SECTION S0 – GENERAL

S 0.1. Project necessity and study limits According to the conclusions of the „Solution study”, the fulfilment of conditions for connecting the wind power plants of a total capacity of 600 MW, to the NPS networks, situated all over the administrative territory of the communes Topolog – Casimcea – Dăieni, in Tulcea district, including the rise/reinforcement of the power transmission system safety, in the respective zone, can be assured by performing one new substation of 400/110 kV, incoming-outgoing circuit-connected from the 400 kV Isaccea – Medgidia Sud OHL (Dobrudja). The new 400/110 kV Rahman substation will consist of the 400 kV substation, owned by Transelectrica company and the 110 kV substation, including the transformer units 400/110 kV, owned by the End-user (Alpha Wind SRL, Beta Wind SRL, CAS Regenerabile SRL and Land Power SRL). Each substation will be independent, with its own technological systems, central control building and auxiliary systems / facilities. The limit point of the 400 kV substation, between Transelectrica estates and the End-user one, will be at the 400 kV terminals of the 400/110 kV transformer. The boundary of this project, afferent to the 400 kV substation, including the 400 kV OHL connection, for : - 400 kV substation, consists of: * terminal outgoing circuit towers to the 400 kV line (excluding the insulator strings on terminal towers: * supporting frames for the flexible connecting links to transformers (excluding the frames, in the zone of 400 kV transformers and surge arresters, afferent to their protection). - 400 kV OHL * existing OHL towers, from 236 and 240 terminals.

S 0.2. Location and access ways The 400/110 kV substation will be located in the zone of Topolog, in Tulcea district, on the left hand of the national road DN 22A Tulcea (Catoi village) – Hîrşova and the space including this, between the communes Topolog and Casimcea, approx. 15 Km far from Topolog commune, all over the area placed between DN 22A and the tower 238 of 400 kV Isaccea-Dobrudja OHL. The substation is situated within the plots of land 343 and 342 of the layout plan of the wind power farms, made available by the End-users and the portal towers no. 237 ÷ 239 of the 400 kV Isaccea – Dobrudja line. The access into the substation will be performed from the future operating road for wind power farms, situated at the boundary of the estates, via one new road branch of approx. 160m. Inside the substation yard, the access is porovided by one new, internal road system.

S 0.3. Design and configuration of the 400 kV subst ation The 400 kV substation configuration is provided with 2 bus-bars, to which the following bays are connected: - 2 line bays (Isaccea – Rahman OHL and Rahman – Medgidia Sud OHL); - 3 transformer 250MVA, 400/110 kV bays (T1÷T3); - 2 spare line, non-equipped bays ; - 1 bus coupler bay; - 2 bus- bar measuring bays. The land area, destined to the 400/110 kV substation, allows the future extending of the 400 kV substation, with 3 more bus fields, to which the following bays can be connected: - 2 transformer 250MVA, 400/110 kV bays (T4 and T5); - 3 line bays.

S 0.4. Tender document content The necessary technical documents for drawing up the tender, afferent to the purchase of the ”turn-key” contract for the study "400 kV Rahman Substation, including the 400 kV connecting line", were organized in the following sections:

Section "S0" refers to the content of the tender and the obligatory basic requirements for drawing up the tender, as well as after the contract award. The Basic Design presented in Section "S1", contains the technical solutions, used for performing the substation, both for the technological

and for the constructions and afferent installations part. This section also presents the constructive solution for the 400 kV connection to Isaccea – Medgidia OHL (Dobrudja). The sections S2 ÷ S7 present the technical specifications for purchasing the main equipment and materials, necessary for achieving Rahman substation. Section S8 presents the technical specification for performing constructions and their afferent installation works of the substation. Section S9 contains the technical specification for mounting works performance. SecŃiunea S10 contains the technical specification for performing the OHL 400 kV connecting line mounting works. Having in view that the 400 kV Rahman substation will be staged out in 3 stages, it is to specify that sections S1 ÷ S11 present the bills of quantities for equipment, materials, constructions – mounting works and services, afferent to the entire substation performance, whereas in Section S12 these works are broken down in 2 stages, each stage consisting in: - stage 1 - contains the total quantity of equipment, materials, constructions - mounting

works and necessary services for performing the 400 kV connecting circuit to Isaccea-Medgidia line and the 400 kV substation, with the following configuration:

• 1 transformer 250MVA, 400/110 kV (T1) bay, including PT1 compact

secondary transformer for supplying the a.c. auxiliary services of the 400 kV substation, from the tertiary circuit;

• 2 line bays (Isaccea and Medgidia OHL);

• 1 bus coupler bay

• 2 bus-bar measuring bays

- stage 2 - contains the equipment, materials, construction – mounting works and services,

necessary for equiping one transformer 250MVA, 400/110 kV (T2) bay, including PT2 compact secondary transformer for supplying the a.c. auxiliary services sub-

system of the End-user 110 kV substation

- stage 3 - it is similar to stage 2 and it refers to the equipment (primary and secondary circuit) of one 400 kV bay, afferent to transformer T3

S 0.5. Main terms used in the study The terms, used according to the Law 337/17.07.2006 requirements, are:

• Contracting Authority – it is described in phase I of the turn-key contract (tender + contracting)

by the End-user, which consists of 4 companies: Alpha Wind SRL, Beta Wind SRL, CAS Regenerabile SRL and Land Power SRL. After the project contracting, this will be transfered to CN Transelectrica SA, the new owner of the contract.

• General Contractor/Contractor – the tenderer whom the Contracting Authority, generally

awards the "turn-key contract", based on one organized tender for the complete performance of lthe project.

• Turn-key contract - contract concluded between the Contracting Authority and the General

Contractor, for the complete achievement of one project, including commissioning; by the turn-key contract, the unique contractor takes everything under its charge (engineering, studies, designs, transfer of technologies, systems/equipment and materials supply and their installation, buildings construction, including the afferent installations, as well as roads and other infrastructure/over-structure civil worls performance .

• Supplyer - performer or manufacturer of systems/equipment, as a sub-contractor of the general

contractor.

• Constructor - performer of constructions-mounting works, as a sub-contractor of the general

contractor.

• Tele-control – remote control of one system operation, by data transmission via the

telecommunications system [ IEC 50 (60371-01-01)] • Remote supervisory- one geographically-distributed system supervisory [ IEC 60 870-1-3] • Control center - Place in which one control point – master – point is located [ IEC 60 870-1-3] • control center - place in which one control point is located [ IEC 60 870-1-3]

S 0.6. Proposal content The works for performing each stage of the 400 kV Rahman substation, will be procured on the basis of "turn-key contracts"; within each contract, the Contractor has to supply all the necessary products and services for performing the project, afferent to the respective stage, as follows: - design, consisting in the Basic Design phases elaboration ( according to the adopted solution and the equipment of the furniture for the respective stage of Rahman substation, Engineering documents, Detail designs and As-built, according to the Romanian legislation in force, performed by one specialized, Romanian company, technically certified by ANRE and by CN Transelectrica, of minimum 5 year design experience in similar projects. The general Contractor will assure the control of designs in the Basic Design and Detail Design phases, as well as the engineering projects for secondary and auxiliary services circuits, made by MLPTL and MEC certified inspectors.

- main equipment and materials procurement, according to the requirements of Sections S2 ÷ S7

and assurance of their transport to the mounting site, the quantities complying to the respective stage; - site organization; - constructions-mounting works performance, including materials procurement (different from

those contained in Sections S2 ÷ S7), according to the requirements of Sections S8 and S10, as

well as to the bills of quantities of works, presented in Section S12, appropriate to the respective stage;

- all the necessary notices, approvals, agreements, authorizations and licenses procurement for assuring the equipment transport and the works performance, according to the Romanian law requirements; - environment agreement procurement for constructions-mounting works; - land survey up-drawing, under STEREO 70 coordinates for the performed substation/stage; - technical assistance; - furniture –contained equipment and systems test and check; - equipment and systems parametering and setting (these operations will be preferably made by the suppliers of equipment and systems); - Rahman substation/ respective stage commissioning; - Construction Technical Book up-drawing; - Contracting Authority personnel training (CN Transelectrica SA).

S 0.7. Requirements for Contractor The Contractor must bring evidence for its technical capability of supplying equipment and sistems, destined to remote controlled and operating personnel-free substation, continuously as well as its economic-financial capability for executing the contract. All the works under this contract, will develop under a temporary or mobile building site, a condition for the sinequanon implementation of HG 300/2006 by the General Contractor/ General Employer.(AG) The Contractor/AG shall bring evidence for the operation authorization. In terms of labor security and health assistance and also an evidence for the notification of all the Territorial Labor Inspector Authorities, under which they will carry on their activity, according to the agreement with the Contracting Authority. All the tehnical-economic documents, worked out by the Contractor/AG or, ai its order, to fulfil the contract object, will include distinct chapters on the applying laws and specific requirements: - quality management, - environmental management, - health assistance and labor security management, - emergencies management. The Contractor must submit the above documents, both for its own company and also for its sub-contractors.

S 0.8. Technical agreements and certificates All the equipment, technological equipment and systems shall be technically agreed and certified, according to the European regulations and norms, regarding the goods circulation in EU and according to the Romanian law, illustrating the European norms, in the field : - Law of labor security and health assistance no. 319/2006, along with the Methodological applying Norms, attached to the law, regarding quality certifying, in terms of equipment labor security ;

- HG 1022/2002 regarding the condition of hazardeous products and services for humans life, health, labor security and environment protection; - HG 1029/2008 on establishing the conditions for industrial machines market implementation - Labor security own instruction for power plants/substations in operation (IPSM-IEE/2007 approved by CTES Transelectrica with the no. 35/2007) - Law 608/2001 regarding the products conformity evaluation - Government Ordinance no. 95/99 and Methodological Norms on the quality control of equipment and technological industrial equipment, systems mounting works (approved by MEC Order no. 293/08.11.99) - MIR Order no. 344/31.10.2001 on preventing and reducing technological hazards and avoiding work accidents - HG 1055/18.10.2001 regarding market implementation conditions for metering instruments. - Regulation for certifying economic companies, designing, mounting and operating power plants/substations of NPS (ANRE code 9.1.207.0.0028/05/04)

I. Technical equipment certifying 1.1. According to the requirements of the Law of Health Assistance and Labor Security 319/2006 and HG 119/2004, within the labor security Quality Certifying, established by the Ministry of Labor and National Solidarity, the technical equipment, made in Romania or imported, must undergo labor security quality certifying and be attached legal documents, according to HG119 and HG 882/2007 requirements. 1.2. The technical equipment certificate shall comply with the “Methodological Norms of quality certificate for labor security of technical equipment, operated under normal environments". The Contractor will render available to the Contracting Authority, the technical instructions for mounting, tests, checks and Commissioning, operating handbooks and Labor Security and Health instructions for the supplied equipment, drawn up in Romanian, to be duly used for the operating personnel training and for the supplied equipment, installations maintenance. 1.3. The 400 kV primary equipment shall meet the essential, labor security and health requirements, listed by the Methodological Norms of the Law 319/2006, translated in the own Instruction IPSM-IEE/2007 1.4. All the primary equipment, especially the equipment/apparatus, representing metering means, shall also meet the requirements, contained in HG 1055/2001. 1.5. The measuring transformers, mounted in the exchange points, shall be homologated and standardized/metrologically checked by the Romanian authorities BRML/INMB, the Contractor having to procure the authorization, at its own expense, before delivery.

II. Technical agreement According to art.1 requirements of the government Ordinance no. 95/99, within the quality control and certifying system for equipment and technological industrial installations mounting works,

established by the Ministry of Industry and Resources, the technical equipment must undergo the following: 1. Quality certifying of sub-systems, parts and materials, used for performing technological equipment mounting works. 2. Technical agreement on products and methods, used for technological industrial equipment mounting works The quality conformity certifying of products, used for technological industrial equipment, installations mounting worls will be performed via:

- Products quality conformity certificates, issued by one acknowledged testified authority or by using

- Products quality statements of conformity, provided by the supplier of the equipment, either based on tests control, made by one certifying authority or, by one acknowledged test laboratory, or on its own responsibility, according to HG 1022/2002.

III. MLPTL and MI technical agreement – Firemen Br igade Headquarters. The air conditioning system and fire detection, alarmar signaling and fire-fighting systems, afferent to technological buildings, including their constitutive elements, shall also undergo technical agreements by MLPTL and MI – Firemen Brigade Headquarters. Regarding all the equipment, to be supplied and which contain chemical substances quantities, equal to or over 1 ton, the Contractor shall prove the transmission of documents for pre-registration at the European Agency for chemicals, in Helsinki, according to EC requirements 1907/2006 and HG 882/2007. In compliance with HG no. 1022/2002 requirements for the regime of products and services which can endanger humans life, health, labor security and environment protection, the Contractor/AG, as a responsible person with the market implementation of products and services (in the position of supplier or its representative, services importer and/or supplier or, works executor) shall assure, guarantee and state that the supplied products and services as per contract, in the event in which they are installed, utilized, maintained or supplied, by case, according to their purpose and to the assumed norms, do not endanger life, health, labor security and environment protection, for which the Contractor/AG will release and sign one „Statement of conformity” drawn up on its own responsibility, according to Annex 1 to HG 1022/2002, which it shall attach to the file „Works Completion Final Acceptance”. The new supplied equipment/systems will have improved, functional and maintenance technical characteristics and they shall be state of the art. The entire furniture shall comply with the applying, above-stated, standards, laws, regulations and norms, in force. All and any modifications to them, during the contract implementation, shall be observed by appropriately modifying the non-delivered products/non-supplied service, on the day of the respective, occurred modification.

S 0.9. Quality management General data The Contractor shall certify that the contract-contained furniture and its adjoined services, are in compliance with the demanded quality requirements and additionally, the services and furniture comply with the principles of good quality mounting works. Referring to services (design, engineering, technical assistance) the demands for quality requirements are presented in Section S11. The quality assurance shall be fulfilled by each manufacturer of products, according to standard SR EN ISO 9001:2008 – „Quality management systems. Requirements”. The Contractor shall assure the delivery of equipment/systems andi services (design and mounting works) which shall comply with Order 1193/06, HGR 1136/06 and HGR 493/06 requirements. Mounting, testing and commissioning works shall be performed according to SR EN ISO 9001:2008 – „Quality management systems. Requirements”, in compliance with the local Transelectrica and national norms and regulations, according to IEC norms, for the works performed in H.V. substations

Quality system The quality system shall describe, for each Sub-contracttor (Manufacturer/Constructor), the quality management system implementation, with the following details included: - manufacturer company organization; - obligations and responsibilities for the assigned personnel to assure labor quality ; - materials procurement, deliveries and control system; - construction-mounting quality management system; - documents control system; - non-conformites control system; - arangents for manufacturer audit; - one list of administrative and working procedures, necessary for fulfilling and controling the Contract-included quality requirements. These procedures shall be as quick as possible made available for the Contracting Authority, at its request, to be studied; - data about any previously performed checks, audit, under ISO certificate.

Supplier/Constructor quality plan The Contractor shall submit the detailed Quality Plan, to each Sub-contractor (Manufacturer/Constructor), according to ISO 9001:2008 norms- „Quality management systems. Requirements” and SR ISO 10005:2007 „Quality management systems. Guidelines for quality plans” to be approved, within the contract due term. The quality plan will set out the actions, in a logic sequence and it will include the following: - one detailed schedule, including the work broken down structure, with the different tasks and covering the scope of work;

- internal (local) organization procedures; - procedures regarding the relationship with the Contracting Authority; - references to the manufacturer specific quality procedures, for each type of activity; - inspection points afferent recordings. The Quality Plan will include the quality control plans for furniture and services. These plans will contain the following, but not limited to: - control operations per flow, in a technological order, including the environment protection requirements control, specific to the necessary product/system for the project performance; - document applying to each operation: - resulted recordings from the respective operation performance; - columns for marking authorities or, Contracting Authority established inspection points; - rubrics for mounting confirmation. For construction-mounting works, it will be supplied the appropriate quality plan to one relevant activity, which shall contain the works „Monitoring Sheet” per flow, specifying the determining phases, in which it will be written down the control and monitoring operations for the environment state, the resulting recordings, list of necessary means for performing the project and for preventing contamination by accident, with hazardeous, poisonous products, as well as the way and means of intervention, in case of environmental impact incidents.

Quality monitoring The Contracting Authority and its representatives are entitled to make quality controls on different constitutive elements, provided in the furniture. The quality control actions for different stages of the Quality Plan, can be made: - when ordering furniture, performing calculi and plans, specifications, procedures and schedules; - on furniture manufacturing; - on mounting execution The Contractor shall assure the Contracting Authority representatives access to sub-contractors and manufacturer, which can be requested by the latter for monitoring operations.

Quality control plan The Contractor shall ensure that any of its Suppliers/Constructors observe the requirements of the contract-attached technical specifications. One prime responsibility for the performed control and test is borne by the Contractor for each Supplier/Constructor. The inspection reports will include minimum the name of Contractor, name of inspector/auditor, the date of inspection/test, operation, the used technique, applying standard and acceptance level. The Contractor shall inform in a detailed way, the Contracting Authority about the control/inspection on the Supplier/Constructor (at site), about the inspection field and the time

schedule. The Contractor shall carefully make available any necessary data and equipment to the Contracting Authority, with respect to furniture and services final acceptance (reception). The Contractor and Supplier/Constructor shall take care of accessing any type of facilities to undergo inspections, with respect to the field of furniture and services. The expenses for inspection, test operations and for the necessary sampling equipment, at the request of the Contracting Authority, shall be borne by the Contractor. The expenses, resulting from any post-test and inspection occurring damages, shall be borne by the Contractor. If rejected, all the respective furniture and services shall be replaced with other new ones, according to the Technical Specifications. Before the works commencement, the Quality Plan shall be studied and approved by the quality and environment Inspector from the Contracting Authority (CN Transelectrica SA).

S 0.10. Assurance of environment protection require ments All the equipment, materials, construction – mounting works and servicles, supplied by the Contractor, shall fulfil the environment protection requirements (acc. to UE direction 97/11, Environment protection Law OUG 195/2005, modified and completed with the Law no. 265/2006 OUG 114/2007, 57/2007 and 164/2008), according to the law in force, in Romania. After establishing the Contractor of the project, the latter shall submit for the entire furniture (equipment and material) under normal or anomalous operating conditions, as well as for the construction-mounting works, the environment management Plan, containing the environment impact reducing Plan and the monitoring Plan, for all the phases of the respective project stage, in run, appropriate to the new power substation construction and operation, also indicating the costs for the following environment parameters: - waste waters quality (rain, residual and oil-contaminated); - air quality (flue gas and SF6 gas exhaust pollutants reducing below 0,5%); The air quality protection shall comply with MAPM Order no. 462/93 for approving the technical conditions on the ambient air protection, the methodological Norms for determining air pollutant emissions and OUG 243/2000, regarding ambient air protection, modified and completed with the Law no. 655/2001 and OUG 12/2007. - noise impact max. 65dB at the fence of the substation Noise and vibrations-fighting protection shall be assured according to HGR 493/06 – Minimum security and health requirements for operators and inhabitants exposure to noise generating hazards and STAS 10009/88. - wastes management and recovery, from construction works and from equipment packages, according to:

• Law 27/2007 regarding OUG 61/2006 approval for modifying and completing OUG 78/2000 on

the wastes condition

• OUG 16/2001 regarding renewable wastes management, including further modifications and

completions;

• HGR 1872/06 on the management of packages and package-resulting wastes, modifying and

completing HGR 621/05

• HGR 347/03 on restricting the market implementation and the use of certain hazardous

substances and chemicals, including further modifications and completions - ionized radiations-fighting protection, according to HGR 1136/30.08.2006, regarding the minimum labor security and health assistance Requirements for operators exposure to electromagnetic fields generated hazards (10 kV/m – electrical field andi 0,5mT – magnetic field in the yard) and according to Order 1193/06 regarding the minimum labor security and health assistance requirements for inhabitants exposure to hazards, generated by electromagnetic fields (5kV/m electrical fields and 0,1 mT magnetic field, outdoors); - hazardeous, poisonous substances; - soil and subsoil; - underground waters quality. For assuring the above parameters, the Contractor shall indicate the costs and responsibilities, in the Environment Management Plan (Annex B). Also, for avoiding the negative impact over humans health, goods and the environment, the utilized oil from equipment shall be PCB-free and the utilized equipment and materials shall be asbestos-free. The Supplier shall bring the proof of having laid the pre-registering documents at the European Agency for Chemicals, in Helsinki, with respect to all the chemicals, used as they are, either prepared or existing in equipment, put in the site of Rahman substation, on the occasion of the project, according to Regulation (EC) no. 1907/2006 of the European Parliament and Council, from 18 December 2006 and HGR 882/2007, regarding chemicals registration, evaluation, authorization and restriction (REACH). Following the construction-mounting operation of the substation, it resulted wastes from constructions and equipment/materials de-mounting. From the construction-mounting works, it resulted wastes free of hazardeous substances, classified in the list of wastes categories, at pos. 17 (according to the requirements for equipment and materials dis-assembling) and also, it resulted wastes from packages, for which HGR 1872/2006 requirements shall be observed. All the wastes, resulting from dismantling and construction-mounting works, shall be sorted in renewable and unrenewable wastes and they shall be handed over, on the basis of justifying documents to authorized companies, for revaluation, removal from site, respectively.

S 0.11. Assurance of labor security and health assi stance requirements According to the law in force, regarding labor security and health, the Contractor along with its sub-contractors (design, supplier, constructor) are responsible in front of the Contracting Authority, for complying with the law requirements in force, both with respect to the contracted equipment/systems and with respect to construction-mounting works. • technological equipment and systems which are the object of the contract

• the documents to be supplied to the Contracting Authority, with respect to mounting, test and

commissioning instructions, operating handbooks and Labor Security Health Assistance instructions

• personnel training

• indoor, outdoor, electrical systems

• Contractor accreditation and authorization (including sub-contractors) for performing works

within NPS

• temporary and mobile building sites, including site organization

• endowment with performing, reliable equipment, aggregates, devices, in terms of operating

personnel security

• works conventions conclusion between the Contracting Authority and Contractor and between

the Contractor and each sub-contractor (acc. to art. 33 of IPSM-IEE/2007) which will have in view the following requirements, but not limited: * involved parties responsibilities for labor protection measures; * obligations for parties involved in works performance and mounting personnel training on particular labor protection conditions for the power plant/substation in which they work; * assurance of the individual protection equipment by the Contractor for its own personnel, necessary for avoiding accident risks, which can occur when performing different categories of works; * work accidents investigation and recording mode; * name of declared sub-contractors for works contracting; * substation/plant access conditions; * open fire working mode; * materials storage; * time schedule (staged out, where necessary), as well as other requirements, appropriate to the Contractor, having in view the work specific conditions, those appropriate to the substation/plant and to the applied technologies. By using the work conventions, it can be established the tasks and responsibilities of the parties, in terms of Labor Security and Health Assistance, specifying the documents, concluded between the operating companies, owned by the Contracting Authority and Contractor, apropriated and signed by all the sub-contractors of the Contractor. The Contractor/AG will attach all the specific documents to the works convention, according to the documents of „Labor security oen instruction for power plants/substations in operation (IPSM-IEE/2007), applicable to CNTEE „Transelectrica” SA.

Regarding the technological equipment/systems and those afferent to constructions, it shall be observed the requirements, specified in chpt. S 0.8. and the following norms, but not limited to:

• HGR 493/06 eith respect to the minimum LSHA requirements for workers exposure to noise generating risks and STAS 10009 • HGR 1136/06 with respect to the minimum labor security and health requirements for workers exposure to electromagnetic fields-generating risks • Order 1193/06 regarding the minimum labor security and health requirements for inhabitants exposure to electromagnetic fields-generating risks • Orderl MIR 344/01 regarding techological risks-fighting and reducing and work accidents avoiding The equipment purchased outside Romania, shall be marked, in terms of labor protection and security, according to the European law in force and in compliance with the law requirements, presented in chpt. S 0.8. The Contractor (Supplier of equipment, respectively) shall indicate the risks caused by each element of the furniture and the measures to be taken, in operation, for preventing them and for assuring the operation and maintenance of the power plant/substation, under full labor securith and health.

Regarding the constructions-mounting works , the Contractor shall assure the compliance with

the law in force, minimum of the requirements of the following labor security and health norms: - Law 319/2006 – Law of labor security and health, including the methodological Norms for applying the law, approved by Decision no. 1425/2006 - Labor security own instruction for power plants/substations in operation - IPSM-IEE/2007 approved by CTES Transelectrica - HGR 300/2006 regarding the minimum labor security and health requirements for temporary and mobile building sites - HGR 1146/30.08.06 regarding the minimum labor security and health requirements for using labor protection equipment by operators, during their work - HGR 493/2006 regarding the minimum LSH requirements, referring to operators exposure to noise-generating risks - HGR 1136/30.08.06 regarding the minimum labor security and health requirements, referring to operators exposure to electromagnetic fields-generating risks - HGR 1091/16.08.06 regarding the minimum labor security and health requirements for the job site - HGR 1048/9.08.06 regarding the minimum LSH requirements for the use of individual labor protection equipment, by operators at their job site - OG no. 95/99 and methodological Norms regarding the quality control on mounting works for aggregates, equipment and technological industrial systems (approved by MEC Order no. 293/99) - HGR 1051/9.08.06 regarding the minimum labor security and health requirements for handling hazardeous masses, weights to operators, especially affected by backbone diseases - HGR 971/26.07.06 regarding the minimum requirements for labor security signaling and/or health assistance at job site

- MIR Order 344/2001 regarding technological risks fighting and reducing and work accidents avoiding - Regulattion for certifying economic companies designing, mounting and operating power substations of NPS (ANRE 9.1.207.0.0028/05/04). The Contractor and its construction-mounting units (as sub-contractors) shall be ANRE-licensed. - 3-RE-Ip41-1992 – Design and operating Norms for fighting the negative impact, resulted from OHL approaching - Labor security own instruction (Contractor/Sub-contractor), approved as per LSH norm no. 319/2006, with respect to all works categories to be carried on, within the contract, as follows: * technological equipment and metallic structures mounting works * earth excavation, foundation works, earthworks, etc. * trafficable roads and railways specific works * paint-coating and anti-corrosive protection works * concrete form works * indoor and outdoor installation works * road and railway transport works for equipment, materials and personnel

The Contractor will appoint its coordinators, in terms of labor security and health, during the works performance, with tasks according to HGR 300/2006 requirements. The Contractor, including its sub-contractors, will draw up their own Plan of labor security and health assistance, according to Chpt. III, Section 1 requirements of HG no. 300/2006 in which it will be indicated the set of measures to be taken for fighting the risks occurring during works at site and, it will include the following data, but not limited to:

• administrative data

• site organization general measures

• risks identifying and description of hazardeous works

• specific labor security measures for hazardeous works

• site arrangement and organization, including monitoring actions

• obligations resulting from collaboration works and means interface

The Contractor own labor security and health Plan will be based on the plan, presented in Annex C, and it will be available, along with its sub-contractors similar plans, to the labor security and health assistance coordonator of the Contracting Authority, during the project performance, with the view to consult and notify them. The LSHA plan shall be continuously completed and adaptated, according to the site development and the works/work stages effective time.. Also, the Contractor shall bring evidence that it/its sub-contractors have the available authorized personnel, as per HG 1146/2006 stipulations, with respect to the minimum labor security and health requirements for the use of labor protection equipment and that they are provided with technical endowment, appropriate to the specific and complex Project for reducing the accumulated factors of risk .

The Contractor shall observe the following minimum labor security requirements for constructions-mounting and site otganization works: - Works shall start on the basis of one "Official Report of site delivery " concluded between the Contracting Authority and the Contractor. - Access conditions shall be assured for the site organization and working zones, handed over to the constructor via Official Report, according to the norms in force. The Law no. 333/2003 requirements shall be observed for goods and material valuables safety - The Contracting Authority is legally entitled, by its own coordinator in the field, to make controls on the way of complying with the labor security norms, by the mandatory personnel and, apply sanctions, by case.

On the completion of construction-mounting works , before the Project final acceptance, the

Contractor must make maesuring works, along with specialized companies, with respect to:

• value of the electrical and magnetic field, in the yard of the substation and at its fence, which

shall observe the HGR 1136/2006 and Order 1193/06 requirements respectively, specified in chpt. S 0.10.

• limit value for noise exposure level, in the yard and at the fence of the substation, according to

HGR 493/2006 and STAS 10009, taking into account the substation location in the urban environment

• resistance value of the entire substation earthing system and of the touch and step voltage

S 0.12. Fire-fighting and quenching measures The FF measures to be assumed, when manufacturing or purchasing systems/equipment and materials, contained in the furniture, have been indicated in the technical specifications and when designing, the norms in the field, in force, shall be observed. In terms of emergencies, the Law no. 307/2006 requirements for all categories of works shall be fulfilled, with respect to fire-fighting protection, of OMAI no. 163/2007 – General fire-fighting Norms, whereas the mounting personnel shall be trained acording to Order 712/2005 requirements, completed with Order no. 786/2005. The Contractor shall draw up, assisted by specialized and authorized personnel, in this respect, according to Order no. 130/2007. - Fire security scenario, according to Order 130/2007 requirements, regarding the updrawing Methodology for fire security /fighting protection scenarios - Evaluation of FF hazardeous factors - Project intervention plan On works completion, the Contractor will make available for the Contracting Authority, register books with the evidence of special fire fighting/detection systems, drawn up according to OMAI no. 163/2007 requirements, for all the existing fire signaling and fighting systems, equipping the substation.

The Tenderer shall fill in the Table no. 6 of tariffs and prices with data for spare parts which can be purchased or not by the Contracting Authority. All the necessary spare parts and expendibles within the guarantee period, shall be supplied, cost-free. The Tenderer shall fill in one Table E, within each section, with the recommended spare parts and expendibles for a post-guarantee, normal operating 5 year-period (different from those of Table no.6). The Contracting Authority will decide upon the quantity of spare parts it shall purchase, based on the Tenderer list and prices.

S 0.14. Installation, test and commissioning contr ol The Contractor shall specify and propose, for approval by the Contracting Authority, its technical assistance for control operations on installation, test and commissioning works afferent to each stage of Rahman substation performance. Also, the Contractor shall estimate and specify the costs for service supply, maintenance works.

S 0.15. Package and transport The main equipment/systems/installations and materials to be supplied, according to the technical specifications, shall be ready for delivery, in such a way as to be easily handled and prevent any damage, during transportation. Each packet for transport, shall be anti-corrosive protected and seal-closed for transport. The package material shall be selected in such a way to be appropriate to the type of transport, its time period, means of transport, to the storage type and time period. The transport operation shall be performed by adequate means of transport. The packets are fixed-tightened in the respective means of transport, not overlapped and not in an inclined position. The Contractor shall insure the equipment transport, download and its storage in one specially arranged space (eg. concrete platform of the substation), as well as its transport from the store-room to the mounting site. In the event in which the storing conditions are not fulfilled on the storage platform, the Contractor shall rent one adequate storage space, outside the substation. Spare parts and maintenance tools shall be packed, independently, in appropriately protected packets for a long time storage period (years), damage-free. The equipment proposal shall also contain the lists of packets. Each package shall be marked, in a visible way, with: manufacturer name, weight, weighing center position, warning signs for fragile product, order number of the package, within the furniture and other data, in compliance with the applied standards.

The goods final acceptance will be made at the substation, by the representative of the Contractor, attended by one representative of the Contracting Authority. The following documents shall be attached to the goods, in Romanian language and in three copies : - statement of conformity/quality certificate in terms of labor security and health, for each type of supplied equipment; - quality certificate (according to the norms in force) control and test report, respectively; - technical book with instructions, referring to equipment and accessories conservation, installation, operation and maintenance, accessories mounting, respectively. In addition to technical data, this book will also contain the list of sub-suppliers .

S 0.17. Obligations in case of failures The Contractor is due to be responsible for eventual concealed, manufacturing and mounting faults, occurred during the standard operating periods, even post-guarantee time and it is obliged to repair or replace the supplied items, according to the agreement with the Contracting Authority. In the event in which it declines this, the Contracting Authority is entitled to ask for indemnities. It shall also assure the reparation and/or supply, at its own expense, of the necessary equipment/systems and associated services for repairing any fault, occurred duting the guarantee period and it shall also assure and supervise the repairs (substitutes). MTBF for any fault, occurred during the guarantee period, will be established along with the Contracting Authority, according to the contract-attached protocol model.

S 0.18. Deviations from specifications All the deviations from the requirements, underlined in the technical specifications, shall be written down in Table G of each Section (S2÷S7). In absence, the requirements of the technical specifications are assumed to be appropriated by the Contractor.

S 0.19. Garantees The Contractor is obliged to assure operation, according to its furniture and services, in compliance with the contract stipulations. An appropriate operation is assumed that, in which there are maximum 5 withdrawals from operation/year, during the guarantee period, due to one faulty equipment/solution/performance, failing the substation unavailability. The guarantee period starts on the day of conclusion of the acceptance official report, while commissioning the project and it ends, on the day of the final reception. The Contractor is responsible for the supplied furniture, with respect to the compliance with the technical specification requirements (for equipment and materials), the adopted design, mounting, construction works solutions, as well as the factory, site tests and inspections and meant to put in operation the plant/substation. The Contractor shall guarantee that on the reception day, the performed work has all the required properties by the technical specification, it complies with the technical norms in force andit has not been affected by operating deffects ,

according to nornal operating conditions or those clarified by the TD and technical books of the manufacturers.

S 0.20. Technical documentation By means of the technical documentation, necessary for the technical Proposal, on each stage of Rahman 400 kV substation performance, the Tenderer is obliged to bring evidence on the products, works and services compliance with the requirements stipulated in the procurement TECHNICAL DATA SHEET and the Tender Document. In this respect, the technical proposal will contain: A. For equipment and technological systems a) one detailed description of the essential technical and functional characteristics, to which the afferent technical document is attached; b) one comment of technical specifications, item by item, contained in the Tender Document, which shall show the compliance of the technical proposal with the respective specifications; c) one description of the materials, equipment quality and of the employed manpower as well, for performing the products to be supplied ; the quality assurance system for all the products d) samples, certificates, agreements and any other similar documents e) products supply diagram f) one description of the way of providing post-sale services and technical assistance, including engagements on spare parts, sub-systems or furniture long time supply. B. For construction-mounting a) quality plan, adapting the quality assurance and quality control system to the concrete peculiarities of the project, which is the object of this proposal, worked out and approved by specialists or competent bodies, authorized in this respect. The quality time schedule must contain: - description of the quality system, applied to the project, including the lists of the quality system afferent procedures; - lists of technical procedures for carrying out the main categories of works to perform the project and the quality control, checks and tests plan; - certificates released by the employed and authorized laboratories, of an appropriate level to works b) project time schedule c) lists with the works bills of quantities, completed per chapters, afferent to works categories; Tenderers are fully free of providing, in their proposal, their own consumptions and mounting technologies, in compliance with the quality and quantity requirements, tipulated in the Basic Design, in the Tender Document and in other legal norms, in force, which regulate the works performance

For services a) one detailed description of the designed working methodology and plan for supplying services b) particular, concrete jobs and responsibilities to be assigned to the stated personnel and the time schedule foreseen for fulfilling these jobs and responsibilities c) one comment on the technical specifications, item by item, included in the Tender Document, which shall prove the compliance of the technical proposal with the respective specifications All the technical documents (drawings, texts, handbooks, prospectuses, technical books, instructions) shall be drawn up in Romanian language and shall be delivered, under written and electronic format. The Contractor which supplies the above-requested documents, in a foreign language, it will supply the documents in the respective language with the respective authorized translations attached to. The drawings shall be performed at the scales agreed by the Romanian law and submitted on paper and magnetic support. The measuring units, used in the contract comply with the International Units System (SI), including the afferent multiple and sub-multiple values.
