For most violations of rules andrestrictions contained in a Condo-minium or Homeowners’ Associationgoverning documents, the enforce-ment procedure is fairly simple. Acall or letter is sent by managementtelling the rule or regulation violatorto knock it off. If the violation con-tinues, then a certified letter is usu-ally sent from the Association’s attor-ney to the violator giving him or herone last chance to stop the violation. If that does not work, then the vio-lator is usually sued either in arbitra-tion for some Condominium viola-tions or in local courts for other Con-dominium violations and for Home-owners’ Association violations.
If successful in litigation, the vio-lator will then get an Order from theJudge to stop or cure the violation.
