the Draft Gold Coast Planning Scheme 2003 Amendment – Protection of Golf Courses; and

the Varsity Station Village Local Area Plan. 4 PREVIOUS RESOLUTIONS Gold Coast Planning Scheme 2003 Amendment – Protection of Golf Courses Council at its meeting of 14 March 2011 (Minute No. G11.0314.008) resolved to adopt the following recommendation of the Sustainable City Future Committee (Minute No. SC11.0308.003): 1 That Council endorse the recommendations detailed in the report and the “Review of

Submissions for Gold Coast City Council Protection of Golf Courses Planning Scheme Amendments” report by Buckley Vann Town Planning (attached to the report) as Council’s formal response to the submissions received during the public notification of the Gold Coast Planning Scheme 2003 draft Amendment – Protection of Golf Courses.

2 That Council endorse the revised Gold Coast Planning Scheme 2003 draft Amendment – Protection of Golf Courses (attached to the report).

3 That the endorsed Gold Coast Planning Scheme 2003 draft Amendment – Protection of Golf Courses, Council Report and the Review of Submissions for Gold Coast City Council Protection of Golf Courses Planning Scheme Amendments report by Buckley Vann Town Planning, be forwarded to the Minister for Infrastructure and Planning for adoption subject to a second review of State interests.

2 That Council endorse the revised draft Varsity Station Village Local Area Plan and Consequential Amendments subject to the following amendments:

a That the MCU Code Assessable column, Precinct 2 – Village Heart, Shop and Shopping Centre be amended to read as follows:

Shop - where the total resulting GFA for shop or shopping centre development within the LAP area is not greater than 5,500m2.

Shopping Centre Development – where having a direct frontage to High Street and where the total resulting GFA for shop or shopping centre development within the LAP area is not greater than 5,500m2.

b That the MCU Code Assessable column, Precinct 3 – Station Corridor, Shop be amended to read as follows:

c That AS1.1, Supermarket be amended to read as follows:

The total retail floor space within the village is limited to a maximum of 5,500m2 GFA inclusive of one supermarket having up to a maximum of 2,500m2 GFA.

3 That the endorsed draft Varsity Station Village Local Area Plan and Consequential Amendments and Submission Response Table for Varsity Station Village – Public Notification 26 May 2010 to 16 June 2010, be forwarded to the Minister for Local Government and Planning for adoption subject to a second review of State interests.

619th Council Meeting 24 October 2011 7 Sustainable City Future Committee Meeting 18 October 2011 Adopted Report ITEM 1 (Continued) ADOPTION AND SETTING OF A COMMENCEMENT DATE FOR THE DRAFT GOLD COAST PLANNING SCHEME 2003 AMENDMENT – PROTECTION OF GOLF COURSES AND VARSITY STATION VILLAGE LOCAL AREA PLAN FOR COMMENCEMENT PD113/433/04(P15) & PD302/574/76/01(P10) 5 DISCUSSION On 01 August 2011, Council received approval from the Deputy Premier, Minister for Local Government to adopt and commence the Draft Gold Coast Planning Scheme 2003 Amendment – Protection of Golf Courses without conditions. The delay in adopting this amendment for commencement was due to the anticipated release of the Draft Varsity Station Village Local Area Plan, for adoption and commencement.

On 21 September 2011, Council received another approval from the Deputy Premier, Minister for Local Government to adopt and commence the Draft Varsity Station Village Local Area Plan. It is noted that in this instance, the Minister has imposed a number of conditions to the approval. The Minister’s conditions to the LAP seek to do the following: Intent of State Imposed Conditions Officer’s Comments Decrease carparking rates for all commercial development, requiring one space per 50m2

Carparking rates are consistent with the Transit Orientated Development Guide for Practitioners which identifies a base maximum carparking rate for neighbourhood TODs as 1 space per 50m2, it is identified that the preferred maximum according to the guide is 1 space per 100m2.

Increase the total gross floor area for shops and shopping centre development to 6,400m2 inclusive of one supermarket having up to a maximum of 3,600m2 GFA.

This amount is consistent with the economic report prepared by SGS Economics and Planning which was funded by and provided to Council in response to submissions.

Removal of the provision for the park and ride facility.

The Park ‘n’ Ride facility is part of the Railway Station development which is defined by the Planning Scheme as “Public Utility”. As a “Public Utility” is exempt development, the provisions would not affect the future of the Park ‘n’ Ride component of the railway station.

Ensure that development fronting High Street does not support carparking between ground and podium level.

Changes provide further support to the intent of the LAP ensuring that frontages become active and pedestrian friendly environments.

Ensure that advertising devices do not dominate the Pacific Motorway

Advertising devices should not be allowed to compromise the amenity and safety of the pacific motorway.

Ensure that the references to street names are correct. Eg. Bridge Road, is identified as Stapley Drive.

619th Council Meeting 24 October 2011 8 Sustainable City Future Committee Meeting 18 October 2011 Adopted Report ITEM 1 (Continued) ADOPTION AND SETTING OF A COMMENCEMENT DATE FOR THE DRAFT GOLD COAST PLANNING SCHEME 2003 AMENDMENT – PROTECTION OF GOLF COURSES AND VARSITY STATION VILLAGE LOCAL AREA PLAN FOR COMMENCEMENT PD113/433/04(P15) & PD302/574/76/01(P10) 6 ALIGNMENT TO BOLD FUTURE VISION, CORPORATE PLAN, OPERATIONAL

PLAN The draft amendments advances the implementation of the Corporate Plan 2009 - 14 particularly the following outcomes: Key Focus Area 1: A City Leading by Example 1.1 There are strong foundations for a sustainable city. Key Focus Area 2: A City Loved for its Green, Gold and Blue 2.1 Parks and open green spaces are safe, connected and accessible for all members of the

community. 2.2 Biodiversity is protected. Key Focus Area 3: A City Connecting People and Places 3.2 Public transport and other environmentally- friendly modes of travel are attractive and

desirable options for people to use. Key Focus Area 4: A Safe City where Everyone Belongs 4.1 Our active and healthy community embraces recreation, leisure and social interaction. Key Focus Area 6: A City Shaped by Clever Design 6.1 Integrated land use planning takes account of environmental, social and economic needs to

provide the basis for a sustainable community. 6.3 Infrastructure is planned and delivered to meet the needs of growing community. 6.4 High quality urban design creates a world-class city image and accommodates diverse built

forms. 7 FUNDING AND RESOURCING REQUIREMENTS Budget/Funding Considerations To proceed with the adoption and commencement of the amendments, Council are required to publish a notice within the local newspaper and the State Government Gazette advising that the amendment has been adopted and the time for when it will commence. In addition to this, Council publishes various hardcopy material to update existing copies of the planning scheme and electronic copies (CDs) of the planning scheme incorporating the adopted amendments for distribution. Based on the commencement of previous amendments of this size, the costs are likely to be between $25,000 - $35,000. 8 RISK MANAGEMENT Adoption of the draft Amendment Package will help to ensure the city's growth and development is adapted, enhanced or preserved through a strategic and long term planning approach. 9 STATUTORY MATTERS Part 3, Schedule 1 of the superseded Integrated Planning Act 1997, outlines Council’s requirements for adopting and commencing planning scheme amendments.

13 STAKEHOLDER IMPACTS As a result of the public consultation period, impacts regarding the two amendment packages have been considered and addressed. 14 TIMING The Gold Coast Planning Scheme 2003 Amendment – Protection of Golf Courses and the Varsity Station Village Local Area Plan are proposed to be commenced on 14 November 2011, with a public notice to be printed within the Courier Mail and the Gold Coast Bulletin on 12 November 2011, and the Government Gazette on 11 November 2011. 15 CONCLUSION The Gold Coast Planning Scheme 2003 Amendment – Protection of Golf Courses and the Varsity Station Village Local Area Plan have both completed the second round of State Interest checks. In response to the Minister’s approval to adopt the proposed Varsity Station Village Local Area Plan with conditions, a revised LAP has been drafted for Council endorsement. It is recommended that both the Draft Gold Coast Planning Scheme 2003 Amendment – Protection of Golf Courses and the revised Draft Varsity Station Village Local Area Plan be adopted with commencement set for the 14 November 2011.
