ICBC PItfallsIf you are injured in a car accident the clinical notes of your doctor and other care givers are often used by ICBC to reduce how much you are paid. How do you prevent this from happening to you?
The solution starts by appreciating the nature of the problem. On average it takes 4 years for an injury claim to get to trial. It is difficult to accurately recall the details of all your medical visits over this many years. In addition, almost al-ways there are several years of medi-cal records from before the collision. The details taken from all these notes can contradicts the victim’s memory. Simple mistakes are used by an ICBC appointed lawyer to question your hon-esty and accuracy as a witness.
Even honest mistakes can end up cost-ing you tens of thousands of dollars - or more. In a recent court decision, Ms. Welygan asked Mr. Justice Truscott to award her over $400,000. Relying in part on the clinical notes the Judge awarded less than $45,000. He con-clude many of her problems were not related to the collision.
In a busy clinic the doctor or chiroprac-tor seldom has the time to carefully write notes. The notes are designed to remind the doctor - not to be used as a complete and accurate history at a trial. Patients contribute to the problem by only giving the doctor part of the details. Patients may not tell their doctor about something they see as unimportant or they may believe it will go away. With certain types of symptoms patients may be embarrassed to tell their doctor. The
result is an imperfect record that skilful lawyers use to defend your injury claim.
A first step to protecting yourself is to get the clinical notes. Then with the help of someone who is able to read and understand the medical notes determine what they say and mean. Where the notes are simply wrong, bring that to the attention of the care giver.
Incomplete clinical notes are more difficult to deal with because by their nature all clinical notes are incomplete. As an example you may have driving anxiety following a car crash, along with a neck injury. The chances are good the doctor’s notes will discuss the neck injury but be silent about the driving anxiety. Years later an expert hired by ICBC may conclude your anxi-ety has nothing to do with the collision because the none of the notes from the initial doctor visits mention the prob-lem.
Another common example arises from the initial experience of a general-ize pain basically everywhere which weeks later becomes more focused with, for example, lower back pain and pain in the back of the neck. Follow up visits tend to be less comprehensive with the result that the specific areas of injury may not be accurately re-corded until months after the collision. When an x-ray or MRI finally reveals a disc injury months after the collision, an expert for ICBC may rely on the ini-tial clinical notes to conclude this is a new injury unrelated to the collision.
A second useful step is to write down your problems before you go in to visit the doctor. This decreases the chance of some problem being missed. Lastly, speak with somebody who is experi-ence in solving this type of problem.

ICBC PItfallsIf you are injured in a car accident the clinical notes of your doctor and other care givers are often used by ICBC to reduce how much you are paid. How do you prevent this from happening to you?
The solution starts by appreciating the nature of the problem. On average it takes 4 years for an injury claim to get to trial. It is difficult to accurately recall the details of all your medical visits over this many years. In addition, almost al-ways there are several years of medi-cal records from before the collision. The details taken from all these notes can contradicts the victim’s memory. Simple mistakes are used by an ICBC appointed lawyer to question your hon-esty and accuracy as a witness.
Even honest mistakes can end up cost-ing you tens of thousands of dollars - or more. In a recent court decision, Ms. Welygan asked Mr. Justice Truscott to award her over $400,000. Relying in part on the clinical notes the Judge awarded less than $45,000. He con-clude many of her problems were not related to the collision.
In a busy clinic the doctor or chiroprac-tor seldom has the time to carefully write notes. The notes are designed to remind the doctor - not to be used as a complete and accurate history at a trial. Patients contribute to the problem by only giving the doctor part of the details. Patients may not tell their doctor about something they see as unimportant or they may believe it will go away. With certain types of symptoms patients may be embarrassed to tell their doctor. The
result is an imperfect record that skilful lawyers use to defend your injury claim.
A first step to protecting yourself is to get the clinical notes. Then with the help of someone who is able to read and understand the medical notes determine what they say and mean. Where the notes are simply wrong, bring that to the attention of the care giver.
Incomplete clinical notes are more difficult to deal with because by their nature all clinical notes are incomplete. As an example you may have driving anxiety following a car crash, along with a neck injury. The chances are good the doctor’s notes will discuss the neck injury but be silent about the driving anxiety. Years later an expert hired by ICBC may conclude your anxi-ety has nothing to do with the collision because the none of the notes from the initial doctor visits mention the prob-lem.
Another common example arises from the initial experience of a general-ize pain basically everywhere which weeks later becomes more focused with, for example, lower back pain and pain in the back of the neck. Follow up visits tend to be less comprehensive with the result that the specific areas of injury may not be accurately re-corded until months after the collision. When an x-ray or MRI finally reveals a disc injury months after the collision, an expert for ICBC may rely on the ini-tial clinical notes to conclude this is a new injury unrelated to the collision.
A second useful step is to write down your problems before you go in to visit the doctor. This decreases the chance of some problem being missed. Lastly, speak with somebody who is experi-ence in solving this type of problem.
