SummaryThe report below details the history of the solid waste rate increase discussion, the efforts of the Phoenix Public Works Department Solid Waste Management Program (Public Works) to engage the public in a dialogue on the future of solid waste disposal, recycling, and diversion in Phoenix, and the recommendation to adopt Option One($6.40 - maintaining current service levels) as the recommended rate increase option.

Public Works assists in providing a safe and aesthetically acceptable environment through effective, integrated management of the community's solid waste stream, including collection, disposal, source reduction and recycling activities. Public Works provides solid waste collection services to approximately 400,000 residential customers. Last year, Public Works collected and processed over one million tons of material at two City-owned transfer stations and material recovery facilities. The City also owns and operates the State Route 85 Landfill in Buckeye, Ariz.

Public Works, in conjunction with the Finance Department, developed a solid waste financial plan to determine the revenue requirements that support the operating budget, capital infrastructure, vehicle replacement, and debt service requirement for the solid waste utility. On May 1, 2019, with the concurrence of the City Manager-appointed Solid Waste Rate Advisory Committee, City Council authorized Public Works to enter into a contract with an independent consultant, NewGen Strategies and Solutions (NewGen), to conduct a comprehensive solid waste cost of service and rate design study. The revenue requirement and rate recommendation of the independent consultant were incorporated into the solid waste financial plan.

On Oct. 22, 2019, the Solid Waste Rate Advisory Committee approved recommendingfour rate options to the City Manager for consideration by the City Council. Each of therate options includes recommended capital and operating program reductions andefficiencies. The rate options also included additional revenue by increasing thedisposal fee for customers at the transfer stations and landfill, implementing acommercial hauler fee, and amending current recycling agreements.

Since that time, Public Works initiated discussions with private waste haulers thatprovide solid waste collection services in Phoenix regarding the potential ofimplementing a new commercial hauler permit program designed to cover a portion ofthe costs associated with providing citywide code enforcement and community clean-up events. Many other Valley cities currently assess a commercial hauler fee as part oftheir solid waste programs. These discussions with the private waste haulers havehighlighted unique challenges of program administration and equity that require furtherevaluation. Public Works will continue discussions with these private haulers towardsolutions to design a system that can be properly and equitably administered andreturn to Council at a future date with a recommendation.

At this time, Public Works is not recommending moving forward with inclusion of acommercial hauler fee as part of the additional revenues to be collected by PublicWorks.

A report on solid waste service levels and an update on the revenue requirement andrate options was presented to City Council at the Nov. 12, 2019 Policy Session(Attachment A). As required by Arizona Revised Statutes, section 9-499.15, theNotice of Intent to consider an increase in solid waste rates was posted on Nov. 22,2019. City Council directed Public Works to perform community outreach discussingthe rate options, and requested information regarding recycling costs, citybenchmarking, alley closure potential savings, impacts to the rate by dividing theincrease over two years, managed competition, and potential positions for eliminationif the revenue requirement is not met. A series of reports have been provided to CityCouncil responding to these information requests (Attachments B-D).

Maintaining the current monthly rate of $26.80 would require $36.5 million in servicecuts, which include a shift to every other week recycling, elimination of bulk trash andhousehold hazardous waste events, closing the compost facility and one of the City'srecycling facilities, removal of eco-stations, and elimination of approximately 135 staffpositions.

to the rate each year through 2026 to align with annual inflation impacts.

Option OneMaintain current service levels and increase the solid waste residential rate to $33.20,an increase of $6.40 per month.

Option TwoSuspend the City's compost program by eliminating curbside green organics collectionand terminating operations of the compost facility for all customers. This option wouldincrease the solid waste residential rate to $32.45, an increase of $5.65 per month.This would result in elimination of 16 positions.

Option ThreeAdjust the collection frequency of recycle containers to every other week, which moreclosely aligns with service demand. This option reduces the staff and equipmentrequired for collection, reduces emissions and vehicle miles traveled, and maintainsfull access to recycling and composting for all participating customers. An approvedvariance plan from the State of Arizona with concurrence from Maricopa County isrequired to implement this change. This option would increase the solid wasteresidential rate to $32.30, an increase of $5.50 per month. This would result inelimination of 16 positions.

Option FourSuspend the City's recycle program and suspend the City's compost program byeliminating curbside green organics collection and terminating operations of thecompost facility for all customers. All refuse will be collected as trash and sent to thelandfill for disposal. This option would increase the solid waste residential rate to$31.55, an increase of $4.75 per month. This option would result in elimination of 26positions.

Community OutreachPer City Council direction, Public Works engaged the community to receive feedbackand suggestions on the proposed rate increase and options.

Public Works published solid waste service levels and rate options information in thecity services bill, created an extensive website, and engaged with residents via socialmedia outreach. The information was also included in City Council newsletters. Thewebsite opened on Nov. 22, 2019 and in 75 days, it generated 11,092 visits frominterested individuals. Visitors to the website reviewed the Frequently Asked Questionssection 5,377 times, with the top viewed FAQ being:

1. What about recycling? Will Phoenix keep recycling?2. Why is Public Works asking for a rate increase?3. What is recyclable in Phoenix?4. What about composting? Will it go away?5. Is the recycling revenue Phoenix generates yearly decreasing?

There were 126 emailed comments sent to Public Works and 51 phone calls, with themajority supporting a rate increase and the recycling program. Those in oppositionstated they were on fixed incomes and would prefer a program where they paid alower rate for throwing away less garbage and recycling less.

Additionally, Public Works hosted 13 community meetings spread across every councildistrict, participated in 25 neighborhood association, block watch, community, andbusiness meetings, and met with customers at the transfer stations, householdhazardous waste events and other city events, to obtain feedback. Approximately 170people attended the 13 community meetings and 86 comments were recorded andapproximately 360 attendees were at the other, non-Public Works-hosted meetings.The majority of comments were in support of maintaining existing solid waste servicesand expressed willingness to pay the increased fee. Many attendees asked questionsto gain a better understanding of the City's solid waste services and expressedappreciation for those services. Individuals in opposition to any rate increases statedthey should pay a lower rate if they threw away less garbage and recycled less.

Public Works also collected feedback via a resident survey. The survey was madeaccessible to residents via the Public Works's department website, through multiplesocial media accounts, and a traditional paper survey made available at all publicmeetings. More than 5,800 Phoenix residents have provided survey responses withthe following results (Attachment E):

· Nine out of 10 residents say they are satisfied or very satisfied with solid wasteservices provided. Trash collection, recycle collection and the bulk trash collectionprogram are the most important services.

· Nine out of 10 residents say it is important to divert waste from the landfill.

· Six out of 10 residents prefer Option 1 - maintain current service levels at a $6.40per month increase.

· Six out of 10 residents prefer to split the rate increase over two years.

RecommendationThe proposed solid waste rate changes for residential customers will be an increase of$3.75 monthly effective the first bill-day of April 2020 ($30.55), followed by an

additional increase of $3.25 effective the first bill-day of January 2021 ($33.80), with atwo percent inflation factor annually, effective the first bill-day of January 2022 through2026. Additionally, customers requesting an additional 90-gallon refuse container willpay half the applicable residential rate and customers requesting an additional 300-gallon refuse container will pay three times the applicable residential rate, andcustomers requesting an individual 60-gallon (in lieu of a 90-gallon) refuse containerwill pay $3.00 less than the applicable residential rate each month.

With these rate changes, all existing services can be maintained, which reflects thepreferences expressed through the public feedback process.

The proposed rate change for solid waste disposal facility customers will be anincrease of $3.75 per ton ($42.00) effective April 1, 2020, followed by an additionalincrease of $2.00 per ton ($44.00) on July 1, 2021 and an increase of an additional$1.00 per ton ($45.00) effective July 1, 2023.

Solid Waste Service Level and Rate Update

This report provides the City Council with an update on the Public Works DepartmentSolid Waste Management Program and presents options for solid waste service levelsand rates.

THIS ITEM IS FOR INFORMATION AND DISCUSSION.

SummaryThe Public Works Department Solid Waste Management Program assists in providinga safe and aesthetically acceptable environment through effective, integratedmanagement of the community's solid waste stream, including collection, disposal,source reduction and recycling activities. The Department provides solid wastecollection service to approximately 400,000 residential customers. Last year, theDepartment collected and processed more than 1.1 million tons of material at two City-owned transfer stations and Materials Recovery Facilities (MRFs). The City also ownsand operates the State Route 85 Landfill in Buckeye, Ariz.

Phoenix is experiencing substantial population growth. Based on growth and newaccount trends, the Department forecasts 3,550 new Solid Waste customer accountswill be opened this Fiscal Year and anticipates this growth to continue in Fiscal Year2020-21. The local economy is also strong, resulting in larger volumes of garbagethrown away per household. Services provided include: weekly residential curbsidetrash and recycling collection; quarterly bulk trash collection; processing recyclablematerials; managing solid waste materials; and nine annual household hazardouswaste events across the City. These services are provided to ensure the health andsafety of Phoenix residents; to protect the environment and preserve naturalresources; and to divert solid waste from the landfill. In 2013, City Council initiated theReimagine Phoenix Initiative, setting a waste diversion goal of 40 percent by 2020. InApril 2016, City Council adopted a goal to achieve Zero Waste by 2050.

Revenues for the Solid Waste Program are generated by monthly fees charged forresidential household service, disposal fees charged at the transfer stations andlandfill, and the sale of recycled materials. For the past 10 years, the current monthlyresidential solid waste rate has remained unchanged at $26.80 per month, per

household. The transfer station disposal fee has also remained unchanged for the past10 years at $38.25 per ton. The residential rate and the transfer station and landfilldisposal fees are currently published in Chapter 27 of the Phoenix City Code andrequire City Council approval to amend.

Since the last rate increase, the Solid Waste Management Program has withstoodvarious economic pressures. Inflation has averaged 2.5 percent each year. The solidwaste utility is also experiencing rising fleet maintenance costs and vehiclebreakdowns resulting from an aging fleet, as the utility has been unable to adequatelyfund replacement trucks. As recycling markets have responded to international policychanges enacted in 2017, recycling revenues have decreased. For example, revenuefrom the sale of recyclables in Fiscal Year 2017-18 was $8.9 million. This Fiscal Year,the forecast is $3.3 million, a reduction of $5.6 million in annual revenue.

DiscussionOn June 11, 2018, the City Manager appointed a Solid Waste Rate AdvisoryCommittee consisting of business, industry and non-profit representatives andcommunity leaders to review revenues, expenses and the utility rate forecast processand make recommendations regarding solid waste rates. On May 1, 2019, with theconcurrence of the Solid Waste Rate Advisory Committee, City Council authorized thePublic Works Department to enter into a contract with NewGen Strategies andSolutions (NewGen) to conduct a comprehensive solid waste cost of service and ratedesign study, including: Cost of Service and Rate Design Study; BenchmarkingAnalysis; and Recycling Market Analysis. NewGen's report, includingrecommendations to systematically address the City's primary solid waste user feemechanisms, was presented to the Solid Waste Rate Advisory Committee in October2019.

On Oct. 22, 2019, the Solid Waste Rate Advisory Committee approved recommendingthe four solid waste rate options outlined below to the City Manager for considerationby the City Council. Each of the rate options includes recommended capital andoperating program reductions and efficiencies. The rate options also include additionalrevenue by increasing the disposal fee for customers at the transfer stations andlandfill, amending current recycle agreements, and implementing a new commercialhauler permit program, similar to programs in most other Valley cities. Response to Council Members' Requests from Nov. 12, 2019 Policy Meeting

At the Nov. 12, 2019 City Council Policy meeting, Council members requested staff tofollow up on several questions regarding the presentation on Solid Waste Rateoptions. This report provides a response to a number of questions asked during themeeting. Staff continues to research answers to other questions asked by Councilmembers and will submit that information as it becomes available in the future.

SummaryThis report responds to four sets of questions asked by Council members during theCouncil Policy meeting.

1. During the Policy meeting, Councilman Sal DiCiccio requested information about theaverage replacement cycle for side-load collection vehicles for the department as wellas the cost of replacement for an automated side-load arm for a refuse or recycletruck.

Answer: To achieve a healthy replacement schedule, the Public Works Departmentrecommends a seven-year average replacement cycle for side-load collection vehiclesand a 10-year average replacement cycle for other solid waste vehicles. Current costschedules indicate the cost to replace an arm for an automated side-load refuse orrecycle truck the City currently uses is between $30,000 and $40,000.

2. While discussing the different rate options, Vice Mayor Betty Guardado,Councilwoman Laura Pastor, and Councilman Sal DiCiccio asked several questionsabout staff reductions that will occur given the recommended solid waste rate optionsproposed, as well as the staff reductions for the "no rate increase" scenario.

Answer: The numbers referenced below are based on the number of vacant positionsin the Public Works Department as of Nov. 26, 2019. As of this date, the Public WorksDepartment's Solid Waste program has a vacancy rate of seven percent or 42positions. A service reduction description as well as the required staff reductions isdescribed below for each option, along with the "no rate increase" scenario:

At the Nov. 12, 2019 City Council Policy meeting, Councilmembers requested staff tofollow up on several questions regarding the presentation on Solid Waste Rateoptions. This report provides a response to several of the requests made during themeeting. Staff continues to research answers to the other questions asked by Councilmembers and will submit that information as it becomes available.

SummaryThis report responds to two sets of questions asked by Councilmembers during theCouncil Policy meeting.

1. Councilwoman Laura Pastor and Councilman Sal DiCiccio requested informationabout the cost of the recycling program and the percentage of the monthly rate relatedto recycling.

Answer: According to the Cost of Service study completed by the solid waste rateconsultant, NewGen Strategies & Solutions, the total operating cost for recyclingservices provided by the City is approximately $32 million annually, which represents22 percent of the total cost of service or approximately $6 of the current rate of $26.80per household, monthly. Recycling operational costs include provision of containers,collection services, sorting of materials at the materials recovery facilities, and residenteducation.

In addition to operating expenses, the Capital Improvement Program (CIP) is acomponent of total expenses to be covered by the rate. The total 5-year CIP in theproposed forecast (CIP Option 1) is $81,484,010 including two recycling projectsfunded at $17,750,000, which represents 22 percent of the CIP. The two recyclingprojects are the 27th Avenue Material Recovery Facility Upgrade at $17 million andfuture upgrades at the North Gateway Transfer Station at $750,000.

Based on 22 percent of operating and capital expenses planned over the next fiveyears, recycling costs range from $1.23 for Option 1; $1.26 for Option 2; and $1.43 forOption 3 of the proposed rate increase options.

2. Councilman Sal DiCiccio requested information on the City of Chandler's SolidWaste rate and services as compared to the City of Phoenix's Solid Waste rate andservices.

Answer: On Nov. 26 and Dec. 4, 2019, City of Phoenix and City of Chandler staff metto discuss the City of Chandler's Solid Waste rates and services. Information fromthose meetings and a comparison to the City of Phoenix's Solid Waste rate andservices is summarized below and detailed in Attachment A. General comparativeinformation on the services provided and rates charged by the two municipalities waspublished in the City Council General Information packet on Dec. 5, 2019 as well.

ChandlerThe City of Chandler has a population of 252,500 residents, spans 65 square miles,and provides solid waste services to approximately 76,000 living units. Chandler’sannual operating budget for solid waste services is approximately $12.5 million andmaintains staffing levels for 22 regular full-time staff. All collection and disposalservices are outsourced to private haulers. The City of Chandler owns a RecyclingSolid Waste Collection Center (RSWCC) to provide disposal of refuse and recyclingmaterial for Chandler residents. The City budgets for replacement of light duty vehiclesonly, as the contractor is required to provide the necessary solid waste collectionvehicles to service Chandler customers for trash and recycling. Solid waste servicesare maintained using revenue generated from the monthly residential rate of $16.93.

Included in the monthly fee are the following services:· Weekly trash & recycling collection

The City budgets approximately $20 million annually forvehicle maintenance and repairs for all Solid Waste vehicles including light, mediumand heavy duty (collection) vehicles. The monthly residential rate is based on the sizeof the customer’s trash container: $26.80 per month for a 90/96-gallon container, or$23.80 per month for a 65-gallon container. Solid waste services are maintained usingrevenue generated by the monthly residential rate, disposal tipping fees, recyclingrevenue, land rental, building rental, late fees, and interest.

Nine events throughout the City each year.

Customers may schedule an appointment to drop off all acceptable Hazardous Waste at the Household Hazardous Waste Collection Facility. No commercial business waste accepted.

Construction and Demolition Debris Disposal

1. Vice Mayor Betty Guardado, Councilwoman Debra Stark and CouncilwomanLaura Pastor requested information about the potential savings that couldresult from removing contained and uncontained solid waste collection fromalleys and relocating service to the curb.

Answer: Alleys were originally intended as service drives for residences and as utilitycorridors. Many challenges have emerged over the years with regard to solid wastealley collection, such as illegal dumping, homeless encampments, private propertydamage, and increased resident and operator safety risks.

Currently, there are 876 miles of alleys in Phoenix, of which 671 miles are used forsolid waste collection. Of the 400,000 living units being served by the City of PhoenixPublic Works Department, approximately 80,000 (20 percent) receive collectionservice in an alley. Public Works staff evaluated the potential savings of relocatingalley collection services to the curb citywide, with the understanding that a smallportion of alley service would necessarily remain due to the configuration of thecommunity.

Five areas of potential savings were identified when evaluating relocation of alleyservice: operational efficiencies; alley maintenance; education and enforcement;property claims; and container cost and delivery. Based on detailed analysis, staffestimated savings based on a one-year implementation strategy.

evaluated as potential operational efficiencies. Alley containers on average contain459 additional pounds of garbage each year compared to curbside containers. Thisresults in additional hauling, maintenance and fuel costs to move the additionaltonnage. Relocating service from the alley to the curb would reduce tonnage percontainer and allow for balanced service of all residential accounts with an estimatedannual savings of $1.1 million. However, these savings do not take into account thepotential impact to other City departments in determining if relocation of solid wastecollection alley to the curb is a viable option in the best interests of the City.

Alley MaintenanceSolid Waste collection vehicles travel alleys on a weekly basis, which requires regularmaintenance of those alleys by the Street Transportation Department to keep themoperable and dust proof. Public Works currently pays $537,000 annually formaintenance of these alleys. With fewer Public Works vehicles using alleys, this costwould be reduced, with an estimated annual savings of $470,000. In addition to thecost savings, removal of service from the alleys will reduce the dust from trucks drivingthe alleys.

Education and EnforcementCurrently, Solid Waste Specialists provide education and enforcement in both servicedand non-serviced alleys. In FY 2018 - 19, alleys accounted for 32 percent of servicerequests for education and enforcement. Alley accounts were twice as likely to have aservice request compared to curbside accounts. Converting service to curbsidecollection likely will reduce the overall number of service requests, allowing for areduction in the number of specialists with an annual estimated potential savings of$216,000. Education and enforcement efforts will continue to help mitigate illegaldumping and maintain blight-free areas within Phoenix.

Property ClaimsOperational property damage claims are four and a half times more likely to occur inthe alley compared to the curb, and alley claims cost $196 more on average.Removing service from alleys will reduce operational property damage claims with anestimated annual savings of $56,000.

Container Cost and DeliveryRelocation of service from alley to curbside collection will require removal of 300-gallon alley containers and purchase and delivery of 90-gallon containers to impactedcustomers. The anticipated one-time cost to purchase and deliver new containers is$3.5 million. This is the largest cost associated with relocation of services. Beginning inthe second year there would be an ongoing annual savings of $333,000.

Other ConsiderationsIn addition to relocation of solid waste services from the alley to the curb, ongoingpublic health and safety should be taken into consideration. Residents frequentlyexpress concerns with illegal dumping, crime, and homeless encampments in alleys.While the Solid Waste Enterprise could achieve savings by relocating service from thealley, there is potential for a financial impact to General Fund departments includingbut not limited to Neighborhood Services, Street Transportation and Police.

Should the City proceed with the relocation of solid waste collection services from alleyto curbside, a one-year implementation strategy will provide the largest estimatedsavings over a five-year period with a return on investment projected in year two ofimplementation. This strategy would require an initiative to reroute the entire City formore efficient operations, as well as significant education and outreach. Additionally,considering the potential impact to other City departments, further evaluation isneeded to assess if relocation of solid waste collection from alley to the curb is a viableoption in the best interests of the City.

2. Councilman Sal DiCiccio requested information about the managedcompetition model for provision of residential solid waste services.

Answer: The City of Phoenix implemented the managed competition model in 1979 asa process with private industry to maintain effective and economical pricing for publicservices. The managed competition process, also referred to as public/privatecompetitive proposal process, allows both City departments and private businessesthe opportunity to compete in a public bid process to determine who can best provideservices to customers. This model has been commonly used in areas including: billingservices, street sweeping, landscape maintenance, ambulance services, refusecollections, street repairs, senior housing management, and landfill operations to namea few. The Public Works Department has used the managed competition process toensure that Phoenix residents receive the most cost effective and highest qualityresidential solid waste collection services.

The procurement process that has been used for solid waste collections requires theCity to submit an audited detailed bid simultaneously with private solid waste haulersto compete for residential collection services in one of the City's 10 Bid Areas (A-J) fora period of six years. Over the past 41 years, 14 bid processes have been conductedresulting in six areas being serviced by private companies and eight serviced by theCity. The most recent managed competition process was conducted in 2012 for Bid

Area F for the six-year term of June 1, 2013 through July 31, 2019. The Public Works Department serviced Bid Area F and had the lowest offer.

In 2013, the Mayor and City Council established a citywide goal to divert 40 percent ofsolid waste from the City's landfill by the year 2020 (40X20). On Jan. 7, 2014,following recommendations resulting from the Solid Waste Program Study conductedby SAIC Energy, Environment & Infrastructure LLC, Mayor and City Council approveda number of programs for implementation to support the 40X20 goal. To ensure thecompetitive bidding process would include the new proposed services, all programchanges needed to be implemented prior to re-initiating the managed competitionprocess. The City decided at that time to postpone the competitive bidding process forService Area G.

Traditionally, the managed competition process involves coordination with keystakeholder departments including Finance, Law, City Auditor's Office, HumanResources, and the operating departments. Should the City decide to proceed againwith managed competition, the Public Works Department recommends engaging anindependent consultant to manage the process. The overall process includingengaging an independent consultant is anticipated to take approximately two years tocomplete for solid waste collection services.

Staff researched surrounding local cities and discovered that no other Arizona cityconducts managed competition for solid waste/recyclable material containedcollections. The benchmarking results show that the majority of municipalitiesinsourced solid waste collection, and a few outsourced solid waste collections withouta public/private competitive process. Specifically, the cities of Glendale, Mesa, Peoria,Scottsdale, Surprise, Tempe and Tucson provide solid waste collections directly totheir customers. The City of Goodyear contracts out solid waste/recyclable materialcontained collection to a private hauler and provides bulk trash services directly to itscustomers. The City of Chandler contracts out all solid waste services.

Other ConsiderationsThe Public Works Solid Waste Enterprise currently has an unfunded pension liability of$106 million and contributes approximately $11 million annually to cover the pensioncosts of its employees. If solid waste collection were outsourced, there would continueto be an annual pension payment, unless the unfunded pension liability is paid off.
