IntroductionStateandfederalregulationsrequiretheMetropolitanTransportationCommission(MTC)toconductgovernment-to-governmentconsultationregardingMTC’splanningandprogrammingactivitieswithtribalgovernmentsoffederally-recognizedNativeAmericantribes.Additionally,effectiveJuly1,2015,AssemblyBill52(Gatto,Statutesof2014)beganrequiringthatstateandlocalagenciesanalyzetheimpactstoNativeAmericanculturalresourcesundertheCaliforniaEnvironmentalQualityAct(CEQA).ThelawintroducednewstaterequirementsforconsultationwithNativeAmericantribalgovernments.Assuch,leadagenciesunderCEQAmustworkwithtribalgovernmentstoavoidormitigatetheimpactstoculturalresources.
ThisreportdocumentsMTC’soutreachtotheregion’sNativeAmericantribesduringpreparationofPlanBayArea2040,theregion’slong-rangetransportationplanandsustainablecommunitiesstrategyforthenine-countySanFranciscoBayArea.
OverviewofPlanBayArea2040PlanningProcessPlanBayAreaisastate-mandated,integratedlong-rangetransportation,land-useandhousingplan.Bylaw(SenateBill375),allregionsinCaliforniamustcompleteaSustainableCommunitiesStrategy(SCS)aspartofaRegionalTransportationPlan(RTP).IntheBayArea,theMetropolitanTransportationCommission(MTC)andtheAssociationofBayAreaGovernments(ABAG)arejointlyresponsiblefordevelopingandadoptinganSCSthatintegratestransportation,land-useandhousingtomeetgreenhousegasreductiontargetssetbytheCaliforniaAirResourcesBoard(CARB).
TheregionadopteditspreviousPlan—PlanBayArea—inJuly2013.AstheBayArea’sfirstregionaltransportationplantoencompassaSustainableCommunitiesStrategy,theoriginalPlanBayAreachartedacourseforreducingper-capitagreenhousegasemissionsthroughthepromotionofcompact,mixed-useresidentialandcommercialneighborhoodsneartransit.ThePlanidentifiedPriorityDevelopmentAreas(PDAs)andsupportedthemregionallywithplanninggrants,technicalassistanceandprioritizationforvariousregionalandstatefundingrelatedtotransportationinfrastructureandaffordablehousing.
MTCandABAGlaunchedthePlanBayArea2040planningprocessin2015.Theplantookshapeoverthenexttwoyears,throughextensivepublicoutreach,analysis,andthedevelopmentoftargetsthatcanbeforecastedbymodelingtoolsandpotentiallyinfluencedbythepoliciesandinvestmentsintheplan.PlanBayArea2040isalimitedandfocusedupdatethatbuildsonthegrowthpatternandstrategiesdevelopedduringtheoriginalPlanBayArea,butwithupdatedplanningassumptionsthatincorporatekeyeconomic,demographic,andfinancialtrendsfromthelastfouryears.

Phase1ConsultationABAGandMTCbeganthePlanBayArea2040outreachandconsultationprocessinspring2016.Generaloutreach(asrequiredbystateandfederallaw)andconsultation(asrequiredbyAB52)occurredduringthesameperiod.
AB52ConsultationAssemblyBill52(Gatto,Statutesof2014)establishesanewcategoryofresourcescalled“tribalculturalresources”thatmustbeconsideredundertheCEQAprocess.Thenewcategoryconsiderstribalculturalvalueinadditiontoscientificandarchaeologicalvalueswhendeterminingimpactsandmitigationofaproject.Additionally,AB52requiresleadagenciestoestablishameaningfulconsultationprocessbetweenCaliforniaNativeAmericantribalgovernmentsandleadagencies.ThelawrequiresthatpriortothereleaseofanEnvironmentalImpactReport(EIR),theleadagencyshallbeginconsultationifaNativeAmericangovernmentrequests,inwriting,tobenotifiedofprojectsthataffectthemandrequestconsultation,inwriting,within30daysofsuchnotification.However,tomeetthespiritofthelawandestablisha“meaningfulconsultationprocess,”ABAGandMTCnotifiedaffectedtribes(identifiedbytheNativeAmericanHeritageCommission)atthestartofpreparationofthePlanBayArea2040EIR.
OnMay3,2016,MTCstaffrequestedviaemailalistoftribestraditionallyandculturallyaffiliatedwiththegeographicareaofPlanBayArea2040fromtheNativeAmericanHeritageCommission(NAHC).MTCstaffreceivedtheTribalConsultationListonMay23,2016,whichincludes17tribestraditionallyandculturallyaffiliatedwiththenine-countySanFranciscoBayArea.ThelistofaffectedtribesisincludedasAppendix1,Exhibit1.AdetailedsummaryofAB52consultationactivitiesduringPhase1isincludedinAppendix1asExhibit2.
