ùi. james sa¡O that he did not have any paper work authorizing the Town of Fairmount Height's
to have the speed camera Program.
It is my recommendation that the cameras are shut down today, until we can sort this matter out'
I think it would be in the best interest of the Town.

Dear Dr. H'tjazi:
The Town of Fairmount Heights'council passed ordinance 02-11on July 2o 201L establishing new
school zones to include portion, of sheriff Road within the corporate limits of the Town; and in addition,
approving the use of School Zone Speed Monitoring Systems to assist in enforcing the posted speed at
this and several other locations. ln response to growing citizen complaints in referençe to excessive
speeding in the Town along the 5300 block of Sheriff Road, the Town conducted a speed study during
the month of Decembe r Zotl. This location study was conducted because it serves as primdry
pedestrian crosswalk for the Town residents and children attending nearby schools; in addition, this
location serves as a school bus stop.
After reviewing the disturbing results of the study and conducting public hearings, in accordance to
Maryland Transpoftat¡on nrticle 523.-809 allowing the use of speed monitoring systems in school zones,
the Town has determined that the use of these calming devices would greatly increase the safety of the
residents and school-aged pedestrians in our municipality. lt is therefore our objective to notify the
prince George,s counti Department of Transportat¡on and Public works of our intention to begin speed
camera enforcement of the roadways within ourTown corporate limits to include the portions along the
5300 block of Sheriff Road. We intend to cooperate with the Department of Public Worl<s and
Transportation to adhere to all State Laws and/or County codes, rules or regulations regarding the safe
and proper use of speed cameras as determined by the stature. lt is further our goal that collectively we
will reduce the events of speeding and aggressive driving within ourTown as we focus on the safety
benefits of enforcing the speed limit at these locations'
We are currently in the process of finalizing the notifications and signage required by law to assist in
educating our drivers and through our publ¡c works and Police Department personnel and engineering,
has established our school zone enforcement areas' All areas selected for automated traffic
enforcement via speed cameras reside well within the prescribed half-mile radius around our learning
institutions and are within the Town's corporate limits. Please accept this letter as our notification to
move forward with our safe speed program'

"PROGRAM")inTheTownofFairmountHeights,Maryland;and
NOW THEREFoRE, the Town of Fairmount l{eights, MD ancl BREKFORD agree to tlre following:
I. BACKGROUNDThe Maryland state General Assernbly passecl Maryland rransportation Law $21-s09 in spring, 2009 allowing the
use of ,,photographic speed-monitoring systems". -As
a result of this legislation, the Maryland Transportation
Article includes for t¡e Town of Fairmount Hêights use of photographic speed-¡nonitorilìg systems in its school
zones. A photograp¡ic speed-rnonitoring ryrr*ir is a speed+n*"õ.ttíng syit"m thatworks in conjunction with a
photographic, video, or elecrronic canrèrâ io automatiially measure the speed attd produce photographs' video' or
ãigit"ti*äges of vehicles violating a speed limit or spee d restriction.
Tire goal of the program nÌust l¡e to ensure the safety of pedestrians ancl motorists by providing a üaffic safety
enforcement progr-am specifically focused on schooi zonis, Monday through Friday betvr¡een the hours of 6am to
Bpnt.
The Torvn of Fairmount Heights Department of police seeks a camera service provider to implement and assist in
managingcertain otpu.tt of*the fieù operations as well as turnkey back-office support of the Program'
il. SCOPE OF SERVICDS
The contractor mustprovide all goocls and services as clescribed in this conh'acL as seL folth in the Brekford
pr.oposal provided in tne submitied prnposal by Brekford- [See 'A'BreKord's Proposal to the Town of Fairnrount
Iìeights)
T¡e Contractor must provicle, and be responsibìe for rnaintaining ancl supporting all of its speed camera
equipment. The Town of Fair¡nount Heights wilt not be financiaily, or othä¡'wise, responsible for the speed calnerâ
equip,nent placecl lly Brekford or provided to the Town for use under this agreement'
III. COMPENSATIONTire contractor s¡all5e compensated rurder this agreement at 400/o of the rnonthly Proglam payments' The
contracror musr provirle a detaiìed sysrem billing i'eport each month showing all futl payments (by citatiou
nunrber] to accompany each subtnitted invo ice'
The cornpensation rate is basecl upon the contractor's provision of tìre fbllowing goods and selvices as described
below alrd as delineated in the scope of ser-vices:
o Two (2J portable camet'a systems * aìl inclusive of internal power, and personnel to service the technology
five (5) daYs a week;
' On-call technical service for the hours of daily operâlions by the Police Departmenü
a lnitial event review, nãrne and adrlress acquisition, ancl online police review;
' Mailing of up to three 13) notices per violation (including late noticesl;
o paynrent and mail processing of citations, telephone customer service, pay-by-phone, pay-by-web'
Integrâted Voice Response [lVR) rystenl, clocument imaging, and online cashiering support to the
cashiering efforts of Tlre 'l'own of Fairmount Heights, MD;
ê SuÌ)port of a public web site and training for Police, Town ancl court personnel;

The Contractor must sr.tbmit monthly invoices in a form ancl format to be approvecl by the Town. At a minimum
each ¡ronthly invoice must contain a report that includes all full payrnents by citation number. The Contractor's
monthlyinvóice ¡s due byt}e 1S,r'of eaãh month forthe previous month and mustbe submitted to: Program
Director, Departmentof Police of the Town of FairmountHeights, MD.
The Brelcford r,rrill provide the Town of Fainnount I'leights cotlections efforts for all outstanding citåtions owed to
the Town for speeã camera violations. ^Additional feei for the collections of outstanding citations wiil be attached
to each delinqte¡t t¡cket to be paict'by the violator. Collections for flagging outstaÌrding citations will be at no
additional cost to the Town.
The Town of Fairmount Heights reserves the righu ro negotiate with Brekford for any fitture colìections efforts
beyoncl the flagging efforts undertaken by Brekford-

VIII. TERMINATION BY DEFAULT AND ATTONNH¿S EËES

Stare Motor VehiclJÀdministation (Chapter 693, Laws of 1974) and an administrative
fee of $50.00 to be added (03/30/03)
D. The Town of Fairmount Heights cooperates with the Marl"land Department-of
ü*rportution tvtoto, v"hicle A-<lminisnafion's vehicle tag-flagging program. Violators
whose tags are naggea under this program must pay an administrative charge to the

(ADD) SECTTON s-2r7 SPEED MONITORTNG SYSTEMS
A. SPEED MONITORING SYSTEMS.
l. A "speed monitoring system,tt as defined in Maryland law, means a devicewithone or more motor vehicle sensors producing recorded images of motor vehiclestraveling at least 12 miles per hour above the posted speed limit.
2. School zone speed monitoring systems are hereby authorized at locations,determined by the mâyor and council designee after consultation with the Townmanager, in school zones within the Town, as established under S 21-83.1 of thetransportation article of the Annotated Code of Maryland.
3. Before activating any school zone speed monitoring systems(s), the Town shall:
a. Publish notice of the location(s) of the speed monitoring systems(s) on the

,,'.'' b. Ensure that each sign that designates a school zone indicates that speed

monitoring systems are in use in school zones.
The school zone speed monitoring system may operâte Monday through Fridaybetween 6:00 A.M. and 8:00 P.M.
For a period of at least 30 days after the lirst speed monitoring system is placedin the Town, any violations recorded by any speed monitoring system in theTown shall be enforced only by the issuance of a warning.

6. The school zone speed monÍtoring system in the town shall be conducted incompliance with all applicable provisions of the Maryland vehicle law.
B. School zones.
1. school zones in the half mile radius around a) Robert R. Gray Elem, Sçþool;b) Fairmont Heights High School; and, c) SeaJ Fleasant Elem. Schooi.
2. Town staff is hereby authorized to take those actions necessâry to allowoperation of a speed monitoring system in the above designated school zoneareas within the Town.
3. Town staff Ís hereby authorized to take those actions necessary to obtain anyrequired permission from the State of Maryland or other County Governmentwith the jurisdiction to operate a speed monitoring system within one-halfmile of the school zones.
(ADD) SECTION s-209 CITATION PpNATIES
A cÍvil penalty under this subsection for a speed monitoring system violation may
not exceed $40. Violations resulting from any speed monitoring systems shall be
granted reasonable time for payment of an imposed fine.
Any citation issued as result of a speed monitoring system must be paid to the
Town within a cerúain time. Failure to make payment to the Town within a
certain time for a violation resulting from a speed monitoring system will result in
additional late fees for delinquent amounts owed.
Nothing in this section shall restrict the Town of Fairmount Heights fromimposing additional fees owed to the Town for the collection of a citation issued as
result of a speed monitoring System.
And be it further ordained that if any provision of this Orclinance or the application
thereof to any person of circumstance is þeld invalid for any reason, such invalidityshall not affecf the other provisions or any other applications of this ordinance which
can be given effect with the invalid provision or applications, and to this end, all the
provisions of this Ordinance are hereby declæed to be sevelable.
Be it further ordained, that this ordinance shall take effect (30) days from the date ofpassage and shalt be published in the Town newsletter or a newspaper having general
circulation in the town

GENERAL PROVISIONS
1. PURPOSE: The purpose of this Memorandum of understanding (Mou) between theMaryland
State Police as the International Justice and Public Safety Network (Nlets) Criminal Justice
Information Systems (CJIS) Systems Agency (csA) and the Laurel Police Department, hereinafter
referred to as the ..partìes," is tó memorialize the parties' understanding regarding the transmitting,
receiving, and storing of information distributed by Nlets for access to vehicle registration and/or
driver license records.
2. BACKGROUND: Nlets provides the computerized, high-speed message switching system
between the criminal justice community and state motor vehicle registration agencies. This
infrastructure provides owner information on vehicles and motor vehicle operator's license captured
in numerous motor vehicle databases. This information is accessed for criminal justice enforcement
purposes.Criminal justice agencies in Maryland have instituted Speed Enforcement Camera Technology'
Their vendois providÉ video equipment and software to search registration and/or driver license
databases for vehicle owner and/or motor vehicle operator's license information and take enforcement
action. An originating Agency Identifier (oRI) with limited Nlets access is required to perform this
search and is issued to the criminal justice agencies for vendor access.
3. AUTHORITy: The csA shall have the sole discretion to promulgate and retain any rules'
regulations, and procedures necessary to the operation ofthe speed enforcement camera technology'
4. SCOpE: This Mou applies to the csA issuing an oRI with limited Nlets access to the criminal
justice agency specifically -for
vendor use to access vehicle owner and/or operator license information
databases.
A. The CSA will:
1. provide the User Agency with a Speed Enforcement Camera ORI with limited
Nlets access;
Z. provide the User Agency with name and telephone number of a technical and
administrative Point of contact'
B. The User AgencY will:
l. Use the ORI with limited Nlets access for criminal justice purposes pertainingto the Speed Enforcement Technology;
Z. provide the CSA with the name and telephone number of a technical and
administrative Point of contact'
5. DISCLOSURE AND USE OF INFORMATION: The vendor and agency use of this oRI will be
limited to Speed Enforcement Camera activity only'
6. SECURITY AND PRIVACY OF DATA: The User Agency agrees to protect and prohibit
dissemination of information received from this ORI access to any other vendor' agency' or any
unauthorized person(s).
7. INDEMNIFICATION OF THE MARYLAND STATE POLICE: The user Agency agrees to
indemnify the Maryland State Police, its officers and employees, to the extent permitted by law and
subject tá tne timitations as set forth in the Stæe Tort Claims Act, Title 12, Subtitle I of the State
Govemment Article or the Local Government Tort Claims Act, Title 5, Subtitle 3 of Courts and
Judicial Proceedings Article, Annotated Code of Maryland from and against all claims' demands'
actions, suits, and proceedings by others, against all liability to others, including, but not limited to'
any liability for da-mages by reason of, or arising out of any false arrest or imprisonment' or any
other cause of action ihutro"u"r, and therefrom, arising out of or involving any negligence on the
part of the User in the execution of the Agreement. Nothing contained in this agleement shall be
deemed to constitute a waiver of the sovereign immunity of the state or to provide indemnification
for negligent acts by the Maryland state Police, their officers, employees, or agents'
g. TERM: All activities of the parties under this MOU will be carried out in accordance to the
above-described provisions. The cSA reserves the right to immediately suspend the oRI whenever
the security, privacy, uses or dissemination requirements established by this Mou are violated' The
cSA may reinstate access in such instances upon receipt of proof the violation has been corrected'
Either party may rerminate this MOU upon 3ó days written notification to the other pafly' Such
notice will be subject of immediate consultation by the parties to decide upon the appropriate course
of action. Inthe event of such termination, the following rules apply:
1. The parties will continue participation up to the effective date of termination'
2. All project information, copies, thereof, and rights therein received under theprovisions of -
this MOU prior to the termination will be destioyed within six months of the termination of
this MOU.
9. The MOU, which consist of nine sections, will enter into effect upon signature _of
both parties
and will remain in effect until terminated. The foregoing represents the understandings reached
between the CSA and the User Agency'

My apologies for the Mass Mailing and for the Urgent Tag. However, Iwanted to make sure that you were all aware of the recent letter fromDistrict Court Judge Ben Clyburn stating that the District Court would nolonger enforce Late Fees and Tagging Fees for Speed Camera and Red LightCamera Programs. Since we have all implemented different fee structuresfor our programs it is Judge Clyburn's conclusion that we do not meet theUniformifl Clause in the state constitution and that mention of these feesneeds to be removed from tickets immediately. I'm not sure how you feelbut I feel strongly that not being able to collect late and tagging feeswill be a significant detriment to enforcement,
To that end Senator Ramirez has introduced legislation (SB 1101) that will addressthis issue. Special Thanks to the Senator for trying to drive this issue.
Given that session is almost over in Annapolis -- this bill would need topass in less than a week. We need you to contact your delegationsto indicate the impoÉance of this bill.

Brekford Corporation
Guidelines Regarding Acceptance or Rejection of Violations
The "report reference line" is used by the camera system as a point of reference showing an
approximate area (on the 1" photograph only), where the target vehicle ends or has advanced
beyond. As an added secondary form of reference forthe evaluator ofthe photograph(s), he or
she may refer to this line in determining if the target vehicle's rear t¡res have advanced, (or are
directlv on). this line.
The report reference line should primarily be used as the threshold whereby the target vehicle
has passed or is bevond. Any target vehicle captured in a photograph with a report reference
line will have:a. Entered the RADAR beam for detection and speed measurement; and
b. Remained within the beam long enough for a speed measurement to be made and an
image taken showing a target vehicle exceeding the set threshold (e.g. the radar
communicates to the camera to capture the image when a violation is detected).
As you can see from the l't multi-lane diagram, there are several vehicles within the camera's
field of view. The target vehicle, which has passed the "report reference line," is recorded as
captured by the RADAR as a violation.
The 2nd image is primarily used as verification of movement and that the target vehicle has
traveled some distance beyond the point of capture.
It is vital to understand that the L't, or "Violation lmage" is the only position [and thus
photographl where the RADAR speed measurement is taken and recorded.
The key point to convey is that the criteria for confirming a violation is that the vehicle has
moved bevond the "report reference line". This means the line can be touching the reartires,
OR it can be some distance behind the tires, but it is not a requirement that the rear tires must
be touching the line in order to confirm a violation.
Even in cases where there are multiple vehicles within the camera field of view, it is possible to
accurately determine the violating vehicle (such as in the image attached).
On occasions where more than one vehicle's position and proximity to the report reference line
makes it difficult to clearly determine the target vehicle, both images may be rejected.
Note: Brekford's speed meosuring system is programmed to generolly discord images when itdetects multiple vehicles in such proximity causing an inconclusive reoding.
The above explanations are applicable to multi-lane roads only. Single-lane roads allow the
system to capture and to target one violation at a time in image #1.
Note: On single-lane roads, a violation's second image may show onother troiling vehicle in it.
However, there must be two photos for eoch violation so the trailing vehicle is not being torgeted
as a violation.
