Dear Member,

The publication of this year’s TFA Members’ Handbook falls under the shadow of the global Covid-19 pandemic and the measures put in place by the UK Government to control the spread of the virus. No sector of the economy, no walk of life and no part of society has escaped the impact of the measures that have been put in place and agriculture has not been immune.

Not only has the TFA been active in Whitehall and Cardiff, to ensure that the needs and requirements of the tenanted sector of agriculture were understood by Ministers and Officials throughout this period, we have been in individual discussions with members helping to manage the consequences of the restrictions within businesses and in relationships between landlords and tenants. It has been particularly important to ensure that members are being kept up to date with the rapid pace of new information. We have been pleased with the feedback from members who have found our weekly e-Bulletins invaluable in helping them navigate through the emerging difficulties and challenges.

In just the same way, as under normal circumstances, we have aimed through the time of crisis to provide helpful advice, timely information and important support. Although our programme of events through the remainder of this year has had to be cancelled, the TFA remains fully committed to meeting the needs and aspirations of our members. Within this handbook you will encounter the full range of services available to you as a member of the TFA. I would encourage you to make full use of your membership for the benefit of your farm business.

He then spent four years as Rural Economics Adviser to the Country Landowners Association before joining the Tenant Farmers Association as Chief Executive in January 1997.

He was appointed a member of the Properties Committee of the National Trust in 2001 and it’s Rural Enterprise Panel in 2004 and is now a Specialist Volunteer for agricultural and land use matters. He served as a Trustee of the Farming Community Network for seven years and as its Chairman for the last five of those years standing down at the end of 2015. He served as a member of DEFRA’s Future of Farming Group and is a continuing member of the Tenancy Reform Industry Group and the Welsh Government Strategic Partnership group for agriculture. He is a Fellow of the Royal Agricultural Societies, a Trustee of the Arthur Rank Centre and is active in his local church.

Lynette Steel graduated from Harper Adams University in 2009 after studying Rural Enterprise and Land Management. She then went on to work for Holstein UK for six years, immersing herself within the UK Dairy Industry. Lynette will be advising members on a range of topics, including Basic Payment Schemes, Environmental Stewardship and other agricultural schemes and grants and working on post Brexit agricultural policy issues in England and Wales.

Growing up on the family’s dairy farm in Cornwall, Lynette now farms alongside her husband on a tenanted arable holding in Hampshire. She has within the last few years, become an integral part of running the business, whilst overseeing the introduction of a commercial sheep enterprise and running of a HLS scheme.

Caroline Foot joined the TFA head office Team as an Adviser in January 2018. Having grown up on a tenanted farm in Cornwall, Caroline had always wanted to work in the agricultural sector. She graduated in 2011 after studying Rural Resource Management at Reading University, a course focussing on everything rural, agricultural and environmental. She then completed a postgraduate course in Rural Estate and Land Management at Harper Adams University in 2015. This focussed slightly more on the legal and technical aspects of the rural sector and allowed Caroline to qualify as a Chartered Surveyor. Caroline is now a fully qualified Rural Chartered Surveyor (MRICS) and Agricultural Valuer (FAAV). Before joining the TFA’s team, she worked in the rural advisory sector for Luscombe Maye, in South Devon and Stags in Launceston, Cornwall. Caroline works partly from home, in Cornwall, but visits the TFA’s Head Office regularly.

Adriana Vaux graduated from the Royal Agricultural University with a Royal Institution of Chartered Surveyors approved MSc in Rural Estate Management. She previously studied for a BSc (Hons) in International Equine and Agricultural Business Management at the university in 2009. In 2014, Adriana joined the TFA where she worked for four years as an assistant adviser whilst gaining her Membership of the Royal Institute of Chartered Surveyors qualification enabling her to become a Chartered Rural Surveyor and achieving Fellowship of the Association of Agricultural Valuers. Adriana worked away from the TFA for a year, as a trainee solicitor for the highly regarded law firm, Agri Advisor. She did this alongside studying law with the University of Law in Birmingham. Adriana returned to the TFA in 2019, in an adviser capacity, as well as carrying out TFA Plus work, acting on behalf of TFA members who wish to be represented. Adriana’s favourite areas to work within are landlord and tenant, equine and agricultural law. Adriana has spent her life in the countryside growing up in west Kent. For the last eleven years living in North Herefordshire with her family.

3.2 TFAPlus

In addition to the free advice, information and support enjoyed by all TFA members, through our TFAPlus service we can go further on your behalf. If you need someone to act on your behalf, on any tenancy related or other land occupation matter, through our TFAPlus service you could use one of the TFA’s head office team on a chargeable, not-for-profit basis. Using TFA Recommended Professionals may still be the best option for more detailed, complex or larger cases. For more straightforward issues, TFAPlus could be just what you need.

TFAPlus is ideal for situations where you feel out of your depth to act on the advice the TFA has provided, but you do not want to go to the full extent of engaging the services of a Recommended Professional. The issue could be about settling the terms of a consent for a non-agricultural use, finalising a rent review, appealing against a penalty imposed by the Rural Payments Agency or Rural Payments Wales, or assisting with putting together a planning application or planning objection.

TFA Advisers will be able to guide you on whether using TFAPlus would be the right course to take for your individual circumstances, or if, in fact, it would be better for you to use a TFA Recommended Professional (see section 3.4 below). TFA Advisers are also able to act under the terms of the TFA’s legal expenses insurance (see section 6). Our aim is to help you to resolve matters swiftly, efficiently and as cost effectively as possible. Ask for more details about how TFAPlus could work for you. 3.3 LegalHelpline(non-farmingandnon-tenancyissues)

Non-farming, business related legal matters (including employment disputes, contract issues and liability claims) or taxation issues, can be handled by our legal helpline that is provided for TFA members by Stephensons solicitors, through our affiliation with the Legal Protection Group (LPG). It is available 24 hours a day although, depending on the query, the helpline may need to arrange to call you back with a specialist adviser.

Members accessing the helpline need to say that they are members of the Tenant Farmers Association and quote policy reference LPGBTE016. The telephone number to use is 0344 840 6345.

3.4 RecommendedProfessionals

The TFA works with 61 professional chartered surveyors, solicitors and accountants who have been selected by the Regional Committees of the TFA for their expertise in dealing with landlord tenant and other land occupation matters. The selections are made following recommendations made by TFA members. More information about individuals can be found on page 51 of this handbook, within the Recommended Professional Directory or by contacting the TFA head office.

Each Recommended Professional has agreed to be bound by terms and conditions established by the TFA to ensure that TFA members are receiving the best possible service. The full terms and conditions appear on page 52 of

The regular dialogue is enhanced by holding two formal meetings each year with the Recommended Professionals: One held in each of the regions and one on a national basis, normally in London.

Many of our Recommended Professionals can act for members who have the benefit of the TFA’s legal expenses insurance through LPG. When doing so, the Recommended Professional will liaise with both LPG and TFA head office in the conduct of your claim. 4.1 MembershipPackOn joining the TFA, you are provided with a Membership Pack. The pack contains a full range of TFA literature, Guidance Notes, background information and details on the varied special offers available to members.

4.2 TFANews

TFA members receive six issues of the TFA News every year though the post. The main aim of these newsletters are to highlight important policy developments to members, provide up to-date information and raise awareness on a wide range of issues. TFA Cymru members also receive six issues of the TFA Cymru News. Printed in both Welsh and English, these newsletters aim to provide information on topical issues specific to Wales.

4.3 TFAWeeklye-Bulletins(e-Newsande-Bites)

Each week, the TFA distributes an email bulletin to members outlining recent activities, documents which have been published on the website over the previous week, forthcoming meetings and other items of interest. The format changes every other week, so you will receive a longer e-News one week where stories are more in depth and because we know your time is precious the following week you get a shorter e-Bites, which gives you more of a flavour of what the hot topics are while still allowing you to read more if you want via a web link.

4.6 RentDatabankComparable evidence of rent settlements is always hard to find. The TFA monitors rent trends and has collated, with the help of TFA members, a comprehensive and unique Rent Databank. The Rent Databank provides a valuable bench marking tool, allowing members to make a comparison to gauge if their rent is competitive with others. The TFA Rent Databank is accessible to all members on the TFA website and is fully searchable. For further information, please contact head office.

The Rent Databank is only as good as the information provided by members. Please ensure to let us know the outcome of all rent reviews, whether they end up with a change in the rent or a standstill. Information can be provided in hard copy with the forms issued with the regular TFA News, online through the Rent Databank page in the members’ area of the TFA website or by calling one of the Advisers at head office. All information is kept confidential and data is published anonymously.

4.7 BusinessOpportunities(IncludingTenancies)

The TFA has a dedicated area within the Members area of the TFA website, where it brings together information about available business opportunities throughout England and Wales. This database is usually updated on a weekly basis and includes tenancies, partnerships and grazing licences. The TFA harvests information from a wide range of sources including landlords and agents to create a unique, comprehensive list of opportunities for its members. Brief details are also included within the weekly e-Bulletins.

While the TFA cannot find you a farm, it can offer its members advice on writing tender documents and assist with interview preparation in order to maximise your chances of success.

4.11 MemberMeetings

From time to time the TFA will arrange to hold member meetings throughout the country which allow members to meet head office staff and to hear topical presentations from interesting speakers. They provide a forum for discussion and members can also raise individual concerns on a face-to-face basis. Dates, times and venues for member meetings for TFA and TFA Cymru are advertised to members in advance of them taking place and we aim to move them around England and Wales so that all members have the opportunity to attend.

Meetings and farm walks are run on a demand-led basis. If members would like to have a meeting in their local area to discuss topical issues, such as an issue on an estate, or something specific to your area, the TFA is happy to facilitate requests. If you would like a meeting to be arranged in your area please contact head office.

In 2020/21 the TFA plans to attend a variety of shows and technical events up and down the country. 5.0 SUPPORTINGYOUALLTHETIME

5.1 TFACymru

TFA Cymru is the respected voice of the tenanted sector of agriculture within Wales. TFA Cymru is fully engaged with

the Welsh Government across a wide range of policy areas. TFA Cymru is represented on many Welsh Government stakeholder groups and has regular meetings with Rural Payments Wales, Natural Resources Wales, Farming Connect and other Welsh stakeholders. Through the TFA’s Chief Executive, TFA Cymru has a seat on “Amaeth Cymru” the Welsh Government and industry partnership group for Welsh agriculture. TFA Cymru members have a dedicated newsletter in both English and Welsh and access to the full range of TFA member benefits.

5.2 LobbyingGovernment

The TFA keeps in regular contact with Government Ministers and Officials in Whitehall and Cardiff to ensure that the views of members are represented at the highest levels of Government. Our lobbying of the Government seeks to ensure that when policy decisions are made or changes in legislation proposed, the views of the tenanted sector of agriculture and those who do not own the land that they farm are known, understood and appreciated by the decision-makers. We respond to all relevant Government consultation documents and draft policy statements. Whilst most of our time is spent with DEFRA in England and the Environment, Energy & Rural Affairs Directorate of the Welsh Government, we are also involved with a host of other Government Departments including the Treasury on matters of Taxation, Business Enterprise and Industrial Strategy in relation to the functions of the Groceries Code Adjudicator and the Government’s wider Industrial Strategy and the Department for Housing Communities and Local Government on planning. Our lobbying of Government extends to all relevant statutory agencies including the Rural Payments Agency, Rural Payments Wales, the Environment Agency and Natural Resources Wales.

5.8 TenancyReformIndustryGroup(TRIG)

The TFA is an active member of the Tenancy Reform Industry Group (TRIG) which advises DEFRA and the Welsh Government on farm tenancy issues, both in relation to specific tenancy legislation and wider policy areas. As a result of the work of TRIG, DEFRA and the Welsh Government consulted on changes to farm tenancy legislation which are now progressing through Parliament in the Agriculture Bill. As well as the TFA, the membership of TRIG is made up of representatives from landowning, young farmers and professional bodies.

5.9 FBT10+

With the launch in 2015 of our FBT10+ campaign targeted at increasing average lengths of term on Farm Business Tenancies

to 10 years or more, we achieved significant coverage of the problems associated with short lengths of tenancy term and the reasons why we need to increase average lengths for farm business resilience, environmental and soil quality purposes. The Government has understood the need to encourage longer lengths of tenancy to ensure the prosperity and resilience of the tenanted sector of agriculture but, to date, we have seen little progress from Government in bringing forward any of the necessary legislative and taxation changes required. The TFA will continue the campaign to achieve more sustainable lengths of term on Farm Business Tenancies.

Parliamentary and Assembly questions relevant to the needs of TFA members. We meet with the opposition spokespeople from the non-Government parties to brief them on issues of concern. From time to time, the TFA also seeks to ask MPs and AMs to raise formal questions of Government Ministers. The TFA regularly contributes to Committee Inquiries of both the English Parliament and Welsh Assembly and is often asked to provide oral evidence on specific topics.

5.4 ContactwithLandlords

The TFA meets regularly with representatives of major rural landlords including the National Trust, Duchy of Cornwall, Duchy of Lancaster, Crown Estate, Church Commissioners, the Defence Estates and Local Authorities. We also engage regularly with the Country Land and Business Association which represents the interests’ of private landlords throughout the country. 5.5 ProfessionalBodies

The TFA has regular engagement with the bodies which represent the professionals that operate in the agricultural tenanted sector including the Central Association of Agricultural Valuers, the Royal Institution of Chartered Surveyors, the Association of Chief Estates Surveyors and Property Managers in the Public Sector (ACES) and the Agricultural Law Association.

5.6 OtherFarmingOrganisations

The TFA has close links with a host of other farming organisations both informally and formally through various stakeholder groups. In particular, the TFA works closely with the NFU and CLA as well as building alliances with environmental, consumer interest and animal welfare groups in the development of new policy frameworks.

5.7 Media

The TFA has extensive contacts in national, regional and industry media who are sent regular media briefings by the Association to keep them up to date with what is happening in our sector. Increasingly the TFA is becoming more involved in social media, web forums and blogs.

6.0 TFALEGALPROTECTIONINSURANCE

The TFA and Legal Protection Group (LPG) are working together to provide this unique insurance, which is available only to TFA members. The cost, including insurance premium tax, is £386.

With the cost of legal disputes continuing to escalate, this policy offers TFA members cover that will provide at least a significant contribution towards the costs involved in tenancy disputes, and other related disputes, up to a maximum level of indemnity of £50,000 in each case. In summary, the areas of cover available under the terms of the policy are as follows:

• Arbitration and Tribunal hearings on agricultural tenancy disputes (for example rent reviews, notices to quit and succession).

• HMRC tax, PAYE and VAT investigations protection.

• Employment disputes and compensation awards.

• Defence of legal rights.

1. Recommended Professionals appear on the TFA’s list in their personal capacity. The TFA recommendation does not apply to their firms or others within their firms unless they also appear on the list as individuals on their own account.

2. Recommended Professionals are not entitled to claim that they are authorised by the TFA to act for the TFA on its behalf.

3. When contacted by a TFA member for advice, Recommended Professionals will confirm that the individual is a member of the TFA and whether or not they are already represented.

4. Recommended Professionals will provide TFA members with initial advice by way of a telephone call (or if appropriate a meeting). Initial advice will be provided by the Recommended Professional on a free of charge basis except that reasonable travelling expenses may be charged to the member where the member requests a visit to his farm. The Recommended Professional should advise the member of the level of travel expenses that will be charged. Following the initial advice, the Recommended Professional should indicate the basis of the costs of being retained to act on the member’s behalf.

5. Subsequent fees and charges from work arising as a result of the initial advice should be explained to and agreed by the TFA member prior to instructions being given.

6. The outcome of any rent negotiations shall be reported to the TFA for inclusion in their Rent Databank by the Recommended Professional unless the TFA member specifically instructs otherwise.

7. The TFA cannot be held liable in any way for the advice provided by a Recommended Professional. Any liability relating to the advice will be borne by the Recommended Professional. All Recommended Professionals have confirmed that they are adequately covered by insurance in respect of their advice and actions.
