Leadership from the federal level is not on the horizon
Your Federally Mandated Testing (DOT, Homeland Security, etc.) is not affected
It’s a whole new world regarding drug testing The laws have far exceeded the technology The legal challenges are already arriving Be informed Take ownership of your choices Communicate

Discuss Medical and Recreational Use Laws
How does this affect the Workplace?
Inhaled vs. vaporized vs. edibles
Effects of Marijuana
CBD the miracle drug
How should an employer respond?

A Recommendation Not a Prescription
Must register with the State of Michigan as a:◦ Patient
◦ Caregiver
Permits◦ Use
◦ Possession
Plants
drug
◦ Sales or Transfer
4/25/20192019 Michigan Safety Conference
Permits adults age 21 and older to:◦ Possess up to 2.5 ounces (160 .5g joints)of
marijuana on their person◦ Possess up to 10 ounces securely stored in their
home◦ Grow up to 12 marijuana plants in their home,
outside of public view.◦ Use marijuana but not in public or driving under the
influence.◦ Commercial sales will be permitted beginning in
2020 including the sale of marijuana infused edible products which will be subject to a 10% tax.

Municipalities may prohibit the commercial sales of marijuana
Under the proposal, marijuana plants cannot be visible from a public place "without the use of binoculars, aircraft, or other optical aids or outside of an enclosed area equipped with locks or other functioning security devices that restrict access to the area.“
Landlords may prohibit use, possession and sale of marijuana in the buildings.
Employers may refuse employment or discipline employees who violate company policy regarding drugs of abuse.

“This act does not require an employer to permit or accommodate conduct otherwise allowed by this act in any workplace or on the employer’s property. This act does not prohibit an employer from disciplining an employee for violation of a workplace drug policy or for working while under the influence of marijuana. This act does not prevent an employer from refusing to hire, discharging, disciplining, or otherwise taking an adverse employment action against a person with respect to hire, tenure, terms, conditions, or privileges of employment because of that person’s violation of a workplace drug policy or because that person was working while under the influence of marijuana.”
Impairment◦ No currently established levels of impairment◦ Some specimens are incapable of ever determining
impairment Hair
Urine
Sweat
◦ Variations between methods of ingestion Smoked- 10% marijuana converted to metabolite
Edibles- 50% marijuana converted to metabolite
Because these specimens test for the metabolites of marijuana, edible users are much more likely to indicate higher drug usage or exceed the cut-off levels for testing
◦ Policies do not address the new state laws

Blood◦ Extremely invasive for workplace testing
◦ Timeliness of testing
Cannabinoid levels may decrease by 90% in 90 Minutes
◦ Availability of testing services
Oral Fluid◦ Quicker and less invasive
◦ Test result more closely reflects state of individual
◦ Tests of THC directly instead of metabolites
◦ Loose correlation between Oral fluid and Blood
4/25/20192019 Michigan Safety Conference
Approval of collection devices and certification of testing Laboratories
Possible short sample collections due to dry mouth caused by THC use.
Studies to demonstrate the correlation between oral fluid concentration and impairment
Nationally accepted level of impairment

Indica (chilled, relaxed) Sativa (excitation)
Euphoria
Altered Physical Senses- smells, hallucinations, sounds, etc.
Altered perception of time
Relaxation
Sense of creativity
Impaired body movement

Suppression of nausea and vomiting
Pain relief
Stimulate appetite
Encourage bone growth
Sleep enhancement
Tumor inhibition

Psychotic episodes
Hallucinations
Paranoia
Panic attacks
Impaired motor ability

Food or liquid products laced with marijuana Colorado and Washington regulate a dose as
10 mg Edible products available from 10 mg to 1000
mg. Euphoria has a delayed reaction vs. smoked. Converts into far higher percent of THC
metabolites than smoked resulting in much higher levels of the drug in a hair or urine test result.
Erratic quality control of products

Cannabinoids interact with the cannabinoid receptors in the brain.◦ Endocannabinoids- produced in the body◦ Phytocannabinoids- produced in plants
▲9-tetrahydrocannabinol (THC)
Cannabidiol (CBD)
◦ Synthetic cannabinoids- manufactured in labs K-2, Spice
THC- Psychoactive effects related to percent of THC some as high as 29%
CBD- medicinal in nature with very low concentrations of THC (.03%)

Minimal side effects◦ Dry mouth
◦ Inhibits liver’s ability to break down many synthetic pharmaceuticals
◦ My render BP meds and antiarrhythmic medications ineffective
Many possible medical benefits◦ Epidiolex is approved for some seizures
◦ Anxiety relief
◦ Seizures/convulsions
◦ Psychosis relief

Available in:◦ Lotions
◦ Oils
◦ Foods
◦ Coffee products
◦ Cocktails
◦ Dog Treats
Is it Pure?◦ Quality control is often questionable
◦ Intentionally higher concentration of THC
◦ Has the potential to cause a positive test
4/25/20192019 Michigan Safety Conference
Urine
◦ 3.5 to 4.5 Hours after use
◦ 48 hours to 3 days
Hair
◦ 7-10 Days after use
◦ 90 days
Oral Fluid◦ Minutes after use
◦ Determined by confirmation cut-off level
4/25/20192019 Michigan Safety Conference
Review your current policy:◦ Address the Medical Marijuana and Recreation Use Laws;
What is your response to: positive marijuana positive Possession on site Sales or transfer of marijuana on site
When do you test? Post accident R/C Random Pre-employment
Which drugs are you testing? Still test for THC? Are you testing for Opioids? Which specimen are you using for testing? Different testing panel and specimen for R/C?
4/25/20192019 Michigan Safety Conference
Match your testing program to your policy◦ Zero tolerance-
Hair, Urine, Oral Fluid, breath
Pre-employment, random, P/A, R/C Return to duty
◦ Deterrence program-
Hair, Urine, Oral Fluid, breath
Pre-employment, random, P/A, R/C, RTD, Follow-up
◦ Fitness for duty program
Urine, Oral Fluid, breath
Pre-employment, random, R/C, RTD, Follow-up

Confirmation Cut-Off Detection Time
6 ng/mL 18 to 24 hours
8 ng/mL 12 to 18 hours
10 ng/mL 6 to 12 hours
