no 16/12(the present case) dated July 7,2012.....," Additional SessionsJudge Daya Prakash said.

"If at this stage, accused (Tehsinand Waqas) are handed over to theNIA, the whole investigation so farconducted by the Special Cell inFIR no. 16/12 will be frustrated,"the judge said and noted that per-mission of the Ministry of HomeAffairs to conduct the probe into thecase was also placed on recordbefore it.(PTI)

Over Rs 269 crore of cashhas been seized so far by theElection Commission (EC)-appointed teams, with AndhraPradesh topping the list.

Acording to official data pre-pared till today, the EC-appointedElection Expenditure Observershave so far seized a total of Rs 129crore in cash in Andhra Pradesh,Maharashtra Rs 33.46 crore, Rs.19.87 crore in Tamil Nadu, Rs.12.29 crore in Karnataka, over Rs12 crore in Uttar Pradesh and overRs 5 crore in Punjab includingnumerous other small seizures inother states.

Also, the total liquor seizedstands at 132 crore litres, heroin104 kg while more than 12,000FIRs have been registered againstdistribution of cash and illegalinducements in various states.

A senior official, who is a partof the EC-appointed team, saidsurveillance teams drawn from

IRS and other central serviceshave been deputed to all LokSabha and Assembly constituen-cies and they are reporting cashseizure instances since the pollswere declared on March 5.

The Commission, as part of itsmeasures to curb black money inthe polls, has deployed the‘expenditure observers’ drawnfrom central revenue services likethe Income Tax and Customs andExcise departments.

The EC, in order to keep atrack of huge cash during thepolls, has also asked the CentralBoard of Direct Taxes and theFinancial Intelligence Unit(FIU), both agencies under theUnion Finance Ministry, to keepa watch through their intelli-gence and investigative toolsduring the poll period. (PTI)

The Supreme Court today heldthat a woman employee of CentralGovernment can get uninterruptedleave for two years for child care,which also includes needs likeexamination and sickness.

A bench of Justices S JMukhopadhaya and V GopalaGowda set aside the order ofCalcutta High Court which hadheld that Central Civil Services(Leave) Rules do not permituninterrupted CCL(Child CareLeave) for 730 days.

“On perusal of circulars andRule 43-C, it is apparent that awoman Government employeehaving minor children below 18years can avail CCL for maxi-mum period of 730 days i.e. dur-

ing the entire service period fortaking care of upto two children.The care of children is not forrearing the smaller child but alsoto look after any of their needslike examination, sickness etc,”the bench said.

It said that CCL even beyond730 days can be granted by com-bining other leave if due and thefinding of the High Court wasbased neither on Rule 43-C noron guidelines issued by theCentral Government.

The court passed the order

on a petition filed by a womanGovernment employee KakaliGhosh challengingGovernment’s decision not togrant her leave of 730 forpreparing her son for second-ary/senior examinations.

She had first approachedCentral Administrative TribunalCalcutta for getting leave. Thetribunal had ordered in herfavour but the High Courtreversed the order after whichshe moved the apex court.

The apex court set aside the

High Court’s order.“We set aside the impugned

judgement dated September 18,2012 passed by the DivisionBench of Calcutta High Court,Circuit Bench at Port Blair andaffirm the judgement and orderdated April 30, 2012 passed bythe Tribunal with a direction tothe respondents to comply withthe directions issued by theTribunal within three monthsfrom the date of receipt/ produc-tion of this judgement,” it said.(PTI)
