INSTRUCTIONS AND SAMPLE LETTER-BRIEF INOPPOSITION TO RULE 12(b)(6) MOTION TO DISMISS
FOR FAILURE TO STATE A CLAIM
Inpro se prisoner cases, defendants will often le a motion to dismiss
for failure to state a claim. In cases led in federal court under 42 U.S.C.
1983 ci!il ri"#ts actions$, a motion to dismiss for failure to state a claim is
