The Police Association ofOntario and both opposition

parties have joined OPSEU inurging the provincial Liberals

to abandon any plan to down-load the prosecution of themost serious non-criminalprovincial offences, known asPart III offences, to municipal-ities.

Bill 177, the Stronger, FairerOntario Act, passed lastDecember, allows theprovince to move the prosecu-tion of offences, such as care-less driving, hit-and-runs, sexoffender registry violationsand serious motor vehicle col-lisions, including tractor trailerrollovers, from the Ministry ofthe Attorney General tomunicipalities.

In his letter to PremierKathleen Wynne, Warren(Smokey) Thomas, Presidentof OPSEU, said he was"deeply concerned" about thenew legislation. "People whoprosecute Part III offenceswith very serious penalties upto and including imprisonmentshould be employees of, anddirectly accountable to, theMinistry of the AttorneyGeneral," he wrote.

Others are also speaking outabout the possible download,including Police Association ofOntario (PAO) PresidentBruce Chapman. In his letterto Premier Wynne, he wrote,"The PAO strongly believesthat the prosecution of Part IIIoffences should remain withthe Ministry of the AttorneyGeneral in order to preserveand foster public safety,accountability, transparencyand justice."

NDP justice critic GillesBisson has posted a videostatement roundly condemn-ing any move to downloadPart III prosecutions.

Bisson said Wynne is "at itagain," following in the foot-steps of former Premier MikeHarris, who infamously down-loaded many public servicesonto municipalities. The MPPfor Timmins-James Bay repre-sents a large number of north-ern municipalities and warnedmany could not assume thefiscal burden.

"We have the expertise withinthe provincial count system.We know how to do it well,"Bisson said. "Downloadingthat onto a municipality thatmay not have the resources todo it is problematic from alegal prospective, but also afiscal perspective."

"Nobody outside this govern-ment approves of the down-

load of justice: not the police,not the opposition, not theprosecutors and certainly notme," said Thomas. "It's

absolutely the wrong thing todo. The due process of law inOntario should not, and mustnot, be relegated to a patch-

work of municipal govern-ments."
