TEST REVIEW FORPAGE 4 TEST

What documents/people gave us the idea to create a Bill of Rights for our new Constitution?

The philosopher, John Locke gave us the idea of natural rights to life, liberty, property. The English Bill of Rights gave us a blue-print for our Bill of Rights.

What documents/people gave us the idea to have 3 branches of government?

The philosopher, Montesquieu gave us the idea that power should be divided and clearly listed-separation of powers.

What documents/people gave us the idea to limit the power of the ruler of your country and set up a Congress that ruler must answer to?

The Magna Carta gave us the idea to limit the power of our ruler and make them listen to our representatives and the English Parliament is the example they set up for our Congress.

What documents/people gave us the idea to band together for self defense?

The Iroquois League showed us that different groups getting together to back each other up in times of attack worked well. You could be separate and still united.

When the state is in conflict with the federal government, who decides the conflict and who generally wins the conflict?

The Supreme Court (Judicial Branch) decides the issue and the federal government is supreme over the state government, so federal laws/rules are higher than the state ones.

Who makes the laws?Legislative Branch-Congress.

Who makes sure laws are carried out/enforced?Executive Branch- President.

Who interprets the laws and decides if one has been broken?Judicial Branch- Supreme Court and federal courts.

Who takes the popular (people’s) vote and uses the results to officially elect the president?

The electoral college- if you get 51% of the popular vote in that state you get 100% of its electoral votes.

Why was getting all of the 13 states to ratify the Constitution important?

We needed to start over as a unified group because we weren’t unified under the Articles of Confederation.

Why was it important to create the Bill of Rights as soon as possible? Think about what group was very concerned about government abusing its power.

The Bill of Rights convinced people like the Anti-Federalists that our rights would be protected from the strong central government because they were listed out.
