This quotation is valid for a period of 30 days from the date of quotation.
Based on Your demands and needs Underwriters shall agree to incept cover under and solely
within this Policy on the condition that You provide the following information within the time
scales specified below:-
1) The attached Statement of Fact
You are not required to sign the Statement of Fact but You should read it carefully in
conjunction with the quotation to verify that all of the statements contained therein is correct.
If any statements are incorrect You must notify Underwriters prior to the inception of this
Policy Insurance
2) Payment
To be paid in full within 30 days of inception of this Policy
Underwriters reserve the right to amend the terms and conditions of Your Policy including
the premium or to withdraw cover after review and acceptance by Underwriters of the
required information.
We will inform You of our intention to amend the terms and conditions including the premium
or to withdraw cover within 14 days of receiving the required information.
In the event that You fail to comply within the time scale specified we may amend the terms
and conditions of Your Policy including the premium or withdraw cover.
If this occurs we will communicate our intentions to you in writing within 14 days of the expiry
of the time scale outlined above.
If we amend the terms or premium as a result of actions described above, then You will have
14 days to accept or reject the revised basis. In the event You reject the revised basis, time
on risk premiums will be payable by You.

Additional Policy Warranties
Height Exclusion - No Work above ground level
We shall not indemnify You under Sections 7 Employers Liability & Section 8 Public Liability of this
Insurance against legal Liability or defence costs arising from any work carried out on the outside of any
building or structure other than when working wholly at normal ground level.
Incident Log Condition
It is a Condition Precedent to Our liability under Section 8 Public & Products Liability that
You shall keep a log of all incidents where a user of the equipment sustains any form of injury, no
matter how trivial. Such log shall include:
a) the date and time of the incident;
b) the names and ages of the person(s) involved and contact details of the parents (if applicable);
c) name and contact details of the hirer and any independent witnesses;
d) whether independent medical advice was provided by a first aider;
e) a brief summary of the event.
Inflatable Exclusion - Public Use
We will not indemnify You for legal liability or defence costs where equipment is used on licenced
premises or other premises or events that are open to the public unless:
a) You or Your Employees supervise the use of the equipment at all times;
b) Where the equipment is on licensed premises, it is operated in a fenced, glass-free area.
Inflatable Exclusion - Second Hand Equipment
We will not indemnify You under Section 8 Public & Products Liability for legal liability or defence costs
arising from the sale of sell second-hand inflatables You know, or should have been expected to know
was is in a dangerous condition.

Inflatable Exclusion - Wet Hire Equipment Only
We will not indemnify You under Section 8 Public & Products Liability for legal liability or defence costs
Liability or defence costs arising from use of the following equipment:
a) bouncy boxing;
b) inflatable slides with a platform height of over ten (10) feet including items
featuring slides of over ten (10) feet;
c) ibar fly;
d) velcro Olympics;
e) velcro walls;
f) surf simulators;
g) unrideable bikes;
h) trampolines;
i) swing boats;
unless operated and supervised by You or Your Employee at all times.
Inflatable Operators / Hirers - Section 8 Public & Products Liability Definitions
It is noted that the following special Definitions apply to Section 8 Public & Products Liability:-
Controller
The person, organisation or hirer (those who hire to others) having the overall control, including
responsibility for maintenance, of the inflatable device.
Operator
The person over the age of 18 and appointed by the controller to be in charge of the operation of the
inflatable at any time when it is intended to be available for public use.
Inflatables Exclusion - Domestic Inflatables
We will not indemnify You under Section 8 Public & Products Liability for legal liability or defence costs
caused by or arising from the use, operation or hire of any inflatable device, inflatable slides or other
“toy” inflatables designed or classed for domestic use.

Inflatables Exclusion - Extreme Weather
We will not indemnify You under Section 8 Public & Products Liability for legal liability or defence costs
caused by or arising from the use, operation or hire of any inflatable device;
a) when being operated by You and/or Your Employees during;
i. Heavy rain as categorised as codes 13, 14 or 15 by the met office;
ii. Wind with a gusting speed of twenty five (25) miles per hour or more;
b) When being hired out by You the terms of hire must make the hirer aware that the equipment
must be deflated and not used during;
i. Heavy rain as categorised as codes 13, 14 or 15 by the met office;
ii. Wind with a gusting speed of twenty five (25) miles per hour or more;
This exclusion shall not exclude legal liability or defence costs the equipment is being deflated due to
extreme weather conditions.
Inflatables Exclusion - Inflatables Exceeding 20ft in height
We will not indemnify You under Section 8 Public & Products Liability for legal liability or defence costs
caused by or arising from the use, operation or hire of any inflatable device which exceeds 20ft in height.
Personal Protective Equipment Condition
It is a Condition Precedent to Our liability under this Insurance that;
1. All Employees are made aware of the dangers of not using personal protective equipment
2. Personal protective equipment provided to all Employees
3. A register maintained which demonstrates that all Employees have received appropriate training
and are fully conversant with the way in which to access such personal protective equipment
Product Origin
It is a Condition Precedent to Our liability under Section 8 Public & Products Liability that all goods
and/or Products are sourced from suppliers from within the European Union, Australia, New Zealand,
Switzerland, Norway, United States of America or Canada only.
Proprietary Brands Only Condition
It is a Condition Precedent to Our liability under Section 8 Public & Products Liability that only
proprietary brand products will be used and that these are used and stored in accordance with the
manufacturer's instructions.

Rights of Recourse Condition
It is a Condition Precedent to Our liability under Section 8 Public & Products Liability that You
maintain full rights of recourse against any manufacturer or supplier with whom You have entered into a
legal contract for the provision of Products as defined in this insurance.

Inflatable Code of Conduct Condition
It is hereby noted and agreed that it is a Condition Precedent to Our liability under Section 8 Public &
Products that You must ensure that:
a) all inflatables are visually inspected at the start of each hire for any:
i) any rips, holes or bulges; or
ii) signs of damage which could cause the equipment to fail
and appropriate repair undertaken before the hire commences;
b) all inflatables are correctly staked down at all anchor points (usually a minimum of six (6)) and guide
ropes, where applicable, must be used.
c) any inflatable sited on a hard surface such as concrete, wood or tarmac has adequate heavy
sand-bags attached to the anchor points to secure the inflatable;
d) safety mats be used for entry/exit points when the inflatable is sited on a hard surface;
e) every hirer is given a terms and conditions of hire form at the start of the hire and written
safety/operating instructions (or similar);
f) all electrical equipment have Portable Applicant Tests (PAT) done on an annual basis. This includes
blowers, extension reels and Residual Current Devices (RCDs);
g) RCD's (power breakers) must always be used and installed at the source and not attached to the
blower or extension reel socket;
h) that the age group of the users (e.g. children) is suitable for the size and type of inflatable;
i) any exposed electrical connections are fully waterproofed prior to use using specially designed
waterproof outdoor electrical connections;
j) a slip-sheet is used on inflatable slides to prevent users from falling through a split seam;
k) Operators must ensure that responsible adults will be available to supervise children while playing on
Your inflatables at all times;
l) You and Your Employees have training and knowledge to understand the procedures and rules
regarding the safe use/operation of such devices;
m) where You hire the equipment to a third party and you do not supervise the operation of the
equipment, the equipment is installed on site, inflated, tested and deflated by You or Your Employees;
n) where You hire the equipment to a third party and You do not supervise the operation of the
equipment, the hirer assumes the responsibility of ensuring:
i) the maximum age (or height) and maximum number of users permitted on the inflatable as
determined in the manufacturer's guidelines or recommendations;
ii) No food or drink (including gum) shall be used on the equipment;
iii) that all users remove their footwear and where applicable, glasses;
iv) that no person over the age of sixteen (16) is permitted on the equipment unless such
equipment bears the prefix “adult” unless to retrieve an injured child and all other children are
not on the equipment;
v) where “adult” use is permitted, adults and people under the age of sixteen (16) are not
permitted to participate on the same equipment at the same time;
vi) that no persons shall be permitted to use the equipment if appearing to be under the
influence of alcohol or drugs or otherwise intoxicated.
Where You are supervising the hire, the onus shall be on You to enforce the requirements of i)
to vi) above;
o) the equipment is:
i) maintained and operated in accordance with British Standard BS EN 14960:2006;
ii) inspected annually to ensure that it complies with British Standard BS EN 14960:2006
You shall retain a copy of the inspection certificate which You will be required to produce in the
event of a claim;
p) there is a system of check in place to ensure that the equipment carries up to date PIPA tag and
certification;
q) You belong to at least one of the following associations:
i) British Inflatable Hirers Alliance (BIHA);
ii) National Association of Inflatable Hirers (NAIH);
iii) Association of Inflatable Manufacturers, Operators, Designers and Suppliers (AIMODS).

Total Participant to Participant Exclusion
It is noted that the participant to participant liability exclusion under Section 8 Public & Products Liability
of the Policy Wording is deleted and replaced as follows:-
We shall not indemnify You against legal liability or defence costs in respect of Injury caused by any
member, player or participant or official of Yours to any other person whilst such member, player,
participant or official.
Bungee Run Condition
It is a Condition Precedent to Our liability under Section 8 Public & Products Liability that:
A. a suitable supervising adult must be in attendance at all times whilst the equipment is in use to
ensure safe operation;
B. users of the equipment must not be stretched along the bungee by another party;
C. socks must be worn by all participants whilst using the equipment;
D. the bungee chord is anchored to the wall end by a method recommended by TIPE (The Inflatable Play
Enterprise www.tipe.co.uk);
E. runs anchored with the use of karabiners or welded metal parts are excluded.
Inflatable Operators / Hirers - General Definitions
It is hereby noted and agreed that the General definition of Gaming, Amusement and Entertainment
Equipment contained within the Policy wording is restated as follows;
Gaming, amusement machines, snooker or pool table, bingo, casino and other entertainment equipment
including but not limited to special lighting and sound equipment, including tapes, records, compact
discs, mini discs and inflatable equipment.
For the purposed of this Endorsement inflatable equipment shall mean:
fairground equipment consisting of airfilled structures made from flexible fabric that are inflated by one
or more blowers and rely on air pressure to keep their shape. Such structures are designed to allow
users to bounce, slide or climb on.

GENERAL LEISURE STATEMENT OF FACT

IMPORTANT INFORMATION
The Statement of Fact is a record of information that you the Insured have provided to your
Broker, Intermediary or Agent and any assumptions Underwriters have made about the Insured
and the Insureds Business upon which this insurance quotation is based.
The Statement of Fact and Schedule are incorporated and form part of the Policy and should be
read together as one contract.
The Insured must take care when answering any questions Underwriters ask by ensuring that all
information provided is accurate and complete. If Underwriters establish that the Insured
deliberately or recklessly provided Underwriters with false or misleading information Underwriters
may for example:
• treat this Policy as if it had never existed and refuse to pay all claims and return the premium
paid, Underwriters will only do this if Underwriters provided the Insured with insurance cover
which Underwriters would not otherwise have offered;
• amend the terms of insurance. Underwriters may apply these amended terms as if they were
already in place if a claim has been adversely impacted by the Insureds carelessness;
• charge the Insured more for the Policy or reduce the amount Underwriters pay on a claim in the
proportion the premium the Insured paid bears to the premium Underwriters would have charged
the Insured;
• cancel the Policy in accordance with Underwriters Cancellation Rights.
The Insured are not required to sign the Statement of Fact but should read it carefully in
conjunction with the Schedule to verify that all of the information contained therein is correct.
If any of the information is incorrect the Insured should immediately notify the Broker,
Intermediary or Agent who is responsible for arranging this Policy on their behalf.
Neither I nor any Directors, Partners, Officers or Committee Members in the business have ever;

Can Underwriters cancel my policy?
Yes, but only under certain circumstances which are fully explained in the policy wording.
Cancellation will sent to you in writing to your last known address not less than 30 days notice of
cancellation.
Can I cancel my policy?
You may cancel the insurance at any time if you wish to do so please send written confirmation to
the Broker Intermediary or Agent who arranged the Policy.
Cooling off Period
You have the right to cancel this contract of insurance, without giving any reason, within 14 days
of the policy start date.
If you exercise your right to cancel during this initial period of cover, you will be entitled to a
refund of the premium paid, as long as you broker has received your written instructions and
provided that you have not made a Claim.
Any refund will be subject to a deduction for any time you have been covered and for any costs
incurred by in issuing the policy.

In accordance with the Employers Liability Insurance: Disclosure by Insurers Instrument 2010
made by the Financial Services Authority (FSA) we will be required to provide some of your
information to the Employers Liability Tracing Office (ELTO). The information that we supply in
accordance with this requirement will be added to an electronic database that will be managed by
the Employers Liability Tracing Office (ELTO), it will be subject to periodic update and certification
