1. INTRODUCTION
In2015,TheAustralianSenate’sEconomics
ReferenceCommitteereleasedareportthat
underscoredtheimportanceofaffordable,secureand
suitablehousingasavitaldeterminantofaperson’s
wellbeing.Thereportsuggestedthatasmarket
solutionstolowcosthousingwillsimplynotemerge
naturally,aconcertedeffortbyGovernmentatall
levelsisrequiredtoaddressthechallengesofhousing
affordability.Thereportidentifiedsignificantissuesin
achievinghomeownershipaswellasproblemsrelated
totherentalmarketanddeficienciesintheprovision
ofaffordablehousingforpeoplewithdisabilitiesand
olderAustralians.
Inaddition,researchundertakenbyAustralianHousing
andUrbanResearchInstitute(AHURI)inrecentyears
suggeststhatoneofthekeychallengesforAustralian
citiesistoincreasethequantityofinfilldevelopments
ensuringasufficientsupplyofaffordablehousing.
Concludingthatmediumdensitydevelopmentswithin
innerandmiddlesuburbsprovidethebestopportunityto
increasethesupplyofdiverseandaffordablehousing.

designanddevelopmentindustriestotestnewproducts
andconstructionmethodssuitableformedium
densityhousing,whichwillultimatelycontributetothe
developmentofawiderrangeofaffordablehousing

DELIVERY OPTIONSInordertoprovideflexibilityandtoengagewidely
acrossthedesign,buildinganddevelopmentindustries,
two(2)deliveryoptionshavebeenincludedinthebrief.
Thisallowstheflexibilityforarchitects/designersto
submitadesignproposalwhichLandCorpcandeliver,
whileatthesametimeprovidingopportunitiesfor
adeveloperand/orbuilderincollaborationwithan
architectordesignertoparticipateinthecompetition
andifsuccessful,designandconstructthewinning
prototype.Participantsmustnominatetheirpreferred
deliveryoptionwhensubmittingtheirStage1submission

willbebuiltinLandCorp’sShorelineDevelopmentat
CockburnCoast(subjecttofeasibilityandapprovals).
LocatedfourkilometressouthofFremantle
and18kilometresfromPerth’sCBD,Shorelineis
thefirststageofdevelopmentwithintheCockburn
CoastRedevelopmentArea,avisionaryprojectthatis
transformingmorethan106hectaresofformerindustrial
landintoavibrantnewhomeforupto12,000residents.
CivilandlandscapingworksatShorelineStage1,
comprisingamixofsingleresidentiallotsand
apartmentsites,wererecentlycompleted.Themajority
oflotsreleasedarenowundercontractwithbuilding
worksonindividualsitestocommencelaterin2016.Itis
envisagedthatconstructionofthewinningprototypewill
commenceonLot217inlate2017(subjecttofeasibility
andapprovals).
Shorelinewillsetanewbenchmarkformediumdensity
livinginWesternAustraliaandbecomeaunique
destinationandhighqualityexampleofurbanrenewal.

thewinningdesigntobeconstructedonLot217in
LandCorp’sShorelineDevelopmentatCockburnCoast
(subjecttoagreement,feasibility,financeandapprovals).
Thechallengeforproponentsistodemonstrate
howtheproposedhousingprototypewilladdress
theaffordabilitychallengeandhowitwillcontribute
significantlytotheprovisionofinnovativemedium
densityhousingdesignthatcanmeettheneedsoffuture
generations.TheCompetitionAssessmentCriteriais
outlinedinSection3.
LandCorpinvitesproponentstoexploreinnovative
ideasthatwillcreatenewdesignsandoptimisenew
technologies,materialsandconstructionmethods
withoutcompromisingliveabilityanddesignquality.
Proponentswillneedtoconsiderarangeofissues
includinghouseholdanddemographicneeds,
contemporarylifestylesandfuturetrendsaswellas
interrogatingthemultipledwellingR-Codeprovisionsto
optimisethedevelopmentpotentialofthesite.
Wearelookingforcosteffective,practicaldesign
solutionsthatcaneasilybemodifiedtosuitarange
oflocationsandcontextssothatthebenefitsof
implementingthewinningdesigncanbemaximised.
Climateresponsivedesignandspatialefficiencywill
beimportantconsiderationsaswelltheefficientuse
oflandallocationperdwellingtokeeptheindividual
costofunits’low.Innovativesiteplanningandparking
arrangementswillalsoplayaroleaswilltheprovision
ofprivateoutdoorareasandsharedcommunalspaces.
Participantsareencouragedtochallengecurrent
perceptionsofstandardhousingtypesbyconsidering
alternativedesignsolutions,takingintoaccountflexible
andadaptablelayoutsforavarietyofhouseholdtypes,
opportunitiesforsharedoccupancy,workingfromhome
andprovisionsforageinginplace.
Competitioncategoriesincludeavarietyofhousing
typologiesincludingmaisonettes,multi-unitdwellings
(e.g.GenYDemonstrationHousingProject),walk-up
apartmentsandspecialhousing(e.g.sharedhousing/
shelteredhousing/seniorshousing).Participantsmay
choosetosubmitinoneormorecategoriesbuteach
proposalmustbetreatedasaseparatesubmission.All
submissionswillbeassessedagainstthesameselection
criteriawithonlyoneoverallwinnertobeselected
forconstructionatShoreline.Allproposedhousing
developmentsmustcomplywiththeShorelineplanning
frameworkanddesignguidelines.

Priortotheannouncementofthewinningprototype
theParticipantwillworkinclosecollaborationwith
LandCorp’sprojectteamtoensurethatthefinal
designisinlinewiththeoverallprojectobjectivesand
affordabilitypricepoint,priortofinalisingtheconditions
oftheconstructioncontract.Aperiodoffour(6)weeks
willbeallocatedtothisexclusiveworkingperiod
duringwhichtimetheParticipantwillprepareworking
drawings,finalspecificationsandcostingsothatthe
applicationforbuildingapprovalcanbesubmittedas
soonasthedevelopmentapprovalisreceived.

inclusioninStage3.Asumof$20,000willbepaidto

STAGE 3: STEP-UP AFFORDABLE HOUSING DETAILED DESIGN (THREE (3) FINALISTS)• Stage3submissionsaretoincludefullyresolved
designdrawingsanddetailedconstructioncostsas
wellasdetailsofsaleprice,sustainabilitypackages,
andmaterialspecificationstobeincludedinthefinal
product.Itisexpectedthatsubmissionswillincludeall
informationnormallyrequiredtoobtainadevelopment
approvalfromtheLocalAuthority.Participantsshould
checkrequirementswiththeLocalAuthoritypriorto
developingtheDetailedDesigntoensurecompliance
withallregulationsandlocalpolicy.
• Acertificateofdesigncomplianceandenergyrating
certificateisalsorequired.
WINNING SUBMISSION • ThewinningStage3submissionwillbechosenby
theselectionpanelforconstructionatLandCorp’s
‘Shoreline’developmentatCockburnCoastsubjectto
feasibilityandapprovals.
• Asumof$20,000willbepaidtothewinning
participantinadditiontoapromotionalpackagewhich
LandCorpestimateswillhaveamaximumvalueof
$80,000.Themarketingpackagewillcontributeto
thecostofpromotingthewinningdesignincludingan
OpenSource“Step-upAffordableHousingPrototype”
webpage,mediapublicationsanda‘Demonstration

Submissionsshouldaddressthebroad
conceptofhousingaffordabilityandaffordableliving
encompassingnotonlydirectmortgagecostsbutalso
runningandmaintenancecosts,stratafeesandtravelto
workcostsetc.
Itisakeyrequirementofthe‘Step-Up’Affordable
HousingCompetitionthatParticipantsdemonstratethe
abilitytodeliveranaffordableproducttothemarket
withinthefollowingpricepoints:
• between$300,000and$350,000for1bedroom
units;and
• between$300,000and$430,000forunitswithmore
than1bedroom.
The$430,000upperlimithasbeencalculatedtoensure
thatanyproposedprototypeunitsareaffordablefor
householdseligibleforKeystarthomeloanproducts
(includingkeyworkers,retireesorpensionersand
personswithadisability).However,asLandCorpwants
toachieveinnovativehousingsolutionsthatwillbe
accessibletoawidegroupofpersonsseekingaffordable
housing,LandCorpexpectsarangeofpricinginthe
developmentwithinthepricebracketof$300,000
to$430,000.
ItispreferabletoLandCorpthatthesalepriceofall
theproposedprototypeunitsarewithintheaboveprice
brackets,withaminimumof25%oftheunitswithinthe
$300,000to$350,000pricebracket.AParticipantwill
needtodemonstratethatthebuiltformofthedesigncan
bedeliveredtoachievethesesalepricesaspartofthe
‘Step-Up’AffordableHousingCompetitionsubmission
requirements.
LandCorpwill,however,considerproposalswherea
Participantdemonstratesthatatleast50%ofthesale
pricesoftheproposedprototypeunitsarewithinthe
abovepricebrackets,withaminimumof25%oftheunits
withinthe$300,000to$350,000pricebracket.
IfthewinnersubmitsaDesign&Constructentry,the
finalcontractforacquisitionofLot217fromLandCorp
willincludearequirementthat,unlessthewinner
otherwiseobtainsLandCorp’swrittenconsent,those
dwellingswithintheproposeddevelopmentwithinthe
abovepricebracketsaresoldonlytopersonswhose
incomeiswithintheincomelimitstoqualifyfora
KeystartHomeLoan.
LAND VALUEThecurrentvaluationofthelandatShoreline(Lot217)
is$855,000.Participantsselectedtosubmitaproposal
forStage2willneedtoconsiderthelandcostaspart
oftheirfeasibilityanalysisandincludeanoveralltarget
salepricebasedonthislandvaluation.
IfaParticipantentersthe‘Step-up’AffordableHousing
CompetitionwithintheOption2stream(Design&
Construct)theParticipantacknowledgesthatthesale
priceofthelandwillbe$855,000.

ultimatelydeliverahighlyinnovative,affordablemedium

Selection of the winning Step-up Affordable Housing PrototypeThefinalselectionofthewinningPrototypewillbemadebyapanelofindependentindustryprofessionalsappointedbyLandCorp.LandCorpatitssolediscretionmaydecidetoproceedwithconstructionofthewinningdesignsubjecttofeasibility,financearrangementsandapprovals.
3.4.4 AFFORDABLE HOUSING PROTOTYPE WINNERThewinnerwillbepaidasumof$20,000tocontributetothecostoffinalisingthedocumentationforthewinningprototype.Inaddition,thewinnerwillbenefitfromapromotionalpackagewhichLandCorpestimateswillhaveamaximumvalueof$80,000whichwillincludeanAffordableHousingPrototypewebpageandprojectpublicationsaswellasaspeakingopportunityattheLaunchofLandCorp’sStep-upAffordableHousingPrototypeLaunchEvent(DateTBC).
ThewinningParticipantwillbenotifiedinwritingfollowingLandCorp’sdetermination.AllParticipantswillbenotifiedinwritingoftheresultsofsubmissions.

‘InnovationthroughDemonstration’eventorganisedby
LandCorp.Subjecttofeasibility,financeandapprovals,
thewinningdesignwillbedeliveredthroughoneofthe
deliveryoptionsoutlinedintheTerms&Conditions

Oncecompleted,aportionoftheStep-upAffordable
HousingPrototypemustbemadeavailablebythe
winnerforuseasadisplayandinformationcentrefor
anagreedperiodoftime(beingnotlessthan3months)

tovisitthedevelopmentandlearnabouttheprototype.
Duringthistimearangeofactivitiesandpresentations
willbescheduledtoensurethattheuniquequalities

subjecttoagreementwiththewinningparticipantonce

challengeanydecisionofLandCorparising

4. Submission Requirements For Each Stage
(a) AllsubmissionsbyrelevantParticipantsforeach
stageoftheCompetitionmustcomplywiththe
requirementsoutlinedintheCompetitionBriefor
asadvisedbyLandCorpfromtimetotime.
(b) Participantsareadvisedtoretaincopiesoftheir
entriesassubmissionswillnotbereturned.
(c) Anysubmissionsthatdonotconformwiththe
entryrequirementsintheCompetitionBriefwillbe
deemednon-complyingandmaybedisqualified.
LandCorpmayacceptanon-complyingsubmission
ifitconsiders(actingreasonably)thatthenon-
conformingaspectisnotmaterial.
(d) AParticipantmaynotchangeitssubmissionfor
anyStageoftheCompetitionaftertheclosingdate
fortherelevantStageunlessLandCorpinvitesthe
Participantinwritingtodoso.
5. Assessment Process For Stage 1
(a) ParticipantsmustmakeasubmissionforStage
1inaccordancewiththerequirementsofthe
CompetitionBrief.
(b) EachsubmissionforStage1mustindicatewhether
thesubmissionisaDesignandBuildSubmissionor
aDesignOnlySubmission.
(c) AninternalLandCorppanelassistedbyan
independentprobityadvisorwillassessthe
submissionsfromStage1.
(d) TheinternalpanelwillselectuptosixParticipants
whomadesubmissionsforStage1toprogressto
Stage2.
(e) Theinternalpanel’sdecisionwillbeatitsabsolute
discretionandwillbefinal,bindingandno
objectionswillbeconsidered.
(f) LandCorpwillpay$10,000toeachStage2
ParticipantasacontributiontowardstheStage2
Participant’scostsinpreparingtheirsubmission
forStage2.Allotherexpenseswillbethe
responsibilityoftheStage2Participants.Only
onepaymentwillbemadetoaStage2Participant
regardlessofthenumberofpartiescomprising
theStage2Participant.Halfofthepayment
willbemadeoncompletionofStage1andthe
remainderwillbemadeoncethesubmissionfor
Stage2hasbeensubmittedinaccordancewiththe
requirementsoftheCompetitionBriefandthese
TermsandConditions.
6. Assessment Process For Stage 2
(a) Stage2Participantsmaymakeasubmissionfor
Stage2inaccordancewiththerequirementsofthe
CompetitionBrief.
(b) WhereaParticipanthassubmittedaDesignand
BuildSubmissionintheCompetition,inorderfor
LandCorptobesatisfiedthataStage2Participant
hastheabilitytodelivertheDevelopment,
LandCorpmayrequireStage2Participants
toprovidecorporateandfinancialdetailsto
LandCorp.Stage2Participantsmustprovideall
informationrequiredbyLandCorpinthisregard
whensubmittingtheirsubmissionsforStage2.
(c) Aselectionpanelofindependentindustry
professionalsappointedbyLandCorpwillassess
theStage2submissionsbyStage2Participants.
(d) Theselectionpanelwillselectuptothree
ParticipantswhomadesubmissionsforStage2to
progresstoStage3.
(e) Theselectionpanel’sdecisionwillbeatits
absolutediscretionandwillbefinal,bindingandno
objectionswillbeconsidered.
(f) LandCorpwillpay$20,000toeachStage3
ParticipantasacontributiontowardstheStage3
Participant’scostsinpreparingtheirsubmission
forStage3.Allotherexpenseswillbethe
responsibilityoftheStage3Participants.Only
onepaymentwillbemadetoaStage3Participant

3submissionsandforLandCorptobesatisfied
thatthefinaldesignoftheProposedWinner’s
Stage3submissionwillmeettherequirementsin
clause7(h).
(d) Subjecttoclauses3(b),7(h)and7(j),theselection
panelwilldetermineawinneroftheCompetition.
(e) Theselectionpanel’sdecisionwillbeatits
absolutediscretionandwillbefinal,bindingandno
objectionswillbeconsidered.
(f) LandCorpwillpay$20,000totheWinnerto
contributetotheWinner’scosts.IftheWinner
submittedaDesignandBuildSubmission,this
contributionwillnotbeawardediftheWinnerdoes
notsigntheContractinthetimeallowed.
(g) LandCorpwillalsoprovideapromotionalpackage
totheWinner(whichLandCorpestimateswill
haveavalueupto$80,000)whichwillinclude
theproductsandpromotionsidentifiedinthe
CompetitionBrief.
(h) PriortoannouncingtheWinnerpursuantto
clause7(d),theProposedWinnermustworkin
collaborationwithLandCorp’sprojectteam(fora
periodupto6weeks)toprepareworkingdrawings,
finalspecificationsandcostingsandtoensurethe
finaldesignoftheParticipant’sStage3submission:
(i) isinlinewiththeoverallprojectobjectivesof
thisCompetitionandtheShorelineEstatein
NorthCoogee;and
(ii) canbedeliveredandsoldforthesaleprices
identifiedbytheParticipantintheirsubmission
withoutcompromisingthequalityofthe
proposeddevelopment.
TheProposedWinneracknowledgesthatthe
ProposedWinnermustsatisfyLandCorpand
provideallinformationrequiredbyLandCorp
thattheProposedWinner’sfinaldesignmeets
theabovecriteriabeforebeingannouncedasthe
WinneroftheCompetition.
(i) IftheWinningConceptDesignwassubmittedtothe
Competitionas:
(i) aDesignandBuildSubmissionandclause8(b)
issatisfied,theWinnermustenterintothe
Contractwithin5BusinessDaysoftheContract
beingdeliveredtotheWinner;or
(ii) aDesignOnlySubmissionorclause9applies,
theWinnergrantstoLandCorp(andanypartner
orbuilderinvolvedintheconstructionofthe
Development)theLicence.
(j) LandCorpreservestherighttoselectan
alternativewinnerfromtheStage3submissions
forconstructiononLot217if:
(i) LandCorpisnotsatisfied(initsabsolute
discretion)thatthefinaldesignoftheProposed
Winner’sStage3submissionmeetsthe
requirementsofclause7(h);
(ii) theProposedWinnerorWinner(iftheWinner
hasbeenannounced)doesnotcompleteand
executetheContractinthetimeallowed(if
clause7(i)(i)applies);or
(iii)ifthereisanyotherdisputebetweenLandCorp
andtheProposedWinnerorWinnerthatcannot
beresolvedtoLandCorp’ssatisfaction(inits
absolutediscretion).
(k) LandCorpreservestherighttodecidewhether
tousetheWinningDesignConceptforthe
Developmentornot.

8. Development By Winner
If,subjecttoclauses7(i)and7(k):
(a) thesubmissionoftheWinnerwasaDesignand
BuildSubmission;and
(b) LandCorpissatisfiedinitsabsolutediscretionthat
theWinnerhasthefinancialability,experienceand
capacitytodeliverthebuiltformoftheDevelopment,
then
(c) LandCorpandtheWinnermustenterintothe
Contractinrelationtotheconstructionofthe
DevelopmentonLot217bytheWinnerandthesale
ofunitsinthecompletedDevelopment;and
(d) theWinnermustconstructtheDevelopmenton
Lot217inaccordancewiththeContract.
9. Development By Landcorp
If,subjecttoclause7(k):
(a) thesubmissionoftheWinnerwasaDesignOnly
Submission;or
(b) thesubmissionoftheWinnerwasaDesignand
BuildSubmission,however:
(i) LandCorpisnotsatisfiedpursuanttoclause
8(b);and/or
(ii) theWinnerhasfailedtoenterintotheContract
inaccordancewithclauses7(i)(i)and8(c);
and/or
(iii)theContractterminatesforanyreason,
then
(c) LandCorpmayconstructtheDevelopmentonits
own,bypartneringwithanotherparty(includinga
developer,not-for-profitorbuilder)toconstructthe
Developmentorbyengagingabuildertoconstruct
theDevelopment;and
(d) theWinnergrantstoLandCorp(andanypartner
orbuilderinvolvedintheconstructionofthe
Development)theLicence.
10. Licence For Development
Ifclause9applies:
(a) Subjecttotheremainderofthisclause10and
clause15,LandCorpacknowledgesthattheWinner
remainstheownerofallWinningIPandthat,
exceptforclauses16(c)to16(e),nothingprevents,
limitsorrestrictstheWinner’ssubsequentuseor
exploitationofWinningIP.
(b) TheWinnergrantstoLandCorpandanyparty
partneringwithoranybuilderinvolvedwiththe
constructionoftheDevelopmentanon-exclusive,
transferable,royaltyfree,irrevocableand
perpetuallicencetouseallWinningIPandallIPin
theWinningConceptDesignforthepurposesofor
inconnectionwiththeDevelopment.
(c) TheWinneragreesthatLandCorpmayamendthe
WinningConceptDesigninitsabsolutediscretion
andthattheDevelopmentundertakenbyLandCorp
mayincludeamendmentstotheWinningConcept
Design.Wherepracticable,LandCorpwillengage
theWinnertoamendtheWinningConceptDesign
(whererequiredbyLandCorp)foralimitedfee
(basedoncurrentreasonablehourlyrates)agreed
byLandCorp.
11. Enquiries
(a) AParticipantmaysubmitquestionsinwriting
abouttheCompetitiontoLandCorp’sappointed
representativeidentifiedintheCompetitionBrief.
IfthequestionisconsideredbyLandCorptobe
suchthattheresponseshouldbeprovidedtoall
Participants(and,ifnecessary,asdeterminedby
theProbityAdvisor),thenLandCorpwillmake
suchansweravailabletoParticipantsthrough
theCompetition’swebsiteorthroughanyother
electronicplatformforsubmissionstothe
Competition.
(b) Participantsmustnotattempttocontactany
otherLandCorprepresentativeregardingthe
Competitionotherthantherepresentative
identifiedintheCompetitionBrief.
(c) Aperiodofsevendaysaftertheopeningdateof
eachstageoftheCompetitionhasbeensetaside
forParticipantstoseekclarificationastothe
relevantstageoftheCompetition.Enquiriesand/or
questionsreceivedmorethansevendaysafterthe
openingdateofeachStagemaynotbeanswered.

thatananswergivenbytheProbityAdvisortoa
Participant’squestionshouldbemadeavailableto
allParticipants).
13. Confidentiality Of Submissions
(a) TheParticipantsacknowledgeandagreethat:
(i) thisCompetitionisbeingruntopromote
innovativethinkinginthedevelopmentofquality
affordablehousing;and
(ii) itisLandCorp’sintentionthatallStage1ideas
andStage2conceptdesignsmaybeexhibited,
usedinLandCorp’spromotionsandincluded
onLandCorp’swebsitesandParticipantsagree
fortheirStage1andStage2submissionsto
beused,advertisedanddisplayedforthese
purposes.
(b) LandCorpacknowledgesthatsomeofthedetail
includedintheStage3Submissionsmayinclude
innovativeideasthattherelevantParticipantdoes
notwantadvertisedorexhibited.TheStage3
Participantsacknowledgeandagree:
(i) LandCorpmayexhibit,advertise,promoteand
includetheWinningConceptDesignandthe
Winner’ssubmissionstothecompetitionon
LandCorp’swebsitewithoutlimitation;and
(ii) alloftheRunnersUpsubmissionstothe
Competitionmaybeexhibited,advertised,
promotedorincludedonLandCorp’swebsite
exceptforanyinformationidentifiedbythe
RunnerUpintheirStage3submissionas
beingconfidential(suchinformationmustbe
includedonseparatepagestotheremainderof
theirStage3submissionandmustbeclearly
markedasconfidential).Globalclaimsof
confidentialityoverentireStage3submissions
willbedisregarded.Thelimitedconfidentiality
providedinthisclauseonlyappliestoStage
3submissionsandtheStage1andStage2
submissionsofRunnersUpmaybeusedby
LandCorpasidentifiedinclause13(a)(ii).
(c) InformationidentifiedbyRunnersUpas
confidentialinformationintheirStage3
submissionswillbekeptconfidential,however,
LandCorpreservestherighttodetermineifaclaim
ofconfidentialityisjustified.
14. Costs
EntryintotheCompetitionandallothercostsassociated
withtheCompetitionwillbethesoleresponsibilityofthe
ParticipantsandLandCorpacceptsnoresponsibilityfor
anycostsorexpensesincurredbyParticipantsorany
otherparties.
15. Licence To Use Winning Concept Design In Other Locations
(a) TheWinnergrantsLandCorpanon-exclusive,
transferable,royaltyfreeirrevocablelicence
unlimitedintimeofallWinningIPandIPforthe
WinningConceptDesigntoenableLandCorpto
usetheWinningConceptDesigninupto5other
locations.TheWinneracknowledgesthatLandCorp
currentlyintendstoreplicatetheWinningConcept
Designinatleast2otherlocations(however,
LandCorpmaychoose,initsabsolutediscretion,
nottoreplicatethedesigninanylocations).
(b) Alimitedfee(basedoncurrentreasonablehourly
rates)agreedbyLandCorpwillbepaidtothe
Winnerforarchitecturalservicestoamendthe
Clickheretoreturntocontentspage.
WinningConceptDesigntosuitdifferentlocations
andorsitesforanyfutureLandCorpdevelopments
(includingdevelopmentswhereLandCorpisin
partnershipwithanotherparty).
(c) TheWinneragreesthatLandCorpmaydisclosethe
identityoftheWinneranddetailsoftheirdesigns
forpublicity,marketing,exhibitionsandanyother
promotionalpurpose.
16. Advertising And Exhibition
(a) Subjecttoclause13(b)(ii),allParticipantsgrantto
LandCorpanirrevocablelicenceinperpetuityto
useanddisplayalloranyinformation,ideasand
designssubmittedbytheParticipantincluding
(withoutlimitation)therighttodisplayallorany
information,ideasanddesignssubmittedbya
ParticipantonLandCorp’swebsiteandother
websitesrelatingtotheCompetition,LandCorp’s
Shorelinedevelopmentandinanyexhibitionsand
tousealloranyinformation,ideasanddesignsin
anyLandCorppromotionalmaterials.
(b) AllStage2Participants,Stage3Participants
andtheWinneragreethatLandCorpmayuse
theidentityofthoseParticipantsandtheWinner
(includingdetailsoftheirdesigns)forpublicity,
marketingandanyotherpurposes.
(c) TheWinnermayusetheWinningConcept
Designinotherlocations,providingtheworkis
acknowledgedasadesignthatwasdeveloped
throughaLandCorpcompetition.
(d) TheWinnermustobtainLandCorp’spriorwritten
approval(nottobeunreasonablywithheldor
delayed)foralladvertising,marketingand
promotionoftheWinningConceptDesign
otherthanthroughthewebsiteofthewinning
Participant’sfirmorcompany.
(e) AllParticipantsmustpromptlyinformLandCorp
if,asaresultoftheCompetition,aParticipant’s
designorideasubmittedaspartoftheCompetition
isused(inwholeorinpart)inanyproposed
developmentoriftheParticipantreceivesany
commercialbenefitfromanydesignoridea
submittedaspartoftheCompetition.
(f) TheWinneristobeavailableforpublicity
opportunitiesasreasonablyrequiredbyLandCorp
foraperiodof18-24monthsfollowingthe
announcementoftheWinner.
17. Privacy
(a) ThepartiesagreetocomplywiththeInformation
PrivacyPrinciplessetoutinsection14ofthe
PrivacyAct1988inrespectofpersonalinformation
received,createdorheldbypartiesinconnection
withthecompetition.
(b) LandCorpreservestherightto:
(i) disclosetheidentityoftheParticipants;and
(ii) subjecttoclause13(b)(ii),reproduceanyorall
oftheentries,inwholeorinpart,forarchival,
exhibitionorpublicitypurposes.
(c) AnyuseofaParticipant’sinformationwillbe
subjecttoLandCorp’sprivacypolicywhichcanbe
viewedonLandCorp’swebsitewww.landcorp.com.
auandtheInformationPrivacyPrinciples.
18. Disclaimer
(a) Participantsmustrelyontheirowninvestigations
andsatisfythemselvesinrelationtoallaspectsof
theirsubmissionsintheCompetition.
(b) LandCorpanditsemployees,officers,consultants
andadvisersgivenowarrantyastotheaccuracyof
informationprovided.
(c) Tothemaximumextentpermittedbylaw,all
Participants,partnersandrelatedfirmsindemnify
andreleaseLandCorpanditsemployees,officers,
consultantsandadvisorsagainstallliability,cost,

(a) Anypaymentsorbenefitsmadeorgivenby
LandCorppursuanttotheseTermsandConditions

anypaymentorbenefitgiventotheParticipantin
connectionwiththeCompetition:
(i) theParticipantisresponsibletoremittothe
AustralianTaxationOfficeanyGSTpayablein
connectionwithsuchpaymentorbenefit;and
(i) LandCorpwillprovideaTaxInvoicetothe
ParticipantifrequestedbytheParticipant.
21. Definitions
Affordability Bracketmeansthesalepriceofunitsinthe
Developmentwithinthefollowingpricepoints:
(a) between$300,000and$350,000for1bedroom
units;and
(b) between$300,000and$430,000forunitswith
morethan1bedroom.
Affordable Housing Unitsmeansthoseunitsinthe
DevelopmentwhichtheWinneridentifiedinitsStage3
SubmissionasbeingwithintheAffordabilityBracket.
Competitionmeansthe“StepUp”AffordableHousing
DesignCompetitionasoutlinedintheseTermsand
ConditionsandtheCompetitionBrief.
Competition Briefmeansthe“StepUp”Affordable
HousingDesignCompetitionBrief(asmaybeamended
byaVariationfromtimetotime).
Contractmeansthecontracttobeenteredintobetween
LandCorpandtheWinnerfortheWinnertopurchaseLot

includesagreementbythefirstmortgageethat
thefundsadvancedbythefirstmortgagemust
onlybeadvancedprogressivelytofundthe
Development(sothattheamountowedtothe
firstmortgageefromtimetottimewillbeasum
equaltotheactualcostofconstructionofthe
Developmentplusinterest);
(h) thecontractwillgrantLandCorptheoptionto
repurchaseLot217fromtheWinneriftheWinner
breachesthecontract;
(i) theWinnermustobtainLandCorp'spriorwritten
approvalof:
(i) anymarketingmaterialsinrelationtothe
Development;
(ii) thesalepricesoftheAffordableHousingUnits
intheDevelopment(toensuretheAffordable
HousingUnitsareaffordable(inlinewiththe
objectivesoftheCompetition)andaresold
withintheAffordabilityBracketatthesale
