Most of the major tasks of implementing our new unified court system have now been completed.
The system is functioning as it was designed and, wi~h unified management at the state level, the administration of justice in Alabama is being carried out in an expeditious and cost-effective manner.
However, the challenge of continued improvement is al\"ays with us. We are moving for':rard with full development of a judicial college in order that judges, court officials and court personnel may obtain continuing education and training to become better prepared to carry out their important functions.
We must continu~ to be conscious of keeping dockets current and improving caseflow management as well as the management of jurors and witnesses.
I am confident that we have nm" established a firm base for the future of our judicial branch of government.

Report Of Activities
There are approximately 1,400 full-time judges, officials and employees in the 96 trial court locations throughout Alabama who comprise the Unified Judicial System. Most of these employees were incorporated under the state umbrella during the past year, the majority of which were personnel in judges' and clerks' offices in the 67 counties.
FISCAL, BUDGET, ACCOUNTING
A significant function of the Administrative Office of Courts is the area of budgetary and fiscal operations. The office processes all payroll checks for the court system personnel, handles the majority of purchasing for the sjstem, prepares a budget for all trial court operations and must keep track of all expenditures.
A year ago, no individual or group in Alabama knew' or could determine the true cost of providing judicial services. Today, with the expense accounting system developed for the trial court operation, the AOC can determine, on short notice, the current date cost and the itemized cost of every office within the system. During the past year, new procedures, new cash books, and new forms were established to provide for the transmission of fines and court costs collected by the trial courts. A new statewide procedure for the payment of juror and witness fees is now in operation. This procedure has replaced 68 separate bank accounts throughout the state with one central account through which a computerized system provides a monthly printout of juror costs broken down to each individual county.
The AOC currently processes some 1,500 vouchers and an average of nearly

3,000 payroll checks per month and has reduced the turnaround time for the preparation of these vouchers through the development of a new filing system, new coding forms and through an accrual basis for expense accounting. Current developments include the establishment of a completely computerized expense, appropriation~ budget control and purchasing system using a centralized data information system to develop the proper cont.rol and historical information reports. Such a sys tern will significantly decrease staff time and paperwork which had been required in using old methods of providing financial information.
RECORDS MANAGEMENT
It has been estimated that some 125 million documents exist in the court system of Alabama today. Storage and retrieval capability of these important court records is totally inadequate. Throughout the state, the massive problem of records storage must be addressed in order to save millions of dollars in future construction costs for record storage.
T.he records management division of the Administrative Office of Courts is currently addressing this problem. In initial surveys, the AOC's records management section discovered that more than 10,000 different forms were being used in the trial courts of Alabama. By January 1, 1979, that number will have been reduced to a more workable standardized set of approximately 300. This will result in a significant cost savings for the court system.
After staff analyzed the overall situation, an effort began to design and develop new forms for the system. These forms were developed in coordination with the various committees of judges, clerks and attorneys.
The conceptual design elements for the new forms are building blocks for the future, designed to support comput~rization, microfilming and modern filing systems. All new forms

, . have been numbered and given titles which will eliminate the requirement of reading an entire form to determine specific identification. Records management personnel also assisted in developing and designing the new Alabama Uniform Traffic Ticket and Complaint. It is important to note from a cost standpoint that, in the past, the cost of forms to process a traffic case, including the ticket itself, docket sheet, folder, bond and affidavit, warrant and other related forms, totaled $2.75. Under the new uniform traffic ticket system, these forms cost less than $.12 for each case.
The refinement of forms developed for small claims and juvenile courts, plus development of forms for other civil and criminal jurisdictions, are making a significant impact toward improvement in case processing in the courts.
The records management staff is currently developing an administrative procedures system to control the distribution and maintenance of policy statements and procedures within the Unified Judicial System. This system will offer the Unified Judicial System personnel a standard system for filing and retrieving policies and procedures. The staff is also involved in coordinating the development of other manuals for judges, court reporters, and clerks and registers.
An inventory of court records is presently undenvay as part of the total "records retention program." In October, 1978, six temporary full-time employees will be hired to complete this inventory. Retention schedules will be developed to determine final disposition of court records -destruction, microfilm, or transfer to State Archives.
PERSONNEL
Prior to the time judicial personnel in the state were brought under the state umbrella, the Administrative Office of Courts" established a

judicial personnel system. A classification plan was developed for all employees and procedures for review and appeals established. This involved interviewing and completing a job analysis for every full-time court employee serving in the judicial system. Additional tasks involved grouping together or classifying those positions with significantly similar duties ani responsibilities so that they could be treated alike for administrative purposes, systematic recruitment and placement and promotion of court system employees. In addition, a pay plan was developed for each classification. These plans had to be similar in composition with the state employees personnel system. Rules were developed to guide administration of court personnel in conjunction with state laws and regulations. A personnel procedures manual was developed and a personnel information system was designed and is used to establish and update job applicant registers for each classificat~on in the court personnel system.
The personnel division has handled all appeals in regard to classification and pay; has developed a statewide register for all merit system classifications; has initiated an Employee Performance Evaluation Program and has had the responsibility of operating and maintaining the 26 different kinds of personnel actions which are possible under the system.
INFORMATION SYSTEMS
The ability of any centralized system, whether it b~ in the private sector or the governmental sector, cannot adequately function without having accurate data and management information readily available. The information systems division provides this function for the Administrative Office of Courts. The use of computer technology is necessary in order for this information to be developed and utilized most effectively. The State of Alabama, through its Criminal Justice Information System, has this

modern-day technology available and the AOC is taking advantage of it to improve the delivery of court services.
Computer technology is being used in the following ways:
1. In the personnel area, systems have been utilized to facilitate the development of the statewide judicial personnel system; to maintain a master file of personnel data; to facilitate personnel management and provide a basis for personnel cost projections; and in a job applicant system which includes an automatic register displaying the names and addresses of the top ten applicants for positions statewide in the sequence of their personnel test scores.
2. A system was implemented to provide the Administrative Office with a means of identifying and managing the approximately 20,000 items of property in the court system.
3. A system was developed to provide ticket accounting capability and a means of managing and controlling the centralized disbursement of uniform traffic ticket books. This system also provides the source information required for an automated driver history system developed by the data systems management division of the Department of Finance.
4, An administrative support system was designed to produce computer printed mailing labels for all judicial personnel and other lists to support the centralized administration function.
5. In the fiscal management area~ two systems have been developed. A revenue accounting system provides the AOC a means of maintaining an accounting of revenues generated by every court in the Unified Judicial System. It not only provides fee and fine information, but shows the actual disbursements in the various state accounts by courts on a monthly basis and aggregates these totals into year-to-date figures. This system also produces a caseload report by the courts for those cases actually disposed of for which fines and fees
'tyere collected. An expense accounting system provides a detailed accounting of all elements of expenses as they accrue to each court office of the unified system. Through this system, a detailed expense report is produced monthly which is essential to budget projections for the system.
6. The current caseload reporting system consists of three elements. The small claims case disposition system was developed to store and display caseload information, by judge, for every district court in the state. It also provides detailed management information including time-lapse data and numbers of cases by disposition type and amount. In addition, it displays the revenues generated from the small claims courts statewide. A district case disposition reporting system has been implemented to collect, process, store and display caseload information relative to the district court workload in the state. It includes the traffic, criminal and civil dispositions reported on a monthly basis. The information includes total filings and dispositions for each court and a current figure for the pending caseload. The caseload reporting system, a refinement and enlargement of the two just described, includes not only the district court workload, but also the circuit court case load data at the circuit level. The source form for this system was implemented st~tewide last August and the computer programs are now fully operational.
7. A new criminal case history (CCll) reporting system is currently being implemented and will provide detailed information on all felony cases. This data will be used to assess criminal caseload problems. Besides providing critical criminal caseload information for the system, some of this new data will be transferred to the Alabama Criminal Justice Information Center for inclusion into the computerized criminal history files in compliance with Act No. 872, Acts of Alabama. The ACJIC will then use this information, along with data from other

criminal justice agencies, to provide computerized "RAP" sheets and criminal summary data which will assist all justice agencies and link up with the National Crime Information Center (FBI) in Washington. This will be particularly beneficial to the courts as it should greatly reduce the time necessary for completing pre-sentence investigations and expedite the sentencing process.
Initial implementation of the CCll reporting system was begun June 1, 1978, in the following locations: 3rd Circuit, 15th Circuit, 12th Circuit, 20th Circuit, 22nd Circuit, 33rd Circuit, and the Birmingham Division of the 10th Circuit. This first region, with the exception of the Birmingham Division, was selected because it represents a broad cross section of circuit types ranging from urban to rural. The Birmingham Division was selected because of its large size and because the computerized data input method to be used there will be different from the data input method used in any other location.
Following implementation of the CCH reporting system in the first region, the AOC will evaluate the progress made and recommendations of the Regio~ 1 participants, making any adjustments required before proceeding with state,vide implementation on-October 1, 1978.
JUDICIAL PLANNING
The court planning unit of the Administrative Office of Courts was established in March, 1977, to assist in the execution of statutory requirements delineated in Act No. 1205, Article 11, Section 11-103(b) and Section 11-105. Primary requirements focus on the conducting of studies for the improvement of the Unified Judicial System and the coordination of federally funded assistance projects.
In carrying out its administrative requirements, the court planning unit exercised three major functions: the development and maintenance of planning data; the development of projects or programs to implement priorities

established through the planning process.
The third primary function of the court planning unit is the development and coordination of both long and short range studies designed to improve the administration of justice.
Since its establishment in 1977, the court planning unit has primarily focused its efforts on the implementation and coordination of federal grant assistance projects. Currently, over a million dollars of federal support is being provided to the judiciary within Alabama. Projects vary in size and complexity from an $8,000 grant for personnel training to a $230,000 grant for personnel and equipment for local trial courts.
Currently, the court planning unit is finalizing plans and applications for new federal assistance projects to become effective in FY 1979. This process included the solicitation of project requests from each of the local circuits, the analysis of requests by the judicial planning committee, and the formulation of an annual action plan and the multi-year plan identifying future potential areas of assistance to be provided to the Unified Judicial System.
Following the completion of the mUltiple year and annual action plans, the court planning unit will focus on the development of an ongoing planning process for the Unified Judicial System including the reV1S1on of the Alabama Courts 11aster Plan.
MUNICIPAL COURT DIVISION
A municipal court divis.ion has heen established within the AOe to assist in servicing the needs of municipal court judges. This division of the AOC which, in effect, replaces the old traffic court division, has been placed under the area of trial court management. In addition to assuming all the functions of the old traffic court division, the new muni-

cipal court division has the specific assignment of maintaining liaison with the municipal cour.ts throughout the state. This division is composed of three program elements: administration and education; uniform traffic ticket control; coordination of the court referral programs for traffic court judges.
Additional municipal court projects will look into areas such as legal and procedural matters, forms and filing systems, uniform traffic citation procedures, court referral programs and caseflow management in which the Administrative Office can provide direct support.
In 1976, the Administrative Office assumed the responsibility of the design, distribution, and control of the uniform traffic citation. The first series of tickets were distributed during the first quarter of 1977 and were put into operation on April 1, 1977. The ticket was redesigned during the summer of 1977 and the redesigned tickets were distributed to law enforcement agencies for use beginning in January of 1978.
LEGAL SERVICES
Questions of a legal nature are submitted to the two-member legal division. This division has responsibility for researching and responding to questions of a legal nature which are posed by court officials and personnel, as well as from other sources. In addition, this section prepares and distributes a monthly synopsis of major state appellate court decisions, Attorney General opinions, advisory opinions from the Judicial Inquiry Commission, and other sources.
In addition to these projects, the legal section has participated in the following projects:
(1) establishment of local purchasing procedures;
(2) resolution of questions posing
problems relating to distribution of fees and commissions;
(3) participation in development of procedures mandated by passage of the Juror Qualification and Selection Act;
(4) preparation of a journal of salaries for judicial officers and employees; and
(5) assistance in the development of education programs.
TRAINING AND EDUCATION
A judicial college for Alabama has now been established for the purpose of in-state tndning and education for all judicial officers and employees. During the past year, a plan for an Alabama judicial college was developed which has provided an excellent base for the needed continuing education programs for the Unified Judicial System. The new judicial college will begin full operation during the fall of 1978.
Meanwhile, an expanded educational program for judges, clerks and registers, other court officials and employees has been scheduled for the remainder of 1978.
Planning and development of new educational programs for the next fiscal year is currently under way by the judicial education division of the Administrative Office of Courts.
The judicial education division is currently establishing individual training records for all court officials. A training survey was initially conducted during June of 1977 and was completed during June, 1978.
SERVICES TO LOCAL OFFICES
Another primary function of the Administrative Office as the AOC begins to shift gears from implementation into the day-to-day routine administration of the unified court system is the ability to provide on-site staff

assistance to the various elements and offices within the system. For over a year now, a coordinator for clerks and registers has been employed.
For the past year and a half, it has been necessary to focus most of the staff attention at the state admin1strative level. However, in the future, it will be possible to provide local offices with more on-site technical assistance with a competent staff available for local officials to call upon for assistance at any time. Currently, the AOC provides that assistance in regard to case10ad reporting, casef10w w~nagement and implementation of the new case history reporting procedures.
SPECIAL PROJECTS
The largest and most significant single project the Administrative Office has undertaken is the program to assist counties in the refilling of jury boxes pursuant to the provisions of Act No. 594 recently passed by the 1,egis1ature. Approximately $180 ,000 in assistance was provided the various counties to carry out the mandates of this Act. In addition, the AOC prepared a qualification questionnaire for jury commissioners to mail to prospective jurors. The AOC obtained over two million names on computer printouts to be utilized by jury commissions as source lists in the selection of prospective jurors to refill jury boxes.
ADMINISTRATION AND CENTRAL OFFICE ORGANIZATION
The admin~stration at the AOC provides the general support necessary for its functioning as a service agency for the trial courts of this state. Aside from managing the various divisions of the AOC, the administrative function answers correspondence, handles the services required within the AOC, coordinates the public affairs and public information aspect for the AOC and the Unified Judicial System, prepares the judicial system newsletter, provides

• liaison activity with the legislature and with all elements within the trial courts, assists court officials at all levels in the area of information
• services and printing and publications.

The Administrative Office of Courts is designed as the administrative and service agency for the state judicial branch of government. In carrying out this role, the administrative director and the staff strive to continually improve the management of the system and service to the offic~als and personnel of the courts.

MODERNIZATION • •
A BRIEF HISTORY
Under the leadership of two Alabama chief justices, Howell T. Heflin and C. C. Torbert, Jr., the judicial branch of Alabama's government has been modernized constitutionally and statutorily. During the past two years, it has been transformed from a system with a total lack of fiscal ac;countability into a unified system where court services are delivered to the people of Alabama in an efficient, speedy, cost effective and businesslike manner.
This accomplishment would not have been possible without the support of the other two branches of state govern~ ment working in concert with juq,icial offi.cials and many interested state citizens.
The unified Alabama court system stands today, after seven years of constitutional, legislative and procedural modernization, prepared to deliver state judicial services in a fashion which can be equaled by only a few sister states. This is accomplished by three key features:

(1) flexibility offered by the authority given the state Supreme Court to develop and alter the procedural rules under which the system operates; (2) the unified administration of the system which is vested at the state level in the Administrative Office of Courts; and (3) unified budgeting for the system's trial court operation.
FIRST REFORMS
The first movement toward modern~ izing Alabama's court system came in 1971 through both statutory and constitutional improvements, all of which were later carried forward in the adoption of a new Judicial Article to the state Constitution in 1973. These first reforms carried out by the legislature are worthy of note. They provided the following:
• Legislation to give the state Supreme Court exclusive power to promulgate rules of procedure, practice and pleading for the trial courts in civil matters.
· Legislation giving the state Supreme Court authority to establish its own rules pertaining to appeals and practice in the state appellate courts.
· Legislation providing for continuing judicial training and education for state judges.
• Legislation creating a permanent commission to continually study the system of justice in the s~, te.
Two proposals enacted by the legislature were constitutional amendments requiring a vote of the people. They were:
1. A constitutional amendment abolishing the old impeachment method of removing judges and establishing a judicial commission to serve as a clearing house for complaints about jarists and allowing that commission the authority to censure, discipline, involuntarily retire or remove a judge found guilty of misconduct in office.
2. A constitutional amendment abolishing justice of the peace courts and establishing the authority for small claims courts.
In January of 1972, the people approved both constitutional amendments by a two-to-one vote.
During 1972, the new A1abalM. Rules of Civil Procedure were written ~nd were adopted on January 3, 1973. These new rules revised the pleading, p".ractice and procedure in all civil matters before state courts in an effort 1:.0
make justice speedy and less expensive for the litigant.
JUDICIAL ARTICLE
Utilizing much of the work product of the Alabama Constitutional Commission, a proposed new Judicial Article was introduced in bill form in the State Senate on Hay 22, 1973, by State Senator Stewart 0 1 Bannon.

The heart of the Judicial Article would be to create a unified court system in the state. For this to be accomplished, the myriad of courts below the circuit court level in the state would have to be brought into some type of uniformity. The Article would do this by creating a district court to replace the various courts below the circuit court.
After working its way through the legislative process, passing the Senate by a 25-3 vote, and the House on a 77-22 vote, the Article was sent to the people for ratification.
The major changes included:
- over 400 different types of trial courts reorganized into a threetiered unified court system;
- all judges in the state required to be lawyers;
- uniform jurisdiction for all trial courts;
- mandatory retirement for all judges at age 70;
- the establishment of rule-making power, criminal, civil and administrative, in the state Supreme Court;
- creation of "Canons of Judicial Ethics;"
- provisions for flexible assignment of judges;
- a centralized judicial administration system built into the Constitution;
provisions for a Judicial Salary Commission;
- creation of a Judicial Inquiry COmmission and a Court of the Judiciary.

and, on December 18, 1973, the new Article was ratified by a margin of two-to-one.
With ratification of the Judicial Article, the framework had been established. Building the remainder of the new judicial house would be required through legislative implementation. The Article, although parts of it were effective immediately upon passage, gave the legislature four years to fully implement its mandate.
IMPLEMENTATION LEGISLATION
In early June, 1974, a 55-member Judicial Article Implementation Commission was named. to draft the implementation legislation which would be introduced at the 1975 Regular Session of the state legislature.
The changes brought about by the new Judicial Article required a considerable amount of study. Every piece of prior legislation, both local and statewide which applied to the courts in Alabama, had to be r€lviewed in order that the new 1egis1ati('c'l. could be drafted.
By July, 1974, many of the selfexecuting provisions of the Article, such as the Judicial Inquiry Commission and the Court of the Judiciary, the exercise of new rule-making authority by the Supreme Court and provisions pertaining to mandat«:>ry retirement of judges were already in effect.
In the meantime, the Supreme Court began to move on part of the implementation process. Proposed new rules of appellate procedure were being drafted to insure just, speedy and inexpensive determination of every appellate proceeding on its merits. The Court adopted a new Code of Professional Responsibility for state lawyers which became effective on October 1, 1974, and an advisory committee on judicial conduct had been named by the Supreme Court to begin drafting rules of conduct and canons of ethics for state judges.

The Supreme Court adopted a Student Practice Rule in order that prospective lawyers might obtain clinical legal education.
In May of 1975, the Implementation Commission had completed its work product of rec.ommendations to the legislature. It was presented to the legislature in the form of a 168-page implementation bill.

Torbert of Opelika was chief sponsor of the implementation bill in the Senate during the 1975 session.
BILL INTRODUCED
The bill was introduced in the Senate on June 3, 1975, as Senate Bill 400 by Torbert. A week earlier, on May 25, Representative Robert Hill, Jr. had introduced an identical bill, HB 480, across the hall. The Senate bill carried the nam~s of more than two-thirds (25 of the 35 senators) as sponsors. The House bill was sponsored by 72 of the 105 House members. .
A subcommittee of the House Judicia~J Committee spent over seven weeks studying the bill line by line. There was perfect attendance at all subcommittee meetings and each of the seven members logged over 70 hours in work on the bill.
By prior agreement with House leaders, Representative Hill asked that the measure then be assigned to the House Ways and Means Committee for that group to look at the fiscal part of the bill. On September 16, after some additional cost reductions, Ways and Means, by a unanimous vote, gave House Bill 480 a favorable report and sent it to the floor.

Q'Bannon in the Senate, and John Baker. On September 9, Senate Bill 400 was given a favorable report, unanimously, by the Finance and Taxation Committee. un the 30th day of the 1975 Regular Session, September 16, the Senate, with several amendments, approved Senate Bill 400 by a 30-0 vote.
After passage, Senat0 Bill 400 was sent to the House and assigned to Ways and Means Committee. It was at this time that sponsors of the implementation legislation decided to let the House bill lie on the calendar and proceed with the Senate-passed version that contained several items which had been eliminated from the House bill.
After some close calls and considerable debate, the House passed the Senate version on the final day of the session by a 100-1 vote. The Senate concurred, again by a 30-0 vote.
IMPLEMENTATION SIGNED INTO LAW
The two-and-a-ha1f year quest for constitutional and legislative reform of Alabama's judicial branch of government ended on October 10, 1975, when the implementation bill, swelled to 198 pages in the legislature, was signed into law by Governor George Wallace.
Major items covered by the article and its implementation were:
- establishment of a unified court system with unitary state financing;
- establishment of a new district court and d:i ;,trict court judges to replace the hodg;epodge of "inferior" courts in the state and the placing of all courts in Alabama under a single, unified system with uniform procedures and jurisdiction;
- rewriting of the state's outdated juvenile code, which had not been revised in 45 years and establishment of uniform treatment of juveniles;
- establishment of a small claims
court with exclusive jurisdiction of claims up to $500 in which a litigant need not be represented by a lawyer;
- establishment of an office of Administrative Director of Courts and funding of that office;
- the requirement that all judges in the state be licensed to practice law;
- the establishment of the machinery for streamlined judicial administration;
- prov~s~ons to bring all court personnel unCier state employment;
- establishment of uniform budgeting for the entire state court system.
TORBERT BECOMES CHIEF JUSTICE
In early 1976, Chief Justice Heflin decided not to seek re-election and Senator Torbert later made the decision to seek election to the state's highest judicial office. He was elected and took office as Alabama's 25th chief justice on January 17, 1977.
While Chief Justice Heflin had been the driving force behind the constitutional and statutory revision of Alabama's court system, it fell the task of the new chief justice to implement those revisions. On January 17, 1977, the day Chief Justice Torbert was invested into office, the new district courts also went into operation. It was also on this day that the new fine and court cost schedules were put into effect.
One of the new chief justice's first tasks was to begin preparation for total unification of the system, which would occur on October 1, 1977. At this time, some 800 court employees in the 96 judicial offices throughout the state would move from the payrolls of the various counties into state merit system jobs and the state w~:lld assume full financial responsibility for the new system. nine months, individual problems involving these personnel transfers were numerous, but on October 1, 1977, the transition was made in a relatively smooth fashion.
The major problem in the transition, however, was funding of the new system. In preparation of the 1976-77 court system budget in 1975, court officials ~vere asked to provide estimates of revenuE' which would be produced by the entire judicial process in the state. The estimates provided the legislature, as it later turned out, far exceeded actual revenues produced through the judicial process. However, because of the high revenue estimates, language was placed in both the 1976-77 and 1977-78 judicial system budgets which restricted expenditures to the revenues produced by the court system. In April, it became obvious that the revenues into the court system would fall short of the estimates with the consequence being severely reduced funding for the judicial system during the remainder of the 1976-77 fiscal year. Fortunately for the court system, the regular session of the legislature was ongoing at that time.
Chief Justice Torbert stated that such a budgetary stipulation was fundamentally unsound and the legislature agreed by striking that language from the 1976-77 fiscal year budget for the courts. However, the same budgetary
striction had been earlier placed on the 1977-78 judicial system budget and this restriction was not removed during the regular session in early 1977. However, the Governor called a special session on utilities in May of 1977 and the legislature removed the restriction which had been placed on the 1977-78 court system budget, allowing the trial courts to operate on the full $20 million budget approved during the regular session.
On October 1, 1977, when all judicial personnel in the state came under the unified court system umbrella, the first full year of operation of the new system began. However, funding

problems continued to jeopardize the smooth functioning of the system.
Insufficient data causing erroneous projections as to revenues had created the earlier problem. Likewise, insufficient data in regard to the cost of operating judicial services in the 67 counties would create further problems. Because of hidden costs, which could not be pinpOinted in the various county budgets, it was impossible to determine the total cost of operating the trial courts. Based on t11r~e different surveys, the estimates of the cost under the old system ranged from $18 million to $20 million, but this did not include the many costs which could not be determined.
Court system officials had requested a budget of $22 million for the 1977-78 fiscal year at the regular session in 1977. A compromise was reached, giving the trial court operations a $20 million budget. It became apparent in the early winter of 1977 that the $20 million 1977-78 fiscal year budget would be insufficient for the operation of the state's trial court system.
Chief Justice Torbert apprised the legislature that the system would have to seek a supplemental appropriation at the regular session in 1978. The legislature approved a $1.8 million supplemental appropriation at this 1978 regular session. This supplemental appropriation gave the trial court system a 1977-78 budget of $21.8 million plus appropriations for a cost of living pay raise granted all state employees on October 1, 1977. When the cost of living appropriation is added in, the budget for the state's Unified Judicial System for 1977-78 totals $23.2 million. This amount is less than 2% of total state revenues.
On October 5, 1977, Allen L. Tapley was named Administrative Director of Courts by Chief Justice Torbert. Under Mr. Tapley's guidence, a.nd that of the Chief Justice, most of the wrinkles in the new judicial system have been ironed out.
The judicial personnel system has be(m activated; the bu(l~et and fiscal ope~ation of the Administrative Office of Co~trts has been streamlined to provide total accountability of all monies spent for the operation of judicial services; a new municipal court division has been established to coordinate the activities of the Administrative Office and the various municipal courts in the state; effective and long range judicial planning has been established for the system; a plan has been developed and implemented for a new judicial college for the state; improved and expanded work in the area of records management has been achieved; a judicial system newsletter was started; implementation of the new juror selection and qualification act including funding for jury commissions and clerks' offices to carry out the mandates of that act is being carried out; a sound and adequate budget for the operation of the judicial system for the 1978-79 fiscal year was approved by the legislature; the institution of effective jury management procedures in many circuits has occurred; computer capabilities to monitor judicial case1oads, budget expenditures and other day-to-day operations of the system have been established; policies and procedures are now in effect which will allow judicial services in Alabama to be provided in a cost effective and businesslike manner.
In brief, the judicial system of Alabama, over the past seven years, has been transformed from an antiquated, unorganized system with no statewide fiscal accountability into a system where the expenditure of every dollar is accounted for and closely monitored and judicial services are being continually improved.
