Biological father - is the guy whose sperm caused the baby to be conceived

Presumed father – (A.N.S story) husband of the baby’s mother at the time of birth (is not always the same person) or within 300 days of the birth.

He is always the legal father unless he denies paternity!

Alleged father - man not married to the mother and says he is the biological father but this has not been proven by testing yet

Legal father -

man whose name appears on the birth certificate or he signed the AOP form and is responsible for support of the child

Birth Certificate in TX:

• Mother’s name goes automatically on birth certificate

• If married, the husband's name will be placed on the certificate, unless he denies that he is the biological father.

If not married:

NO FATHER’S NAME unless the baby’s parents take steps to establish legal fatherhood or “paternity”

If boy denies that he is the father, he can be ordered to submit to paternity testing.

Moms should contact Office of the Attorney General for help with this.
