In a recent court case, XimpleWare argued that GPL doesn’t include a patent license
If upheld, using even GPL software could expose you to patent infringement

Why should I get a patent if I don’t want to sue someone?
Patents can be used purely defensively
Defensive patent examples include

Can I combine open source and patents?
The short answer is yes.
The long answer is that we are working on a new open source license that will allow you to better control what happens to your work – including dedicating it freely to the public – by using patents.
