DETAILED TENDER NOTICE FOR THE YEAR 2017-18

Sealed percentage rate tender are invited by the Commissioner, Ahmednagar

Municipal Corporation, Ahmednagar from technically sound and experienced agencies

for Project Management Consultancy Service for the following work Name of Work :

APPOINTMENT OF PMC FOR IMPLEMENTING LED ESCO PROJECT FOR AHMEDNAGAR

MUNICIPAL CORPORATION

Government Undertaking agencies and other agencies having eligible experience in

Project Management are eligible for tendering.

6 Earnest Money : Rs.23,000/-

a. Earnest Money Deposit should be paid through online process while of E-

Tender process as per tender notice.

b. The earnest money will be refunded in the case of tenderers whose tenders

are not accepted . Earnest Money Deposit of other bidders and successful

tenderer will be refunded after completion of contract documents and

payment of security deposit.

5. Security Deposit :

a. Total Security Deposit will be of Rs. 57,500/- Cash or to be in the form of

Demand Draft, Bank Guarantee in the favour of Commissioner, Ahmednagar

Municipal Corporation, Ahmednagar. Bank Guarantee from any Nationalized

Bank or Scheduled Bank in the form specified, for completion of work,

extendable up-to at least two years after satisafactory commissioning of the

work by the successful tenderer. In case, the bank guarantee is submitted for

security deposit, it will be the entire responsibility of the PMC for the

extension of the same till the above period.

b. Security Deposit will be refunded after completion of defect liability period

(i.e. two years).

c. Stamp Duty : Stamp Duty, on the date of agreement to be in the form of

adhesive stamps or Franking as per Govt. norms.

6. Period of Completion :

Upto Completion of Work compensation on account of delay in completion of

work will be levied.

8. Manner of Submission of Tender and its Accompaniments :

The Tender shall be submitted in two separate sealed envelopes as below

A. Envelope No. 1 :

The first envelope shall contain the following documents.

a. PMC must be registered as mention in tender notice & Attested Xerox Copy

must be attached.

b. In case of partnership firms, a certified copy of partnership deed and power of

attorney to sign the tender documents and other proceedings pertaning to

the work tendered.

c. Attested copy of valid registration under Service Tax and Income Tax Return

for last financial three years.

d. Attested Xerox copy of PAN card.

e. Work In Hand & Work Done Certificate for last three years in Form No. I.

f. Necessary Required all machinery and equipment for PMC should be fill in

Form No. II.

g. Information of List of Similar Work should be fill in Form No. III.

h. Information of Permanent/ Temporory Staff working should be fill in Form No.

V.

i. Attach "Declaration" & "Affidavit" as mention in Tender Document.

All mention documents in tender notice as well as above documents should

be attached for Envelope No.1. If these documents are not complete,

Envelope No.2 will not be opened.

B. Envelope No. 2 :

The Second envelope shall contain only the main tender including the common

set of conditions / stipulations issued by the Ahmednagar Municipal Corporation,

Ahmednagar after the pre – tender conference duly signed by the PMC. A tender

submitted without this would be considered as invalid.

The tenderer should quote his offer on form and Recapitulation sheet of the

tender as percentage of estimated rates at the appropriate place on tender

documents, to be submitted as per Tender Notice only in Envelope No.2. He

should not quote this offer anywhere else directly or indirectly in Envelope No.1.

The PMC shall quote for the work as per details given in the main tender and also

based on the details of the conditions issued / additional stipulations made by

the Ahmednagar Municipal Corporaton, Ahmednagar as informed to him by a

letter after pre-tender conference. This tender shall be unconditional.

9. Right to Modify the Tender Documents :

The right is reserved to revise or to amend the contract documents prior to the

date of submission of tender or the receipt of the tender or to extend the date

said above such revisions, amendments or extension if any, shall be

communicated to all concerned in the form of corrigendum or by notice in the

press as may be considered suitable.

10. Acceptance of Tender :

Right to reject any or all tenders without assigning any reasons thereof is

reserved by the competent authority, whose decision will be final and legally

binding on the tenderers.

11. Payments will be made as per availability of funds from Ahmednagar

Municipal Corporation.

12. If it is found that, even sufficient funds are available, the Contractor delay’s

work first as per Clause – 2, of accepted tender the action will be taken. Even

after the action as per Clause – 2, the Contractor fails to show proper progress of

work, notice of 15 days will be served on Contractor & his Registration will be

suspended for Three Years.

13. Any dispute arising between Ahmednagar Municipal Corporation & PMC as to

the contract terms & conditions shall be subject to the Ahmednagar Jurisdiction.

I. Background :

Street lightning is an important service provided by Urban Local Bodies. Issues of poor

maintenance, lack of optimization and technological up-gradation not only after the

quality of services, but also put an extra burden on the energy demand of local

government services and subsequent costs.

Under this project services to assist in structuring and developing an ESCO (Energy

Service Company) project for 33000 street lights to improve the illumination level of the

city, ensure large scale energy efficiency in municipal street lightning,

modernization/augmentation and ensure opeartion and maintenance of street lightning

services in Thane city, with the sole aim of reducing the energy burden of the service.

AMC seeks the services of a technical consultant who will support Municipal

Corporation in assessing the techno-economic feasibility of the ESCO project,

developing tender documentation and subsequently in managing a competitive bid

process for selecting an ESCO for implementing the LED based street lighting project in

Ahmednagar.

II. Scope of Work :

The consultant is required to perform the following set of activities as part of the

engagement with AMC. The consultant is also required to work in close coordination

with the city officials and AMC team.

• For a representative sample of these 10% of feeder or 3300 light points (to be

finalized in consultation with AMC) conducting inventory of the key features for

the municipal lighting fixtures such as fixture types, wattages, nos., spacing,

fixture housing type, control systems, system efficiency, energy demand, their

current operating efficiency/efficacy, related characteristics like Color Rendering

Index (CRI), existing lumen levels and other technical specifications. A realistic

estimation of current energy bills attributable to street lightning is to be done.

The field assessments would also encompass noting metering arrangements,

checking for non-functioning meters and fixtures, conducting lightning

measurements with light meters.

• Evaluate the effect of non-available hours of street lighting, average time of

replacement/repair of the fault etc. on the baselines.

• This baseline situation is to be used to determine the potential cost and saving as

a result of LED replacement in the entire city.

• Preparation of ESCO tender documents through assessments of appropriate new

technology options, finance, risks, sensitivity etc (through an investment grade

audit for agreed upon, representative sample from among the identified

streetlights for replacement) to determine viability of replacing approximately

33000 street lights in areas identified by the consultant with input from AMC.

• Evaluation of various issues, including different system networks, potential for

energy savings and exact number of light points for inclusion in the ESCO project.

• Develop technical specifications for LED fixtures. Based on the recommended

standard, bring out the gaps ( if any ) and bring out their effects on the baselines.

• Development of elaborate capital and O&M cost estimates and estimates for

energy savings, emission reductions, potential for carbon credits etc. for the

different options.

• Develop methodology for verification of performance of installed LED fixtures.

• Deveopment of performance standards/elaborate objective mechanisms for

estimating/assessing savings achieved by the energy service company (ESCO).

• Analysing alternate ESCO models from technical aspects and suggest the most

appropriate model.

• Drafting the ESCO model and preparing relevant tender documents.

• Drafting of the technical due diligence report and the AMC team in compilation

of tender documents and manging the bid process including vetting of potential

bidders technical and financial proposals for selection of an ESCO.

• Develop methodology for third party measurement and verification of actual

savings for a period of one year after implementation.

III. Deliverables and Outputs :

• Identification and Baseline Assessment of street lights to be replaced in

Ahmednagar (based on indicative sampling of identified replaceable light

fixtures).

• Tender Documents for ESCO for street lighting for approximately 33000 street

lights.

• Methodology for monitoring implementation of ESCO.

• Methodology for third party verification of ESCO based street lighting.

• Preparation of Third Party Auditor Tender Document.

IV. Qualifications of Proposing Firm :

The following qualifications are mandatory :

Experience in preparing technical feasibility reports, designing, cost estimation and

technical specifications for street lighting systems/energy efficiency lighting projects.

• Experience in tendering including preparation of tender documents, scheduling

planning for implementation of a street lighting system/energy efficiency lighting

projects in India or outside India OR work as technical expert firm.

The following qualification is desirable :

• Experience in carrying out technical due diligence on designing and

implementation of energy efficient urban street lighting system in a developing

country, preferable in last 3 years. Minimum one proposal in India or Outside

India.

VI. General Conditions :

1. AMC reserves the right to verify any information provided, or to request

additional information after EOI packages are received.

2. All data and information received from AMC for the purpose of this assignment

are to be treated confidentially and are only to be used in connection with the

execution of these terms of reference. The contents of written materials

obtained and used in this assignment may not be disclosed to any third parties

without the expressed advance written notice of AMC

3. Correspondence related to this EOI should be addressed in writing only.

4. AMC reserves the right to modify/cancel this call for Expression of Interest as

may be required.

Percentage Rate Tender and Contract for Works.

General Rules and Directions for the Guidance of PMC

1. All the works proposed to be executed by contractor shall be notified in a form of

invitation to tender pasted on a notice board hung up in the Office of the

Commissioner, Ahmednagar Municipal Corporation, Ahmednagar and signed by

the Commissioner, Ahmednagar Municipal Corporation.

2. In the event of the tender being submitted by a firm, it must be signed by each

partner thereof, and in the event of the absence of any partner, it shall be signed

on his behalf by a person holding a power of attorney authorizing him to do so.

a. The PMC shall pay online as per tender notice the sum Rs. 23,000/-

(Rs.Twenty Three Thousand only ) as and by way of earnest money. The said

amount earnest money shall not carry any interest whatsoever.

b. In the event of his tender being accepted, subject to the provisions of sub

clause (3) below, the said amount of earnest money shall be appropriated

towards the amount of security deposit payable by him under conditions of

General Conditions of Contract.

c. If, after submitting the tender, the PMC withdraws his offer or modifies the

same, or if, after the acceptance of his tender, the PMC neglects to furnish the

balance amount of Security Deposit without prejudice to any other rights and

powers of the Ahmednagar Municipal Corporation hereunder or in law,

Ahmednagar Municipal Corporation shall be entitled to forfeit the full amount

of the earnest money deposited by him.

d. In the event of his tender not being accepted, the amount of earnest money

deposited by the PMC shall , unless it is prior thereto forfeited under the

provisions of sub clause (c) above, be refunded to him on his passing receipt

therefore.

3. Receipts for payments made on account of any work, when executed by a firm,

should also be signed by all the partners except where the PMC are described in

their tender as firm, in which case the receipt shall be signed in the name of the

firm by one of the partners, or by some other person having authority to give

effectual receipts for the firm.

4. Any persons who submits a tender stating at what rate below or above the rates

specified in Schedule ‘B’ (Memorandum showing items of work to be carried out)

he is willing to undertake the work. Only one rate or such percentage on all the

Estimated Rates / Scheduled Rates shall be named. Tenders which propose any

alteration in the work specified in the said form of invitation to tender, or in the

time allowed for carrying out the work, or which contain any other conditions of

any sort will be liable to rejection. No printed form of tender shall include a

tender for more than one work.

5. The Commissioner or his duly authorized assistant shall open tenders in the

presence of the PMC who have submitted their tender or their representatives

who may be present at the time. In the event of a tender being accepted, the

PMC shall, for the purpose of identification, sign copies of the specifications and

other documents. In the event of tender being rejected, the Commissioner shall

authorize to refund the amount of earnest money deposited to the PMC making

the tender, on his giving a receipt for the return of the money.

6. The Officer competent to dispose off the tenders shall have the right of rejecting

all or any of the tenders.

7. No receipt for any payment alleged to have been made by a Contractor in regard

to any matter relating to this tender or the contract shall be valid and binding on

the Ahmednagar Municipal Corporation, Ahmednagar Unless it signed by the

Commissioner.

8. All works shall be measured net by standard measure and according to the rules

and customs of the Ahmednagar Municipal Corporation, Ahmednagar and

without reference to any local custom.

9. Under no circumstances shall any Contractor be entitled to claim enhanced rates

for items in this contract.

10. Every registered PMC should produce along with the tender, Certificate of

Registration as approved PMC in the appropriate class and renewal of such

registration with date of expiry.

11. All corrections and additions or pasted slips should be initialed.

12. The measurements of work will be taken according to the usual methods in use

in the Ahmednagar Municipal Corporation, and no proposals to adopt alternative

methods will be accepted. The Commissioner’s decision as to what is “the usual

method in use in the appointed agency / Ahmednagar Municipal Corporation “

will be final.

13. A tendering PMC shall furnish a declaration along with a tender showing all

works for which he has already entered into contract and the value of the work

that remains to be executed in each case on the date of submitting the tender.

14. Every PMC shall furnish along with the tender, information regarding the

Income Tax Circle or Ward of the District in which he is assessed to income tax,

the reference to the number of the assessment and the assessment year, and a

valid Income Tax Clearance Certificate.

15. In view of the difficult position regarding the availability of foreign exchange, no

foreign exchange would be released by the Ahmednagar Municipal Corporation

for the purchase of plant and machinery required for the execution of the work

contracted for (GCM/PWD/CFM/1058/62517 OF Dt. 26.05.1959).

16. The Consultant will have to provide full pledge office with experience Staff and

other office bearers at the place suggest by Ahmednagar Municipal Corporation.

17. The PMCs shall also give a list of machinery in their possession which they

propose to use on the work.

18. Every PMC shall furnish along with the tender a statement showing previous

experience and technical staff employed by him.

19. Successful tenderer will have to produce to the satisfaction of the accepting

authority a valid and current license issued in his favour under the provisions of

Contract Labour (Regulation and Abolition) Act 1973 before starting work failing

which acceptance of the tender will be liable for withdrawal and earnest money

will be forfeited to the Ahmednagar Municipal Corporation.

20. The PMC shall comply with the provisions of Apprentices Act, 1961 and the

rules and order issued thereunder from time to time. If he fails to do so, his

failure will be breach of the contract and the Commissioner, may, in his discretion

cancel the contract. The PMC shall also be liable for any pecuniary liability arising

on account of any violation by him of the provisions of the Act.

21. Keeping in mind the nature of work if any accident occurs during the work and

at the time some injuries have taken place then the PMC will be resposible for

further legal action regarding accident.

Specifications The agency shall provide Technical Services and Project Management

Consultancy Services for execution of this project as per terms and conditions

incorporated herewith.

A) AHMEDNAGAR MUNICIPAL CORPORATION HEREBY AGREES TO

1. The AMC shall access the properties / rights of ways / easement required for

carrying out necessary survey during actual project construction.

2. AMC shall take all responsibilities of acquiring lands / accesses to the lands

required for the project.

3. AMC shall be responsible to obtain the permission for laying pipeline across /

along roads / Railway. From the concern authorities as and where required and

without delay during the actual project work.

4. Pay the fees as per breakup given below to appointed agency for Technical

Service Provider and Project Management Consultancy Work as per Schedule

given below.

The project completion cost is not known initially and hence the above breakup

of payment shall be with reference to cost of project.

1. The PMC charges will be paid only against the proportionate executed work.

2. Arrange power supply, water supply wherever required for execution/

arrangement of PMC Office.

3. Arrange for testing of materials as per accepted tender and get it scrutinized

from appointed agency.

4. The Consultant will have to provide centralized full pledge office with

experienced Engineer’s and other office bearers at the place suggested by

Ahmednagar Municipal Corporation.

5. Pay the interim payment to appointed Contractor within 15 days after submission

of demand bills by appointed Contractor.

6. Communicate the instructions given by AMC Engineers on site, to the concerned

Contractor & abide by them

7. AMC will carry out routine maintenance of the project work after its completion

of defect liability period.

B) APPOINTED AGENCY’S (P.M.C.) WORK

1. After Work Order invisilate and inspect the site with Electric Dept., Ahmednagar

Municipal Corporation.

2. Make basic survey as required for detail estimate.

3. Collect all necessary data as required.

4. Take necessary test from Govt. agency as before estimate.

5. Make detailed drawing, L-Section, Central line, table survey drawing for

ancrochment in 5 sets of hard and soft copy).

6. Make detailed design and get it checked from third party (Any Govt. Organisation)

& also take GAD approval from aprovate authority.

7 After successful technical scrutiny & GAD Approval make detiled estimate

including all necessary.

6. After making detailed estimate with including all necessary items as required,

estimate should be checked technically by HOD, Electric Dept. / City Engineer ,

P.W.D. Ahmednagar Municipal Corporation.

7. After successful administrative approval make arrangements for Schedule 'B', B-1

tender form with hard and soft copy and make arrangements for detailed tender

notice with City Engineer, Ahmednagar Municipal Corporation.

8. Make all arrangements of administrative approval Government Office. Make

necessary documentation with City Engineer, Ahmednagar Municipal

Corporation for forwarding and approval.

9. Make arrangements for prebid meeting with Contractor.

10. After opening tender make necessary technical negotiation and consult AMC for

negotiation.

11. After Work Order of successful Contractor take necessary bar chart before work

order and consult for AMC for all work.

12. Checkout the detailed surveys of the project with necessary documentation get

approved from Govt. Technical Organisation.

13. The appointed agency shall supervise the tendered work during the entire period

of its execution untill completion and commissioning.

me found correct & work is as per specification hence proposed for this Bill " .

a. This shall include check line out of the work as per approved plans & design.

b. Inspect the foundation strata of the structure & decide the safe bearing

capacity.

c. Supervision of excavation, Lowering, Laying & Jointing of Pipes during

execution as per standard practice.

d. Inspection of works. The inspection should be organised by the agency at

their cost and also the agency has to submit the third party inspection report

from the Contractor. Third party inspection will be done in presence of PMC,

AMC, Contractor & Govt. Agency.

e. Inspect various test required to be done at the cost of executing agency as

per PWD specification & PMC should states their opinion on test report &

rectify the defects regarding specification.

f. PMC should have his own instrument for survey, testing & measurement with

recently calibrated & PMC should submit all his instruments with its

calibration report.

g. PMC should take all required design and certify from Govt. Organisation

before execution of work.

14. Certify the bills submitted by the contractors with respect to works carried out

and submit it to AMC with duly signed & remark in proper manner for further

action.

15. The appointed agency shall guide AMC in case of any claims of Contractors.

16. Arrange monthly progress meeting with technical officer of AMC, contractor and

submit monthly physical & financial progress report to the AMC.

17. Preparation & submission of revised scheme if required as needed by Govt.

18. If required take permission of Railway, P.W.D., Defence authority or any other

Offices on behalf of A.M.C.

19. Preparing various proposals like land acquisition, excess quantity, progress

reports and any other information required time to time for A.M.C., Govt.

meeting.

20. During day to day supervision taking actual measurements of on going works

time to time recording & preparing bills.

21. Preparing various registers like test of material, Issue, Consumption of material

issued by A.M.C. or supplied by Agency as per PWD manual.

22. The A.M.C. shall help in accessing document/payment required for the

permission of Railway, P.W.D., M.S.E.B etc. various department. The follow up

should be of P.M.C.

23. P.M.C. should submit physical as well as financial progress report to A.M.C. and

Govt. also.

24. PMC should represent AMC to the Govt. and various authorities whenever

required.

C ) CONCILIATOR & DISPUTE RESOLUTIONS

1. During execution instructions given by appointed agency shall be binding to

Contractors.

2. AMC will abide for carrying out various works as per technical circulars.

3. Technical deviations, if any shall be carried out by mutual consent of Appointed

Agency & AMC with prior approval from competent authority.

4. If there is a need for conciliation or dispute resolution in relation to this

agreement or in case of any force major issues, or suspension of works due

reason beyond anybody’s control. AMC & PMC may approach the Arbitrator or

Secretary, Nagar Vikas Vibhag Mumbai Govt. of Maharashtra. The opinion of

Commissioner, Ahmednagar Municipal Corporation in this regard will be final.

5. If at all the PMC goes in the Court, in the interest of work, AMC reserves the right

for the process of getting work done from another PMC will be in continuation.

6. PMC should be present at the time of Govt. Officials visit.

7. The Engineer-in-charge of PMC will be responsible for the progress and quality of

work.

8. P.M.C. must handle Court Cases related to work.

25. Prepare drawing get approved from appropriate authority.

26. Make total stator line out to contractor.

27. Make supervision by a technical persons whenever work is going on.

28. Take measure & record in MB as per norms after satisfaction 100%

make available to HOD, Electric dept. and City Engineer, AMC with Bill.

G U A R A N T E E B O N D

This deed of Guarantee is made for Name of Work : -----------------------------------------------

----------on the ___________ by having his head office at Ahmednagar from the demand

under the terms and conditions of Agreement dated _____________ made between

Commissioner, Ahmednagar Municipal Corporation, Ahmednagar and for of additional

security deposit for the due fulfillment by the said Contractors of the terms and

conditions contained in the said Agreement on production of a Bank Guarantee for Rs.

at the request of do hereby undertake to pay to the Ahmednagar Municipal Corporation

hereinafter referred to as AMC, an amount no exceeding Rs. /-against any loss or

damage caused to or suffered by the suffered by the AMC by reasons of any breach by

the said Contractor of any of the terms and conditions contained in the said Agreement.

We, do hereby undertake to pay the amount due and payable under this guarantee

without any demur, merely on a demand from the AMC stating that the amount claimed

is due by way of loss or damage caused to or would be caused to or suffered by the

AMC by reason of breach by the said Contractor(s) of any of the terms and conditions

contained in the said Agreement or any reason of the Contract(s) failure to perform the

said agreement. Any such demand made on the bank shall be conclusive as regards the

amount due and payable under this guarantee shall be restricted to an amount not

exceeding Rs.

We undertake to pay the AMC any money so demanded notwithstanding any dispute or

dispute raised by the Contractor(s) / Supplier(s) in any suit or proceeding pending

before any court or tribunal relating thereto our liability under this present being

absolute and unequivocal. The payment so made by use this bond shall be availed

discharge or our liability for payment thereunder and the Contractor(s) / Supplier(s)

shall have no claim against us for making such payment.

We,______________ further agree that the guarantee herein contained shall remain in

full force and effect during the period that would be taken for the performance of the

said Agreement and that it shall continue to be forcible till all the dues of the AMC

under or by virtue of the said Agreement have been fully paid and its claims satisfied or

discharged or till 2011 of AMC certifies that terms and conditions of the said

agreement have been fully and properly carried out by the said Contractor(s) and

accordingly discharges this guarantee. Unless a demand or claim under this guarantee is

made on us in writing on or before the / /2011. We shall be discharged from all

liability under this guarantee hereafter.

We further agree with the AMC that the AMC shall have the fullest liberty without or

our consent and without affecting in any manner our obligations hereunder to vary any

of the terms and conditions of the said Agreement or to extend time of performance by

the said Contractor from time to time or postpone for any time or from time to time any

of the powers exercisable by the AMC against the said Contractor(s) and to forth or

enforce any of the terms and conditions relating to the said Agreement, and we shall

not be relieved from our liability by reason of any such variation, or extension being

granted to the said Contractor(s) or for any forbearance, act or commission on the part

of the AMC or any indulgence by the AMC to the said Contractor(s) and to forth and

enforce any of the terms and conditions, relating to the said Agreement, and we shall

not be relieved from our liability by reason of any such variation, or extension being

granted to the said Contractor(s) or for any forbearance, act or commission on the part

of the AMC or any indulgence by the AMC to the said Contractor or by any such matter

or thing whatever which under the law relating to surety would, but for this provision,

have effect of so relieving us.

The guarantee will not be discharged due to the change in the constitution of the Bank

or the change in constitution of the Contractor / Suppliers.
