West Coast Council write to Health Minister Michael Ferguson expressing our disappointment that a community forum similar to those held elsewhere in the state on the One Health System plan was not held on the West Coast, and that perhaps in future the West Coast community can be more widely consulted; especially on matters as important as health.

Background/Rationale to motion: The minister held Community Forums in Hobart, Launceston, Devonport and Burnie to discuss the ‘One Health System’. This was supported by a large advertising campaign encouraging Tasmanian’s to ‘go and have their say’. It is disappointing that regional Tasmania, including the West Coast, were not able to be consulted by way of community forum. Moved/Seconded

Planning General

Land Use Planning & Approvals Amendment Bill 2014 The amendments to the Land Use Planning & Approvals Act 1993 came into effect on the 1stJanuary 2015 with additional amendments being effective from 1/02/15. Changes enable a planning authority and third parties to enable and enforce compliance to a planning prescription, process and permit. Single Statewide Planning Scheme Process The second package is to provide framework for delivering a single statewide planning scheme outcome. This will be undertaken by the Taskforce in conjunction with the Local Government Association of Tasmania. There is a scheduled Taskforce meeting to be held later this month. Interim Planning Scheme The Tasmanian Planning Commission session from January outcome was that the commission have accepted the number of amendments made by Council on the recommendation of Council’s Planner. Next meeting is scheduled for the week commencing 9th February 2015. All issues above will be discussed with Councillors at the briefing session scheduled for 19th February 2015.

Building

Council issued four building permits for the month of January with included the building permit for the Strahan Primary School for the relocation of the library from the Parks and Wildlife building to the school.

Other three applications were minor residential development.

Building General

Tasmanian Building Regulatory Framework Review Council submitted the response to the latest Tasmanian Building Regulatory Framework response paper on 31st January 2015.

Correspondence Out Dear Miss Stacey, Re: Strahan Pool Request I refer to your recent letter to Council requesting a pool for Strahan. First of all let me apologise for the delay in writing to you. Council is currently undergoing a major review so that we can identify ways to continue to improve and thereby become more professional in what we deliver for the community of the West Coast. As a result of the review process I have not had sufficient time, following the Council meeting last month, to turn my mind to this letter. I must say I thought your arguments were very well thought out and you made a good case overall for the youth in your area regarding the potential for a pool in Strahan. Unfortunately, you must realise that Council (on behalf of the community) is continually weighing competing interests every year to determine where to allocate money and for this year’s budget no money was set aside for infrastructure of this type. You question in your letter whether it’s “Council’s money” and I can clarify for you that local government in Australia (Councils) exist to serve their communities. They are the ‘business arm’ if you like of the community and they deal with community funds raised through Rates, State and Federal Government allocations / funding grants applied for on behalf of the community etc. It is your money (the community) and Council is charged with budgeting and making decisions on how to spend that money to meet the needs of each of the communities of the West Coast. Sometimes that means choosing between projects that all have merit, but with limited funds cannot all be done. I like your suggestion for the private sector (Fish Farms) to potentially become involved in looking at further infrastructure for the Strahan community. Involving private sector in partnership with the Council (and therefore the community) is something I personally will be pushing in coming years. Once again, thank you for interest in local government processes. I commend you on your effort in writing to Council and suggest that you become involved in the community engagement processes that Council will be undertaking this year to formulate a new Strategic Plan for West Coast i.e. we will be running a series of engagement / consultation exercises to give the community of West Coast an opportunity to put forward ideas and suggestions for how we implement new projects and look to build a sustainable (and growing) economy in the West Coast over the next 10 years. Please take the opportunity to have your say during this process, as all suggestions will be considered by Council and budgets allocated according to priorities identified in coming years.

31/15 REPORTS - ORDINARY MEETING OF COUNCIL February 2015:

Title: Airlines of Tasmania – Par Avion (Waiver of Landing Fees) Reporting Officer: General Manager Date: 10 February 2015 File: Appendices: NIL

PURPOSE

1. To acknowledge that Council has a significant role to play in facilitating (directly and indirectly) economic development initiatives that will enhance the growth and prosperity of the West Coast.

2. To seek approval for a partnership approach with Airlines of Tasmania in relation to the commencement of a trial of new tourism related flights into Strahan Aerodrome.

BACKGROUND Airlines of Tasmania (the proponent) operates the Par Avion Wilderness Tours venture. The Proponent previously operated Regular Public Transport (RPT) to the West Coast in 2003, but withdrew the service due to limited traffic. The Proponent now believes the market has shifted and that significant demand could see regular flights resume and even grow over time. In order to test the market, the proponent is willing to invest significant funds to undertake a trial and is therefore requesting a partnership approach with the West Coast Council in the form of a waiver of landing fees to support the trial period. DETAILS Even with a waiver of landing fees by the Council (a nominal amount in comparison to other expenses), the proponent expects to operate at a loss for between 3 to 6 months. This operating loss is in addition to the start-up costs associated with the venture such as expenditure on licencing, equipment upgrades, training and even marketing. Based on capacity of the Aircraft to be used and the Proponent’s business planning the capacity to bring in between 3,500 and 7,000 people to the area exists presently and could potentially grow further, depending on demand. STATUTORY IMPLICATIONS Council is currently working with the Civil Aviation and Safety Authority (CASA) to ensure the new RPT proposal does not impact on Council in terms of triggering any further statutory obligations. STRATEGIC IMPLICATIONS Strategic Plan 2010 to 2015: Governance:

POLICY IMPLICATIONS Council has a published ‘Fees and Charges’ Policy that identifies the following in relation to relevant landing fees at the Aerodrome for the type of aircraft proposed to operate as part of the new RPT: Avgas Aircraft - $12.00 per tonne x Maximum Take Off Weight (MTOW) = 3.81 tonnes. Therefore the total cost per flight, in this case, would be $45.72 (including GST). Note: Council will be undertaking a Review of all existing Policies in 2015 and likely amending fees and charges marginally for the new financial year as part of the budget process. FINANCIAL IMPLICATIONS Exact figures are not possible given the trial nature of the proposed service at this time. However, as two flights weekly are planned to start with during the trial period, the waiver of landing fees as indicated would amount to a potential loss of revenue amounting to $91.44 per week (or $1,097.28 for the full waiver period of 12 months). It should be noted that without the new service starting up, this revenue would not exist anyway. RISK IMPLICATIONS Council has consulted with the Proponent and CASA regarding any security implications or other triggers that might impact on Council’s operation of the Aerodrome - should RPT flights resume as proposed. At the time of writing no adverse implications financial or otherwise have been identified. CONSULTATION PROCESS With CASA and the proponent – ongoing. COMMENT It should be noted that Council is currently reviewing the operations of both Aerodromes (Strahan and Queenstown). As part of that process rectification works at Strahan are currently being undertaken to address outstanding items identified in a recent CASA inspection (June 2014). Once these works are completed (being done as a priority) a copy of Council’s response to the

Inspection will be forwarded to CASA; and a copy supplied to Airlines of Tasmania to assist them in their dealings with CASA regarding the potential for RPT to resume at the facility as soon as possible. Moved/Seconded RECOMMENDATION That Council approve the waiver of landing fees at Strahan Aerodrome for 12 months for Airlines of Tasmania Pty Ltd, in relation to the proposed trial of Par Avion tourism flights into the facility (the 12 month waiver to commence on and from the first landing date of the new service in 2015).

Title: Use of Queenstown Aerodrome for Events Reporting Officer: General Manager Date: 11 February 2015 File: N/A Appendices: Nil

PURPOSE To determine whether Council will proceed to enter into a licence arrangement with Performance Driving Australia (PDA) “the Proponent” for the continued use of the Queenstown Aerodrome, in accordance with Council’s prior decisions, or whether a different arrangement is warranted and even necessary, based on advice now received in relation to the trial period conducted to date with this Proponent. BACKGROUND Council’s Interim General Manager met with a local resident in August 2014 for the purposes of discussing the possibility of utilising the Aerodrome for a one off motorsport event. Subsequent discussions led to a concept for a series of motorsport related events being conducted annually at the Aerodrome. The proponent, Mr Mark Butcher, trading as ‘Performance Driving Australia’ developed a concept to either conduct personally, or host motorsport related events to be held at the Aerodrome. A briefing was made at the Councillor Workshop held in October 2014 during which an outline of the Proponents professional background and the concept was delivered. The Proponent sought a licence, initially for a period of 24 months, to permit the activities. The Proponent agreed to assume responsibility for promotion, the development of a calendar of activities, together with the management and liability for conducting the activities. In return for access to the Aerodrome, the Proponent offered to conduct a number of complimentary training days to support continued road safety initiatives in partnership with the Council. No cash fee was proposed, given the uncertainty of latent demand. Council agreed at its Meeting on 21 October 2014 that:

1. “the Interim General Manager be authorised to negotiate the terms and conditions of a license for a period of 24 months to Mark Butcher, trading as Performance Driving Australia for the use of the Queenstown Aerodrome for the purposes of conducting motorsport events with the proposed license to be presented to the Council for final approval”; and

2. “authority be given for Mark Butcher, trading as Performance Driving Australia for the use of the Queenstown Aerodrome for the purposes of conducting motorsport events for the period prior to the License being executed, or for a period concluding in February 2015, whichever is the lesser, subject to terms and conditions considered necessary and acceptable to the Interim General Manager.”

Following some complaints from the community and subsequent investigations and letters of support from the community, Council again agreed at its Meeting on 15 December 2014 that:

The General Manager met with the proponent on multiple occasions and discussed implementing appropriate terms and conditions to support a professional approach to the use of the Aerodrome. Draft Terms and Conditions were ultimately compiled and presented to the Proponent for discussion and ratification. The Proponent subsequently briefed Councillors on the outcomes of the trial period to date and advised generally as follows:

The surface of the Aerodrome facility is not conducive to motorsport events i.e. the surface is hard on tyres and paintwork (loose stone movements) and it is possible that after extended use, the surface itself would likely suffer some damage,

The offer to undertake Driver Training for the community at a substantially reduced rate, and as part of the partnership approach with Council, is unlikely to draw significant numbers of participants (based on the interest shown to date being next to nil following the first event),

Based on the holding of the first event, it is clear that a large investment would be needed to undertake extensive marketing of future events to attract substantial local participation and external participation – thus making the coordination effort and business case for holding larger events difficult to justify,

The facility is better suited to aircraft events, but this would take some time to coordinate and would depend on the profile of the facility being lifted etc,

The facility is however suited to Remote Controlled Aircraft (RCA) activities and has proven popular for some locals and even visiting enthusiasts during the trial period.

DETAILS

1. The trail period was successful in identifying that proposed motorsport activities marketed and run by this Proponent are unlikely to bring in sufficient numbers to justify the efforts involved i.e. extending the parameters of activities authorised at the Aerodrome, to these types of uses under a licence arrangement, is unlikely to contribute significantly to the economic development of the Queenstown area and even the broader West Coast community at this time.

2. Increased usage of the facility (beyond the primary purpose of general incoming and outgoing flights) should not be discounted at this point based on one trial period with one proponent.

3. Opportunities for other uses (beyond motorsport events) should be explored further. Noting that as recently as one week ago Council was successful in hosting a major motor vehicle brand at the site to undertake a photo shoot for the launch of a new vehicle.

4. The opportunity for RCA flying has been identified and should be explored further – noting that personal use entry for such uses was never contemplated as part of the trail period, with the focus being squarely on “events” based activities.

5. The primary use for the Aerodrome should be maintained and not compromised in any way.

STATUTORY IMPLICATIONS The Council, as the owner of the Aerodrome, is able to authorise conditional access. The Aerodrome is unregistered and is used infrequently by general aircraft. Broadening the base of potential activities is not expected to have any statutory implications as long as Council manages and maintains the facility in accordance with safety and other general legislative requirements. RISK IMPLICATIONS All usage under the proposals will be directed through Council’s Facilities Application process, which includes a full Risk Management framework and approvals process. CONSULTATION PROCESS Consultation with members of the community and the proponent have been undertaken to date. Should the proposals be approved, further consultation with affected stakeholders will take place. COMMENT Expanding the potential uses for this facility while respecting and maintaining its primary purpose is the aim of the proposals. Council should continue to explore opportunities to facilitate economic development and promote events based activities that have the potential to lift the profile of the West Coast and entice further proponents (locally and externally) to see Queenstown as a vibrant centre with multiple venues available for holding events. RECOMMENDATIONS

1. That Council not proceed to enter into a license arrangement with Performance Driving Australia in accordance with previous Council decisions made on 21 October 2014 and again on 15 December 2014; and

2. That the General Manager be authorised to:

a. include the Queenstown Aerodrome as a “Facility” within Council’s Fees & Charges 2014/15 Policy document; and

b. set reasonable rates and charges for use of the facility (to be reviewed by Council as part of setting the budget for 2015/16); and

3. That the General Manager be authorised to include the Queenstown Aerodrome as a

facility for holding appropriate events and therefore subject to Council’s “Application for Use of Council Facility or Open Space” process – noting that specific terms and conditions (including that the venue is to be used for “events” only and not personal use) should be included to account for the unique nature of this venue.

Title: Queenstown Heritage and Arts Festival (Adjustment to

PURPOSE

1. To acknowledge the confusion surrounding the approved allocation of support for the 2014 Queenstown Heritage and Arts Festival and to adjust the financial support accordingly, to ameliorate the impact of that confusion.

2. To identify the need for a clearer and more sophisticated Policy regarding Gifts, Donations and Sponsorship provided by Council to a variety of Organisations and Individuals.

BACKGROUND Council committed to support the Queenstown Heritage and Arts Festival to the tune of $20,000 (in-kind and cash support) via a formal decision on 19 August 2014. A subsequent breakdown of the cost of Council activities in support of the event identified approximately $13,500 worth of in-kind expenditure, while the remainder ($6,500) was paid in cash to the organisers. Consequently, during discussions between the new General Manager and the organisers of the event it was made clear that the organisers understood the approved support would consist of around $5,000 in-kind support and the rest would be the cash component. Following that conversation, the General Manager reviewed the Council Minutes, discussed the process with the Mayor and other Councillors to confirm the impressions at the time the support was approved - that the in-kind portion would amount to around $5,000. The GM also investigated the accounts and discussed the matter with the acting Corporate and Community Services Manager. It is clear that a ‘loose’ approximation of in-kind support might have been discussed, but the actual in-kind support amounted to a great deal more. There appears to be genuine confusion over the issue, based on the fact that the original Council approval did not distinguish between the in-kind and cash components of the allocation and an accurate estimation was not made during discussions. DETAILS While it may be possible to absorb some of the misjudged in-kind support in this instance, due to the misunderstanding, simply absorbing all but $5,000 would be in contravention of the support formally adopted by Council at its 19 August meeting and would be at the expense of other services Council provides to, and on behalf of, the community i.e. additional money paid to the organisers must come from somewhere in the community budget.

The proposal involves bumping the cash payment up to $10,000 total, which would mean the organisers ultimately receive a total of $10,000 cash and $10,000 in-kind support for the recent event – on the understanding that for the next event the “full” cost for the in-kind portion is now generally known and can therefore be factored into discussions with Council in the future. FINANCIAL IMPLICATIONS The additional cost ($3,500) of in-kind services will need to be absorbed within Council’s operational budget – with the cash equivalent paid to the organisers. 1. absorb additional in-kind expenses associated with the support provided to the organisers of the Queenstown Heritage and Arts Festival; and as a result provide them with an additional $3,500 cash in support of the event; and

2. review and amend its Gifts and Donations Policy at the earliest opportunity to ensure that confusion is minimised and that Council is able to make support allocations fairly and within strict parameters to ensure consistency moving forward.

BACKGROUND As a consequence of staff turnover in recent times, West Coast does not currently have persons appointed to these important roles. DETAILS These roles play a critical role and assist Council in the event of a significant emergency situation. STATUTORY IMPLICATIONS Under Section 23(1) of the Emergency Management Act 2006 (the Act), the Minister is to appoint these roles for each municipal area on a nomination from Council. Under Section 23(4) of the Act each Coordinator holds their position “… for the period and on the terms and conditions specified in their instrument of appointment”. Under section 23(8) of the Act a council may only nominate a person for the position of Municipal Emergency Management Coordinator or Deputy Municipal Emergency Management Coordinator if the person, once appointed to the position, would have the authority and ability to make decisions relating to the coordination of emergency management in the municipal area during an emergency without first seeking the approval of the council.
