Let’s look at some different situations and discuss if these situations, statements and graphics are permitted – or against

the Jamberry Policy and Procedures.

Some of them are going to be pretty obvious – some not so obvious.

RECRUITING

COMPLIANT OR NOT?“Jane, you would not believe how much

money I’m making selling Jamberry. I made $2,100 last month. I can’t promise you’ll do

the same – but it’s just an amazing opportunity, and I’d love to share it with

you.”

This is to make sure you are in compliance with state & local laws – not just to avoid making promises you have

no way of keeping.

Offering to trade the purchase of a consultant kit or offering to purchase $100 in product from someone else

in exchange for them joining your Jamberry team?

This is most definitely not compliant.

You may not offer any trade, gift, compensation, reward or reimbursement for someone to become a Jamberry

Independent Consultant.

This is not just a Jamberry rule – this is a law.

No. This is called “Poaching” and can result in the termination of your Consultant Agreement. If you speak

with another consultant who is unhappy with the support they receive, encourage them to speak to Jamberry about it. Jamberry will moderate between those two

consultants.

This is not compliant. There is a sheet of nail wraps in the gift bag that is not in the purple envelope. You cannot sell Jamberry in anything other than the original packaging. You *can* offer a gift with purchase. Also, note: you cannot, in any way, sell the Jamberry logo buffers, cuticle pushers or files. Nor can you sell any other items along with Jamberry. You must clearly advertise it as “gift with purchase.”

This is sort of a trick question If you designed and posted this publicly, you would be out of

compliance. But this is an image that was created by a consultant, and submitted to compliance for approval. You may design your own

Headers on Facebook business pages MUST be one of the ones supplied by Jamberry, available in your workstation under the resources tab or on Flickr.

No, this would not be permitted. Any media interviews – no matter how small or hyper-local the paper – has to go through the Jamberry Corporate office.

Any exposure on a blog that has more than 5,000 followers must go through the Jamberry Corporate office.

You may do this. However, you cannot use the word “Jamberry” and you must clearly state “Independent Consultant” in every description, every step of the way.

You may not sell any Jamberry products – wraps or business supplies – on any auction or online website other than Jamberry’s. You may also not sell through a print catalog of your own or another business.

You may not sell Jamberry at anything that is a “regular” event – including Flea Markets. There must not be any impression that this is an ongoing retail situation. Vendor events and fairs are acceptable because they are not permanent or regular occurrences.

SUMMING IT ALL UP

I know – it seems like a lot of rules.But, remember – these rules are in place both for the protection of Jamberry’s brand, to make sure you are

complying with the law, and to ensure that other consultants cannot offer things that you aren’t able

to offer, thereby creating a level playing field.

Comparatively, Jamberry is quite generous with what they *DO* permit us to do in building our business. Think about the fact that all of the images I used, except for one picture I took, were taken off of the

internet. Which means they are publicly non-compliant. There are a lot of people that scour the internet for non-compliant posts. They aren’t doing

anything wrong by doing that – they are just protecting the brand that they represent. Don’t put your Consultant Agreement in jeopardy by giving

them something to report to compliance.
