TERMS&CONDITIONS–AUDIENCEMEMBERS

Inconsiderationofbeingpermittedtoparticipateintheaudiencefor‘Cannonball’(theProgram),producedbyITVStudiosAustralia

PtyLtd(ITVStudios)forbroadcastbySevenNetwork(Operations)Ltd(Seven),Iagreetothefollowingconditionsofentryandparticipationintheaudience:

1. IacknowledgethatITVStudioshasfilmedandrecordedme(orwilldoso)inconnectionwiththeProgram(together,theFootage)andIconsenttoITVStudiosusingthatFootageinorinconnectionwiththeProgram,includingasaso-called"trailer"or“promo”orasaphotograph(takenonitsownorasa‘still’fromthevideorecording)designedtopublicisetheProgram.TheFootagemayinclude,withoutlimitation,imagesofmeandalsomyvoiceandspeechandanyperformancethatImaygive.

2. IacknowledgethatITVStudiosownstheFootageandmayedittheFootageentirelyasitseesfit,includingfortheProgram.TotheextentthatImayownanyrightsinthatFootage,IassignallpresentandfuturecopyrightinthatFootagetoITVStudios.IauthoriseITVStudiostouseandauthorisetheuseofmyname,appearance,likenessandvoiceinconnectionwithanyuseoftheFootageandalsoanybiographicaldetails(whichincludes,withoutlimitation,any“personalinformation”asdefinedinthePrivacyAct1988(Cth)(PersonalInformation))orotherwisecapturedinthatFootage.

3. ITVStudiosmayuse,exhibit,broadcastormakepublictheFootage(oranypartofit)anywherethroughouttheworldinanyandallmediaforeverinanymannerasitseesfit(includinginthecontextoftheProgramorotherwiseandforthepurposesofpromotingandadvertisingtheProgramorinconnectionwithsponsorshipfortheProgram)orauthoriseanythirdpartytodoanyofthesethings.IirrevocablyconsenttoITVStudios(andpersonsauthorisedbyITVStudios)transferringPersonalInformation

aboutmethroughouttheworldwheresuchPersonalInformationiscomprisedintheFootagetotheextentnecessarytoexploittheFootage.

4. IacknowledgethattheProgramisconfidential.IwillnotmakeanycommenttothemediaabouttheProgramortheFootage.IacknowledgeandagreethatitiscriticalthatsecrecyismaintainedwithrespecttoalltheinformationthatImayobtainasaresultofbeingpartoftheaudiencefortherecordingoftheProgramandthisisinordertomaintainsurpriseandsuspenseforviewersoftheProgramwhentheProgramisultimatelybroadcastandalltheinformationobtainedis‘ConfidentialInformation’.AccordinglyIagree:

(a) nottodiscloseanyConfidentialInformationtoanypersonorentityincludingbutnotlimitedtofamilyandfriendswithoutthepriorapprovalofITVStudios.ThiswillnotapplytoanydisclosurewhichIamrequiredbylawtomake;and

(b) nottomakeanypublicstatementswhatsoeverrelatedtotheProgramormy(oranyfriendorfamilymemberwhomayparticipateintheProgram)participationinitincludingbutnotlimitedtoanypostordisclosureonanysocialmediasite(Facebook,Twitter,Snapchat,Instagram)withoutfirsthavingobtainedwrittenconsentofITVStudiostodoso.

5. InrespectofpermissiontobeapartoftheaudiencefortheProgramgrantedbyITVStudios(referredtointhesetermsandconditionsastheTicket,whetheraphysicalticketornotionalrightofentry),Iacknowledgeandagreethat:

(a) theTicketisonlyvalidforthedatesandtimesspecifiedandforthespecificpersonthathasregistered;

(b) theTicketwillbeinvalidifITVStudios’requirementsforconfirmationofattendancehavenotbeenmettoITVStudios’reasonablesatisfaction;

(c) theTicketisnottransferable,notredeemableforcash,maynotbesoldorofferedforsale,maynotbereproducedorduplicatedandcannotbereplacediflost,stolenordestroyed;

(d) alcoholicbeverages,illegaldrugs,controlledsubstances,camerasandrecordingdevicesofanykindmaynotbebroughtintothepremises;

(e) ITVStudiosreservestherighttorefuseentrytomeandtoejectmefromthepremisesifmyconductorspeechisdeemedbyITVStudios(atitsentirediscretion)tobedisorderlyordisruptiveorIotherwisefailtocomplywithITVStudios’reasonabledirections;and

(f) thedateandtimeoftherecordingoftheepisodeoftheProgramtowhichtheTicketrelatesissubjecttochangewithoutnotice.

6. Iacknowledgethat:

(a) nofeeispayabletomeatanytimeinconnectionwiththeFootage;

(b) myparticipationintheProgramasanaudiencemember(includinganyrelatedtravelinrespectofsuchattendance)isentirelyatmyownriskandatmyowncost;

(c) IhavenorightofinspectionorapprovaloftheFootage;

(d) ITVStudios’decisionswillbefinalinallmatters;

(e) Iwillnottransmitoraidintransmittinganydescription,account,picture,orreproductionoftheProgram,includingbutnotlimitedtophotographsandotherimages;and

(f) ITVStudioshasnoobligationtomakeorexploittheProgram,ortousemeintheProgram,andIwillnotbringanyclaimagainsttheStudiosforlossofopportunityinrelationtotheProgram.

7. IreleaseITVStudiosanditsassigneesandlicenseesfromandagainstanyclaimsarisingfrommyparticipationintheProgramincludinginrespectofanymisadventure,accident,injury,loss,damageorotherclaimthatmayariseduringtherecordingoftheProgram.

8. ThisagreementisgovernedbythelawsofNewSouthWalesAustralia,andthepartiesirrevocablysubmittotheexclusivejurisdictionofthecourtsofthatState.
