Our mission is to influence national transport and infrastructure regulation and policy to ensure Australia has safe, secure, efficient, sustainable and internationally competitive supply chains. The Australian Logistics Council members and associate members are major companies, associations, government agencies and organisations participating in the Australian freight transport and logistics supply chain. The policy articulates ALC’s overriding commitment to safety as evidenced by the development of the ALC Safety Codes, and also questions whether another layer of regulation in the name of safety is needed in the heavy vehicle industry. Quite simply, we do not believe a valid case has been made for the introduction of ‘Safe Rates’. ALC is also concerned that Safe Rates will unreasonably limit industry efforts to increase productivity in the sector. Productivity in the transport industry has effectively stalled with recent figures from the Australian Bureau of Statistics showing productivity growth in the sector increasing by only 0.6 percent per annum in the five years to June 2011. Limiting the ability of management to manage their affairs in a way that is efficient, safe and strategically appropriate is not in the industry’s long-term best interests, particularly when it is faced with an ever increasing freight task. For a copy of the ALC National Policy, CLICK HERE MANAGING DIRECTOR’S UPDATE Legislation has been tabled in the House of Representatives to establish a Road Safety Remuneration Tribunal which would be responsible for setting rates of pay or pay related conditions in the heavy vehicle industry. If passed by the Parliament, the Tribunal would begin work on 1 July 2012 and would include members from Fair Work Australia along with independent work, health and safety experts. It is unlikely that the current Parliament will consider another piece of legislation as significant to the heavy vehicle industry as the Road Safety Remuneration Bill, or as it is commonly known, Safe Rates. ALC has been vocal in its opposition to the proposed scheme, and has released a national policy on Safe Rates to draw attention to a number of facts which we believe have been overlooked in the debate.

rLSC Code of Practice a key road safety tool

the National transport commission’s ‘National corporate transport safety Partnership’ initiative has taken a step forward, with Ntc holding a number of workshops to progress the initiative.

the program, which is still under development, aims to encourage and facilitate a greater level of information sharing between the corporate sector in an attempt to drive improved safety outcomes on the nation’s roads.

alc’s submission on the Ntc discussion paper A Corporate Approach to Road Safety highlights the important role the rlsc code of Practice plays maintaining and improving safety across the supply chain. at the forum, the Ntc acknowledged that its program would need to complement and add value to what already exists, and not duplicate existing industry codes, such as the rlsc.

alc will continue focus on developing the rlsc code of Practice as an effective way of ensuring all participants are aware of their responsibilities in the supply chain when they control or influence the movement of freight.

alc continues to play a lead role representing industry at a series of workshops to finalise the contents of the second bill to establish a National heavy vehicle regulator.

the workshops, being run by the National heavy vehicle regulator Project Office involve both industry and government and are designed to separate more than 800 outstanding issues into ‘technical’ or ‘policy’ issues, with the parties then working together to resolve the issues.

alc has concentrated in these workshops on identifying any loopholes in the draft legislation that would potentially weaken the law’s national focus which could threaten the productivity benefits promised under this reform. these have included:

»» opposing state and territories being able to implement derogations to the national law in areas such as penalties

»» Pushing for service level agreements between the Nhvr and states to be open and transparent

»» advocating in favour of decision makers being required to follow guidelines in respect of administering the national law, and that industry be consulted when they are being developed.

these and other issues are likely to be considered by the National heavy vehicle regulator Project board. last month, transport and infrastructure minister anthony albanese announced the appointment of alc deputy chair andrew ethell to the board, as well as Philip halton, who is the executive director of the australian livestock and rural transporters association and an associate member of alc.

meeting deadlines for national regulators “at risk” the coag reform council has sounded a warning on progress to implement national regulators for heavy vehicles, maritime safety and rail safety.

the council’s second report, released in mid-November, acknowledged that significant progress has been made to put in place a framework to establish the three regulators, including the signing of intergovernmental agreements by coag on 19 august 2011.

however, the report also expressed the council’s concerns that the timeframe for completion of these reforms “may be at risk”.

it’s a concern also held by alc, and expressed in a recent australian Financial review article titled Transport shake-up hit by QLD delay.

queensland is the lead legislator for the heavy vehicle National law, and needs to pass the legislation before it can enacted by other jurisdictions. however, with the state election scheduled to occur before the middle of the year, and the draft bill currently before parliamentary committee, there is a risk that it will not pass in time for the regulator’s scheduled start-up date of 1 january 2013.

alc will continue to engage at the state level to push for the legislation to be debated and passed in a timely fashion.

the coag reform council will formally assess the progress of these reforms in its report due to coag later this month.

IA must ensure state infrastructure projects have a national supply chain impact

alc has encouraged infrastructure australia to carefully examine proposals contained in submissions by the victorian and New south wales governments for federal infrastructure funding to assess their potential benefits from a national perspective.

the call was made after the publication of both states’ funding submissions to ia, which highlight the need to invest in key freight routes to boost the efficient movement of freight in their states.

it is pleasing that both states have put forward submissions containing proposals aimed at improving the efficiency of freight movements around their major cities.

both submissions underscore the important role efficient freight infrastructure plays supporting their economies.

however, alc believes government funding should be prioritised towards nationally significant projects, with funding being provided to projects which have a clear national supply chain impact.

alc looks forward to infrastructure australia carefully scrutinising the submissions’ proposals, including undertaking further cost benefit work, to assess their merits and to examine their potential returns to the national economy.

we will then be in a better position to assess which of these proposals warrant further financial support from the Federal Government as nationally significant infrastructure.

NSw inquiry into road access pricing

alc will be making a submission to the Nsw legislative committee on transport and infrastructure which is conducting an inquiry into road access Pricing. the inquiry will examine:

»» current road access pricing in New south wales;

»» road access pricing policy and initiatives in other jurisdictions;

»» the applicability of road access pricing in non-metropolitan areas;

»» the capabilities of road access pricing technologies;

review of Australian road rules

alc’s submission on the Ntc’s review of australian road rules and australian vehicle standards will push for more uniform road rules, and the need for an applied law regime, rather than the current model law approach. the review is designed to assess the effectiveness and efficiency of the rules, and to determine any possible changes to the rules to make them more current and effective. work Health and Safety Codes of Practice

the public comment period is closing soon on 15 draft codes of Practice which have been developed by safe work australia to support new model work health and safety (whs) legislation that is due to come into effect on 1 january 2012. included in these is the Preventing and managing Fatigue in the workplace code of Practice. alc’s believes a national economy should be governed by a single set of national laws, and so we support the establishment of national WHS laws. ALC is satisfied with the contents of the draft code, particularly as they refer to the National transport commission’s guidelines for managing heavy vehicle driver Fatigue.

Safe rates referred to committee

the government’s road safety remuneration bill (see page 1) has been referred to the house standing committee on infrastructure and communications. a timetable to consider the bill has not yet been determined, but as the government has stated its intention for the law to come into effect on 1 july 2012, alc assumes the committee hearing will be expedited. if submissions are invited on the bill alc will provide comment. Air Cargo Security

»» the introduction of an accredited air cargo agents (aaca) scheme in 2012 with businesses under the scheme needing to demonstrate they have adequate safety procedures in place to deal with such things as vehicle security, secure handling of cargo and training.

»» the establishment of a regulated shipper scheme to be introduced in september 2013 that would see cargo originating from a ‘regulated shipper’ being deemed ‘secure’ if its transportation to a cargo terminal operator is undertaken by an aaca or raca.

movement on maritime

November has been a busy month for australia’s maritime industry, with a number of government announcements relating to the environment, industrial relations, the international maritime organization, and the National system for commercial vessel safety:

»» the next stage of consultations on the National system for commercial vessel safety has got underway, focussing on crew

certificates issued under the National standards for commercial vessels

»» australia has been re-elected to second place on the council of the imo at its 27th assembly in london which recognises australia’s commitment

»» laws have passed federal parliament which effectively bans the carrying of heavy grade oils through antarctica

The Office of Transport Security, located within the Federal department of infrastructure, has undertaken to consult with industry on the development of the regulated shipper scheme. alc will focus on ensuring there is no regulation creep affecting industry efficiency in the migration from the aaca/raca scheme to one incorporating the regulated shipper scheme.

the senate has passed changes to the aviation transport security act 2004 which bring into effect changes to australia’s air cargo security arrangements. this will include new screening requirements for air cargo and the introduction of a regulated shipper scheme. the changes include:

»» a requirement for regulated air cargo agents (racas) to have examination capability by april 2013, with the government to provide $20 million to assist racas purchase screening equipment.

»» Australia has ratified the laws to comply with the maritime labour convention set by the international labour organization relating to such things as conditions of employment and minimum requirements for seafarers to work on ships

»» ships found guilty of leaking oil in australian waters face fines of $11 million, previously $1 million.

Federal infrastructure projects brought forward

the Federal government has brought forward spending on a range of infrastructure projects to the 2011-2012 financial year as part of its mid-year economic and Fiscal outlook (myeFo). The $1.4 billion brought forward to this financial year under the building australia Fund and the Nation building Programs will go towards the duplication of the Pacific Highway ($490 million); the western ring road in melbourne ($167 million) and the hunter expressway project in Nsw ($200 million).

Latest road deaths report

The latest road deaths figures from the Bureau of infrastructure, transport and regional economics show deaths on australian roads fell by nearly 5 percent in the year to end october 2011.

The figures show that during the 12 months ended october 2011 there were 1,279 deaths on australian roads which is a 4.8 per cent decrease from the 12-monthly period ending october 2010. the rate of annual deaths per 100 000 population currently stands at 5.7, which is a a 5 percent decrease from the 12-monthly period ending october 2010. Fatal single vehicle accidents fell from 555 to 513, while multiple vehicle accidents fell from 510 to 470.

ASEAN-Australia-New Zealand FTA: Indonesia entry into force

the government has announced that the agreement establishing the aseaN-australia-NZ Free trade area (aaNZFta) will enter into force for indonesia on 10 january 2012. it will then be in force for all 12 parties to the agreement. on aaNZFta’s entry into force for indonesia in 2012, 80% of australia’s current exports to indonesia will enjoy tariff-free treatment, up from 56% at present. australia will enjoy tariff-free treatment on 78% of indonesia’s tariff lines, compared with 11% currently. by 2015, tariffs on 92% of tariff lines will be zero and this will increase to 94% by 2025, by which time 92% of australia’s current exports will enjoy tariff-free treatment.

the Port of melbourne corporation (Pomc) has advised of significant port leasing opportunities for two parcels of land in whitehall street, Footscray, next and close to cc containers and somerville road.

Port of melbourne corporation (Pomc) has commenced an expression of interest process to lease two premium sites at 111-151 whitehall street, Footscray, and 221 whitehall street, yarraville, with an area of approximately 5.6 and 11.2 hectares respectively. subdivided smaller land parcels are also available to lease within these sites.

industrial real estate agents, savills, have been engaged to advertise and lease the sites on behalf of the Pomc.

Port of melbourne record Performance

Port of melbourne recently reported a growth of trade of 7.3% over the same period last year setting a monthly record of 7.81 million revenue tonnes.

underpinning the strong trade performance for october was an 11.3% increase in container throughput to set a new australian record of 241,478 teus. total full container imports and exports both showed strong increases compared to the same month last year.

the alc associate member welcomed its great record result for the Port and victoria, however also remain acutely aware of their role as facilitators rather than generators of this increase in trade.

report into NSw transport and ports

the Nsw auditor general, mr Peter achterstraat, has released his volume eight report to Parliament for 2011, which includes comments on financial audits of government agencies in the transport and ports sector. the report found that rail movement through Port botany fell from nearly 19 percent to 14 percent in 2010-2011, which mr achterstraat said has placed pressure on an already congested road network, and that further pressure would be placed on the transport system following the completion of a third terminal at Port botany in 2013. the report also highlights slower travel speeds in the sydney morning peak period, with travel speeds worsening on six of the seven major sydney roads. the morning peak average speed sits at 29km/h, while the afternoon peak average speed is 42 km/h.

NSw Long Term Transport master Plan

the Nsw government has announced it will develop a Nsw long term transport master Plan to guide the state’s long term transport priorities following consultation with residents from 10 regions across the state. the master Plan will address transport challenges facing the state over the next 20 years, including population growth, employment and increased demand for transport infrastructure. the forums will be held after the release of a discussion paper which alc anticipates it will provide a submission on.

Public comments invited on moorebank Environmental Impact Statement

The Moorebank Project Office (mPo) has concluded two community information sessions for the proposed moorebank intermodal terminal and has invited comment on the environmental impact statement (eis) process. the information sessions provided an opportunity for the community to view information about the project including maps, site displays, and brochures while engaging with members of the project team. around 150 people participated over the two days.

the issues most frequently raised included the suitability of the site due to nearby residential areas, traffic congestion, air quality, health issues and noise. the mPo has noted all the comments made at the sessions and will take them into account as the feasibility study progresses and the eis is prepared.

the department of sustainability, environment, water, Population and communities (sewPac) has developed draft guidelines (terms of reference) for the eis for the proposed moorebank intermodal terminal Project. the draft eis guidelines have now been published on the sewPac website and is available for public comment. comments can be made by CLICkINg HErE

Sydney Ports Annual report Highlight alc associate member, sydney Ports corporation, has released its Annual Report for 2010/11 highlighting an impressive figure of zero lost time injuries for the year.

sydney Ports say they achieved this safety record by implementing a system of safety inspections to continually improve the safety for their staff and by conducting regular proactive safety campaigns.

Another highlight in the report was that container traffic at Port Botany reached 2.02 million teus (twenty-foot equivalent units) exceeding 2 million TEUs for the first time ever in a financial year.

This record figure comes upon the completion of the third container terminal at Port botany. the $1 billion project will enable a doubling of sydney Ports container capacity once it is tenanted by hutchison Port holdings.

at its recent board meeting the transport and logistics industry skills council Pty ltd (tlisc) elected laurie d’apice, President human resources, linfox as its chair. laurie brings his extensive transport and logistics industry knowledge and experience to this important role.

laurie addressed the board and tlisc staff expressing his enthusiasm to lead the organisation as it implements its Strategic Directions 2011-2014. One of Laurie’s first official duties as Chair was to launch the new tlisc branding and associated website.

Tenders sought for warehousing opportunities at Enfield

tenders are now being sought for warehousing opportunities at the $300 million sydney Ports freight terminal at Enfield.

the process comes soon after the Nsw government’s announcement that it intends to privatise Port botany. the Nsw government is also looking at whether or not to sell the sydney Ports’ intermodal logistics centre (ILC) at Enfield which is linked by rail to Port botany.

alc recently toured the developing ilc site at Enfield, due to be operational in 2013, and agree that is a key component in the Nsw freight strategy and will become part of an integrated network of existing intermodal sites. hutchison Port holdings, a global port investor, developer and operator, will be the anchor tenant operating the intermodal terminal.

After nearly five years with ALC the time has come for Ian Ross, Program director of safety, to say goodbye and look back on what has been a huge achievement for him personally, for alc and for the freight and logistics industry.

through ian’s sound management and grass roots work on the retail logistics supply chain (rlsc) code of Practice, and the National logistics safety code (Nlsc), the number of signatories to the codes has grown rapidly, and both have been recognised as codes of Practice by VicRoads.

alc wishes to thank ian for his contribution over the years and wishes him the very best in his new role with origin energy.

Asciano links with mediterranean Shipping Company

alc member asciano has announced that its Patrick stevedore division has extended its relationship with geneva based shipping line, mediterranean shipping company (msc) with the signing of a new agreement for container terminal stevedoring services. asciano predicts its Patrick operations will handle more than half a million containers nationally for MSC in the first year of the agreement.

ACCC recognises importance of infrastructure in latest report

a speech recently delivered by accc chairman rod sims has highlighted the importance of major infrastructure to the economy and its effective regulation.

“if transport infrastructure is used efficiently, the benefits are felt throughout the economy. if it is used inefficiently, the extra costs are passed on to all those businesses that rely on it, right along the supply chain,” mr sims said.

“For this reason, major infrastructure that is a bottleneck to competition in other markets, or that is inefficient to duplicate, can be regulated.”

mr sims said it was appropriate for Government to make specific decisions regarding access to infrastructure, particularly when there are national implications.

“the cases which have been more successful are those where governments have made specific decisions to require access to infrastructure, such as the recent undertakings accepted from australian grain bulk handlers allowing for other wheat exporters to access their port terminals to export wheat,” mr sims said.

“governments should continue to play this role in appropriate cases, where effective access to major infrastructure is clearly important to the economy.”
