1.1 AbouttheChildmindingGuidelines

TheseGuidelinesareintendedtoprovideguidanceforgoodpracticetoassistChildminders.Theyinclude:

• nationallyagreedGuidelinesforgoodChildmindingpractice;• detailedinformationonStatutoryNotificationtotheHealthService

Executive(HSE)andVoluntaryNotification;• servicesprovidedtoChildmindersbytheCity/CountyChildcareCommittees,

theChildminderAdvisoryOfficersandChildmindingIreland;and • contactdetailsofrelevantorganisationsincludingaddressesandphone

numbers.

1.2 TheRoleofaChildminder

AChildmindercaresforasmallgroupofchildrenofmixedagesina“homefromhome”setting.Childrenarewelcomedasindividuals,theyareofferedaffectionandrespectandtheirdevelopmentalandrecreationalneedsaremet.Childmindersofferaflexibleservice,tailoredtoeachchild,therebyhelpingparentsandguardianstobalancetheirworkandfamilycommitments.AChildmindernegotiatesandagreesher/histermswithparents.

Thechild’swelfaremustbetheprimeconsiderationoftheChildminder.Childmindershavesoleresponsibilityatalltimesforthehealth,safetyandwellbeingofeachchildentrustedtotheircare.

1.3 DescriptionsofImportantTerms/ReferencesusedintheseGuidelines

InordertounderstandtheseGuidelines,pleasetakethetimetoreadthefollowingdefinitions.

CHILDMINDER:AChildminderisaself-employedpersonwhomindsotherpeople’schildrenintheChildminder’sownhome.

CCC:AbbreviationforCityorCountyChildcareCommittee.ThirtythreeCCCswereestablishedbytheGovernmentin2001,tohelpimprovetheprovisionofqualitychildcareineachCityandCounty.CCCsarenot-for-profitorganisations.TheyprovideinformationandsupportstomanydifferentclientsinthechildcaresectorincludingChildminders,parentsandchildcareproviderswhoaresettinguporoperatingchildcarefacilities.CCCstaffprovideservicesfrom9a.m.to5p.m.

CHILDMINDINGIRELAND:ThisisaprofessionalassociationforChildminderswhoareself-employedandworkintheirownhomes,providingafamily-baseddaycareserviceforchildren.RegisteredMembershipisopentoChildminderswhoprovidedaycareintheirownhomes,subjecttocertainconditions.

ChildmindingIrelandprovidesmanyservicestoitsmembers.Itisdedicatedtopromotingqualitychildcare,throughprovidingsupportandinformationtoChildmindersandthebroaderchildcaresector,bytelephone,electronically,throughpublishedmaterialsandthroughitswebsite.Italsohelpsparentsinidentifyingqualityinfamilybasedchildcareandinfindingchildmindingplaces.

CMAO:AbbreviationforChildminderAdvisoryOfficer.TheCMAOsworkwiththeCCCsandtheirspecificroleistoassistChildminders.ContactdetailsofCMAOsareshownatAppendixC3.

2.1CoreRequirementsforChildminders

ChildminderswhoarerequiredbylawtonotifytheHSEareboundbytherequirementsofPartVIIoftheChildCareAct1991andtheChildCare(PreSchoolServices)Regulations.New2006regulationsareexpectedtocomeintoeffectinSeptember2007.

TherearealsofournationallyrecognisedcoreareaswherecertainrequirementsshouldbemetbyChildminders:

(i) Suitabilityoftheperson

TheChildmindermustbeapersonaged18oroverwhoisgenuinelyinterestedincaringforchildrenandisofasuitablecharactertodoso.

(ii)WellbeingoftheChild

TheChildmindermusthaveacommitmenttoprovidingqualitychildcarewhichensuresthatthewellbeinganddevelopmentofthechildisparamount.

(iii)PhysicalEnvironment

TheChildminder’shomeshouldprovideasecureandhappyenvironmentinwhichthehealth,safetyandwelfareofthechildisassuredandinwhichthedevelopmentalneedsofthechildaremet.

(iv)Health&Safety TheChildmindermustprovideevidencethatadequatehealthandsafety

proceduresareinplace.DetailsoftheChildminder’sresponsibilitiesinthesefourareasareshownatSection2.2to2.5below.MoredetailedinformationandadviceonallareasisavailablefromthelocalCCC,thelocalCMAOandfromChildmindingIreland.

2.2Suitabilityoftheperson

AChildmindershould:

• begenuinelyinterestedincaringforchildren,beofsuitablecharactertodosoandhavetheabilitytocommunicatewithchildren;

• besuitabletohavesolecareofchildrenandmustbefreeofacriminalconvictionorofapendinginvestigationthatmaydeemthemunsuitable;

• beingoodhealth;

• beaged18orover;

• providereferencestotheparentthatwillattesttoher/hisgoodcharacterandsuitabilitytobeaChildmindere.g.pastemployer,parentofapreviouslymindedchild,GeneralPractitioner;

• respecttheconfidentialityofthechildrenandtheirfamilies;

• bewillingtoundertakeaccreditedtraininginfirstaid;

• bewillingtotakepartinchildcaretraining.

2.3WellbeingoftheChild

AChildmindershould:

• haveacommitmenttoprovidingqualitychildcarewhichensuresthatthewellbeinganddevelopmentofthechildisparamount;

• haveanunderstandingofchildren’srightsandneeds;

• recogniseandrespectthechildren’sindividualcharacters;

• recognisetheimportanceofplayandlearninginthestructureofachild’sdaybysharinginplayandprovidingappropriatematerialforplayactivities–particularattentionisdrawntoSíolta,whichsetsouttheNationalQualityFrameworkforEarlyChildhoodCareandEducation,publishedbytheCentreforEarlyChildhoodDevelopmentandEducation;

TheNationalQualityFramework,Síolta,isavailableonlineatwww.siolta.ieorthroughcontactingyourlocalCCC.

• putinplaceaprocedureforrecordingrelevantinformationinrelationtothechildandensurethatparentsaremadeawareofthisprocedure;

• respecttheparentastheprimarycarerandeducatorofthechild;

• ensurethatthereisstructuredqualitycommunicationtimewithparentstodiscusstheirchild’sprogress;

• provideahealthy,balanced,nutritionaldietforeachchildandbeawareofanyspecialrequirements;

• ensurethatallvulnerablefoodsarestoredundersuitablerefrigeratedstorageconditionsasnecessary;

• befamiliarwiththemostuptodateChildProtectionPolicybyparticipatingintrainingandmustensurethatthispolicyisputintopracticeinaccordancewiththe“ChildrenFirst:NationalGuidelinesfortheProtectionandWelfareofChildren”publication.

Childmindersmustensurethatnocorporalpunishmentisinflictedonachildandthatachildisneversubjectedtoanydegradingorabusivebehaviourwhileintheircare.

2.4PhysicalEnvironment

• theChildminder’shomeshouldprovideasecureandhappyenvironmentinwhichthehealth,safetyandwelfareofthechildisassuredandinwhichthedevelopmentalneedsofthechildcanbemet;

• thehomeshouldbeofsoundandstablestructureandshouldbefitforthepurposeofchildminding;

• thehome,bothindoorsandoutdoors,shouldbekeptinagoodstateofrepairandinacleanandhygieniccondition;

• theChildmindershouldhaveaccesstoatelephonewithinthehome.ItisalsorecommendedthattheChildminderhasacontactpersontocalluponintheeventofanemergency;

• theexitdoors,gatesandperimeterofthehomeshouldbesecure;

• childrenshouldhaveadequatespacetoplayandthereshouldbeadequatefloorspace;

• workandplayareasshouldbesuitableandbeinagoodstateofrepair;andprecautionsshouldbetakentoensurethattheyarenotasourceofinfection;

• Particularattentionshouldbepaidtoallindoorareas,including:

2.5HealthandSafety

TheChildmindershould:

• provideevidencethatadequatehealthandsafetyproceduresareinplace;

• ensurethatgoodhygienepracticesareadheredto;

• haveappropriateinsurancecoverformindedchildrenintheChildminder’sownhomeandwhiletravellingintheChildminder’scar;

• ensurethesafetyofchildreninher/hiscareatalltimes;

• betrainedinFirstAidforchildren;anup-to-dateaccreditedFirstAidCertificateshouldbeprominentlydisplayedandaproperlyequippedFirstAidKitforchildrenshouldbeinplace;

• haveinplaceandobserveFireSafetyandEmergencyProcedurese.g.anevacuationplan,firefightingblankets/equipmentandsmokealarmsshouldbeinplace;

• ensurethatanimals/petsonthepremisesdonotputthehealth,safetyorwelfareofthechildrenatrisk;

• informparentsofanyaccident,injuryorincidentinvolvingthechild.

3.1WhatisNotification?

CertaincategoriesofChildmindersarelegallyobligedtonotifytheHSEthattheyareprovidingachildmindingservice,whileothersarenotobligedtonotify.

IfaChildminderisnotobligedtonotifytheHSE,itcanbeworthwhiletovoluntarilynotifytheexistenceofher/hisservice.ThiscanbedonebycontactingthelocalCMAO.ContactdetailsareshownatAppendixC3.

3.2WhoisobligedtonotifytheHSE?

UndertheChildCareAct1991,apersonmindingmorethanthreepre-schoolchildrenfromdifferentfamiliesisobligedtonotifytheHSEofher/hischildmindingservice,withtheexceptionofthosewhoareexemptfromnotifyingasshownatAppendixB.

A‘pre-schoolchild’isachildwhoisundersixyearsofageandwhoisnotattendinganationalschooloraschoolprovidingeducationsimilartoanationalschool.

AChildmindermustprovidespecificinformationtotheHSEaspartofthenotificationprocess.ThisinformationissetoutintheChildcare(Pre-schoolServices)Regulations1996and1997.TheseareexpectedtobereplacedwitheffectfromSeptember2007withtheChildcare(Pre-schoolServices)(Amendment)Regulations2006.AChildmindershouldcontactthelocalPre-SchoolOfficertogetacopyoftheNotificationForm(forthoseobligedtonotify).SeeAppendixC2forcontactdetailsforthePre-SchoolOfficersintheHSERegions.TheHSEprovidesanadvisoryserviceandaninspectionserviceforallchildcareservicesincludingChildminderswhoarerequiredbylawtonotifythem.TheHSEwillmakeavailabletoanyinterestedpersoninformationonpre-schoolservicesinitsarea.

3.3ChildminderswhoarenotobligedtonotifytheHSE

WhereaChildminderisminding:• childrenundertheageofsixyearswhoareattendinganationalschoolora

schoolprovidingasimilareducationalprogramme;or

• pre-schoolchildrenwhoareallfromthesamefamily,orwhoarethechildrenofthechildminder’srelatives1,or

• nomorethanthreepre-schoolchildrenwhoarefromdifferentfamilies;

theChildminderisnotobligedtoinformtheHSEinordertocarryoutachildmindingservice.

1ArelativeisdefinedintheExplanatoryGuidetotheChildCare(Pre-SchoolServices)Regulations2006asabrother,sister,aunt,uncle,grandparentorstep-parentofthechild.

However,aChildmindermightwishtovoluntarilynotifythataserviceisbeingprovidedandcandosobycontactingthelocalCMAO.

Childminderswhoareunsureastowhethertheyareobligedtonotifyornot,shouldcontactthelocalCCC,thelocalCMAO,theHSEorChildmindingIrelandforadvice.

3.4VoluntaryNotification

3.4.1 BenefitsofVoluntaryNotification

VoluntaryNotificationbenefitsChildmindersbyopeningupaccesstoarangeofsupportsincludinginformation,networkingandtrainingavailablethroughlocalCCCsandlocalCMAOs,whichwillhelpChildminderstoimprovethequalityoftheirservices.ItalsobenefitsChildminderswhowishto:

• operatetohighstandards;

• havetheirworkvaluedandtheircontributiontothechildcaresectorrecognised;

• obtainguidanceonthedevelopmentofpoliciesandstandardsinchildcare;

• participateintraining,networkingandotheropportunities;

• attendconferences,seminarsandothereventsforChildmindersorganisedbytheCCCs;

• availoffinancialsupportssuchastheChildminderCapitalGrantScheme(seeSection4.2)andtheE10,000ChildminderTaxExemption(seeSection4.3);

• removetheisolationoftenexperiencedbyChildminders;

• contactparentswhoareseekingfamily-basedchildcareplaces;

• havetheirnamesincludedonapubliclistofChildminderswhichismadeavailabletoparents(optional).

Section4belowoutlinestherangeofservicesprovidedtoChildmindersbytheCCCsandCMAOs.

3.4.2 Howtovoluntarilynotifyachildmindingservice(i) TheChildmindershouldfirstofallreadcarefullyandthoroughlythese

GuidelineswhichincludethenationallyrecognisedcorerequirementsandgoodpracticerecommendationsforChildminders.

(ii) TheChildmindershouldcontactthelocalCMAOrequestingaVoluntaryNotificationForm.TheCMAOwillthensendthisFormtotheChildminder.TheFormcontainsaChildminder’sSelfEvaluation,whichmustbecompletedandreturned.

(iii)TheCMAOwillthencontacttheChildminder,toarrangeinadvance,adateandtimetovisittheChildminder,toreviewtheSelf-Evaluationandtoensurethatallthecriteriaaremet.

(vi)TheCMAOwillbeavailablethroughouttheSelf-Evaluationtohelp,advise

andguidetheChildminderthroughtheprocessandresolveanyproblemswhichmayarise.Wheneverythingisinorder,theCMAOwillsignoffontheVoluntaryNotificationForm,followingwhich,theChildminderwillbesentaconfirmationthatshe/hehasvoluntarilynotified.

Asampleofthe“VoluntaryNotificationForm”,includingthe“Self-AssessmentForm”,isattachedatAppendixA.TheChildmindershouldreadtheseformstolearnmoreaboutwhatisinvolved.

AllChildminders,whethertheyareobligedtonotifytheHSEornot,canavailofservicesprovidedbytheCCCsandtheCMAOs.Someoftheseservicesareoutlinedbelow.

4.1 Training

TheCCCsofferatrainingcoursecalledtheQualityAwarenessProgramme(QAP)forChildminders.Thisisatenhourcoursedividedintofivetwo-hourclasses,whicharedeliveredoveranumberofweeks.Thecoursecoverstopicssuchaschilddevelopment,childwell-being,play,hygieneandhealthandsafety.FollowingcompletionofaQAP,Childminderscangoon,iftheysowish,topursuefurtherrecognisedqualificationsviatheirCCCoravailofotheraccreditedtrainingoptions.

4.2Financialsupports

ChildminderswhohavecompletedaQAPcanapplyforaCapitalGrant,tocoverthepurchaseofsmallcapitalitemssuchasequipment,toysorminoradaptationcosts,toenhancethequalityoftheirservice.FurtherinformationisavailablefromtheCCCs.

4.3TaxExemption

Childminderstakingcareofthreeorfewerchildrenundertheageof18maybeentitledtoavailofaTaxExemption(ChildcareServicesRelief),fromtheRevenueCommissioners,iftheirannualchildmindingincomecomestonomorethanE10,0001.

ToapplyfortheExemption,ChildmindersareobligedtomakeanannualtaxreturnoftheirchildmindingincometotheRevenueCommissioners.ChildmindersmustalsoprovideevidencethattheyhavenotifiedtheirlocalCCCthroughtheCMAOthattheyareprovidingachildmindingservice.WhentheChildmindervoluntarilynotifies,theCCC/CMAOwillprovidewrittenconfirmationofthenotificationandthisconfirmationcanbeusedbytheChildminderasevidencefortaxexemptionpurposes.

AsCCCsdonotpassChildminderdetailsontotheRevenueCommissioners,itisamatterforChildmindersthemselvestomaketheappropriatedeclarationstotheirtaxoffice.

IftheannualchildmindingincomeisoverthetaxexemptionlimitofE10,000thetotalamountwillbetaxableasnormalforaself-employedperson.

4ServicesProvidedtoChildmindersbytheCCCsandtheCMAOs

1AssetinBudget2006.Thislimitappliesforthetaxyear2006andeachsubsequentyearunlessrevisedoramendedsubsequently.

AChildminderwhoqualifiesfortheTaxExemptionwillberequiredtopayanannualPRSIcontributionofE253inrespectofher/hischildmindingincome.ThisshouldbepaiddirectlytotheDepartmentofSocial&FamilyAffairsandwillensurethatallChildminderswhoavailoftheexemptionhavetheopportunitytobuildupasocialinsurancerecordwhichcan,intime,beadvantageousforbenefitssuchaspensionsandMaternityBenefit.

4.4ChildmindingNetworks

NetworksprovideopportunitiesforChildminderstocometogethertosharetheirexperiences,learnfromoneanotherandoffermutualsupport.AChildmindercanoftenfeelisolated,asthereareno‘co-workers’withwhomtodiscussandreviewthechallengesandjoysofcaringforchildren.NetworksfacilitatethesharingofexperiencesaswellasprovidingavenuesforinformaltrainingandforadviceandinformationfromCMAOs.TheyalsoprovideopportunitiesforChildminderstoidentifyanyadditionalsupportsorformaltraining,theywouldliketoseeoffered.Childminderscangetfurtherinformationonthenetwork/sintheirarea,bycontactingthelocalCMAO.

4.5ListofChildmindersforParents

IfaChildminderwishes,theCCCcanputthatChildminder’snameandcontactdetailsonalistofChildminders,fordistributiontoparentsintheirlocalarea.ThiswillenableparentswhomayneedaChildmindingServicetomakecontactwiththeChildminder.

4.6OngoingadviceandguidanceforChildminders

EachCCChasawealthofinformationandliteratureonchildcareatitsdisposal,toenableittoofferadviceandguidancetoChildminders.BynotifyingtheCCC,theChildminderhasongoingaccesstotheCCC’sandtheCMAO’sknowledgeandexperienceandcanalsobekeptup-to-datewithdevelopmentsinthechildcaresector.

ThesectioninPartVIIoftheChildCareAct1991,whichexemptscertainChildmindersfromnotifyingtheHSEisreproducedbelow:

Section58. Fortheavoidanceofdoubtitisherebydeclaredthattheprovisionsofthis

Partshallnotapplyto—

(a)thecareofoneormorepre-schoolchildrenundertakenbyarelativeofthechildorchildrenorthespouseofsuchrelative,

(b)apersontakingcareofoneormorepre-schoolchildrenofthesamefamilyandnoothersuchchildren(otherthanthatperson’sownsuchchildren)inthatperson’shome,

(c) apersontakingcareofnotmorethan3pre-schoolchildrenofdifferentfamilies(otherthanthatperson’sownsuchchildren)inthatperson’shome.

“pre-schoolchild”meansachildwhohasnotattainedtheageofsixyearsandwhoisnotattendinganationalschooloraschoolprovidinganeducationalprogrammesimilartoanationalschool.

CHILDCARE(PRE-SCHOOLSERVICES)REGULATIONSTheChildCare(Pre-SchoolServices)Regulations,asprovidedforunderPartVIIofthe1991Act,areintendedtosecurethehealth,safetyandwelfare,andpromotethedevelopment,ofpre-schoolchildrenattendingpre-schoolservices.TheRegulationsimpactacrossthevarioustypesofpre-schoolprovision,rangingfromvoluntaryprovisionbycommunityplaygroupsthroughtofulldaycareprovisionintheprivatesector.TheRegulationsandtheExplanatoryGuidetothemshouldbereadfordetailedinformation.Foreaseofreference,thefollowingdefinitionsofpre-schoolservices,asprovidedforundertheChildcare(Pre-schoolServices)(Amendment)Regulations2006,whichareexpectedtocomeintoeffecton3rdSeptember2007,arereproducedbelow:

“Childmindingservice”meansapre-schoolservicewhichmayincludeanovernightserviceofferedbyapersonwhosingle-handedlytakescareofpre-schoolchildren,includingthechildminder’sownchildren,inthechildminder’shomeforatotalofmorethan2hoursperday,exceptwheretheexemptionsprovidedinSection58oftheChildCareAct1991apply.

A“Childminder”isapersonwhoprovidesachildmindingserviceasdefinedintheRegulations.Thisservicereferstopre-schoolchildrenlookedafterinthechildminder’shome.Thisserviceisofferedforthefullworkingdayorfordifferentperiodsduringtheday.

“Sessionalpre-schoolservice”meansapre-schoolserviceofferingaplannedprogrammetopre-schoolchildrenforatotalofnotmorethan3.5hourspersession.

Servicescoveredbytheabovedefinitionmayincludepre-schools,playgroups,crèches,Montessoripre-schools,naíonraí,notifiablechildmindersorsimilarserviceswhichgenerallycaterforpre-schoolchildren.

“Part-timedaycareservice”meansapre-schoolserviceofferingastructureddaycareserviceforpre-schoolchildrenforatotalofmorethan3.5hoursandlessthan5hoursperdayandwhichmayincludeasessionalpre-schoolserviceforpre-schoolchildrennotattendingthepart-timedaycareservice.

“Pre-schoolserviceinadrop-incentre”meansapre-schoolserviceofferingdaycarewhichisusedexclusivelyonanintermittentbasis.

Thisreferstoaservicewhereapre-schoolchildiscaredforoveraperiodofnotmorethantwohourswhiletheparentorguardianisavailingofaserviceorattendinganevent.Suchservicesaremainlylocatedinshoppingcentres,leisurecentresorotherestablishmentsaspartofcustomer/clientservice.

“Overnightpre-schoolservice”meansaserviceinwhichpre-schoolchildrenaretakencareofforatotalofmorethan2hoursbetweenthehoursof7p.m.and6a.m.exceptwheretheexemptionsprovidedinSection58oftheChildCareAct1991apply.

Whereanovernightpre-schoolserviceisprovidedinachildmindingservice,thechildmindershouldlookafternotmorethan5pre-schoolchildrenincludingthechildminder’sownpre-schoolchildren.Nomorethantwochildrenshouldbelessthan15months.Ifitisnotpracticalinachildmindingservicewith5pre-schoolchildrenorlesstohaveanadultawakeandactivelysupervisingthepre-schoolchildrenatalltimes,electronicbabymonitordevicesshouldbeusedandoccasionalcheckscarriedout.Whereachildminderiscaringfor6pre-schoolchildrenincludingherownpre-schoolchildrenatthetimeofthecommencementoftheChildCare(Pre-SchoolServices)Regulations2006,thechildminderwillnotberequiredtoreducethenumbercaredforto5untilsuchtimeasoneofthatgroupof6pre-schoolchildrenbeginstoattendschoolorleavestheservicevoluntarily.

Anovernightpre-schoolserviceshouldhaveatelephoneonthepremisesandasecondpersonmustbeavailabletocopewithemergencies.
