The SRBX Oktoberfest was a huge hit this past fall as we traveled up I-80 to Kathrin’s Biergarten in Rocklin. Look for details on a Halloween-Themed fall mixer this year to be announced soon!

The Women in Construction (WIC) Committee held a lunch panel discussion on Leading the Way, Creating a Construction Workplace for Women to Succeed, Women in the Workplace and By the Numbers: Increasing the number of Women in Construction.

The NEXT Young Professionals Group hosted the 23rd Annual Contractors Caring for Kids Holiday Party. Santa made an appearance at this year’s event which saw the SRBX Barrish Pelham Events Center turn into Santa’s Workshop. More than 3,000 toys were collected for local youth organizations.

SRBX kicked off 2019 with a sold-out Installation Dinner at Mulvaney’s B&L in January. Kelley Cowan of XL Construction was installed as the 2019 Board President. The Board also welcomed Heather Basinger of CliftonLarsonAllen, LLP, Tom Ford of MarketOne Builders, Patrick McNamara of the Porter Law Group, Frank Radoslovich of Radoslovich | Shapiro, P.C., and Craig Sweeney of Intech.

Students are given an RFP to design a mock project and are mentored through the process by industry professionals. During the eight month program they visit active job sites, participate in a hands-on Trades Day, complete a client needs assessment, physical model, cost estimates, floor plans and a final presentation. SRBX member companies gathered for our annual lobby day at the State Capitol in downtown Sacramento in late-Janu-ary where we discussed the construc-tion industry’s most important issues for the 2019 legislative session. SRBX Government Affairs Committee Chair, Cathy Skeen (Excel Bonds and Insur-ance Services, Inc.); Terrance McNamara (Teichert Construction); Kimberly Cook (LB Construction); Kirk Taber (Taber Creative); and Monet Crawley (XL Con-struction) lobbied Governor Newsom’s Cabinet Secretary of Economic Devel-opment and Housing, Lt. Governor Ele-ni Kounalakis and legislative members on SRBX policy priorities including workforce development and closing the skilled labor gap; CTE investments; in-centivizing the construction of afforda-ble housing, including multifamily; and streamlining the contracting process for K-12 and community college districts.

Policymakers are always eager to meet and talk with constituents and it’s impor-tant that our members’ voices are heard to educate and persuade them of what’s important to our industry.

SRBX members should be aware of two legal decisions from 2018 that could im-pact the construction industry: Dynamex Operations West, Inc. v. Superior Court of Los Angeles, which dealt with the classi-fication of independent contractors, and Epic Systems Corp. v. Lewis, which dealt with arbitration provisions and class ac-tions.

In a nutshell, Epic Systems held that an employer, through a mandatory arbitra-tion clause, can prohibit an employee from pursuing its claims through a class action. Specifically, an arbitration clause that re-quires individualized proceedings is legal-ly enforceable.

Potentially of greater interest to SRBX members is the Dynamex decision, which significantly alters the landscape of in-dependent contractor classification in California for employers doing work un-der the Industrial Welfare Commission’s Wage Orders. Essentially, there is now a presumption that all workers are employ-ees and the employer must show that the classification of independent contractor is appropriate under the new ABC Test—(A) that the worker is free from the control and direction of the employer in connection with the performance of the work, both under the contract for the performance of the work and in fact; and (B) that the worker performs work that is outside the usual course of the employer’s business; and (C) that the worker is customarily engaged in an independently established trade, occupation, or business of the same nature as the work performed. All three of these factors must be satisfied for a worker to be properly classified as an independ-ent contractor. Construction companies should pay special attention to the second factor because many workers performing

work for a construction company will be considered to be performing work that is inside the usual course of the business.

The nuances of these cases are compli-cated. You should consult a lawyer if you have questions.
