3/26/91 - When asked i f Texaco would s e l l or farmout the subject acreage, Ron Lanning states t h a t Texaco would not s e l l the acreage but would c o n t r i b u t e i t s acreage t o a communtized p r o r a t i o n u n i t & would indeed j o i n i n the d r i l l i n g of a w e l l a t the proposed l o c a t i o n (NE/4 SE/4 Sec. 18, T-17-S, R-35-E, NMPM, Lea County, N.M.) & asked t h a t I make a w r i t t e n request thereof & send Texaco a copy of an AFE. He sta t e d t h a t a copy of an operating agreement was not necessary a t t h a t time because Texaco would want t o d r a f t t here own copy a t a l a t e r date anyway. See l e t t e r dated 4/3/91 from Owens (0PI) t o Texaco.
4/4/91 - Ron Lanning states t h a t Texaco would route proposal t h r u geology & engineering depts. i n Midland , & i t would come back t o Denver f o r land & f i n a l mgt. approval. He sta t e s t h a t Texaco can't f i n d the f i l e s on the subject acreage & t h a t the process w i l l take "some time".
4/17/91 - Ron Lanning states t h a t the proposal i s s t i l l i n Geology Dept. i n Midland f o r review, Texaco s t i l l can't f i n d i t s f i l e s , & t h a t due t o budgetary c o n s t r a i n t s i n the Permian Basin D i s t r i c t , Texaco would now probably j u s t farmout t o the proposed comm. pror a t i o n u n i t . He says t h a t i f I don't hear from him w i t h i n 2 weeks, I should send a copy of the comm. agreement & another l e t t e r t o Texaco requesting t h a t they e i t h e r j o i n or farmout or t h a t I w i l l f o r c e pool t h e i r acreage. See l e t t e r dated 5/6/91. With t h i s l e t t e r I send copy of communitization agreement, another copy of AFE, & copy of model operating agreement.
5/20/91 - When c a l l e d , Ron Lanning s t a t e s t h a t he r e a l l y s t i l l knows noth i n g , Texaco s t i l l can't f i n d i t s f i l e s , & he w i l l contact me as soon as he knows something. He also s t a t e s t h a t "we may j u s t do nothing & l e t you fo r c e pool us."
6/18/91 - A f t e r my unsuccessful attempt t o contact Rick Highsmith of Texaco's Geology Dept. i n Midland, Ron Lanning c a l l s & t e l l s me t h a t "those guys don't t a l k t o anybody, only the Land Dept. t a l k s to people." He goes on t o say t h a t "at t h i s p o i n t we're leaning toward (saying) No." When asked t o c l r a r i f y what t h i s meant, he s t a t e d : "We're leaning toward doing nothing, so you do what you have t o do." I took t h i s t o mean t h a t I should for c e pool Texaco i f necessary.

Texaco would p a r t i c i p a t e as t o i t s 50% working i n t e r e s t s u b j e c t t o a mutually acceptable j o i n t operating agreement.
