Texas Hazard Communications Act

Purpose, Scope and Authority» To protect employees from exposure to

harmful chemicals.» To provide employers and employees with the

guidance needed to comply with the Texas Hazard Communication Act (THCA).

» The THCA is enforced by the authority of the Texas Department of State Health Services.

To keep you informed about hazards on the job the Hazard Communication Standard was established.

It gives you the Right to Know regarding chemical hazards in the workplace and how to protect yourself from them.

What Is A Hazardous Chemical?

Chemicals are considered hazardous when they present physical and/or health hazards:

Physical hazards» Are combustible liquids, explosive or flammable

liquids, compressed gas and oxidizers. Health hazards

» Chemicals creating acute or chronic health effects.

Information

Information about the chemicals you work with comes in two forms:» The manufacturer’s label or product container.» Material Safety Data Sheets (MSDS) that are

developed by the chemical manufacturer.

MSDSs are kept in each department for chemicals located or used in that area.

A back-up file of MSDSs is kept in the Environmental Health & Safety (EH&S) Office in the Physical Plant, Room 125.

MSDSs contain important information including: Chemical identity- Product identification, name and/or

trade name. Company information – Name and emergency telephone

numbers. Hazardous ingredients- Includes the hazardous mixtures

of solids, liquids or gases and any cancer causing compounds.

Physical characteristics- Color, odor and evaporation rate.

Health hazards- Any identifiable health effects.

Reactivity- How the product reacts with other chemicals. Handling and storage precautions- Proper storage and

handling procedures. First aid and the recommended PPE- Proper medical

attention and personal protective equipment (PPE). Disposal and transport information- Procedure for

disposal, spill clean-up and transport. Fire and Explosion hazards- Proper fire fighting

procedures and extinguishers.

Label– Any written, printed or graphic material

displayed on or affixed to containers of hazardous chemicals which includes the same name as on the Material Safety Data Sheet (MSDS).

Container is» Any bag, barrel, bottle, box, can, cylinder,

drum, reaction vessel, storage tank or the like that contains a hazardous chemical or contains multiple smaller containers of an identical hazardous chemical.

operating systems in a vehicle.

Labels Used at UT-Tyler

The Hazardous Materials Identification System (HMIS) is the preferred labeling system at UT-Tyler. Label colors and numbers indicate potential hazards. For example :

The colored diamond was developed by the National Fire Protection Association (NFPA) to aid fire fighters in identifying hazard during a fire. Label colors and numbers indicate potential hazards. For example :

Read the label before you use a chemical.

If the container labels are missing, damaged, or illegible, notify your supervisor immediately.

Know the dangers you may face.

Personal Protective Equipment (PPE)is designed to protect the employee from exposure to harmful chemicals. PPE should be used as a last line of defense, if the exposure can’t be avoided.

Responsibility

Employers Must

Implement a written hazard communication program.

Establish a hazardous chemicals list in the workplace.

Ensure chemical containers are labeled. Make MSDSs available to all employees. Document education and training for employees

about chemical safety precautions and procedures.

Participate in safety training programs.

Read labels and MSDSs.

Understand the hazards they face.

Follow safety procedures on the job.

Employees Must

Chemical Manufacturers Must

Determine the physical and chemical hazards of their products and the possible health effects.

Label chemical containers accordingly.

Provide Material Safety Data Sheets that list detailed information about hazardous chemicals.

Emergencies

Chemical Spills

Remove yourself and other persons exposed to the chemical. Remember, do not take undue risk. Protect yourself from exposure.

Alert others in the area of the danger.

Call 7300.

Confine the area, close doors and keep unauthorized persons out.

Evaluate the situation. Will an MSDS be needed and should someone else be notified?

Inventory in each department» Maintained by Department Safety Liaisons (DSLs)» The DSLs forward a copy to the EH&S Office by

December 31, of each calendar year. The Texas Hazard Communication Act “Notice

to Employees” is posted in each department where other notices are normally posted.

Use Your Right-To-Know

To Stay Safe and Healthy» Learn what hazards you face.» Read and follow the information on labels and

MSDSs.» Follow the safety procedures established by

the University.» Use proper protective clothing and equipment.

Preventing Exposure

To prevent exposure from hazardous substances, UT Tyler and EH&S utilize the following:» Engineering Controls - Measures taken to eliminate

personal contact with certain hazards.» Administrative Controls - Written policies and

procedures to protect from certain hazards.» Personal Protective Equipment (PPE)- Supplied to the

employee for protection while working with known hazards.
