CP;J 6.00 Unit Price PROCLAMATION NO. 361/2003 THE ADDIS ABABA CITY GOVERNMENT REVISED CHARTER PROCLAMATION WHEREAS, it is believed that Addis Ababa must become a suitable urban space for work and residence measurable by modem standards in view of the fact that it is the capital of the Government of the Federal Democrtic Republic of Ethiopia and the seat of the African Union and of a variety of international organizations as well as it is a reflection of a large and growing residents representatives of Nations, Nationalities and Peoples; WHREAS, the Constitution of the Federal De- mocratic Republic of Ethiopia stipulates that the residents of Addis Ababa have full power of self-government and that the details thereof shall be setout by law; WHWEREAS, it is necessary to create conditions which enable the city to maximize the achievements of its development objectives by giving due account to the best wishes and diligence of its residents and by relying on its development potentials; WHEREAS, in order that the competitiveness and developmental continuity of the city become real and being aware that the city can, by attracting investment, have substantial contribution to the improvement of the lives of its residents and to the opening up of a way for the economic development of the country, it is found necessary to enable the city cope with time through self-renwal so that its operations and processes become efficient, effective and equitable as well as change-generative, and, receptive; ~;J&T ;JH.IIJ r.Ut... ifill!     REVISED CHARTER PROCLAMATIONWHEREAS, it is believed that Addis Ababa must

    WHEREAS, it is found necessary to revise the AddisAbaba City Government Charter Proclamation No. 87/1997by taking into account experiences gained in its applicationand by looking into the organization and management of thecity from the prespective of democratic principles and goodgovernance as well as contemporary trends of growth anddevelopment;

    NOW, THEREFORE, in accordance with the provisionsof Articles 49(2) and 55(1) of the constitution of the FederalDemocratic Republic of Ethiopia, it is hereby proclaimed asfollows:

    PART ONEGeneral Provisions

    1. Short TitleThis Proclamation may be cited as the" Addis AbabaCity Government Revised Charter Proclamation No.361/2003.

    "

    2. DefinitionsUnless the context indicates otherwise, in this Charter:1) "City" means the Addis Ababa City;2) "City Government" means the Addis Ababa City

    Government;3) "Mayor" means the chief executive officer of the

    City Government;4) "Municipal Service" means water and sewerage

    service, road construction service, fire and emer-gency service, day to day services for residentsincluding civil status record operations, land de-velopment and management, city sanitation andbeatification and other services to be designated assuch by the City Government;

    5) "Sub-City" means a second administrative stratumof the City; .'

    6) "Kebele" means a third administrative stratum ofthe City but a unit of a sub-City;

    7) "Conditions of work" means the entire relationsbetween the City Goverment and its officials andemployees and shall include hours of work, salary,leaves, payments due to dissmissal, if any, health andsafety, compensation to victims of employmentinjury ,grievance procedure and other similar mat-ters.

    3. Legal PersonalityThe City Goverment shall have legal personality.

    4. NameThe name of the City is Addis Ababa.

    5. BoundaryWithout prejudice to the existing one.,the boundary of theCity shall be delimited by an agreement to be madebetween the City Government and Oromia RegionalGovernment or pursuant to the decision of the FederalGovernment.

    6. Working LanguageThe working Language of the City Government is '-'.Amharic.

    7. Rights of Resid~ts ,1) Without prej14li~tO tke constitutions of the Federal

    Democratic RepUblicof Ethiopia and other laws ofthe country,the ~side1its of the City have the right toseek and receive information, forward theiropinions, raise qne!Stions,and receive repiles concer-ning decisions relating to the City.

    2) Residents have the right to get services to berendered by the City Government in accordance withthe principles o(equality, .transparency and equity.

    3) Policies, budget!; ,plans and directives of the CityGovernment thust be publicized to residents.

    8. ElectionElections for the (:ouncils at all levels of the CityGovernment, held pursuant to this Charter, shall beconducted in accotd'ance with the electoral law of thecountry .

    PART TWOObjectives, Organization, Powers and

    Functions of the city Government9. Objectives

    The City Government shall have the objectives to:1) maintain good governance in which effectiveness,

    transparancy and accountability, to the residents,prevail; make the City one in which expedient andequitable municipal services and reliable securityand social harmony are ensured;

    2) enlarge the role of the City as a capital city of theFederal Government anrtas a seat of the AfricanUnion and different intrrnational and regional or-ganizations;

    3) create favourable condtions of living and work aswellas to facilitate conditions in which residentsdetermine' the overall operations of the City andbecome beneficiaries of its development;

    4) make the City atentre where Ethiopian Nations,Nationalities and Peoples reside in equality andexpress their cultures;

    5) make the City a place where the well-being andcomfort.ofres1ents are safely kept and particularlywhere children, women, the disabled, the elderly andother disadvataged segments of society avail them-selves of special support; .

    6) bring about the city's speedy economic developmentthrough the encouragement and enhancement ofinvestment and research;

    7) make the City a centre of commerce and industry ofthe country;and

    8) make theCiry a naturally balanced, clean, green andfavourable spotthrbugh the prevention of environ-mental pollution.

    10. Structure of the City Govemment Organs of Power1) The City Government Organs of Power are the

    following:(a) City Council;(b) Mayor;(c) City Cabinet;(d) City Judicial Organs; and(e) Office of the City Chief Auditor.

    2) Sub-City Organs of Power are the following:(a) Sub-City Council;(b) Sub-City Chief Executive; and(c) Sub-City Standing Committee.

    3) Kebele Organs of Power are the following:(a) Kebele Council;(b) Kebe1e Chief Executive;(c) Kebele S~ndihg Committee; and(d) Kebele Social Courts.

    2) The City Council shall have the powers and func-tions to:(a) adopt policies on matters falling within the

    purview of its power;(b) issue Regulations pursuant to powers vested in

    it by Proclamations enacted by the House ofPeoples'Representatives;

    (c) approve the short-term and long-term economicand social development plans and annual bud-gets of the City;

    (d) levy taxes and duties and set service charges onrevenue sources specifiied under this Charter;

    (e) elect from among its members, the Spokesper-son, Deputy Spokesperson and Secretary of theCouncil and establish the Secretariat of theCouncil;

    (f) elect, from among its members, the City Mayorand Deputy Mayor;

    (g) approve the appointment of members of theCity Cabinet upon the recommendation of theMayor;

    (h) approve, the appointment of the President, VicePresident and judges of the City Courts and ofthe Chief Auditor; as well as to establish theJudicial Administration Commission and todesignate its members;

    (i) approve, the appointment of presidents ofbodies accountable to it and having semi-judicial powers and of other officials whoseappointment has to be approved by it as per thelaw;

    (j) establish the executive organs and public enter-prises of the City;

    (k) establish the committees of the Council anddesignate their respective members fromamong its members;

    (1) designate an external auditor from among threecandidates to be proposed by the Mayor at anytime it is so required, and to examine and render

    . decision upon the report submitted by theexternal auditor; .

    (m) approve the quality standard of and charges formunicipal services;

    (n) determine the number of members of Sub-Cityand Kebele Councils;

    (0) allocate budgetary subsidy to Sub-Cities accor-ding to the formula it adopts;

    (p) examine and decide upon periodic reportssubmitted by the Mayor or by organs accoun-table to it;

    (q) approve loan agreements made with domesticsources as per the authorization of the FederalGovernment;

    (r) issue the Code of Conduct for members of theCouncil;

    (s) conduct investigation, hear witnesses, causeother evidence to be produced and renderdecision, according to Regulations to be issued,where it is alleged that the Mayor, DeputyMayor, the Council's Spokesperson and DeputySpokesperson, the City's Cabinet members, theChief Auditor or other members of the Councilhave committed breach of discipline.

    15. Term of Office of the City Council and Its MeetingProcedures1) The term of office ofthe Council shall be five years.

    The council shall have regular and extraordinarymeetings and the regular meeting shall be held everytwo months.

    2) There shall be a quorum where more than half ofmembers of the Council are present at its meetings.

    3) A decision, in any meting of the Council, may bepassed where more than half of the members inattendance second it.

    4) The meetings of the Council shall be open to thepublic unless it is otherwise necessary for the city'ssecurity or safety or for the protection of the interestof individuals or juridical persons.

    5) The Spokesperson of the Council may call anextraordinary meeting; he shall also call an extraor-dinary meeting where more than half of the membersof the Council so demand.

    6) The Council shall issue internal Regulations thatdetermine its operations.

    16. Keeping of Records by the City CouncilThe council shall have a register for its proceddings anddecisions. The Register shall be public unless the Councildecides otherwise in consideration of the security orsafety of the City, or the rights of individuals and others.

    17. Accountability and Dissolution of the Council1) The City Council shall be accountable to the Federal

    Government and to the residents of the City.2) The dissolution of the City Council may be effected

    by the House of Peoples' Representatives or by itsown decision. Without prejudice to Article 61 (3) ofthis Charter:(a) the City Council may dissolve itself before the

    lapse of its term of office in order for a newelection to be conducted.

    (b) where a coalition of political parties seizingexecutive power breaks up and fails to occupythe majority seats of the Council, the Cabinetshall be dissolved, and the political parties inthe Council shall be invited by the Ministry ofFederal Affairs to form a coalition Cabinetwithin a week. If the political parties fail to forma new Cabinet or to continue the coalition,however, the City Council shall be dissolved.

    (c) new election shall be held within six months ifthe Ciry Council is dissolved pursuant to sub-Article (2) (a) or (b) of this Article.

    (d) the new City Council shall cOIIll11enceworkwithin thirty days after the conclusion of theelection.

    (e) the executive organ in power, following thedissolution of the City Council, may not make,amend or repeal laws but only carry out day-to-day executive functions and undertake elec-tions.

    18. Spokesperson of the City CouncilThe Spokesperson, being accountable to the Council,shall:1) have a term of office co-extensive with that of the

    Council provided that he may be removed from hispost, prior to the end of such term, upon resignation,suspension from office or termination of his mem-bership in the Council; details thereof shall be set outby internal regulations of the Cpuncil;

    2) direct the Secretariat of the Council;3) represent the Council in all its dealings with third

    parties;4) call, and preside over, the meetings of the Council

    and co-ordinate the committees thereof;5) prepare the budget of the Secretariat of the Council .

    and implement same upon approval;6) employ and administer the staff of the Secretariat of

    the Council in accordance with civil service laws;7) ensure that laws adopted by the Council are

    published in the Addis Negarit gazette;8) execute disciplinary decisions passed by the Council

    against its members;9) give periodic briefings to residents on decisions

    passed by the Council and notify same to concernedorgans, ensure that documents of the Council aremade accessible to residents;

    10) prepare plans for capacity building of members ofthe Council and implement same jointly with concer-ned executive bodies;

    11) create cordial relations and exchange experienceswith internal and external, counterpart councils;

    12) perform other functions assigned to him by theCouncil.

    19. Deputy Spokesperson of the City Council,The Deputy Spokesperson, being accountable to theSpokesperson of the Council, shall:1) the provisions of Article 18(1) shall also be ap-

    plicable in respect of the Deputy Spokesperson;2) act on behalf of the Spokesperson in case of absence

    or incapacitation of the latter;3) perform other functions assigned to him by the

    Spokesperson.

    20. Secretary of the City CouncilBeing accountable to the Spokesperson of the Council,the Secretary of the Council:1) shall prepare. the agenda of the Council in consul-

    tation with the Spokesperson publish and keep theminutes of the Council;

    2) shall ensure that the minutes and documents of thecommittees of the Council are recorded and kept;distribute minutes in accordance with the internalregulations of the Council;

    3) may be removed from his post, prior to the end of histerm of office, oupn resignation, suspension fromoffice or termination of his membership in theCouncil; details thereof shall be set out by theinternal regulations of the Council;

    4) perform other functions assigned to him by theSpokesperson.

    PART FOUREXECUTIVE BODIES OF THE CITY

    21. Mayor1) The Mayor, being accountable to the City Council and

    the Federal Government, shall be the Chief ExecutiveOfficer of the City.

    2) Without prejudice to the generality of Sub-Article (1)of this Article, the Mayor shall:

    (a) execute decisons, laws, annual plan and budgetadopted by the City Council;

    (b) propose, to the City Council, diverse policies,economic and social development plans and an-nual budget of the City, subsequent to consultationthereon by the Cabinet; ensure the implementationthereof upon approval;

    (c) represent the City as an ambassador thereof;(d) ensure the observance of law and order in the City;(e) nominate Cabinet members of the City Council

    and have their appointment approved by theCouncil, as well as direct the Cabinet;

    (t) propose three candidates where the City Councildecides, as may be necessary, to appoint anexternal auditor;

    (g) subject to consulation with the Cabinet and inconsideration of professional competence, hireand fire the City Manager under a contract ofemployment for a definite period;

    (h) handle the grievances of residents;(i) represent the City at events of national and public

    holidays;(j) cause to be organized forums where plans, budget

    and work performances of the City are presentedto, and commented by, the public;

    (k) submit annual and, as the Council may determineas necessary, periodic reports to the Council;submit reports to the Ministry of Federal Affairspursuant to Article 61 (6) herin;

    (1) ensure that a standardized, equitable municipalservice delivery is implemented;

    (m) prepare and propose to the Federal Governmentthe amount of support needed by the City, afterconsultation thereon by the City Cabinet;

    (n) prepare and submit draft proclamations andregulations to the Council after consultationthereon by the Cabinet;

    (0) appoint the heads of the executive bodies of the. City, other than those whose appointment is

    approved by the council; designate Board Chair-persons and members for public enterprises andother organs of the City.

    (p) organize his own Office;(q) award prizes in accordnace with law;(r) perform other functions assigned to him by the

    City Council and the Federal Government;3) The term of office of the Mayor shall be that of the

    Council provided that he may be removed from his.post, prior to the end of such term, upon resignation,suspension from office or termination of his mem-bership in the Council; details thereof shall be set outby the internal regulations of the Council.

    PART FIVEOTHER EXECUTIVE BODIES

    26. Office of the City Government Chief Auditor1) There shall be an Office of the Chief Auditor of the

    City Government to inspect and report to the CityCouncil on the efficiency, perfonnance effectiveness,resoW"Ceutilization and administration thereof.

    2) The Office of the Chief Auditor ~hall be independent in theperfonnance of its functions.

    3) The Chief Auditor shall not be removed from his officebefore retirement, except for resignation or one of thefollowing reasons:(a) disciplinary 1reach, grave incompetence or poor

    perfonnance;(b) proven inability to fulfil his responsiblities because of

    illness; or(c) where the City Council decides by majority vote to

    that effect4) The Chief Auditor shall prepare and submit to the City

    Council the budget of his office and administer same uponapproval.

    27. Addis Ababa City Police Commission1. The City Police Commission, being accountable primarly

    to the Federal Police Commission and, by delegation, to theCity Government, shall:(a) be established by Regulations of the Council of

    Ministers issued pursuant to the Federal PoliceCommission Proclamation;

    (b) prepare and submit its plan and budget proposal to theMayor and implement same upon approval by theCity Council; submit annual and periodic perfor-mance reports, to the Mayor, for examination anddecision by the City Cabinet and the City Council.

    2) Without prejudice to the generality of sub-Article (1)of this Article, a sub-City mar.ager shall:(a) in consultation with the City manager, propose

    to the chief executive of the respective sub-Citythe utilization of municipal service organs andservice delivery alternatives existing at the levelof the sub-City; implement same upon ap-proval;

    (b) administer, in accordance with the applicablelaw, the employees of the municipal serviceorgans of the respective sub-City;

    (c) constitute and direct a management committeethat consists of the heads of organs subor-dinated to him and functions as per deter-minations of the City manager;

    (d) submit annual and periodic performancereports to the City manager and to the chiefexecutive of the respective sub-City;

    (e) prepare, in consultation with the City manager,the municipal services plan of the sub-City andsubmit it to the chief executive thereof; im-plement same upon approval;

    (t) execute decisions concerning municipalserVIces;

    (g) hire, Kebele managers, in consideration ofprofessional competence, as well as administerand discharge same under a contract of em-ployment for a definite period;

    (h) perform other functions assigned to him by theCity manager and by the chief executive of therespective sub-City.

    3) A sub-City manager may participate, without a vote, inmeetings of the Council of the respective sub-City.

    '38. Powers and Functions of a Kebele1) A Kebele, being a centre for development and direct

    popular participation as we.ll as a location for thedelivery of basic services, sh2.11:

    (a) with its council accountable to the resident there ofand to the respective sub-City Council, have suchpowers and functions as to be specified by the citycouncil,

    (b) facilitate conditions in order for services to beavailable within reach of the respective residents.

    an Appellate Court.2) The. First-Instance Court shall have first-instance

    jurisdiction over matters falling under the jurisidic-tion of the City Courts. ,

    3) The Appellate Court shall hear appeals from thedecisions of the First-Instance Court and otherbodies vested with judicial power.

    4) The City courts shall adjudicate in accordance withapplicable laws.

    5) Without prejudice to the provisions on applicationfor cassation under Article 42 hereinabove, deCisionsrendered by the Appellate Court shall be final.

    6) The organization of the City Courts is to bedetermined by law which the City Council shallissue.

    44. judicial Administration Commission of the Addis AbabaCity Courts.1) A Judicial Administration commission that directs

    operation of judicial matters by the City Courts shallbe constituted; details thereof are to be specified bylaw which the City Council shall issue.

    2) There shall be a representative of Federal Courts onthe Commission.

    45. Appointment and Term of Office of Judges1) The City Judicial Administration Commission shall,

    before submitting a shortlist to the City Council tohave it appoint judges of the City Courts, solicit theFederal Judicial Administration ComJJ1i::si~m'sopinion on the candidates and, through the Mayor,forward said'opinion, together with its recommen-dations, to the City Council, Where the FederalJudical Administration Commission does notforward its opinion within three months, the shortlistfor appointment shall be submitted to the CityCouncil.

    2) No judge shall be removed from his office, withoutconsenting thereto, except under the following con-ditions'a) where the Judicial Administration Commission

    decides to remove him for violation of dis-ciplinary rules or on grounds of professionalincompetence:or poor performance; or

    b) where it is decided that he can no longer carryout his duties on account of illness; and

    c) where the City Council approves, by majorityvote, the decision of the Judical Administrationcommission.

    46. LabourRelations BoardThe provisions of the Labour Proclamation No. 42/1993(as amended) shall be applicable with respect to juris-dication, organization and procedure of the LabourRelations Board of the City Government.

    47. Civil Service Tribunal1) The Civl Servife Tribunal of f.l1eCity Government

    has the power to hear appeals loged, pursuant toCivil Servie Laws, by Civil Servants under the CityGovernment.

    60. Public Enterprises of the City1) Public enterprises of the City shall be directed by a

    board.2) Public enterprises of the City shall be subject to

    applicable laws.3) The Mayor shall designate the chairpersons and

    members from among candidates nom inated by theCity; the boards shall be accountable to the CityManager.

    4) Public enterprises shall report to the City Manager.

    PART NINEINTERGOVERNMENTAL RELATIONSlllP

    61. The City Government and the Federal Government1) The relationship that the City Government maintains

    with the Federal Government shall take cognizanceof the responsibilities of the latter.

    2) The City Government is a component part of theFederal Government. It shall be accountable to theFederal Government concerning security,diplomatic relations as well as policies, laws andstandards thereof.

    3) The Federal Government has the power to dissolvethe City Government and to constitute a transitionalgovernment, as per the decision of the House ofPeoples' Representatives, where an act endangeringthe Constitution is committed by the City Councilorwhere the City Government fails to manage securitymatters and emergency situations.

    4) The Federal Government shall remgySJhe CityGovernment in power and organize ~'transitionalgovernment thereof, where decidea as under sub-Article (3) of this Article. The Prime Minister shallensure that such execution conforms to the decisiongiven by the House of Peoples' Representatives andto the time-limit thereby set.

    5) The Ministry of Federal Affairs shall, by way ofrepresenting the Federal Government, follow up theactivities of the City Government and support thecapacity-building undertakings of the City.

    6) The City Government shall submit to the Ministry ofFederal Affairs annual and periodic performancereports on its plan, budget and the overall state ofaffairs of the City.

    7) Federal Government organs situated in the City shallhave the duty to observe proclamations andRegulations issued by the City Government.

    8) Services provided to the City by Federal organs shallbe run in collaboration and agreement with the CityGovernment.

    62. The Relashionship of the City Government and theOromia Region1) The City Govenment shall have such a relationship

    with the Oromia Region as rests on fruitfulcooperation. .

    c) The special interest of the Oromia Region shall be.

    respected as provided under Article 49(5) of theConstitution of the Federal Democratic Republic ofEthiopia. The details thereof shall be set out byagreement to be made between the City Govern-ment and the Oromia Region or by law to be issuedby the House of Peoples' representatives.

    63. Relations with Other Cities and Regions1) The City Government may establish relations with

    other local cities and the regions as well as withforeign cities.

    2) The City Government may undertake, locally,excahnge of experience and cooperation with otherciteis and the regions in respect of policies,infrastructure and service delivery in order topromote the interest of residents.

    3) The City Government may establish such relationswith foreign sister cities as would, particulary,involve economic and technical cooperation culturalexchange, voluntary service excahnge of goods,training as well as promotion of tourism and invest-ment opportunities.

    PART TENMISCELLANEOUS PROVISIONS

    64. ExperimentationThe City Government may be aut.'lOrized by the CityCouncil to undertake experiementation in connectionwith its powers and functions. The undertaking andevaluation of such experimentation shall be effected asper the time table the Council sets thereto.

    65. Amendmentof theCharter ,Amendment proposals on this Charter may be initiatedby the City Council or by the appropriate organ of theFederal Government. The Prime Minister shall, subject tobringing such proposals before the Council of Ministersand approval thereof, forward the matter to the House ofPeoples' Representatives for its decision thereon.

    66. Transitory Provisions1) Councils and Executive Committees of different

    levels, constitued under the City Goveniemtn beforethe coming into force of this Charter, shall bedissolved upon establishement of the ProvisionalGovernment of the City in accordance with sub-Article (2) of this Article.

    2) A Provisional City Government to stay in poweruntil the next City Council election shall be desig-nated by the Prime Minister. Is shall take-over thepowers and functions of the City Government andassume the respective powers and functions herebyvested in the City Council and the City Council andthe City Cabinet. The Mayor of the City under theProvisional GOllernmc!nt thereof shall exercise thepowers and functions herein given to the office of theMayor.

    3) The Provisional Government:(a) shall designate sub-City and Kebele

    Provisional Government;(b) shall effect sub-City and Kebele delimitations

    in accordance with this Charter;(c) shall reorganize the administrative offices of the

    City Government as well as reassign, hire anddismiss employees in conformity with theorganizational structure it is to approve;

    (d) may establish during the transition period Cityas well as sub-City and Kebele AdvisoryCouncils, comprising of inidividualsnominated by respective residents and differentsections of society, in order to enhance theorganized participation of residents in develop-ment, building of democracy and service de-livery as well as to help render decisions in theinterest of residents; subject to such detailsthereof as it shall subsequently set out.

    4) The Provisional Government of the City shallreassign, train and may, where necessary, discahrgeincumbent Executive Committee members. It shallassign, members of its leadership by way of appoint-ment and transfer as well as discharge same asnecessary.

    5) The rights and obligations of such offices orjuridicalorgans of the City Government as are supplanted oramalgamated by law as per the organizationalstructure to be approved by the Provisional CityGovernment, shall be transferred to the correspon-ding offices or juridical organs thereby establishedor, where found appropriate, the matter shall bedecided by the Provisional Government.
