SUING A SOLICITORHOW AND WHEN A CLIENT CAN SUE A SOLICITOR

Recent studies suggests that Solicitor Negligence claims are rising each year. Claims against Solicitors can be complicated, high value and of critical importance to the parties involved.

When a person comes to a solicitor to represent them they will expect their case to be handled with skill and care.

Unfortunately errors will happen and solicitors have a breach of duty of care, which they owe to their client. As they have a duty of care, if the mistakes by a solicitor has resulted in the client suffering a financial loss this can be seen as Solicitor Negligence, which the client can make a claim against.

A standard way for judging whether a solicitor has acted in a negligent manner is to compare their behaviour with how another competent solicitor would have acted in similar circumstances.

Typical examples of Solicitor Negligence could include things such as missing court deadlines for the submission of documents or making a mistake in drafting a legal document such as wills or divorces.

Errors when dealing with property leases are the most common cause of complaints and solicitor negligence claims.

A solicitor could fail to advise a client on rules imposed on them by a lease, such as a duty to repair a property or failing to include important terms when acting on behalf of a landlord, such as an annual rent review.

As a result of Solicitor Negligence on property, a client may ultimately be evicted from a property or incur significant financial losses due to their negligence.

Each case of Solicitor Negligence is unique and all the factors surrounding it will be considered when assessing the amount of compensation the claimant will receive (if successful).

Suing a solicitor for negligence is possible but it isn’t very easy and could take a couple of years for the claim to be settled.

If a client has suffered financial loss as a result of a negligent solicitor then specialist negligence solicitors are able to help clients on how to sue a solicitor.
