Meaning of the CE marking under the CPR
The CE marking for construction products
does not mean “conformity” (e.g. Basic Work Requirements, European standards, ….)
the information accompanying the product (declared performances) has been obtained according to the provisions of the CPR (using the hEN)
must be considered accurate and reliable.

Implementation of EN 1090-1
Scope of EN 1090-1
This European Standard specifies requirements for conformity assessment of performance characteristics for structural
steel and aluminium components as well as for kits placed on the market as construction products. The conformity
assessment covers the manufacturing characteristics, and where appropriate the structural design characteristics.
This European Standard covers also the conformity assessment of steel components used in composite steel and concrete
structures.
The components can be used directly or in construction works or as structural components in the form of kits.
This European Standard applies to series and non-series structural components including kits.
The components can be made of hot rolled or cold formed constituent products or constituent products produced with other
technologies. They may be produced of sections/profiles with various shapes, flat products (plates, sheet, strip), bars,
castings, forgings made of steel and aluminium materials, unprotected or protected against corrosion by coating or other
surface treatment, e.g. anodising of aluminium.
This European Standard covers structural cold formed members and sheeting as defined in EN 1993-1-3 and EN 1999-1-4.
This European Standard does not cover conformity assessment of components for suspended ceilings, rails or sleepers for
use in railway systems.
NOTE For certain steel and aluminium components, particular specifications for performance and other requirements have
been developed. The particular specifications may be issued as an EN or as Clauses within an EN. An example is given in
EN 13084-7 for single wall steel chimneys and steel liners. Such particular specifications will take precedence in case of
non-compliance with the requirements of this European Standard.

FAQ 31: When does the CE marking have to be
affixed on the basis of EN 1090-1?
The CE marking has to be affixed on a construction product on the basis of the harmonised standard
EN 1090-1:2009+A1:2011 when all the following conditions are satisfied:
the product is covered by the scope of EN 1090-1:2009+A1:2011 (please find the indicative,
non-exhaustive list of products not covered by the scope of EN 1090-1 as provided by CEN),
and the product is a structural construction product within the meaning of the Construction
Products Regulation (EU) 305/2011 which means:
• the product is intended to be incorporated in a permanent manner in construction works
(buildings or civil engineering works), and
• the product has a structural function in relation to the construction work (i.e. its failure will
affect the satisfaction of Basic Work Requirement 1 as detailed in Annex I of Regulation EU
305/2011).
and the product is not covered by a dedicated European product specification (because if a
specific harmonised EN, or an European Technical Approval Guideline (ETAG) or an European
Technical Approval, or an European Technical Assessment (ETA) for this product exists, the basis
for the CE marking is the relevant specific harmonised EN, or the ETApproval, or the
ETAssessment).

FAQ 31: When does the CE marking have to be
affixed on the basis of EN 1090-1?
Note: Wind turbines and their towers cannot be CE marked under EN 1090-1. They are
subject to the Machinery Directive (MD) and the complete wind turbine system must be
CE marked thereunder. One of the essential requirements of the MD is the stability of the
machine. Thus, the obligatory CE marking under the MD also covers the stability of the
wind turbine. The application of the CPR, in addition to the MD, would not cover
additional performance aspects. Furthermore, wind turbine towers are not considered to
be construction products under the CPR. Nevertheless, wind turbine towers can be
assessed by EN 1090-1 (or others) in order to fulfil the stability requirements under the
MD.

Mandate M120
Mandate M120 refers to basic requirements:
1. Mechanical resistance and stability;
2. Safety in case of fire and
3. Hygiene, health and the environment.
Not to basic requirement 4. Safety and accessibility in use. Safety is a
different requirement than stability.

Definition of construction products
The CPR gives a very unclear definition of construction works: article 2.3 ‘construction
works’ means buildings and civil engineering works. It is accepted that all kind of
buildings are included, also industrial buildings. It is not clear what is meant with civil
engineering works.
The Interpretative Document to the CPD O.J. No. C 62, 28.02.1994 states: 'Construction
works' means everything that is constructed or results from construction operations and
is fixed to the ground. This term covers both buildings and civil engineering works.
Construction works include for example: dwellings; industrial, commercial, office, health,
educational, recreational and agricultural buildings; bridges; roads and highways;
railways; pipe networks; stadiums; swimming pools; wharfs; platforms; docks; locks;
channels; dams; towers; tanks; tunnels; etc.
The Royal Decree of 7 July 1994 determining the base standards for preventing fire and
explosions for new buildings gives in annex 1 definitions.

• The CPR does not cover construction works. It covers construction
products (structural metallic components)
• The CPR does not cover onsite execution. It covers components
fabricated in a work shop.
