AccompaniedbysomemembersofourNationalExecutiveBoard, I ledAmCham’s
AnnualDoorKnockDelegationtoWashingtonDC.Wemetseveralkeypeopleinthe
U.S.administrationwhoareengagedwithIndiaoneconomicmattersandconveyed
apositivemessageofachangingandimprovingbusinessclimateinthecountry.The
easeofdoingbusinessinIndiaandeffortsofthepresentgovernmentinconverting
Indiaintoanattractivebusinessdestinationwerediscussedatlength.Weconveyed
our collective concerns on infrastructure bottlenecks and lack of logistics support
for companies but these were also seen as emerging business opportunities for
companies engaged in the infrastructure space. Concerns on the aggressive tax
environment andmultiplicity of regulatory bodies also came up. The fact that the
presentgovernmentinIndiaisactivelyengagedinstakeholderconsultationandkeen
on incorporating the advice and suggestions of stakeholders across sectors was
well received.Thegovernment ismoving fast tomake Indiaapreferred investment
destination.Thegenuineeffortsof thecentralgovernment isexpected to take time
toyield results.AmChamalsoprojectedsuccessstoriesofsomeof theprominent
member companies in a prepared note showcasing a positive and encouraging
businessclimate.
WiththeSmartCitypolicyofthecentralgovernmentinplacethebusinessactivityis
fastshiftingtothestategovernments.Weareintheprocessofreachingouttosomeof
theconcerneddepartmentsandagenciesinthestatesrelatedtourbandevelopment,
infrastructure and energy. All members engaged in Smart City business are
welcometoparticipateactivelyinouroutreacheffortsinChhattisgarh,WestBengal,
AndhraPradesh,Telangana,Maharashtraandotherstates. Inour interactionswith
the state government agencies, AmCham companies have offered solutions in
infrastructure,ICT,healthcare,energy,wastemanagement,environmentandrelated
SmartCitysectors.
ThereviseddraftoftheNationalCivilAviationPolicy(NCAP2015)hasbeenreleased
andIamgladtonotethatmostofAmCham’ssuggestionshavebeenincorporated

inthepolicy.Itisnowaquestionofimplementationandexecution.Theunionministry
suggested that we increase our outreach to some of the state governments where
regional connectivity hasdistinctpotential and request implementationof the central
policyonaviation.Regionalconnectivity,establishmentofMROsandcapacitybuilding
incivilaviationofferalargepotentialforsomeofourmembers.Inthedefencesector,
ourmembershavebeenmeetingtheconcernedofficialsperiodicallytogetourviews
across.TheconcernedcommitteeoftheDefenceMinistryhasgivenussufficienthearing
andconveyedsomeofoursuggestionsforinclusioningovernmentpolicyespeciallyon
offsets.
WehaveincreasedourengagementinsharingexperiencesandbestpracticesinHR,
CSRandothersegments.Consequently,theHRgrouporganizedcompetitionsonSMAC
proposalsandcameupwithexcellentpresentationsoutlininguniquesuggestionson
engagingthemillennialsineachorganization.Sitevisitsformemberstoexamineselect
CSRprojectsundertakenbymembercompaniesinandaroundDelhi/NCRhasbeena
newinitiativewhereparticipationbymembershavebeenveryencouraging.
The Hyderabad chapter organized a national healthcare conference for the third
consecutiveyear.Thiswasgreatsuccessandwemustregularlyorganisenationalevents
attheregionallevelseveryyear.TheWestBengalgovernmentreachedouttomembers
notjustinKolkatabutacrossNorthernandSouthernregionsbyhostingexclusiveevents
forourmembersinBangaloreonITandNewDelhionsmartcities.Thisisanewtrendin
stateoutreachwhichsomeofthestategovernmentswouldbenefitbyemulating.
DIPPhasaskedAmChamtolistoutthechallengesandissuesofindividualcompanies
whichneedtobeaddressedandresolved.AmChamhasbeensubmittingalistofissues
andpossiblesolutionsonaregularbasisandsomeofthemwereresolvedsatisfactorily.
Ourtaxandtariffcommitteehastakenextensiveinputsfrommembersandpresented
theirtaxproposalstothefinanceministry.Themedicaldevicessectorcontinuestoface
challengesby the regulatorsandhasbeenmeeting regularly toprepareandpresent
theirviewscollectively.
Ouractivitycalendarissenttoeachmemberindividuallyeveryweek.Thislistsoutthe
upcomingevents, past events andprogramsat a national level. Doparticipate and
encouragetherelevantpersonfromyourcompanytobepresentatsuchevents.
Irequestyoutosendusanoteonconcerns,challengesandproblemsthatarefaced
byyourcompanyindoingbusinessinIndia.WewillhighlighttheseissueswiththeDIPP,
MEAandconcernedministryatthestateandcentralgovernmentlevels.Ialsorequest

On 7th September 2015, AmCham members heldan interactive session with the visiting Governmentdelegation from West Bengal led by Dr. Amit Mitra,Minister-in-Charge of Finance, Excise, Commerce &Industries, Public Enterprise, Industrial Reconstruction,Commerce and Industry, Government of West Bengal,along with the Principal Secretary Urban DevelopmentMr. Debashish Sen, Principal Secretary S. Kishore,Department of Commerce & Industries, ResidentCommissionerMr.R.D.Meena,andDr.KrishnaGupta,Managing Director, WBIDC. The program focused onunderstanding theapproachandprogramsof theWestBengal Government towards developing Smart Citiesand related infrastructure projects. Dr. Mitra and hiscolleagues shared important updates in these areasespeciallyontheStateGovernment’splanfordevelopingsix theme-based cities alongwith the announced foursmart cities, as allocated to West Bengal under thecentrally announced Smart Cities program. A detaileddiscussion was held and participating U.S. companies
offering solutions and technologies under the variousverticals of Smart Cities, expressed a desire to have aconsultative program which focused purely on Smartcities,withtheUrbanDevelopmentDepartmentofWestBengal,undertheAmChamplatform.
Dr. Mitra also suggested that an IT & ITES focusedInvestorsmeet is tobescheduled inBangaloreshortly,whereU.S.companies’participation,throughAmCham,was welcome. The program details will be worked outin consultation with the West Bengal Government anda program agenda is to be worked out accordingly.Additionally, it was also proposed to have AmChammember companies participate as Summit Partnersunderacommonpavilion,intheupcomingWestBengalGlobal Business Summit (7-9 January 2016). Thediscussionoutcomesfromthismeetingwillbeactionedin the comingweeksanda followupon theproposedprogramsisunderway.

On 7th September 2015, AmCham and TelanganaGovernmentHealthDepartmentorganizedaKnowledge Workshop on Innovations in Medical Technologyin Hotel Taj Krishna, Hyderabad. The workshop wasorganizedkeepinginmindthefollowingobjectives:
• Creating awareness about the medical devicesindustry in India and showcasing the globaldevelopments/trendsintheMedicalDevicesIndustry
• Providingaplatformforinteractionamongstvariousstakeholdersi.e.physicians,policymakers,providersand industry to establish the right position for themedicaldevicesindustryasthepivotforhealthcareindustryinthecountry.
• Deliberating on the possible role that Stategovernmentandthe industrytogethercouldplaytomakeUniversalHealthCoverage(UHC)forthestateareality.
The Workshop was chaired by Shri. Suresh Chanda,Principal Secretary, Department of Health and FamilyWelfare,GovernmentofTelangana.Mr.MichaelMullins,ConsulGeneral,U.S.Embassy,Hyderabadalsoattendedtheworkshop.Other stakeholders includedDr.BuddhaPrakash M. Jyothi, Health Commissioner, Governmentof Telangana and Medical Superintendents, specialistdoctors from government hospitals of various districtsandAmChamMedicalDevicesCommitteemembers.
Welcoming the audience Mr. Prabal Chakraborty,Chairman-AmCham Medical Devices Committee andVP and Managing Director, Boston Scientific Indiacongratulated theHealthSecretaryandhisdepartmentfor conceptualizing this knowledge workshop andemphasized on the important role of medical devicesindustryinmanagingtheholistichealthcareforthestate
byaddressingthediseaseburden.
Commenting on the occasion, Shri Suresh Chanda,Principal Secretary, Department of Health & FamilyWelfare, Government of Telangana stressed on theearly diagnosis and hence effective treatment of non-communicable disease (NCD) by use of innovativemedical technologies. He was also of the opinion thatoptimalusageofinnovativemedicaltechnologieshasthepotential to reduce theoverall cost tohealthcare in thestateandthecountry.
Mr.MichaelMullins,ConsulGeneraloftheU.S.Consulate,HyderabadmentionedthatMedicaldevicesplayacrucialrole in diagnosing andmanaging diseases by allowingpeopletolivelonger,healthierandmoreproductivelivesandinhealthresearch,theUnitedStatesandIndiahaveestablished a strong record of cooperation. The U.S.NationalInstitutesofHealth(NIH)hasdevelopedarobustrelationshipwith India'smedical researchcommunity inthe biomedical and behavioral health sciences. Newand ongoing research partnerships focus on diabetesresearch, low-cost medical devices, and vaccinedevelopment.
Dr. Buddha Prakash M. Jyothi, Health Commissioner,Government of Telangana spoke about need for moreinformationsharingprogramsonnewtechnologieswhichempowersthegovernmenttotakeinformeddecisionsforthebenefitofcitizensofTelangana.
The workshop witnessed extensive participation frommore than 100 doctors from various district hospitals,HODs, hospital administrators, doctors from TelanganaVaidya Vidhan Parishad (TVVP), Department of PublicHealth & Family Welfare, National Health Mission anddoctorsfromotherdistrictsofTelangana.

Theygavean overview of and insights into recent transfer pricingdevelopmentsinIndiatoenabletheparticipantstogaina better understanding of the possible impact of thenew developments on their business. Post this, theparticipantswere introduced to theTalent Management Framework that is being developed as atalent management ready-reckoner for organizations,and were segregated into smaller break-out groups tobrainstorm on the challenges and come up with theirrecommendations formanaging talent of the future.Astheparticipants, had alreadybeen familiarizedwith theFramework through a pre-work mechanism, they werequick to leveragetheopportunity toshare,discussanddefinestrategiesforthetalentmanagementoftomorrow.
After animated discussions and exchange of best
practices within the break-out subgroups, each of thesub-groups presented their ideals to the larger groupfacilitatingfurtherdiscussionandaugmentation.
Theworkshop,whichranwellover3hoursachievedtwocriticaloutcomes:
a) ConsolidatingtheTalentManagementapproachandbestpracticesofasetofcompanies
b) Building the blue-print for talent managementpractices for the future in the form of a TalentManagementFramework,throughthecollectiveinputandexperienceofover20HRandtalentpractitioners.
The Talent Work stream plans to build further on theFramework by bringing together business leaders andmanagers of talent in a similar workshop, to test andreaffirm the recommendations of this workshop and isscheduledforNovember2015.

Soon after India’s PM launched the Make-in-Indiainitiative inSeptember2014,DynamaticTechnologiesand Boeing inaugurated a plant in Bengaluru tomanufacture critical parts for theChinookHeavy LiftHelicopters. In a state-of-the-art facility of the Tatacompany inNagpur,Boeingmanufacturesadvancedcomposite floor beams that form the “spine” of theworld’s most advanced aircraft, Boeing 787-9. InJuly this yearweannouncedapartnershipwith Tatato manufacture advanced aero-structures and aerialsystems including unmanned. We have significantlyupped our manufacturing activities in India, morethandoubling our sourcingover the last year. Now,overhalfabilliondollarinproductsandservicesfromIndia gets on our airplanes each year, and we areworking to increase that. To further leverage India’sdeep engineering capabilities Boeing also plans tosignificantlyexpanditsengineeringfootprintorganicallyinthenearterm.

H-1B Cap
The H-1B visa has an annual numerical limit "cap" of65,000visaseachfiscal year. Thefirst20,000petitionsfiled on behalf of beneficiaries with a U.S. master’sdegreeorhigherareexempt fromthecap.Additionally,H-1Bworkerswhoarepetitioned fororemployedatan
institution of higher education or its affiliated or relatednonprofitentitiesoranonprofitresearchorganization,ora government research organization are not subject tothisnumericalcap.
Family of H-1B Visa Holders
The spouse and unmarried children under 21 yearsof age may seek admission in the H-4 nonimmigrantclassification. Beginning May 26, 2015, certain H-4dependent spouses of H-1B non-immigrants can fileFormI-765,ApplicationforEmploymentAuthorization,aslongas theH-1Bnonimmigranthasalreadystarted theprocessofseekingemployment-basedlawfulpermanentresidentstatus.
L-1A Intra-company Transferee Executive or Manager
The L-1A nonimmigrant classification enables a U.S.employer to transferanexecutiveormanager fromoneof itsaffiliated foreignoffices tooneof itsoffices in theUnited States. The employer must file a Form I-129,PetitionforaNonimmigrantWorker,withfee,onbehalfoftheemployee.
General Qualifications of the Employer and Employee
To qualify for L-1 classification in this category, theemployermust:
• Haveaqualifyingrelationshipwithaforeigncompany(parent company, branch, subsidiary, or affiliate,collectively referred to as qualifying organizations);and
• Currentlybe,orwillbe,doingbusinessasanemployerintheUnitedStatesandinatleastoneothercountrydirectly or through a qualifying organization for thedurationofthebeneficiary’sstayintheUnitedStatesasanL-1.
Doing business means the regular, systematic, and continuous provision of goods and/or services by a qualifying organization and does not include the mere presence of an agent or office of the qualifying organization in the United States and abroad.
Executive capacity generally refers to the employee’s ability to make decisions of wide latitude without much oversight.

InAugust2010,USCIShasimplementedPublicLaw111-230whichrequiresH-1Bdependentemployerstopayanadditionalfeeof$2,000.Thisfeeisonlyapplicabletotheemployerswhohas50ormoreemployeesandhasmorethan50%ofh-1bvisaemployees.
This lawhasexpiredonSeptember 30, 2015.So, fromOctober1st2015, theH-1Bvisadependentswillnotbepayingtheadditional feeof$2,000.Removalof this feewill reduce a huge burden on companies that use thisvisacategory.
