INTRODUCTION The eTRO electronic Temporary Restraining Order is a web based application used by Law Enforcement, Judges, and Superior Court staff members to enter Temporary Restraining Orders. The eTRO application allows Law Enforcement to electronically submit a Temporary Restraining Order that has been issued by a Municipal Court Judge. The submitted electronic TRO immediately updates the DVCR where it is displayed as an active restraining order, and it is also sent to the Family Court Record Tracking System where a docket number is assigned. The eTRO application streamlines the process of recording the service information for restraining orders. A TRO that needs to be served on a defendant is readily available to Law Enforcement for printing, and the information is sent electronically to the court once served through the system.

LOGGING INTO eTRO

• Log into eTRO using your ID and password.

• Click on eTRO tab.

Note: If the user has access to more than one county and/or municipality, the Change Municipality Screen will display.

A list of counties and municipalities will display from the drop down list. The user will be able to select the appropriate county and municipality based on their User ID.

CREATE TRO • Click the Create TRO button, from the home page. The Plaintiff Tab will display.

QUICK ENTRY FROM MUNICIPAL COMPLAINT (ACS) The user will have the option of retreiving data from the ACS System by selecting:

• Select Complaint Type drop down box o Summons o Warant

• Enter the Complaint Number • Select Copy

The data that was added into the eCDR will populate the Plaintiff, Defendant, and TRO Complaint Tabs.

• Required fields are indicated in red. They are Name, Sex, Race and DOB.

• Alias (First, MI, Last)

o If an Alias name is entered, the user must include the Alias Type.

o If the plaintiff has more than one alias, the user can select the

hyperlink.

o This will display additional alias rows. A total of three alias can be added to the Plaintiff Information.

o Selecting the button removes the data from alias and closes the hyperlink.

Confidential Information Confidential information will not be printed on the complaint. The following fields are considered confidential information:

• SSN • Mailing Address (Address Line 1, Address Line 2, City, State, and Zip Code) • Home Phone • Cell Phone • Work Phone • Employer Name • Work Address (Address Line 1, Address Line 2, City, State, and Zip Code)

Save and Continue If all the conditions are passed, the system will save all data, a confirmation at the top of the screen will be displayed. The user can then navigate to the “Defendant Information” screen.

• The TRO form will be saved as a TRO draft and system will navigate to the “Defendant” Tab. Click on the button, system will validate the mandatory fields.

Warning: If users do not click the “Save and Continue” button and the system times-out, all data entered will be lost. It is highly recommended that users periodically clicks on the “Save and Continue” button when entering and modifying data. Print Refer to Floating Side Menu within this document.

DEFENDANT TAB

The following details/information can be entered or modified. All the fields in red on the screen are mandatory. The Defendant information contains the following:

• Name (First, Middle Initial, and Last name) • Sex • Race • Alias (First, MI, Last) • Alias Type

o If an Alias name is entered, the user must include the Alias Type.

It is highly recommended that users periodically click on the “Save and Continue” button when entering and modifying data.

Conditions / Limitations

If users navigate outside the TRO Form screen without clicking the button, the system will display a message in a pop-up window,

prompting the user with the options to proceed or cancel their request.

• To proceed which will result in data lost; click the button.

• To cancel your request and remain on current screen, click on the

button.

Save as Draft

To save the TRO as a draft select the button. Or select “Save As Draft” from the Submit/Option drop down list on the Floating Side Menu then click the

button.

The system will display a confirmation message on the top of the screen and navigate to the “TRO Complaint” screen.

Municipality of Offense

The user identifies the county and the municipality where the offense occurred. To modify the county and municipalities, select a county and municipalities from the drop down menu.

Police Case Number

Number assigned to the case by a Police Officer. This is a required field for all Law Enforcement and Municipal Judge users.

Incident Date

Type the date or click on the calendar icons to select a date.

To change the calendar month, click the left or right arrows next to the name of the month. To choose a date within the month, click the date number; to select the current date, click the “Today” link.

Incident Time

Type the time in each field and select “AM” or “PM” from the drop down list.

Incident Information

Characters Left - As information is typed in the text area, the system counts the number of characters that the user is able to input and displays how many characters are left.

Incident Narrative Description

To add description, click in the text area and type the details of the incident.

Add Additional Incident

• Clicking the link results in an additional incident description field created.

• Maximum of four (4) additional incident description fields can be added.

• Any additional incident description field can be removed by clicking the button to the right of the new incident text area.

Note: Maximum characters entered for incident is 4000. If additional incident is added, total character entered for ALL cannot exceed 4000.

The following information is displayed with check box. Check all applicable boxes.

• Homicide • Assault • Terroristic Threats • Kidnapping • Criminal Restraint • False Imprisonment • Sexual Assault • Criminal Sexual Conduct • Lewdness • Criminal Mischief • Burglary • Criminal Trespass • Harassment • Stalking

The user is able to select or deselect any boxes.

The next section displays the following eight (8) questions.

The user must select a “YES” or “NO” radio button. When selecting the “YES” radio button, the system will display a text box field. Additional data is required to be entered.

Question #1 – Any prior history of domestic violence reported or unreported?

• Select the radio button “YES” or “NO”.

o Selecting the “YES” radio button, the system will display in red additional information and open a text box field to enter data. The maximum number of allowable characters is 1,600.

o Once data is placed in the text box, the “YES” and “NO” radio buttons will gray out. To reactivate the radio button selection, the user will have to remove the text from the text box.

Question #2 – Does defendant have a criminal history?

• Select the radio button “YES” or “NO”.

o Selecting the “YES” radio button, the system will display a message in red: “(Submit any available criminal history report)”

Question #3 – Any prior or pending court proceedings involving parties?

• Select the radio button “YES” or “NO”.

o Selecting the “YES” radio button, the system will display in red “Enter docket number, court, county, state” and a text box will display. The maximum number of allowable characters is 50.

o Once data is placed in the text box, the “YES” and “NO” radio buttons will gray out. To reactivate the radio button selection, the user will have to remove the text from the text box.

Question #4 – Has a criminal complaint been filed in this matter?

• Select the radio button “YES” or “NO”.

o Selecting the “YES” radio button, the system will display in red "Enter docket number, court, county, state" and a text box will display. The maximum number of allowable characters is 50. Data is required in the text box if the "YES" radio button is selected.

o Once data is placed in the text box, the “YES” and “NO” radio buttons will gray

out. To reactivate the radio button selection, the user will have to remove the text from the text box.

Question #5 – If law enforcement officer responded to a domestic call:

The system displays two questions for number five (5).

• Were weapons seized? • Was defendant arrested?

o Select the radio button “YES” or “NO” for both questions.

o Selecting the “YES” radio button, the system will display "Describe" in red and open

a text box field to enter data. The maximum number of allowable characters is 50. o Data is required in the text box if the "YES" radio button is selected. Once data is

placed in the text box, the “YES” and “NO” radio buttons will gray out. To reactivate the radio button selection, the user will have to remove the text from the text box.

Question #6 – Plaintiff and Defendant Marital/Living Status

The system displays two questions for number six (6). Select an option by clicking on the radio button in 6A OR 6B to answer question six.

• 6A - The plaintiff and defendant are 18 years old or older or emancipated and are

• Married/Civil Union - If the Married/Civil Union radio button is selected, the Family Relationship check box will automatically check with a value of "Spousal/Partner" in the Specify box.

o Divorced o Present Household Member o Former Household Member

• 6B - The defendant is 18 years old or older or emancipated and plaintiff and defendant are:

o Unmarried o Co-parents o Expectant parents o Plaintiff and defendant had a dating relationship

Question #7 – The plaintiff and defendant:

• Select one of the following options by clicking on the radio button.

o Presently reside together o Previously resided together o Never resided together

• What is your relationship to the defendant? (Specify)

o Click the Family Relationship check box. The system will display a drop down list. o Click on the arrow to view and select the plaintiff relationship to the defendant.

o Uncheck the box will result in the drop down list to disappear.

Question #8 – Children Information

To add children to a case, click on the link. The system will display/enable fields for the following information.

• Child Name (First, Middle, Last) • Sex • DOB • Reside with (Name)

Note: A total of six children can be added.

Note: If children data is not entered the associated questions below will not be activated.

• Question #2 – Are you seeking a temporary custody order for the children as part of this complaint?

o Select the radio button “YES” or “NO”.

o Upon selecting “YES” the children's name listed above are displayed with check box. You can select or deselect the check box of the corresponding children name entered.

Note: If “YES” is selected and the child’s name is entered, the name will be automatically pre-filled under Part I – Plaintiff Reliefs #12. This question along with the child’s name is disabled.

• Question #3 – Are you seeking ongoing support a the final hearing?

• No, visitation o Selecting this option, system will automatically check Part II – Defendant

Reliefs #1a. This question will be disabled.

o Yes, I want to suspend visitation.

o Yes, I would like visitation as follows. Explain Selecting this option, system will display a text box field. Type

visitation information. The maximum number of allowable characters is 150.

Selecting another option after selecting this option will collapse the entry field and any data entered will be lost.

If this option is selected, the system will automatically update Part II Reliefs - Defendant Reliefs #1c and display the text entered. This question will be disabled.

Note: If any text entered for this option is changed on the Part II – Defendant Reliefs #1c, system will reflect that change in the TRO Complaint - #3 question.

• Question #4 – Ongoing Support

o Select the radio button “YES” or “NO”. Self Dependant(s)

o Selecting the “YES” radio button, the system will display in red additional

information and open a text box field to enter data.

Question #5 – Medical Coverage

• Select the radio button “YES” or “NO”.

• Selecting the “YES” radio button, the system will display in red additional information and open a text box field to enter data.

• Click the check box for one or both fields below. The following fields will display: o Self o Dependant(s)

• Type data in the corresponding field checked.

Click on the button, system will validate the mandatory fields.

• If all the conditions are passed, the system will save all data, display confirmation at the top of the screen and navigate to the “Part I Reliefs” screen.

• If the conditions did not pass, system will display an error message and remain on the current screen.

Warning: If users do not click the button and the system times-out, all data entered will be lost. It is highly recommended that users periodically click on the

button when entering and modifying data.

Note: Upon clicking the button, the Temporary Restraining Order will save as a draft. The title of this screen will change from “Entry” to “Modify”.

PART I RELIEFS TAB This screen is used to enter/modify the Part I Reliefs Sought information.

Defendant Reliefs

The system displays Sought column to the left with checked box and the corresponding questions to the right.

• To enter the reliefs sought information, click on check box to the corresponding questions.

• The system will display a check in the box that was selected.

• Users are able to select/deselect most check boxes.

Pre-checked Reliefs Reliefs # 1, 2, 3, 4, 5, 6, and 10 are automatically checked and disabled except for Relief 1 and 3a. The user will be able to deselect these check boxes, if necessary.

Upon clicking sought for reliefs, the system may display a text box. If that relief is checked sought, user must enter data in the corresponding field.

Warrant

Selecting the check box for “Warrant to search and to seize weapons for safekeeping,” system will expand additional questions. All information in this section is displayed in red.

• Text boxes are displayed for questions “For any law enforcement officer”, #1 and #2. Click in the text area and enter the data.

• Once the data is placed in the text box, the check box will gray out. To reactivate the check box, the user will have to remove the text from the text box.

Plaintiff:

This section displays four questions. To enter reliefs sought for plaintiff information, click on check box to the corresponding questions.

• Reliefs # 12 and “Others relief for Children” are disabled.

o When “YES” is selected in question #2 on the TRO Complaint Tab (Seeking a temporary custody on the “Add Children” section) and the Children(s) name are

Findings Section

The system displays the following two options, select one by clicking on the corresponding radio button.

Note: Selecting one of the options is mandatory.

• Date - populated with system date after the user selects either the TRO Denied or TRO Granted radio button. The user may change the date if necessary by clicking on the calendar icon.

• Time - populated with system time, users may change if necessary by entering the data in the corresponding fields. For AM/PM, select from the drop down menu.

• Honorable – Type judges 's name of type one letter in the field and the chief judge of the municipality will display. Click on the judge’s name and it will populate the Honorable field.

• Municipal Court - Display field only. • County - Display field only.

• The judge’s name for that municipality will appear once the user types a value in the Honorable field.

• Once the judge’s name is affixed to the TRO the button will

be replaced by a button on the bottom of the screen and the TRO Draft will be saved as an order.

PENDING SERVICE This screen will display a list of all restraining orders pending service that originated in the user’s municipality and those restraining orders that have service requested by others. The user will be able to update service on docketed orders as well as TRO's pending court processing.

This screen will display for Law Enforcement and Municipal Court Judges. In addition to displaying pending service orders, the user will be able to view served, could not be served, requests for cancellation of service, unsuccessful service and requested service of an order through the drop down menu selection.

Note: Continuance Orders will be listed together with the unserved TRO/ATR. Continuance Orders must be served in conjunction with the TRO/ATR.

The user will select a case using the radio button and then select an option from the dropdown

box and click . Based on the order selected, the dropdown menu will display only the applicable service options. The following service options are:

• Request Service – If the case originated in the users municipality, the “Request Service” option will be available. The user may request another municipality to serve the restraining order via this option. Once an order is request for service the Request Service pop up screen will display.

• Could Not Be Served - Will display the “Could Not Be Served” pop up screen if the user is not the originator of the order. The user will complete the pop up screen and service will be updated on the order.

Note: If the user is the originator, the “Service Tab” will display. The user will update the “Could Not Be Served” field and save the order.

• Cancel Service Request - Only the originating municipality can cancel a request for service. Once the owner of the order cancels the request of service a message will display. The order will display on the Request Cancelled Screen for the requestee but the status of the requestor will remain on the Pending Screen.

• View/Print • Send Informational Copy – This function is only available for the originating municipality

of the restraining order.

Reminder: Only applicable service options will be displayed based on the case service status.

Service Status Processing

Orders will be automatically removed from the service tabs when:

• Pending Service - 14 days after the TRO is entered.

• When service is “Pending” but the order is removed from the Service Tab either because the TRO is Dismissed, FRO is entered, Amended TRO or the TRO is over 14 days old the service status does not change.

• Issuance of a Continuance Order (CO) automatically takes the restraining order off the “Pending Service” list.

• Served - 10 days after Service is entered.

• Request Service - Within 14 days of the request.

• Request Cancelled - Within 5 days of the requested date.

• Could not be Served - Within 5 days of notice that the restraining order could not be served.

• If the requested municipality could not serve the defendant they will send a "Could not be Served" notice to the requestor letting them know that they could not serve the

Select the county from the drop down list and the button to proceed to the “Home” Page.

MUNICIPAL TRO’s This screen displays a list of TRO drafts submitted by Law Enforcement for Municipal Judge’s review. Only Municipal Judges users have access to this tab.

Once the draft becomes an order, it will be removed from the Municipal TRO Tab. The TRO will then be displayed on the Pending Service Tab and the Pending Court Processing Tab, if not docketed.

Note: The users will be shown only those records to which they have access based on the user role.

FORMS This screen provides all users the capability to print blank order forms based on their user role. Municipal Court Judges and Law Enforcement users will be able to print blank TROs.

The user chooses the TRO Order to print and a PDF file for that order will be displayed. The TRO Order is a fillable form, however, if this form is completed it will not be documented in the system.

Note: This form can be saved onto the user’s desktop to be utilized for contingency purposes only. An example would be that the system was down and the user did not have access to create the TRO. The user will be able to access the fillable form but once the system becomes available, the user will have to enter the order into the eTRO System to document accordingly.

The Name Check Screen provides law enforcement with the capability to perform searches on individuals who have restraining orders issued. Law Enforcement will be able to search on three types of criteria: Name (Last, First), SSN (Social Security Number), SBI (State Bureau of Identification).

• Name (Last, First) • Date of Birth - (MM/DD/YEAR) • SSN – Social Security Number • SBI – State Bureau Identification

The Go To TRO button supplies the user with the capability to copy data from the DVCR to the eTRO System. See Copying data to the eTRO System on the following page for more information

• Plaintiff (PLA) or • Defendant (DEF)

Selecting the "GO To TRO" button will navigate the user to the eTRO System.

Note: The user may select just the Plaintiff Role, or the Defendant Role or may select both the Plaintiff and Defendant. If the Plaintiff Role is just chosen, only the Plaintiff data will be sent to the eTRO System.

FLOATING SIDE MENU The floating side menu is displayed on all the screens when entering or viewing an order/draft.

Floating Side Menu Details

• On the left side of your screen, the system will display a Floating Side Menu. The menu is always visible and will float/move as the page is scrolled.

• To view the details of the Floating Side Menu, click the “Save/Submit Option” to expand the menu.

• The following details maybe displayed on the Floating Side Menu depending on Judges signature.

o Save/Submit Options drop-down and “Select” the drop down box. The following options will display depending on the status of the TRO. Save as Draft displays when the user is saving the TRO without the

Judge’s signature.

o Click the “Spell Check” button and a Spell Check dialog window is displayed.

o If misspelled words are detected the following pop up screen will display.

o The misspelled word will be highlighted and there will be several suggestions of words that you may have meant to type.

• Buttons and Controls o Not Found – Words not recognized in the dictionary.

o Replace With – The word most likely matches the misspelled word that is

highlighted in the suggestions list.

o Suggestions – Words not recognized or considered misspelled, the system

determines which words in the dictionary are similarly spelled and displays a list of those words. The word most likely matches are highlighted.

o Replace – To replace only the single word currently highlighted.

o Replace All – To replace misspelled word with the currently highlighted word in

the suggestions section. If any identical instance of the misspell word is detected on the current screen, they will automatically be replaced with this function.

o Ignore – This functions lets you skip the highlighted word without changing it.

o Ignore All – This command is used to accept particular misspellings.

o Learn – Look up definitions and spellings via the Internet.

o Finish – This button closes the spell check dialog window. If changes are updated, then it will be preserved upon clicking the “Finish” button.

Note: Clicking the “Finish” button does not save your current screen.

Cancel Button

• Click on the “Cancel” button to cancel the changes on the screen and reset all the information to when the screen was loaded.

o System will display a popup message box.

o Click the “OK” button to navigate to the screen you previously access the order/draft.

o Click the “Cancel” button to close this popup message box and continue with the enter/modify process on this screen.

Note: Upon cancellation of order/draft creation process, all information entered or selected on the case will NOT be saved and will be lost.

LOCK/UNLOCK RECORD

The lock feature was designed to prevent data corruption by two users accessing and updating a case at the same time. A message will display notifying the “second user” that another user is accessing the case. This message displayed is as follows:

The message displays the User’s ID (primary user) that has the case open for editing. To release the record from lock mode, the primary user must exit the case before the secondary user can change any data.

The primary user must:

• Exit the case by using the Floating Side Menu and selecting “Cancel”. • A message will display asking the user if they want to proceed. Select “OK”.

• The eTRO application will need to be closed by clicking on either Close or exit eTRO from the upper right hand corner of the screen.

• Once the case is closed by the primary user, the secondary user will be able to reopen the case. The secondary user will have the exit the case and re-enter to have access to the “Modify” Mode.

Note: If the user is still receiving the lock message after the primary user has closed out of the application, the secondary user will have to sign out of the eTRO application and close the browser. Then log back in.
