Getting out and about

Community transport groups are independent charities or voluntary organisations, working to support local people. Community transport is for those who may not be able to use public transport or do not have access to public transport. This may be people who can’t walk to a bus stop or may need assistance to travel or it could be someone living in a rural area where there are no buses.

North Salop Wheelers North Salop Wheelers operates a community transport project in the Wem to Whitchurch corridor. Residents, visitors and holidaymakers in the area can become members of the scheme. A London taxi cab and minibus are both available seven days a week for individuals, members and participating social clubs on a with-driver or self-drive basis. Occupying a convenient and picturesque position next to the Uplands at Oxon Care Home, the Day Resource Centre has been designed as a comfortable, safe and stimulating environment which is available for the use of all adults of mature years.

It can also provide day respite – often much needed and for less than the cost of four hours domiciliary care – for families and carers of clients.

The use of technology can also ensure that family members and carers have reassurance and peace of mind that their loved one will receive a quick response in the event of an emergency. Telehealth monitoring is the remote exchange of physiological data between a patient at home and medical staff at hospital to assist in diagnosis and monitoring. This could include support for people with lung function problems, diabetes, etc. It includes (amongst other things) a home unit to measure and monitor temperature, blood pressure and other vital signs for clinical review at a remote location (for example, a hospital site) using phone lines or wireless technology.

Examples of what telehealth can monitor remotely:

• blood glucose levels;

• cardiac arrhythmia; • asthma; and • medication reminder systems.

Telehealth

Case studyRose has dementia and at times her recall is very poor. Within the last year she has had to move home to an extra care facility because of issues with her neighbours. Rose agreed to have a bed occupancy sensor and property exit door sensor fitted to connect to her Lifeline. If Rose left her bed during the night and failed to return within 15 minutes the call centre would be alerted. The door sensor was active from 10.00pm to 7.00am and would raise an alert if Rose opened the door and did not return within five minutes. The solution has allowed Rose to remain safely at home, providing her with reassurance that help is always available should she become disorientated and avoiding the risk of her leaving the building alone at night. It has also prevented other residents being disturbed, and meant that Rose will not need to be moved to a scheme with 24 hour care for the time being.

Disabled Facilities Grant If you need adaptations to your house so that you can gain better access to and move around your home more freely or use the essential facilities within the home, you

Assistive technology is all about keeping people safe and independent in their own homes and can help a wide range of people; including people with dementia, mobility problems, learning difficulties or long-term conditions (such as COPD and diabetes). Examples include gas, smoke, extreme temperature and flood detectors, as well as simple lighting solutions and sophisticated systems which can control lots of different functions within the home from a single remote control unit. They can also monitor you for a specific health condition such as epilepsy, can raise an alarm should you fall, and outside of the home can be used to find you if you go missing. They can also let you request help should

you become disorientated when away from the home. Other devices can help to support communication including easy to use telephones and mobile phones while some can help act as prompts and reminders by providing visual and audible cues. These include clock calendars, medication reminders and memo minders.

If you have fallen in the past, discuss this with your GP and mention if it has had any impact on your health and wellbeing. Your GP can carry out simple balance tests to see if you are at an increased risk of falling in the future. They can also refer you to useful services in your local area. Regular exercise to improve your strength and balance can help reduce your risk of having a fall. This can range from simple activities such as walking and dancing to specialist training programmes. Tips for preventing falls in the home would include:

• not walking on slippery floors in socks or tights;

• not wearing loose-fitting, trailing clothes that might trip you up;

• wearing well-fitting shoes that are in good condition and support the ankle; and

• taking care of your feet by trimming toenails regularly, using moisturiser and seeing a GP or chiropodist about any foot problems.

Age UK Shropshire Telford and Wrekin run a number of befriending schemes which support volunteer befrienders to visit people’s homes providing friendship and a little bit of extra support for lonely and less mobile older people. The volunteers all have a criminal records check, provide two references and are supported by a dedicated co-ordinator in the Age UK office.

The Volunteer Visiting scheme This scheme is available in Telford and Wrekin. Volunteers visit older people in their own homes, providing friendship and support. Visits take place at times to suit both volunteer and service user and can vary from once a week to once a month. Telephone Buddy This is a free service. Telephone Buddy volunteers come into Age UK’s office at Mardol Gardens on a Monday morning to ring older people for a friendly weekly chat. Volunteers provide two references and are supported by a dedicated co-ordinator in the Age UK office.

The Silver Line The Silver Line is the only free confidential helpline providing information, friendship and advice to older people, open 24 hours a day, every day of the year. The Lottery Fund has announced a major grant of £5 million to The Silver Line describing it as ‘a vital new befriending and advice helpline’ so that it can develop from its pilot stage to launch nationally. The grant has been made available through The Fund’s £20 million dignity programme for older people who are isolated and lonely across the UK. It recognises that a phone call can be transformative and lift someone’s mood and self-esteem; as one caller explained: ‘When I get off

the phone I feel like I belong to the human race.’ Until now there has not been a UK-wide, 24 hour umbrella organisation which links older people to support services in their local communities. The Silver Line will connect individuals to local services and activities, and in the same way that Childline, founded by Esther Rantzen in 1986, helped abused children, The Silver Line will support older people who are experiencing abuse or neglect, and make sure they are protected.

Living a life that is free from harm and abuse is everyone’s fundamental right. We all need to act as good neighbours and citizens in looking out for one another and seeking to prevent the isolation that can lead to abusive situations and put adults at risk of harm. That is one of the fundamental principles of communities that are fair, compassionate and caring. An adult at risk is defined as ‘a person aged 18 years or over who may be unable to take care of themselves, or protect themselves from harm or from being exploited.’

• has mental health needs including dementia or a personality disorder;

• has a long-term illness/condition;

• misuses substances or alcohol; or

Stop smoking Help2Quit, the local NHS Stop Smoking Service in Shropshire, offers free support delivered by stop smoking specialists (including practice nurses, midwives, pharmacists and school nurses) that really works. The service is available in almost all GP surgeries in Shropshire and is also provided in many pharmacies, community venues, hospitals and selected supermarkets. If you use a combination of stop smoking medicine, along with specialist help and support from your local stop smoking service, you’re up to four times more likely to successfully go smoke free than if you try and stop on your own.

If you are aged 40-74 years and are not already diagnosed with one of these conditions you will be invited once every five years to have a check to assess your risk of developing one of these diseases. You will be given advice to help reduce or manage your risk of disease. In Shropshire you will be invited to a Health Check by your GP.

Shropshire Young Carers service is part of the British Red Cross which is a registered charity and works with children and young people who have a caring responsibility for a family member. The service’s vision is to provide support for all young carers in Shropshire who need it through a network of peer support groups across the county and by working in partnership with schools. Referrals can be taken from all agencies, parents and young carers themselves who live in the Shropshire area and must come with parental, or guardian, consent. As a family carer you are entitled to an assessment of your own needs. This is your opportunity to tell the Council about the things that could make caring easier for you. You can have an assessment even if the person you care for does not wish to be assessed for community care services themselves. The Carers Emergency Respite Scheme provides carers

Carers’ Support Service

We can offer carers a Carer Aware online training course, which takes under an hour to complete, on the website https://shropshire.gov.uk/adult-social-care/carers-and-their-requirements The course helps carers, people who work with carers, or anyone who is interested in learning more, to find out who is a carer, what their rights are, what support is available and where to find further information. If you are 16 or over and spend at least 35 hours a week caring for someone with substantial needs, you may be eligible for Carer’s Allowance worth £61.35 a week. You may also be able to claim other benefits, such as an income-related benefit and Pension Credit. The website www.gov.uk has further information.

Carers’ training and benefits


Care in your own home is often referred to as either ‘domiciliary’ or ‘home care’. Given the choice, many people prefer to stay in their own homes surrounded by their possessions and near to their family and friends. This, of course, applies to everyone whether they are elderly and frail, convalescing, have a physical or learning disability, or have dementia. The range of care available is varied and each client should be involved, and agree, with the care provider, a care plan, which states their needs and the expected outcomes. You will require an assessment of your needs, and if you are eligible, you can decide whether you would prefer to arrange the services yourself. If you do not meet your council’s eligibility criteria, you must organise your own care as a ‘self-funder’. Listings of home care providers start on page 23. See page 35 for advice on self-funding your care. Domiciliary care is usually arranged in a manner dependent upon needs:

Low level domiciliary care – this may be to assist with household chores such as shopping, cleaning and assistance with food preparation. It may also involve a care worker accompanying clients on trips out and even holidays.

Medium level domiciliary care – in addition to low level care this will normally involve personal care (assistance with washing, dressing etc.), and/or one care worker to assist with mobility. Clients may wish to have assistive technology installed in their home to monitor them to provide security and reassurance.

High level care – this involves visits by two or more care workers who assist clients with high dependency needs such as being transferred from a bed to a chair etc. Care workers may require specific training for the health needs of a client.

Live-in care – a care worker lives in the client’s home, is allowed time off each day and must have a night’s sleep. Live-in care can be arranged as a short respite for the client’s main care worker or a permanent arrangement to suit the client’s needs.

24 hour care – this is required when the client needs assistance or monitoring through the day and night; it differs from live-in care in that care workers work on a roster to ensure that a care worker is on duty and awake both day and night. Some home care agencies are also registered as Nurses’ Agencies, meaning they can provide registered nurses if needed. All service providers must be registered and inspected by the Care Quality Commission (CQC). It is important to be assured that all care workers have been vetted by the Disclosure and Barring Service, have received necessary training, are properly referenced, and are eligible to work in the UK prior to them visiting your home. Ask the service provider to show evidence that the care workers they introduce are indeed compliant with the legislation, and check their latest CQC report at www.cqc.org.uk or call the CQC on 03000 616161. More information on the CQC can be found on page 32.

Paying for home care Domiciliary care for social needs may be funded in part or whole by the local authority, if eligible, or alternatively private arrangements can be made with service providers. Social services’ funded care is commissioned to independent companies. Fees for services vary; the service provider will be able to give you a detailed cost breakdown prior to the commencement of any service and you should ensure that you check this includes any weekend, bank holiday and mileage costs. Most service providers will accept clients who pay using Direct Payments (discussed further on page 34).

A national, one-stop information and advice service for carers who look after ill, frail or disabled friends and relatives.

Carers Direct includes:

• details of assessments, benefits, Direct Payments, Personal Budgets and time off;

• help to maintain, leave or return to employment;

• help in education or training;

• advice on how carers maintain or improve their social

and emotional well being and their physical and mental health;

• access to health and social care for the person being cared for;

• how to access information about, and support from, health and social care services for the person being cared for.

Specialist care

For care and support provided by Shropshire Council (explained on page 31), everyone goes through the same assessment process, regardless of whether you have a physical or learning disability, mental health issues, or are an older person who requires additional care and support. Services are always designed around people and reflect the needs of those who use the service, their families and carers. Self-funders are also entitled to an assessment to determine their needs. We offer residential, supported living and day opportunities as well as work experience, training and employment opportunities for people with learning or physical disabilities. We aim to ensure people with disabilities have access to the same community facilities as everyone else. We are working closely with other areas of the community to strengthen community links.

A care manager will carry out the assessment (as described on page 31) with you, and your carer (if appropriate). You will then find out what your indicative Personal Budget will be, and then proceed to develop a Support Plan to meet your identified needs and outcomes. Help will be available from the voluntary sector to complete your Support Plan. Your Support Plan could include considering future accommodation needs, employment, respite and help to support people to remain in their own homes. Carers are offered an assessment in their own right and support services can also be provided to help meet their identified needs as a carer. Learning and physical disabilities

If you are worried about your memory you should in the first instance arrange an appointment to see your GP who will carry out some tests for further investigation, your GP may refer you to the Memory Service who will provide specialist assessment and a formal diagnosis. The Memory team may advise commencing medication where appropriate and the team can also provide specialist support and information following your diagnosis. If you have been diagnosed with dementia or you have a family member who has been diagnosed your initial point of contact to access services for health care solutions should be through your GP or for other services through your local Adult Services team who can be contacted through the First Point of Contact for Adult Social Care Services Team on 0345 678 9044.

Support in the community It is important that people with dementia and their carers are supported to live well and independently in their own homes for as long as possible. There are a range of services available within communities across Shropshire to facilitate this, here is just a selection:

• The local Alzheimer’s Society Dementia Support Workers provide individualised support and information for people with dementia and their carers, they will also signpost you to other local services you may need. For further details contact the Shrewsbury Alzheimer’s Society office: 01743 341800.

Residential dementia care If the time comes when remaining at home with support is no longer viable, you may wish to consider the option of residential care. Differentiating one home from another can be difficult but the quality and quantity of staff training is especially important, along with the turnover of staff as continuity of relationships in this type of home is critical.

Dementia care continued

Services for people with mental health issues are usually accessed via the Community Mental Health Teams (CMHTs) which are based on GP practice areas. An assessment of your needs will be done by a member of staff working in the Community Mental Health Team, usually a nurse, social care practitioner or occupational therapist, this should be similar to the assessment process as described on page 31. You will then develop a Support Plan, as described on page 34.

Supporting peoplewith complex needs


Residents The best indication of a good home is that the residents appear happy and responsive. Are the residents:• Involved in activities or chatting? • Clean and comfortably dressed? • Encouraged to do as much for themselves as they

can?• Do they seem alert and interested? • Do they talk to you as you walk round?

Access Check whether:• The corridors and toilets are wide enough

for a walking frame or wheelchair. • Toilets and baths are suitably adapted.• There are ramps or a lift. • There is adequate signage and cues for different

parts of the home.

Bedrooms Can the person with dementia have a single room? Check whether:• Residents are encouraged to bring in some

of their own furniture and possessions.• The bedrooms are bright and pleasant. • Residents can go to their rooms when they wish to

‘How we care for the dying is an indicator of how we care for all sick and vulnerable people. It is a measure of society as a whole and it is a litmus test for health and social care services.1’ Although the subject of dying is often painful to contemplate and as a society we do not discuss death and dying openly, the way care professionals approach the process is incredibly important for the client, their family and carers. The Department of Health has published a Strategy for every organisation involved in providing end of life care. Each will be expected to adopt an overall coordination process, such as the Gold Standards Framework, whilst developing the best possible outcome for clients. Those being cared for will have the opportunity to discuss their personal needs and preferences with professionals who will be supporting them. These will be recorded in a care plan so that every supporting service will be aware of the client’s wishes. All health and social care staff must be trained in communication regarding end of life care and will be trained accordingly in assessing the needs of clients and carers. Programmes available include:

The Gold Standards Framework (GSF) This can be used in various settings, for example hospitals, primary care and care homes, to improve the co-ordination and communication between different organisations involved in providing care for someone near the end of their life.

‘Preferred Priorities for Care’ (PPC) This document is designed to help people prepare for the future and gives them an opportunity to think about, talk about and write down their preferences and priorities for care at the end of life. It is worthwhile asking potential care providers their approach to end of life care and whether they are following national strategies for implementing best practice within their home.

The End of Life Care Strategy


Support and care – where do I start?

When you, or someone on your behalf, first contacts Shropshire Council about adult social care services, you are likely to be asked some key questions about your personal details and your circumstances. These questions are the first stage of carrying out an assessment of your needs and working out if you are entitled to social care support from us. Working out if someone is eligible for support is done by using guidance from the Government, called ‘Fair Access to Care Services’ (FACS). More information on FACS can be found below. Before any support from us can be considered we

must continue to the next stage of this assessment of your needs. This is called an ‘independence assessment’ and will look at all areas of your life and consider how effectively your needs are currently met, and whether there are any risks to your health and wellbeing. It may be that your eligible needs can be met through support already available in your local community that you can readily access and this information will be provided following your assessment. People who help or care for you, a relative, partner or friend may also request an assessment for themselves. This is called a ‘carer’s assessment’ explained on page 17.

Independence assessments

Regardless of your financial situation you are entitled to information and advice about any care needs you may have. We follow Government guidance called ‘Fair Access to Care Services’ (FACS), which has been issued to local authorities across the country. The aim is to make sure all decisions on who receives financial help with care and support are made fairly, openly and consistently. This means each council has to set criteria to make sure help is allocated fairly and to those in greatest need. FACS eligibility criteria is divided into four bands representing the seriousness of the risk to your

independence: ‘critical’, ‘substantial’, ‘moderate’ and ‘low’. Currently you are only eligible for community care services in Shropshire if your needs are assessed as ‘critical’ or ‘substantial’. This ensures that people in the greatest immediate or longer term need will get most help. Some things are not covered by FACS including Blue Badges and disabled facilities grants.

Fair Access to Care Services

Fundamentally, there are two types of residential care home: homes offering personal care only, and homes offering ‘care with nursing’. Following your assessment, your care manager can advise you on the different options that may be appropriate for you.

Personal care only This type of home (commonly referred to as a ‘residential home’) will suit you if you are reasonably active but require help with tasks such as bathing, eating, dressing and moving about. District nurses visit to provide temporary nursing needs. It may be worth considering what your future needs may be – will the home be able to meet them in a few years’ time? Take along the care homes checklist on page 33 to prompt any questions you will have for the manager. Consider if domiciliary care is a better option.

Care home with nursing This kind of home is suitable for those needing nursing

care, where it will be delivered by qualified nursing staff alongside care workers. Nurses are on duty around the clock. Fees are generally higher than residential care homes. Some of the cost of your nursing care will be met by the NHS, who will pay the home directly. At the moment the rate for NHS Funded Nursing Care is £110.89 (price correct as of October 2014) per week. This is paid directly to the home. Figures mentioned here may change during the life of this Directory.

NHS Continuing Healthcare Continuing care is care provided over an extended period of time, to a person aged 18 or over, to meet physical or mental health needs that have arisen as a result of disability, accident or illness. A person who needs continuing care may receive services from the local authority or from the NHS. NHS Continuing Healthcare is a package of continuing >>

>> care that is arranged and funded solely by the NHS. This is free of charge, wherever it is delivered. NHS Continuing Healthcare support may be provided in a nursing or residential care home or in a person’s own home. People eligible for NHS Continuing Healthcare funding will have been assessed by health and social care assessers to have a ‘primary health need’ and are likely to have complex medical needs and substantial or intense on-going care needs. National guidance says that the assessment for NHS Continuing Healthcare should be ‘person-centred’. This means that the person being assessed should be fully involved in the assessment process. They should be kept

informed, and have their views about their own needs and support taken into account. A decision about eligibility should usually be made within 28 days of a referral for assessment being made to the NHS Clinical Commissioning Group. If you are already receiving support from the Council, your social care practitioner will be able to give you more information about NHS Continuing Healthcare and complete with you a NHS Continuing Healthcare screening checklist from which a referral for assessment can be made if you are entitled to it. Your GP or community nursing service should be able to give you advice or make a referral with you if you are not currently receiving support from Shropshire Council.

Types of care home continued

Since October 2010, all care providers must be registered under a new system, introduced by the Health and Social Care Act 2008, which brings care services, independent healthcare and the NHS under a single set of essential standards of quality and safety for the first time. CQC holds and publishes up-to-date information about the compliance of Adult Care Services providers with essential standards of safety and quality. The Care Quality Commission (CQC) registers, inspects and reviews all adult care services and healthcare services in England in the public, private and voluntary sectors. This includes care homes, care homes with nursing, home care agencies and NHS services, amongst others. Following an inspection, each care home and home care agency is given a report of how it rates against national essential standards of quality and safety. Each service’s report can be seen on the CQC website: www.cqc.org.uk

The focus of an inspection is on the standards of care that people who use the service receive and whether they are happy with their care. Virtually all inspections are unannounced. Paying for care

This is a non-means tested, non-taxable benefit from the Department of Work and Pensions paid at the lower rate of £54.45 per week for those needing care by day or night, and at the higher rate of £81.30 per week for those

needing care both during the day and night. Everyone is entitled to claim this benefit. A benefits check is part of your initial assessment with Shropshire Council. (Figures mentioned here correct as of October 2014.)

If you are eligible for social care funding under Fair Access to Care Services criteria (explained on page 31), you will be offered a Personal Budget which is an indicative amount of funding that could be made available to meet your needs. This means that you can exercise choice and

control in how that budget could be used in a way that works for you. You will be asked for and supported to develop a Support Plan that sets out how you wish the funding to be used and how you intend to manage the money. This will need to be agreed by your care manager.

Direct Payments

It is important to remember that more than one of the options illustrated above can be chosen. Your Support

Plan needs to state clearly how much of the budget will be managed in a certain way.

A Direct Payment is money from a council’s Adult Social Care Services department to cover a specific assessed need. People who are eligible are given an agreed amount and can use it to employ a personal assistant themselves or through an agency to help support them. You aren’t allowed to use Direct Payments to pay for permanent residential accommodation - but you may be able to use them to pay for occasional short periods in residential accommodation, if your council agrees that is what you need. If you are applying for services for the first time, your social care practitioner should discuss the Direct Payments option with you when they assess your care needs. Direct Payments are made directly into your bank, building society, Post Office or National Savings account. When in receipt of a Direct Payment we will expect you

to provide documentation to demonstrate how you have utilised your Direct Payment. Such documentation will include bank statements and invoices. A Direct Payment must be spent in accordance with your approved support plan.


You can choose a service provider that you wish to provide your care or support. (For existing clients this may be their current provider if they are happy with them.) Some or all of the Personal Budget is then paid by us directly to the service provider as an ‘Individual Service Fund’. In practice, this is not very different to what happens currently but the important difference is that

you (and/or those closest to you) are making a choice about that organisation. We will enter into a contract with that service provider and you and the provider must agree how the money will be used. The provider is accountable to you and Shropshire Council to deliver the service they have agreed.

Individual Service Funds

If you have capital or savings of more than £23,250 (correct as of October 2014) you will have to pay for any care services you require but you are still entitled to an assessment of your needs by Shropshire Council. If you will be moving into care, you may be entitled to some of the following financial assistance and support, subject to an assessment of need.

Twelve-week property disregard

This applies if:

• your former home is included in your financial assessment;

• your other capital is less than £23,250; and

• your income is not enough to meet your care home fees.

Adult Social Care Services will help with the cost during the first twelve weeks of permanent care in a home, provided its assessment has shown that this is the kind of care you need. This is called the ‘property disregard’ period.

Deferred payment agreements After the twelve-week property disregard period, Adult Social Care Services may be able to help you while your property is being sold. They will charge any financial help they give against the value of your home. This means they will take back the amount they have paid once your property has been sold. However, they may limit how much they will pay. It may affect your entitlement to Pension Credit if your property is not seen to be on the market and becomes treated as capital by the Department for Work and Pensions (DWP).

Attendance Allowance This is a non-means tested, non-taxable benefit from the Department of Work and Pensions paid at the lower rate of £54.45 per week for those needing care by day or night, and at the higher rate of £81.30 per week for those needing care both during the day and night. NHS Funded Nursing Care Whether you are a temporary or permanent resident, if you live in a care home that provides nursing care you may be entitled to a non-means-tested NHS Funded Nursing Care Contribution (currently £110.89 per week for the standard rate) towards the cost of your nursing care. This is paid directly to the home.

Running out of money If your capital is likely to reduce to £23,250 (correct as of October 2014), you must let the Council know well in advance as we may step in to help with your care fees. We must conduct an assessment of your situation and may make a contribution. If the home you have chosen charges more than what we will contribute, you must find someone to help pay the difference – a ‘top-up’ payment. Whoever does this, whether family or a benevolent charity, they should realise that they may have to pay this for some time. Alternatively, you would have to find a home with lower fees. Understanding your rights before moving into care is essential. There are a number of financial products and specialist companies who may be able to help. It is important to seek advice before committing yourself.

Having your say

All care providers need to know how well they are doing. Your feedback is very important to them. They want to know whether their services meet your needs and are delivered effectively. They welcome your comments, compliments and complaints so that they can serve you better. If you are concerned about the care that you, a friend or a relative is receiving, you may want to talk first to the service’s manager. The problem may be resolved quite easily once the manager is aware of it. You should feel able to complain about any aspect of your care whether in your own home or in a care home. You may want to complain about the way you are treated by a staff member or the quality of the food you are served. Sometimes you may just want to make comments and suggestions about how things are done. Making a complaint should be easy to do. Care services must have an easy-to-use complaints procedure that they can share with you. If you do not wish to contact the manager, or talking to the manager may not resolve your concerns, you can contact the registered owners of the service. They have a duty to respond to your complaints. If we have arranged, funded or contributed to the

funding of your care, you can also complain to the Adult Social Care Department.

Comments, compliments or complaints





A solicitor can give you impartial advice about wills, making gifts, estate planning and Powers of Attorney. Some can also offer guidance on immediate and long-term care plans, ensuring (if applicable) the NHS has made the correct contribution to your fees. Lasting Powers of Attorney (LPA) allow you to appoint someone you trust to make decisions about your personal welfare, including healthcare and consent to medical treatment, and/or your property and financial affairs. An LPA is only valid once registered with the Office of the Public Guardian. It allows for a person of your choice to make decisions on your behalf at a time when you may be unable to. The Court of Protection can issue Orders directing the management of a person’s property and financial affairs if they are incapable of managing their own affairs should they not have an LPA. The Court procedure is presently very slow and the fees are quite expensive so preparing an LPA is always advisable, providing you have somebody sufficiently trustworthy to appoint as your attorney. An ‘advance directive’ allows you to communicate your wishes in respect of future medical treatment but it is not

legally binding. You may instead wish to make a living will, properly known as an ‘advance decision’ setting out treatment that you do not want to receive in specified circumstances, which would legally have to be followed, even if you die as a result. Any proposed Gift out of your estate needs careful consideration of the benefits, risks and implications, particularly on any future liability for care costs or tax liability. Long-term care: whether you remain in your own home or move into sheltered or residential care, you may qualify for financial assistance in the form of social care and NHS-funded care and welfare benefits. If you don’t have your own solicitor, ask family or friends for their recommendations. Contact several firms, explain your situation and ask for an estimate of cost and an idea of timescales involved. Many firms will make home visits if necessary and will adapt their communications to meet your needs. It’s important to find a solicitor who specialises in this area of the law. The Citizen’s Advice Bureau offer an advice service and will be able to recommend solicitors in your area.
