A F F I D A V I T

I, ELIZABETH A. MCWAY, of legal age, married, Filipino citizen and a resident of Putik, Zamboanga City, Philippines, after having been duly sworn to in accordance with law hereby depose and say that:

1. I am a registered Veterinarian with PRC License bearing No. 016789 duly issued by Professional Regulation Commission and have been practicing the profession for 18 years now;

2. I am the incumbent City Veterinarian of the Local Government of Zamboanga;

3. I am well-versed in diagnosing, administering immunizations for anti-rabies and biologics, treating, performing operation to any animal which is under the government veterinary service;

4. As a Veterinarian, I am only limited in prescribing non-regulated drugs for animals and/or pets as I am not a holder of S2 license ID and S2 license number ;

5. S2 License is solely issued to any authorized personnel who are acknowledged and allowed by law to prescribe dangerous drugs;

6. Under the Philippine law, the personnel who may be allowed to prescribe regulated drugs are as follows: physicians, veterinarians, and dentists, provided that they are duly registered and/or licensed by Philippine Drug Enforcement Agency and obtained an S2 license ID with S2 license number;

7. Further, the Dangerous Drugs Board issued a Board Regulation No. 3 on July 19, 2005, mandating the inclusion of ketamine in the Philippines #146; list of dangerous drugs, thus, it is now subjected to all regulatory and control measures provided under the Comprehensive Dangerous Drugs Act of 2002;

8. Furthermore, I vehemently deny that I issued prescription for a ketamine vials with 10mg/mL x 10 mL dosage which can be administered intramuscular (IM) or intravenous (IV) as I am not allowed to issue regulated drugs due to the limitations stated above.

9. I execute this affidavit to attest to the truth of the foregoing facts based on personal knowledge and authentic records in support to the resolution of the Criminal Case No. _____ entitled People of the Philippines vs. Ariel T. Huesca;
