Summary and Highlights In 1999, Association for Democratic Reforms filed a PIL with the Delhi High Court asking for the disclosure
of the criminal, financial and educational background of the candidates contesting elections. Based on this,
the Supreme Court in 2002, and subsequently in 2003, made it mandatory for all candidates contesting elections to disclose criminal, financial and educational background prior to the polls by filing an affidavit
with the Election Commission.
As per the Supreme Court judgment, each candidate for election to Parliament or a State Legislature should
submit, along with his/her nomination paper, a duly sworn affidavit, as a necessary part of his/her nomination paper, furnishing information on the following aspects in relation to his/her criminal
background:-
1. The cases which are pending against him/her in which charges have been framed by the court for an offence punishable with imprisonment for two years or more;
2. The cases which are pending against him/her in which cognizance has been taken by the court (other
than the cases which are mentioned in the point above)
3. The cases in which the candidate has been convicted and sentenced to imprisonment by a court of law.
Apart from criminal antecedents, candidates are also required to disclose information related to their
financial, educational, profession and age details in the affidavit.
The Election Commission in consultation with civil society organisations, NGOs and other stakeholders
keeps on modifying the format of the election affidavit in order to enhance disclosure and information about
contesting candidates.
Note: There may be cases where the candidate might disclose criminal charges that do not pertain to the
above points of disclosure mandated by the ECI. For example, some candidates disclose criminal charges
with a punishment of less than two years of imprisonment. Association for Democratic Reforms strives to
provide the voter with all the information as disclosed by the candidate in his/her affidavit and does not add or subtract any information, unless the EC changes the data. In particular, no unverified information from
any other source is used.
Delhi Election Watch and Association for Democratic Reforms (ADR) have analysed the self-sworn affidavits of all 70 newly elected MLAs in the Delhi 2015 Assembly Elections.
