The Clery Act, enacted in 1990 and amended in 1998, 2000, and 2008 requires higher education institutions to report crime statistics and safety policies to current and prospective students and the Department of Education.
Clery Act Institutional Obligation
To ensure that students know about dangers on their campuses, the Clery Act requires institutions to gather and publish data from three kinds of Campus Security Authorities.

Campus Security Authorities “Campus Security Authority” – a Clery-
specific term that includes 3 categories:
People or offices responsible for campus security
People or offices to which campus policy directs that crimes be reported
“Officials with significant responsibility for student and campus activities”
Campus Security Authorities People or offices responsible for
campus security Police and/or Campus Safety Non-police security staff
Responsible for monitoring or controlling entrance to campus property
Special events security staff
Campus Security Authorities
Focus on individuals students might seek out to report a crime.
Line responsibility Student Affairs – residential education, judicial affairs,
student activities
Focus on student activity advisors, coaches, assistant coaches, club advisors
Campus Security Authorities
“Officials with significant responsibility for student and campus activities” – examples:
Dean of Students
Director, Assoc./Asst. Directors of ResEd/Housing
GHCs and RAs
Faculty advisor to student group
Athletic Director
Coaches/Asst. Coaches
Director of Health & Wellness Center
Campus Security Authorities
Some examples of those excluded from the definition of campus security authority include:
Individual faculty who are not advisors to student groups
Individual campus health center physicians Clerical staff
Campus Security Authorities YOU DO NOT HAVE TO REPORT IF:
You are a licensed mental health counselor or pastoral counselor (recognized by a religious organization to provide confidential counseling) and
You are working within the scope of your license or religious assignment

Even though as a counselor you do not have to report, you can tell the person how she/he can report the crime.
Oxy does not have a process to anonymously report crime except for sex crimes (sexual misconduct).
Always explain reporting options and resources available to the person.

I’m not a counselor…what must I do? Promptly make report to Dir. of Campus
Safety Clery Act crimes that can reasonably be concluded are made in good faith.
Tell the person you must report the incident as a statistic but will not identify anyone unless consent is given.
When in doubt, report.

Tell the person you must report the incident as an anonymous statistic but will not identify anyone unless the victim consents to being identified.
Let the person know about options for reporting to the Campus Safety and LAPD.
Remember: The decision to identify someone isn’t yours to make. A person who talks to you doesn’t have to talk to Campus Safety or LAPD.

What Must Be Reported
Type of Crime Location of the Crime

the College or a recognized student organization Timing
Date and time the crime or incident occurred When the person reported it to you
Helpful Information
Name of the victim (if the victim wishes to be identified.
Identities of any known suspects or witnesses.
Use of any weapon in the commission of the crime.
What Not to Report
DO NOT REPORT CRIMES IF:
A person tells you about a crime that occurred before coming to Oxy
While the person was away from campus and not involved in an Oxy activity
Information
Get the information the person wants to tell you, Campus Safety will decide what type of crime has occurred You do not have to prove what happened or
who was at fault. You are not supposed to find the
perpetrator Do not identify the victim unless the victim
consents to being identified.
Information
“Description of the incident or crime” Detailed information will help Campus
Safety or LAPD correctly categorize the crime.
Get as accurate and complete a description of what happened as possible.
If you are not sure if a crime should be reported, report it and let the Director of Campus Safety decide.

If the person reporting the crime is in imminent danger or harm, call Campus Safety immediately at 323-259-2511.
