MINUTES OF THE 53" MEETING OF THE CENTRAL SANCTIONING AND MONITORING COMMITTEE (CSMC) OF THE SUB-MISSION ON BASIC SERVICES TO THE URBAN POOR (BSUP) UNDER JAWAHARLAL NEHRU NATIONAL URBAN RENEWAL MISSION (ThINURIvI)

The 530 meeting of the Central Sanctioning and Monitoring Committee (CSMC) of the Sub-Mission on Basic Services to the Urban Poor (BSUP) under Jawaharlal Nehru National Urban Renewal Mission ONNURM) was held under the Chairpasonship of Secretary, Ministry of Housing and Urban Poverty Alleviation in New Delhi on 3d February, 2009. The list of participants is at Annexure — I.

2.1. Welcoming the Chairperson and the Members of CSMC, Joint Secretary & Mission Director (JNNURM) informed that as the financial year is corning to a dose, the States/UTs should come up with necessary project proposals, seeking ACA out of (i) the balance of the 7-year Mission period allocation and (ii) the new fiscal stimulus package - latest by 15th of February 2009. The deadline is fixed because of the reason that after the sanction by the CSMC/CSC, the Mission Directorate in the Ministry of Housing & Urban Poverty Alleviation would require some time for issue of minutes and processing of proposals for release of funds by Finance Ministry, which in turn woald take time to release ACA. JS (JNNURM) requested the States/UTs to come up with adequate number proposals for the release of 2nd/3d/4th installments for old projects and 1. installment in the case of new projects under BSUP and IHSDP by the stipulated date. They should also demonstrate that the projects already sanctioned are in good progress.

2.2. Reminding the officers present that Mid-term target of 5 latch houses for the urban poor has been committed by the Ministry before Hon'ble Prime Minister, JS (JNNURM) requested the State Secretaries/Chief Executive Officers of State Level Nodal Agencies to establish PMU/PlUs expeditiously, institute 'PIMA, gear up the JNNURM implementation process by fixing clear milestones for progress, undertake regular monitoring, submit tits in time, develop supporting frameworks at State and city levels and undertake capacity building programmes. He emphasized the need for building adequate expertise in SLNAs/PMU5/P11Js in areas such as town planning, engineering, community mobilization, social development and MIS. The States/UTs

may specially avail the services of town planning and engineering experts to ensure that DPRs follow the appropriate town planning norms and State/UT PWD Rules. JS ONNURNO recalled the instructions of Secretary (HUPA) & Chairperson, CSMC that the States/Urs would have flexibility to engage professional technical /town planning experts in their PMU/PIUs using the ACA funds released by Go!.

2.3. JS & Mission Director (JNNURM) informed that the completion of housing projects for the poor is getting delayed in most cases due to several reasons. These include: delays in release of Central and State Share by State Finance Departments to Nodal Agencies (SLNAs) and from the latter to Urban Local Bodies/Executing Agencies, release of ULB share to project accounts, verification / identification of beneficiaries, issues of biometric identity cards, making the beneficiaries pay for their contribution, floating of tenders, need for re-tendering due to contractors not coming forward, land disputes, court litigation, problems in arranging temporary relocation of beneficiaries in the case of in situ projects, escalation in project costs due to rise in prices of building materials like cement and steel, etc. JS (JNNURM) informed that the States/UTs/SLNAs/ULBs should take urgent action to ensure that bottlenecks are removed so as to ensure that the projects sanctioned are completed in time and the Mid-term and Mission targets are achieved.

2.4. Joint Secretary (JNNURM) reminded the SLNAs and appraising agencies that the estimates included in the DPRs must conform to the latest Schedule of Rates brought out by the State Governments concerned. Further, the bills of quantities would need to be certified to be correct by the competent authority. The State Level Nodal Agency must ensure that the competent State engineering authority specified in the PWD Code / State Government Order has certified/accorded necessary technical approval to the estimates included in the DPRs before the same are placed before the State Level Steering Committee (SLSC) / State Level Coordination Committee (SLCC), as the case may be, for approval. The details of SLSC / SLCC approval and check lists along with appraisal reports must be placed by the Appraising Agency before the CSMC/CSC for consideration. JS & Mission Director (JNNURM) reiterated the important points emphasized by the Chairperson in the earlier meetings of CSMC / CSC for adherence/implementation by the States/UTs/ULBs (Annexure-II).

3.1. Secretary (HUPA) & Chairperson stated that the appraising agencies must take care to ensure that the DPRs satisfy JNNURM guidelines, instructions issued by CSMC/CSC from time to time, State PWD Code

and relevant State Government Orders. She emphacized that the appraising agencies would be responsible to ensure that land proposed for housing is free of encumbrance, DPRs/estimates (rates and bills of quantities) are certified by the competent authority, eligible beneficiaries are identified, action is taken for biometric identification, whole slum approach is adopted, a definite plan of action is worked out to put the place vacated by slum-dwellers to productive use in the case of relocation projects, town planning norms as applicable under State laws are followed, State/ULB shares are available, beneficiaries have agreed to pay for their contribution and the Guidelines of JNNURM, toolkits and instructions issues by the CSMC/CSC are adhered to.

3.2. Secretary (HUPA) & Chairperson, CSMC informed that both SLNAs and Appraising Agencies should devote special attention to the following aspects:

• Land availability for housing the poor — verification of ownership • Land tenure status — patta, temporary patta, occupancy right etc.

• Availability of State share, ULI3 share, Beneficiary contribution as per Guidelines of BSUP/IFISDP. • Willingness of beneficiaries to pay for their contribution.

• Housing design — two rooms, kitchen, balcony, individual toilet, individual water connection - refer to the Design Manual circulated by the Ministry.

• Adherence to town planning norms — Layout plans/designs to conform to town planning regulations applicable and be duly signed by competent municipal authority/SLNA officer.

• Provision of adequate open space in layouts — for green belts, parks, playgrounds, avenue plantations, etc.

• Authentication by competent engineering authority as per State Government PWD Code/Order duly signed by engineers and SLNA Chief Executive Officer.

• Identification of eligible beneficiaries - process for issue of biometric identity cards must be started/completed within one month • Rapid/detailed socio-economic survey of beneficiaries

- idemification of needs of community infrastructure • Provision of required civic infrastructure including social

infrastructure such as community hall, livelihood centre, information sector market, etc. Estimation of requirements must be based on judicious norms.

• Connectivity of slum infrastructure facilities with city-wide trunk infrastructure networks — water supply, sewerage, strom drainage, roads etc. — ensuring connectivity of local infrastructure being taken up under BSUP/IHSDP with facilities being created under OIG/ UIDSSMT.

• Availability/provision of basic facilities like post offices, bus stops, transport services, local shopping complexes, electricity transformers, sub-stations, water supply overhead tanks/ground level service reservoirs etc.

• SLSC/SLCC approval, project-wise (not in a block) with all details clearly indicating estimates, plans, availability of State share and agreement to meet cost escalation.

3.3. Secretary (HUM) stressed the need for the preparation and implementation of well-formulated slum development plans following the basic town planning norms. These plans should ensure the provision of water and sewer infrastructure, storm drainage, roads, community facilities, open spaces etc. as per norms applicable to EWS housing. In the absence of proper planning, the slums would remain as slums and the purpose of JNNURM would be defeated. Secretary (HUPA) emphasized the need for a 'whole slum' approach. Under this, pucca houses of the urban poor not having toilet facilities must also be provided with the same. She suggested that every beneficiary household under BSUP and EFISDP must be given individual water connection, individual toilet - connected to city water and sewer systems respectively and individual electricity connection. Secretary (HUPA) expressed that urban renewal cannot be achieved without meeting the requirements of basic sanitation for the urban poor.

3.4. Secretary (-1UPA) & Chairperson, CSMC said that the infrastructure networks being developed under BSUP and IHSDP should invariably be integrated or planned to be integrated with trunk-line city infrastructure facilities, either already existing or being developed under UIG / UIDSSMT or State Govemrnent/ULB programmes in accordance with CDPs. She suggested that the States/ULBs should ensure proper coordination amongst various agencies engaged in the implementation of JNNURM ((JIG, UIDSSMT, BSUP and IHSDP) and other schemes to make sure that slums and low-income communities are linked to city-wide infrastructure systems. The project appraisal teams for LUG, UIDSSMT, BSUP and IHSDP must ensure such type of linkages.

New Projects Uttar Pradesh 5.1. The representative of the State of Uttar Pradesh made a presentation on 25 projects (including 13 projects — 4 from Meerut, 3 from Lucknow, 1 each from Varanasi and Allahabad, 2 each from Kanpur and Mathura — that were deferred in the 50th meeting of the CSMC held on 21.1.2009). The Secretary in charge of BSUP and IHSDP in the State remarked that all the project proposals including technical estimates are duly signed by the competent engineering authotity and then thoroughly scrutinized by the State Level Evaluation Committees before they are brought for consideration of CSINIC. He informed the Committee regarding the progress of reforms and decision of State Government to grant patta to encroachers of government land.

5.2. The Committee observed the following: • The State is coming up with projects with lesser housing to

infrastructure ratio which would make it difficult to meet Mission targets in respect of dwelling units. The ratio should be corrected somewhat in the future projects.

• Project-wise SLCC approval is required in the case of all these projects.

• Whole slum approach must be adopted and the concerned slums should be de-notified after the projects are executed.

• Linkages of slum infrastructure systems to city-wide trunk infrastructure lines must be ensured.

• Biomettic identification of beneficiaries must be completed within 1 month.

• State must appoint TPIM Agency without any further loss of time.

5.3. The State Secretary in charge of BSUP and IHSDP informed that the Government of Uttar Pradesh has developed an elaborate, hill-proof system for the effective appraisal and sanction of projects and quality assurance in execution. He said that all projects costing above Rs,5.00 crores go to the Expenditure Finance Committee for proper appraisal and sanction. Further, the District Magistrates have been made responsible for signing and release of funds for projects based on review of progress and inspection of quality.

5.4. Secretary (HUPA) observed that the State may closely involve the ULBs in JNNURM and eventually empower them to undertake programmes for basic services to the urban poor. Further a State level mechanism needs to be established to ensure the coordination of LUG, BSUP, UIDSSMT and IHSDP - coordinated by one of the State Secretaries and to enforce the effective implementation of the 23 reforms contemplated under JNNURM which require coordinated actions by many Departments including Revenue Department.

5.5. Secretary (HUPA) desired to know whether the estimates in the DPRs have been authenticated as required by CSMC earlier. Slui Si( Tripathi, Executive Director (Corporate Planning), HUDCO, New Delhi informed that three independent engineers have verified the estimates in the DPRs when he and OSD (JNNURM) visited Lucknow for handholding workshop and found the same to be correct.

5.6. The Appraisal Agency has informed that with regard to project-wise SLSC approval, the Secretary to Govt. of Uttar Pradesh has indicated that

the SLSC has approved city-wise total budget and dwelling units covered. These proposals are well within the total budget city-wise as approved by SLSC. The financial statements induding project component-wise costing duly signed have been furnished by the state. Taking into consideration the comments of the appraisal agency (HUDCO), presentation made by State Government, report submitted by °SD (JNNURM), who visited Lucknow along with officials of BMTPC & HUDCO and held training-cum-handhokling-cum-pre-appraisal workshop involving State/ULB level officers, BMTPC and HUDCO, and the information furnished by the representative of the State, the Committee approved the 25 projects, namely:-

Meerut City 7 projects Lucknow 6 projects Agra 2 projects Kanpur 2 project Allhabad 2 projects Mathura 2 projects Varanasi 4 projects

Abstracts of the approved components are at Statement-I to XXV of Anne.xure-IV. Release of 1st instalment will be made after receipt of SLCC approval.

Tamil Nadu 6.1. The representative of the State of Tamil Nadu made a presentation on 4 projects in Chennai. The Committee observed:

• The State must furnish detailed layout plans, to the scale, for the projects within a month.

• The State must attempt to provide individual toilets to each household not covered under housing component.

• Linkages of physical facilities in slums to citywide infrastructure must be ensured.

• Biometric identification of beneficiaries to be completed in 1-2 months.

• The State must appoint TPIM Agency without any loss of time_ • The State must take steps to implement the reform in respect of

reservation of 20-25% of developed land for EWS/LIG category by the end of March 2010.

• The State may take steps to ensure that beneficiaries do not have to pay for their entire contribution upfront. This will ease the burden on beneficiaries.

The Committee also discouraged Community toilets proposed in the Pammal proposal and hence cost of Community toilets is to be borne by the State.

6.2. The Appraisal Agency informed that financial statements including component-wise costing duly signed have been furnished by the State. Taking into consideration the comments of the appraisal agency, presentation made and the information furnished by the representative of the State, the Committee approved the 4 projects at: Pamtnal, Anakaputhur, Poonamallee and Thiruverkadu in Chennai (Urban Agglomeration Area). Abstracts of the approved components are at Statement-X3CVI to XIX of Annexure-IV. Release of ACA will be subject to availability of ACA funds.

Maharashtra 7.1. The representative of the State of Maharashtra made a presentation on one project in Greater Mumbai (Ulhas Nagar). 'Me Committed observed the following:

• The State must furnish the list of beneficiaries; • The State must ensure the availability of bask amenities such as

water and sanitation, health care centres, schools, anganwadis, parks, playgrounds etc in all colonies being developed under BSUP and IHSDP and that the internal infrastructure networks in slums are connected to the external city-wide infrastructure systems;

• A comprehensive state level framework should be developed for the provision of land for housing the urban poor;

• Biometric identification of beneficiaries should be completed in 1-2 months; and

• Encumbrance-free land availability should be ensured in the case of all projects.

7.2. The Appraisal Agency has informed that the State Government has indicated that beneficiaries have been identified and their detailed list will be submitted shortly. Further, one of the sites is owned by the State Government and the nodal agency MHADA has indicated that the transfer of Land in the name of ULB would be done and the list of beneficiaries would be furnished shortly. Taking into consideration the comments of the appraisal agency, presentation made and the information furnished by the representative of the State, the Committee approved the project at Ulhasnagar, Mumbai metropolitan region. Abstracts of the approved components are at Statement XXX of Annexure-IV.

Meghalaya 8.1. BSUP project from Shillong, Meghalaya was discussed in 42', 45' h and 46`11 CSMC meetings and was approved in principle in the 46 11' CSMC meeting. The Committee had observed in the earlier meetings that

• As the land is owned by private persons there is no guarantee that the dwellers would not be evicted later and that the infrastructure facilities proposed to be created would be used for the benefit of the private land owners. Efforts should be to provide tenure with pucca houses along with basic amenities to the slum dwellers.

• Detailed socio-economic survey must be conducted & biometric identification of the beneficiaries should be completed.

• The State should ensure that the beneficiaries selected come under the eligible category as per JININI.JRM guidelines.

• The State must explore the possibility of setting up digester facility. • Rates quoted should be authenticated by the competent authority of the

State. • Valuation report of land (to be acquired for the project) to be submitted. • How the State is going to freeze siluin population on a private land

should be mentioned. • Extending service to private lands should follow norms taking into

account future growth. • State/appraisal agency should re-look at financial proposals w.r.t.

physical components/ assets proposed. • Proposed community toilets need to be reconsidered. Community

infrastructure should not be far aWay from the housing units to be constructed.

• State/ ULB should ensure no overlapping of components with other schemes such as ILCS/UIG.

8.2. The Appraisal Agency has informed that • Agreement between the traditional institutions known as Dorbar Shnong

(under Khasi Hills Autonomous District Council with authority vested under C" Schedule of the Constitution of India) and MUDA, State Level Nodal Agency & Land Owners regarding granting Security of Tenure to the Beneficiaries for availing of all the benefits envisaged under the Project on a self-sustaining and long-term basis, has been Signed and furnished by the State. Undertaking. to this affect is also furnished by Dorbars. The DPR has also been revised.

• It has been indicated that biometric Skyey of the beneficiaries based on soar) economic survey / BPL survey conducted by Government of Meghalaya during 1' September, 2007 to 2P' Oct, 2008, duly appended in DP12, shall be completed within 15' 11 February, 2008.

• The State has indicated that beneficiaries have been selected from EWS/ BPL families based exclusively on 1319. survey conducted by Govt of Meghalaya during 2008.

• It has been indicated that the climatic conditions and hilly terrain are not very conducive for digester. Piped sewerage with SIP, where feasible and provision for toilets within individual house has been included as advised by CSMC adhering to guidelines of ILCS.

• Rates & drawings are authenticated and signed by Chief Engineer, MUDA, the SLNA.

• Valuation of land has been considered as per DC, East Khasi Hills District's minimum prescribed rates applicable to the 5 slum localities. Letter of DC is appended with revised DPR.

• The state has indicated that a number of measures individually or in combination will be undertaken for proper implementation of project. Important among those are enforcement of development control mechanism, building bye laws & revision of GSPA Master Plan, which expires on 2011. Impkmentation of zoning regulation of Shillong UA will commence shortly. In addition, social initiatives of Dorbar to improve living conditions within slums in their respective Shnongs have had remarkable impact.

• As regards the suggestion that extending service to private land should follow norms taking into account future growth, it is indicated that the zoning regulation for Shillong LJA followed by GSPA is to be implemented shortly. Moreover, understanding between Dorbar Shnong (under Khasi Hills Autonomous District Council - with authority vested under 6th Schedule of the Constitution of India) & MUDA — State Level Nodal Agency & Land Owners will provide proper safeguards.

The Appraisal Agency further informed that conditions regarding retook at the financial proposals and community toilets have been complied with and the condition to ensure that there is no overlapping with ILCS has been complied too.

8.3. After caking into account the comments of Appraisal Agency (BNIT 4PC) and information furnished by the State Government, the Committee approved the project of 'Integrated Slum Development Programme in 5 notified slums i.e. Mawah, Lower Mawprent, Demseiniong, Kynjat phutbol & Pyrithorumkhrah in Stilton& Meghalaya Abstracts of the approved project are at Statement-XXXI of Annexure-IV.

4th Instalment: Surat, Gujarat 9.1. Two projects — DPR-I and DPR-HI were presented for the claim of 4th and final instalment by the representative of SLNA. The Deputy Secretary form the State informed that financial utilization is as per requirement_ SLNA has also commented that quality of projects is satisfactory as per the TPIM report furnished along with the utilization certificates. It was also pointed out that the layout plans for 247 units

which could not be started earlier have been submitted to the Appraisal Agency (3mtpc) and work is going to start soon. The Committee had earlier accepted the minor changes in the layout.

9.2. The Committee approved the 4th instalment proposal for two projects in Surat, Gujarat. The projects are titled (i) "Construction of Housing for Urban Poor at 20 various locations within city (DPR-I)" and (ii) "Construction of Housing Units for Urban Poor at Kosad, H-1 (DPR-III)". Abstracts of the approved instalments are at Annexure- V.

10. OS!) (JNNURM) briefed the Committee about the proposal seeking setting up of one PM!) at State level, seven PIUs (in Allahabad, Agra, Lucknow, Meerut, Kanpur, Varanasi and Mathura) and five PIUs, coveting all the IHSDP towns in the State of Uttar Pradesh. He informed the Committee that the proposals are as per the guidelines on formation of PMU and PIUs. Accordingly, the Committee approved the proposals. Details of the approval are at Annexure-VI (a), (b), (c) and (d).

11.1. In her concluding remarks, Secretary (HUM) & Chairperson, CSMC, stressed the need for States/UTs to take all steps to avoid time and cost over-runs and achieve the Mid-term and Mission targets. She also emphasized the need for convergence of BSUP and IHSDP with other schemes such as (JIG, UIDSSMT, Sarva Sikhsa A bbiyan, National Social Assistance Programme, Ann Aadmi Bima Yojana, Rashtriya Swasthya Sims Yojana, SJSKY etc. She expressed the view that slither and basic amenities to the urban poor may not suffice them to move above the poverty line. She suggested that the State Governments/ULBs should make effort to dovetail the implementation of SJSRY with JNNURM. This step would provide the urban poor with access to improved livelihoods and enable them to overcome poverty. Secretary (HUPA) stated that programmes for skill development, self-employment, and community development are necessary to facilitate sustained improvements in the living conditions of the urban poor and develop inclusive cities.

11.2. Secretary (HUPA) emphasized the need for focusing on urban policy and management reforms to address not only the backlog and current urban issues but also the challenges of future urban growth, say in the next 20-25 years so that the conditions that led to urban decay are prevented well in dine. She stated that we should not be in a situation where we are perpetually chasing slum upgradation; we should plan proactively in anticipation of the future patterns of urban growth due to

the factors of rural-urban migration, urban-urban migration, reclassification and natural increase. She cautioned that without the implementation of urban planning and local government reforms and capacity building for effective urban management, JNNUR.M would remain a mere infrastructure upgradation programme, and none of the policy changes for vibrant, productive, sustainable and inclusive cities that JNNURM hopes to drive would materialize.

ANNEXURE-II

IMPORTANT POINTS REGARDING FORMULATION AND EXECUTION OF BSUP AND IHSDP PROJECTS

• In case there is time constraint, a regular socio-economic survey can be preceded by

a sapid survey fir ides:lifting beneficiaties, their main and subsidiag occupations, their edlecational and skill profik and felt-needs so as to design appropriate social isy5-astmetare for each fled Willingness of the beneficiaries should also be taken for any rehabilitation/relocation projects.

•Affordability of the urban poor should be kept foremost in view while working out Beneficiary Contribution. Any contribution amount beyond their financial capacity may lead to the imposition of undue burden on them. Therefore, special care needs to be taken while deciding upfront beneficiary contribution or EMI payment. Overall construction cost of the housing unit should be kept at a minimum. The housing component should generally be at least 50% of the total project cost with a view to giving primacy to provision of shelter to the urban poor except where housing units have already been constructed/are being constructed under VAMBAY or other EWS scheme of Central or State Governments. Further, considering the difficulties and special needs of the urban poor at some locations, clusters having more than 15 housing units can also be considered.

•Each project should be accompanied by a list of beneficiaries based on socio-economic survey and ULBs should go for bio-metric cards and ensure that houses are allotted to properly targeted beneficiaries and the possibility of sale/misuse of housing units is avoided. The list should be notified and placed in the website of the ULB/JNNURM.

•The layout plan must be socially cohesive and should facilitate social interaction. Efforts may be made for providing at least 30% open spaces with 15% green area in the layouts and adequate social and livelihoods infrastructure.

•Adequate space must be provided for community activities, informal sector markets, livelihood activities, pen for animals (if permitted and required), space to take care of convergent services such as health, education and recreation conforming to the specific needs of each of the slum pockets and their beneficiaries.

• The houses proposed should have two rooms, balcony, kitchen and separate bathroom and latrine, individual water connection and

sewer connection. Aspects such as storage space for keeping things in rooms/kitchen, location of kitchen, location of toilet and bathroom in the houses to facilitate privacy, independent access from both rooms to toilet and bathroom, leaving a small space for fitting exhaust fan in kitchen and toilet, balcony for drying clothes eta, are some of the nuances that can be thoughtfully incorporated in the design of the houses for the poor.

•The State authorities/W.25 may adopt some of the innovative designs and layouts of houses, multi-purpose community centres, informal sector tnarkets and animal pens, etc. prepared and compiled by HUDCO and BMTPC. The TooIlcit published in this regard may be referred to.

•The State authorities, in consultation with appraisal agencies, should ensure that necessary clearances such as environmental clearance, Coastal Regulation Zone (CRZ) regulation clearance, land use clearance, etc. are obtained. They should also ensure that necessary technical approvals are secured from the competent agencies as per State PWD Code.

•Since these projects are required to be generally completed in 12 to 15 months, it is generally expected that any escalation in the project cost is borne by the State Government/ULB concerned. For reducing escalation in the cost projects, the following option could be exercised:- I)

Purchasing materials (cement, steel, sanitary pipes, electrical items) in bulk, wherever considered prudent and feasible with a view to reducing cos

Encouraging labour contribution from the beneficiaries under the supervision of qualified personnel;

iii) Bifurcating tendering (between housing component and infrastructure component) with a view to reducing the possibility of time and cost overruns; and

iv) Creating/using a revolving "Basic Services for Urban Poor (BSUP) Fund" earmarked out of the municipal budget and supplemented by other innovative measures like cross subsidization for meeting cost escalation.

Wherever informal sector markets are taken up as a Ran of social infrastructure, their operation on a time-sharing basis by inhabitants for enabling wider coverage of beneficiaries can be considered by the ULB concerned.

Adequate provision should be made for solid and liquid waste disposal and digester technology could be adopted in place of dual-pits/septic tanks, wherever feasible.

• Road-side plantations with tree guards and green belts are advisable. • Responsibility of the technical specifications (adherence to State

PWD Code) and their approval by the competent authority lies with the ULBs/Statc Level Nodal Agency. The appraisal agencies must ensure that technical specifications are duly approved by the technically competent authority as per Stare Government Public Works code.

• Prime Minister's New 15-Point Programme for the Welfare of the Minorities: An important objective of the new programme is to ensure that the benefits of various government schemes for the unde,privilged reach the disadvantaged sections of the minoriy commtmities. In this regard, care should be taken to take up clusters of minority beneficiaries to the extent possible.. Wherever feasible, efforts should be made to allocate upto 15% of targets and outlays under BSUP and IHSDP for the minorities. Similarly, priority should be given to accommodate physically challenged beneficiaries.

• Capacity Building Activities: In the year 2006-07, the Ministry of HUPA had released fund to the State Governments for capacity building activities including Research and Training towards implementation of BSUP and IHSDP projects. Unless the States submit utilisation certificates for the funds released earlier, further release of Central Assistance would be held up, as utilisation certificates have to be furnished within 12 months from the date of closure of the financial year to which financial sanction pertains.

• Status of Project Implementation: The States/ULBs should present Quarterly Progress Reports/Monthly Progress Reports as per prescribed format, without fail to enable the Ministry to report to Prime Minister's Office in time. Further, one page abstract on the status of implementation of projects and reforms must be presented before presenting the details of project proposals in the meetings of Central Sanctioning & Monitoring Committee/Central Sanctioning Committee.

• Setting up of PMU/PIA/PIU: The States/UTs should submit proposals to the ao OSD (JNNURM) which will get the same appraised and bring up before the Central Sanctioning & Monitoring Committee/Central Sanctioning Committee. Transparent method should be adopted in the selection and appointment of professionals in PMUs and PIUs. Such appointments should not be permanent in nature but only in terms of short-term engagements. The appointments should not be seen as a place for parking the dead-wood. Each appointment should be based on prescribed terms of reference and the deliverables should

be measured. Various activities, tasks and outcomes have to be dearly spelt out in the TORs. States/ULBs should exercise utmost caution in making such appointments on a contract basis. The States/ULBs should try and ensure minimum expenditure by selecting/appointing professionals at an appropriate fee rather than immediately opting for the maximum amount indicated by the Centre. However, the calibre of such professionals should be of a reasonably high level. If need be, qualified persons from Central/State Government/ULBs could be taken in PMU/PIA/PIU on deputation. The personnel with PMUs/PIUs should work in tandem/collaboration with the State Level Nodal Agency / ULBs.

• Fees for Preparation of DPRs: The States should submit proposals to the concerned Appraisal Agency which had appraised the projects. The Appraisal Agency has a crucial role in examining the claim with particular reference to the various stages of improvement and modifications that were brought out in the DPRs before they were finally approved by the Central Sanctioning and Monitoring Committee/Central Sanctioning Committee. The Appraisal Agency should submit proposals to the Ministry for releasing Central Assistance towards the cost of preparation of DARs (both in the case of DPIts prepared by in-house personnel as well as by consultants). These will be considered by the Central Sanctioning and Monitoring Committee. After approval, recommendation will be sent to the Ministry of Finance/Ministry of Home Affairs for releasing Central Assistance out of the ACA allocation for the particular State/UT in the case of projects prepared by consultants. The Central Assistance for DPIls prepared through in-house personnel of the States would be released from out of the I% JNNLTRM fund in the Budget of Ministry of HUPA as decided in the Central Sanctioning & Monitoring Committee /Central Sanctioning Committee meetings earlier.

• Community Development Network (CDN): The States / UTs should prioritise and get necessary approval from SLSC/SLCC to the proposals concerning Community Development Network (CDN) so as to seek Community Participation Fund. Such proposals received in the Ministry of BIWA will be appraised by a team working under the GOI-UNDP Project on National Strategy for Urban Poor coordinated by the National Project Coordinator/Deputy Secretary UNNURM). The reports will then be placed before the Central Sanctioning & Monitoring Committee.

Community Development Networks involving Neighbourhood Groups, Neighbourhood Committees and Community Development Societies should be promoted so that the dynamics of the CDN lead to fraternity in the neighbourhoods and the issues of alienation of all sorts are eliminated. CDN should work towards better inter- and intra- relationships in colonies to get over the dividing forces. This will strengthen a feeling of solidarity among the residents.

• Third Party Inspection and Monitoring (TPIM) mechanism: TPIM should be instituted to bring transparency and quality in the implementation of BSUP and IHSDP projects. The Ministry is giving necessary assistance to the States for TPIM. Toolkit has been prepared and communicated to the State Governments.

• Quality of Projects: Housing for the poor does not mean poor quality housing. Utmost emphasis must be given to the quality of houses for the poor. A vector-free atmosphere and healthy living environment should be ensured in the housing projects under BSLiP/IHSDP.

• Socio-economic Survey: No efforts should be spared for conducting socio-economic surveys of potential beneficiaries. This would facilitate assessing the needs of the beneficiaries, especially for schools, health centres and other social/community facilities. Based on the socio-economic survey, biometric identity cards should be issued to the beneficiaries to ensure that they do not sell the dwelling units and squat elsewhere. Such surveys should cover housing, health, educational and livelihood profiles of the urban poor. The surveys would assist in designing good BSUP/IHSDP projects by taking into account important aspects such as dependency load in the existing schools, capacity of hospitals for in-and out-patients, need for multi-purpose community centres including livelihood centre and informal sector markets. HUDCO and 8MTPC have detulofred good designs of houses, colonies and various,Iws of social infrastneture facilities which could be appropriatefr used while

fonneclating project Impost:a. A Toolkit has also been published.

• City Poverty Reduction Strategy Report. The city of Rajkot (Gujarat) has brought out a City Poverty Reduction Strategy Report. Other cities/towns may bring out similar reports.

• Convergence of Health, Education and Social Security: It is necessary to integrate provisions of Health, Education and Social Security with Housing for the Poor to enable them to lead a better quality of life. The Urban Local Bodies and Stare Governments

have a critical role to play to ensure proper convergence of facilities under the already available schemes for education, health and social security implemented through different departments/fields. The projects should list out the deficiencies in terms of access to school, primary health centre, provision of social welfare measures so that timely remedial measures in accordance with the socio-economic survey can be taken up. Provision of adequate infrastructure for school and health care should be taken at the formulation of the project itself. A mere statement that adequate number of schools/health centres is available in the vicinity of the proposed housing colony would not be sufficient. The State/ULB/ implementing agency should certify that such facilities available in the vicinity are also accessible to the slum dwellers. Similarly proper convergence of schemes in the realm of social security such as old age pension, health insurance, maternity benefit scheme, etc. should be accessed to benefit the urban poor selected underiNNURM.

• Educational facilities: Proposals for additional schools or additional rooms in existing schooLs must be part of the DPRs. The capacity of the existing schools to absorb the children from colonies being developed under BSUP and IHSDP needs to be studied. The estimate of school-going children (including those from the new colonies) and demand for classrooms in terms of prevailing norms, capacity in existing schools and the additional capacity required should be worked out Similar exercise should be done for providing health care Facilities. Further, action needs to be taken to provide other community infrastructure and facilities. Detailed estimates of requirements as per norms, availability and gaps to be addressed have to be prepared at the initial stage of project preparation itself.

• Projects for in-situ development: States should come up with projects for in-situ development with good lay-outs and type designs. The emphasis should be to provide a better and supportive atmosphere for living and working. The in-situ development should not end up with creation of another duster of houses without access to water, sanitation and social infrastructure.

• Sense of belongingness: create a sense of belongingness, the slums may be named in consultation with the intended beneficiaries. Provision of a low cost enclosure around open spaces in the slum pocket being covered under BSUP/IHSDP could be considered by States/ULBs, if the cost is not prohibitive.

• O&M System for Maintenance:- Maintenance of the assets and upkeep of cleanliness and hygiene in the housing complexes / colonies developed under BSUP and IHSDP should be given importance. State Governments/ULBs should evolve a viable mechanism for maintenance of the assets created under BSUP and IfiSDP projects, especially the houses and common facilities constructed.

• Three key reforms core to the urban poor Special attention should be paid for the implementation of the three key reforms stipulated under JNNURM that are critical to the urban poor (1) internal earmarking within local body budgets for basic services to the urban poor, (ii) provision of basic services including the implementation of 7-Point Charter in accordance with agreed timelines; (iii) earmarking at least 20-25% of developed land in all housing projects (both public and private agencies) for EWS/LIG category with a system of cross subsidization.

• EEC activity: In a people-centric programme like BSUP and IHSDP under JNNURM, there is a need to generate greater awareness among the targeted sections so that they received what is intended for them by the Government. Any awareness campaign should have a national appeal and recall value with consistent and coherent slogans and themes. The States/ULBs could bring out advertisements in vernacular languages with local adaptation of the templates prepared by the Ministry of ffUPA. States/ULBs should ensure that the local adaptation does not deviate from the letter and spirit of the national templates and the messages conveyed are only about the programme and related policy advocacy. They should also ensure that all such media campaign is in accordance with the relevant rules and regulations applicable. Cost of such campaign, in accordance with Government approved rates, would be reimbursed to the States/ULBs under IEC component of JNNURM subject to limits fixed by CSMC. Reimbursement will be made if prior approval of the Mission Directorate/CSMC/CSC in the Ministry of HUPA was obtained before launching such campaign. Proposals for teirnbursement of such expenditure will be submitted through HUDCO which will put up the same to the Central Sanctioning and Monitoring Committee for its consideration and approval of reimbursement through Department of Expenditure, Ministry of Finance or Ministry of Home Affairs, as the case may be.
