    INSTITUTES,ONMARCH5TH,2011, WITH A POLLUTED MINDSET AND UNDER THE INFLUENCE

    OF SOME RIVAL ELEMENTS ,TO DEFAME A REPUTED INSTITUTION AND ITS MEMBERS COMMITTED

    FOR THE BETTERMENT OF EDUCATIONAL ENVIRONMENT AT LARGE.

    2. THAT LEGAL PROVISION ILLUSTRATE Defamation as a false and unprivileged statement

    of fact that is harmful to someone's reputation, and published "with fault," meaning as a

    result of negligence or malice. Libel is a written defamation; slander is a spoken

    defamation. The elements that must be proved to establish defamation are:-a

    publication to one other than the person defamed; a false statement of fact, which is

    understood as. being of and concerning the plaintiff; and tending to harm the

    reputation of plaintiff. And accordingly,you(Ankit agarwal) are liable to be prosecuted

    under the criminal law.

    3. That Internet provides us with a very cheap and a quick way of communication. It

    has made the world a close knit organisation. Also, with the growth of social

    networking sites like orkut, facebook, etc., lot of personal information is shared amongst

    many people therefore, the chances of defamation through internet has become a major

    threat in todays world. Even if a single defamatory email is forwarded, it becomes very

    difficult to trace and stop its circulation. Any article published on a website is open for

    the entire world to read. The damage or losses caused to the victim is very huge

    especially if the imputation is intended to harm the business of an individual or a

    business entity. As per the provisions of cyber crime act 2000, your act of baseless

    allegation has ruined an institution and severely affected the life of a respectable citizen

    Therefore you are guilty of committing criminal offence and deserve appropriate

    punishment.

    4. That Information Technology Act deals with the various cyber crimes in chapters IX

    & XI under sections. 43/65/66/67 making a provision of imprisonment and monetary

    penalty. Section 67 deals with publication of obscene/false material and provides for

    imprisonment up to a term of 10 years and also with fine up to Rs. 20 lakhs. The white

    lie made by you (Ankit aggrawal) naturally demands the application of penalty under

    various sections of this act.

    5. That Section 499 of IPC reads as under:whoever, by words either spoken or intended

    to be read, or by signs or by visible representations, makes or publishes any imputation

    concerning any person intending to harm, or knowing or having reason to believe that

    such imputation will harm, the reputation of such person, is said, except in the cases

    hereinafter excepted, to defame that person. According to section 500 of IPC

    punishment for Defamation shall be simple imprisonment up to 2 years or fine or

    both. IT Act replaces the words intending that the document forged, with the words

    intending that the document or electronic record forged in section 469 of the Indian

    Penal Code. The offence under this section is cognizable, bailable and triable by a

    Magistrate of the first class. You(Ankit agrawal) have committed crime under

    abovementioned section through his use of unconstitutional language in a public

    domain, the evidence of which will be submitted in the court of law.

    6. That through your baseless character assassination and malicious campaign he has

    generated a heavy financial loss to a law abiding private limited company as well as

    mental trauma to a sensitive and reputed teacher of this organisation .therefore you are

    liable to be prosecuted under both criminal and civil law.

    In the circumstances we call upon/advice you to kindly pay the damage amount of Rs.TEN

    LAKH (Rs.1000000) for financial-social-personal-professional loss incurred to the institution

    and individual, failing which we have definite instruction from our client to proceed against

    you in court of law and in that event you shall be liable for the cost and consequences

    resulting there from.

    You are also liable to pay a sum of rupees 110000 toward charges to present this notice.
