Preface

Act regarding library services was passed by the Danish parliament, Folketin-get, in the summer 2000, being the latest act in a long line of Danish publiclibrary acts since the first one appeared in 1920.

The ambition of this act is to create an adequate framework for the library inthe information society, that is to say the networking hybrid library.

It aims to do so by defining the library as ’extended’ in relation to media andby providing more flexible rules on the development of library infrastructure.Furthermore by establishing an Internet-based union catalogue with searchingand ordering facilities, by placing all relevant academic libraries under an obli-gation to contribute to the interlibrary lending system and by establishingregulations between municipalities in order to support a closer inter-municipalco-operation.

The act continues the basic traditions in Danish public libraries, above all thefree – and free of charge – and equal access to all library media – includingInternet access. And it is still an obligation for all municipalities to run apublic library.

However, it is also significant that the act gives provisions for libraries to char-ge users for extended services, that the libraries are even expected to establishnew chargeable services and that for instance express delivery service is sup-posed to fall into this category, as are various learning and consultancy servi-ces.

During the preparatory legislative work we experienced a marked professionalinterest from many countries – and we actually promised to prepare an Englishversion of the act once it was passed. That promise is hereby fulfilled.

§ 1. The objective of the public librariesis to promote information, education andcultural activity by making available books,periodicals, talking books and other suit-able material, such as recorded music andelectronic information resources, includingInternet and multimedia.

(2) The public libraries must endeavourto make available videos.

(3) The public libraries promote munici-pal and government information and infor-mation about society in general.

§ 2. The objective of the public librariesshall be achieved by observing quality,comprehensiveness and topicality in thechoice of materials to be made available.These criteria alone must be the decisivefactors and not any religious, moral orpolitical views which might be expressedin the material.

§ 3. The municipal council is obliged,possibly in co-operation with other munici-pal councils, to run a public library withdepartments for children and adults. Themunicipal council may enter into an agree-ment with another municipal council oncomplete or partial library service.

(2) The municipal council must as far aspossible1) establish library service for those

children and adults who are unable to visit the library in person,

2)adapt the libraries’ opening hours according to the users’ needs and

3)establish branches or provide other ser-vice points where the size and character of the municipality make this expedient.(3) The head of a public library must

have a relevant professional background.(4) Municipal councils may appoint a

library council with a view to a co-ordina-tion of library services between severalmunicipalities.

§ 4. Upon consultation with the munici-pal parties the Minister for Culture may laydown detailed rules concerning the publiclibraries’ materials and the use of these.The rules may i.a. concern the contents ofthe libraries’ collections, the libraries’ opti-on - in specific cases – to request a depositin connection with a loan and the possibili-ties for restricting loan of material.

§ 5. The public libraries are at the dispo-sal of everyone for use on the premises andfor the loan of materials. The obligation tolend material applies to the items mentio-ned in § 1 (1).

(2) Through participation in the generalinterlibrary loan service the public librariesmust endeavour to provide the users withsuch material as the library itself does notpossess.

§ 6. The public libraries may establishand run service points in companies andinstitutions or enter into agreements onprovision of library service to these.

(2) Expenses in connection with libraryservice to government, county and othernon-municipal institutions must be paid bythe institutions in question.

§ 7. The municipality’s public librariesmust co-operate with the municipal schoollibraries. Identical cataloguing systems etc.must be used in public libraries and schoollibraries.

Part 2Government tasks within the library

domain

The government’s tasks

§ 8. The government encourages co-operation within the library sector andendeavours to ensure that through the pub-lic library the users have access to govern-ment and government-supported libraries’material, cf. §§ 9-18.

County libraries

§ 9. The county libraries act as main loancentre for the public libraries by endeavou-ring to obtain material to the extent that thepublic libraries do not themselves possessthis material, cf. § 11.

§ 10. Upon consultation with the munici-pal parties the Minister for Culture decideswhich public libraries must also act ascounty libraries.

(2) When making this decision it must betaken into consideration that the library’smaterials, staff and premises all measureup to the standard required for the professi-onal conduct of the special duties of acounty library.

§ 11. Concerning the county library ser-vice the Minister for Culture enters into anagreement with the municipality whosepublic library carries out this function.

(2) The agreement must include a de-scription of the tasks which the countylibrary carries out on behalf of the numberof public libraries which it serves. Theagreement must include a description ofthe services which the county library

makes available free of charge. The agree-ment may i.a. concern the tasks aimed at aregional co-ordination within a definedgeographical area and at strengthening pro-fessional skills in the libraries.

§ 12. The government pays the expensesin connection with the county library servi-ce.

(2) The government grant to the countylibraries is stipulated in the annual govern-ment budgets.

Government libraries

§ 13. The government runs a number oflibraries with a view to serving educationalestablishments, institutions and research.

(2) A government library is at the dispo-sal of anyone for use on the premises andfor loan of material and participates in thelibraries’ general interlibrary loan co-ope-ration in so far as the task forms part of theprerequisite for the grant to the library.

(3) A library which receives subsidyfrom the government is at the disposal ofanyone for use on the premises and forloan of material and participates in thelibraries’ general interlibrary loan co-ope-ration in so far as the task forms part of theprerequisite for the subsidy to the library.

(4) Upon consultation with the appropri-ate ministers the Minister for Culture laysdown detailed rules for the obligations ofgovernment and government-supportedlibraries, mentioned in (2) and (3). Therules may i.a. concern the libraries’ option- in specific cases - to request a deposit inconnection with a loan and their possibilityfor restricting the loan of material. Whendetermining the rules specific conditions inrelation to the individual libraries may betaken into consideration.

§ 14. The State and University Libraryacts as main loan centre for the publiclibraries by1)making available books, periodicals and

other suitable material to the public libraries,

2)effecting loans nationally and internatio-nally,

3)providing the public libraries and other relevant institutions with material speci-fically intended to fulfil the needs of refugees and immigrants and

4)maintaining a central repository library function for the public libraries.

§ 15. The Danish National Library forthe Blind acts as main loan centre for thepublic libraries by providing the librarieswith material specifically intended for thepromotion of information to the blind,visually handicapped, dyslexics and otherswho due to a handicap are unable to orfind it difficult to read a printed text. TheDanish National Library for the Blindeffects loans nationally and internationallyin connection with the public libraries’ ser-vice to the group of users mentioned.

(2) The Danish National Library for theBlind may advise the libraries on conditi-ons relevant to the service to the group ofusers mentioned in (1).

Other government tasks

§ 16. The government pays the expensesin connection with the compilation of thenational bibliography which forms part ofthe national common library catalogue.

(2) The government strives to ensure thatas far as possible the national common li-brary catalogue is made available to every-one by access via Internet.

§ 17. The government provides subsidiesfor the libraries of the German minority inSouthern Jutland.

(2) The government may provide subsi-dies for library service to other specialgroups.

(3) The Minister for Culture may laydown detailed rules for the submission ofaccounts, the auditing proficiency and theauditing process in connection with subsi-dies paid in accordance with (1) and (2).The Minister for Culture may requestfurther material from the recipients of thesubsidies and submit this to the NationalAuditors for further auditing.

§ 18. The government provides subsidiesfor development within the public andschool libraries.

Part 3Special provisions

The public libraries

§ 19. Loan of material from the publiclibrary and service provided in the libraryare free of charge for the user, cf. however§§ 20 and 29.

§ 20. The municipality may charge theuser for special services associated withthe public libraries’ general service, butwhich go beyond use on the premises, loanof material and general advice. The muni-cipality may also offer for sale knowledgeaccumulated in the public library in con-nection with solving ordinary library tasks.The municipality may process and furtherdevelop this knowledge with a view tooffering it for sale. The sale of this know-

ledge must be prepared in such a way asnot to impair the running of the generallibrary services to an unreasonable extent.

(2) Services, mentioned in (1), must beexpressly requested by the user.

(3) The municipal council determines thesize of and the way in which the fee shouldbe charged for the services mentioned in(1), cf. however (4).

(4) If the services mentioned in (1) areoffered in competition with private parties,the prices for the services must be fixedaccording to market conditions to avoidunfair competition.

(5) The municipality’s sale of servicesthat are offered in competition must notover a period of three years show a totaldeficit.

(6) Upon consultation with the Ministerfor the Interior the Minister for Culturelays down detailed rules on price fixingaccording to (4) and submission of ac-counts in connection with the municipa-lities’ sale of services mentioned in (1),cf. (4) and (5).

§ 21. Municipalities may charge for over-due material. The fee must not exceedDKK 20,- for items which a user hasborrowed simultaneously, which have thesame loan period and which are returnedtogether, for children and young peopleunder 14 the fee must not exceed DKK10,-. If the loan period is exceeded bymore than 7 days, the fee may be raised toDKK 110,- for children under 14, however,the fee must not exceed DKK 55. If theperiod is exceeded by more than 30 days,the fee may be raised to DKK 220,-, forchildren under 14 the fee must not exceedDKK 110,-.

(2) The amounts mentioned in (1) are to

be adjusted on 1. January, beginning withthe 1. January 2001 on a rate adjustmentpercentage, rounding off to amounts divi-sible by 5.

§ 22. By participation in the interlibraryloan co-operation a municipality may re-quest payment from another municipalityfor loans, however not for loans effected aspart of the county library function. Thepayment cannot be levelled at the user.

(2) Upon consultation with the municipalparties the Minister for Culture lays downdetailed rules for the payment mentionedin (1). The rules may i.a. concern the sizeof the fee and the way in which it is char-ged, including notice of fee being charged.

§ 23. Having given reasonable notice themunicipality may charge a fee if a userfrom another municipality borrows materi-al from the public library. Payment is re-quested from the user’s municipality of re-sidence and cannot be levelled at the user.

(2) Upon consultation with the municipalparties the Minister for Culture lays downdetailed rules for the payment mentionedin (1). The rules may i.a. concern the sizeof the fee and the way in which it is char-ged, including notice of fee being charged.

§ 24. The municipality may charge theuser for the issuing of a replacement ticket.

Government libraries

§ 25. Government and government-sup-ported libraries which have obligations inaccordance with § 13, (2) and (3) lendmaterial and offer service in the libraryfree of charge to the user, cf. however § 27,(1) and § 29.

§ 26. Government and government-sup-ported libraries which have obligations inaccordance with § 13, (2) and (3) effectloans to the public libraries free of charge.

§ 27. Government and government-sup-ported libraries which have obligations inaccordance with § 13, (2) and (3) maycharge the users for specific library servi-ces that are associated with the generallibrary service, but which go beyond useon the premises, loan of material and gene-ral advice.

(2) Upon consultation with the relevantministers the Minister for Culture laysdown detailed rules on the government andgovernment-supported libraries’ services,mentioned in (1). The rules may i.a. con-cern which services may be chargeable,including the size of the amount.

§ 28. A government library may charge afee for overdue material. The fee must notexceed DKK 5,- per unit. If the loan periodis exceeded by more than 7 days the feemay be raised to no more than DKK 25. Ifthe loan period is exceeded by more than30 days, the fee may be raised to no morethan DKK 50,-. The amounts are adjustedper 1. January, beginning with the 1. Janu-ary 2001 on a rate adjustment percentage,rounding off to amounts divisible by 5.

(2) Government-supported libraries maycharge a fee for overdue material in accor-dance with (1).

Common regulations

§ 29. An agreement between a libraryand a supplier or rights holder on deliveryof material to a limited group of users maycontain a provision to the effect that

delivery of material to users outside thegroup can be effected by payment of a spe-cial consumer determined license fee. Alibrary may decide that such a fee be level-led at the user.

§ 30. Upon consultation with the munici-pal parties and relevant ministers the Mini-ster for Culture may decide that the libra-ries must charge for ordering of materialvia Internet access to the libraries’ com-mon library catalogue.

(2) The fee is charged by the library thateffects the order.

(3) Upon consultation with the municipalparties and relevant ministers the Ministerfor Culture lays down detailed rules on thecharging of the fee mentioned in (1). Therules may i.a. concern the size of theamount, the way in which it is requested aswell as exceptions from the obligation topay.

§ 31. A library may exclude a user fromborrowing at the library if the person inquestion has to a considerable extent vio-lated his obligation to return borrowed ma-terial in undamaged condition.

(2) Exclusion from borrowing at thelibrary may also occur if a user has omittedto pay the fees according to §§ 21 and 28.

(3) Upon consultation with the municipalparties and relevant ministers the Ministerfor Culture lays down detailed rules forexclusion. The rules may i.a. concern gui-delines for exclusion, notice and exclusionperiod.

§ 32. A bailiff ’s order may be implemen-ted regarding fees which have been deter-mined according to §§ 21 and 28 if theamount due is DKK 200,- or above.

§ 33. Outstanding fees according to § 21and § 28 (1) can by the collecting authori-ty, with a surcharge for extra expenses, becollected by withholding of salary etc.according to the rules on collection of per-sonal taxes in the act on deduction at sour-ce. Furthermore, for an amount corre-sponding to the unpaid fees with a surchar-ge for extra expenses, a municipality entersinto the right to payment of overpaid taxand labour market contribution with com-pensation and interests as well as expeditedreturn of tax payment according to the acton deduction at source.

(2) The Minister for Culture may laydown detailed rules on the procedure inconnection with withholding of salary.

(3) The collecting authority may requestsuch information from the taxation authori-ties and other public authorities as isnecessary for effecting the collection of thein (1) mentioned amounts, including infor-mation on income and capital. The infor-mation can be transferred electronically.

§ 34. In the regulations for the procedurein connection with withholding of salaryfor unpaid fees according to § 33 (2) apenalty may be imposed for infringementof the stipulations in the regulations.

(2) Criminal liability may be imposed oncompanies etc. (legal persons) according tothe provisions in Part 5 of the penal code.

§ 35. The libraries must provide a set ofrules for their users. The rules must includeconditions for borrower’s identification,loan period, charge of deposit, violation ofthe obligation to return borrowed materialin undamaged condition, charge of finesand fees and implementation of bailiff ’sorder.

Part 4Concluding conditions

§ 36. The Act comes into force 1. July2000. At the same time Act No. 1100 of22. December 1993 on Public Librariesetc. is repealed.

(2) The right to borrow recorded musicand multimedia from other public librariesthan the library of the municipality of resi-dence, cf. § 5 (1) does not take effect until1. January 2003.

(3) The public libraries’ and governmentand government-supported libraries’ char-ging of fees for overdue material accordingto the regulations in §§ 21 and 28 does nottake effect until 1. January 2003.

§ 37. Until the Minister for Cultureaccording to this Act has appointed thelibraries which will act as county libraries,the present county libraries are maintained,cf. § 8 in Act No. 1100 of 22. December1993 on Public Libraries etc. Furthermorethe special grants to the metropolitanmunicipalities of Copenhagen and Frede-riksberg for that part of the library servicewhich corresponds to the county libraryservice, cf. § 11 in the Act mentioned, shallbe maintained.

(2) The public libraries’ possibility ofcharging a fee for overdue material, cf. §18 in Act No. 1100 of 22. December 1993on Public Libraries etc., shall be main-tained until 31. December 2000.

§ 38. This Act does not apply to theFaeroe Islands and Greenland.

Pursuant to § 4, § 13 (4), § 20 (6), § 22(2), § 23 (2), § 27 (2), § 31 (3), § 33 (2)and § 34 in Act No. 340 of 17. May 2000on library services the following provisionsapply:

Part 1The public libraries

The public libraries’ materials etc.

§ 1. The public libraries must each year,with due regard to the character of the areaserved, acquire a suitable part of publishedDanish works.

(2) Prior to the disposal of materials,which have been de-accessioned from thecollections of the public libraries andwhich are considered suitable for reuse,these works must be offered to the Stateand University Library.

§ 2. The municipality may request a de-posit or demand surety from a user bor-rowing material from the public library, ifthe user is not domiciled in the municipa-lity.

§ 3. If a public library runs a departmentin an institution or a company, the depart-ment’s materials are to be regarded as partof the public library’s collection, unlessotherwise agreed.

§ 4. When cataloguing and classifyingthe materials the same rules should be fol-lowed as those applied for the preparationof the Danish national bibliography.

The public libraries’ sale of services which are offered in competition with

private parties

§ 5. Before submitting a tender and ente-ring into an agreement about a particulartask which is offered in competition withprivate parties, cf. § 20 (1), cf. (4) of theAct, the municipality must work out acalculation of the total costs involved inthe municipality’s taking on the task inquestion or the type of task in question.

(2) The price of a task must be determi-ned in such a way that it will, as a mini-mum, cover the estimated total costs inconnection with carrying out the task.

§ 6. The calculation of a municipality’stotal costs in connection with carrying outa task in accordance with § 20 (1), cf. (4)of the Act must include:1) all direct costs associated with the

carrying out of the task, for example salary incl. pension contribution etc., as well as overtime and extra work, officialjourneys, materials and specifically acquired apparatus, and

2) all indirect costs associated with the

performance of the task, for example indirect wages costs, share of joint costs for example management, administrati-on, rent, equipment, development etc. and statutory insurance, pension obliga-tions, interest on working capital, interest and depreciation on investment funds as well as calculated costs for any other facilities which have been providedin connection with the task.

§ 7. As regards the services offered inaccordance with § 20 (1), cf. (4) of theAct, the municipality must prepare a cur-rent registration of the returns and costs inconnection with the tasks, cf. § 6.

(2) Each year the municipality must in-clude in its annual accounts a detailedreport on the total costs involved in car-rying out the tasks in accordance with § 20(1) cf. (4) of the Act. The report must con-tain an overall status for the annual activiti-es within the area as well as informationon status for the activities during the pasttwo accounting years.

The public libraries’ interlibrary loan co-operation and loans to users domiciled

in other municipalities

§ 8. Payment for loans effected as part ofthe public libraries’ interlibrary loan co-operation, cf. § 22 (1) of the Act, is fixedat DKK 25,- per unit. Postage and packingmay also be charged for.

§ 9. A lending municipality may inaccordance with § 23 (1) of the Act, chargefor loans to citizens from another munici-pality when these exceed 7% of the bor-rowing municipality’s total loans. If thelending municipality also functions as

county library, the lower limit is fixed at10%. A borrowing municipality can onlybe charged by a lending municipality, if theintermunicipal loans amount to at least1000 units.

(2) A borrowing municipality’s totalnumber of loans include loans from own(local) library service to own (local) citi-zens, to citizens from other municipalitiesand to other libraries. When a municipalityhas established co-operation with othermunicipalities on joint administration of apublic library or has entered into agree-ment with other municipalities on fulllibrary service, cf. § 3 of the Act, the loansfrom these municipalities are included inthe registration of the total number ofloans.

(3) A lending municipality’s intermunici-pal loans are counted after deduction forthe borrowing municipality’s intermunici-pal loans to the lending municipality. Thededuction is done when calculating thelower limit of 1000 units and when calcula-ting the total number of chargeable loans.

(4) The payment is fixed at DKK 10,-per unit lent. The payment is worked outon the basis of the volume of loans over aperiod from 1. January to 31. December ina year and can not be requested before theend of the period. Notice must be given atleast 18 months prior to the time of requestfor payment. For the period 1. January to31. December 2002, request for paymentcan not take place before 1. January 2003.

(5) In connection with serving notice alending municipality must offer a bor-rowing municipality the possibility to ne-gotiate the establishment of co-operation asan alternative to intermunicipal payment.

§ 10. Government and government-sup-ported libraries which have obligations inaccordance with § 13 (2) and (3) of theAct, can in consideration of the library’sobjectives in special cases prioritise theservicing of the library’s primary users.By primary users is meant researchers, stu-dents, staff and others attached to the insti-tutions which the library serves.

(2) The libraries may in specific casesrequest a deposit or surety from users whoare not included in the library’s primaryuser group.

§ 11. The Danish National LibraryAuthority annually announces whichgovernment and government-supported li-braries have obligations in accordance with§ 13 (2) and (3) of the Act.

§ 12. A special service, cf. § 27 (1) ofthe Act, is constituted by a particularlyresource-demanding task.

(2) A special service must be expresslyrequested by the user.

Part 3Common regulations

Restrictions in access to borrowing material from the library and exclusion

of borrowers

§ 13. If a library holds material of parti-cular value, of which only a few copiesexist or which for other reasons is less sui-table for lending, the library is entitled todecide on certain restrictions in access toborrowing the material.

§ 14. Exclusion in accordance with § 31of the Act, can be enforced if a user re-peatedly has failed to return materials orreturns borrowed material in damaged con-dition.

(2) Exclusion in accordance with § 31of the Act, can further occur if a user hasomitted to pay the fees stipulated in §§ 21and 28 of the Act, if the amount due isDKK 200 or more.

(3) Exclusion of a user according to (1)and (2) must be pre-empted by 7 days writ-ten notice. If exclusion according to (1) isdue to the in § 13 mentioned material,exclusion may be effected without noticebeing given.

(4) If the user settles the matter with thelibrary, for example by returning the mate-rial, by replacing damaged material or bypaying the fees due, the exclusion must bewithdrawn.

Withholding of salary in connection with outstanding fees for exceeding

the loan period

§ 15. The collecting authority makes thedecision as to withholding of salary etc.according to § 33 of the Act on outstandingfees which are requested in accordancewith § 21 and § 28, (1) of the Act, withadded costs.

(2) The decision is made following anassessment of debtor’s personal and finan-cial conditions, cf. Act on tax deduction atsource, § 73 (3).

(3) Debtor is obliged to provide the col-lecting authority with all the necessaryinformation about personal or financialconditions which is important in relation tothe withholding of salary and to the questi-on as to whether the withholding can beeffected.

§ 16. The collecting authority informsthe debtor at once about the decision. Thismust be done in writing and must state thekind of debt involved and the amount,including costs. The message must further-more quote the content of § 33 of the Act,as well as that of §§ 17-19 of this ministe-rial order.

§ 17. A decision on withholding of sala-ry is effected by reporting to the CommonRegister for Withholding of Salary, cf. § 3in Act on the Common Register forWithholding of Salary.

§ 18. The person in charge of the with-holding of salary pays the appropriateamount to the Common Register forWithholding of Salary. Payment is effectedat the same intervals as the withholding ofsalary. The amounts fall due on the 1. ofthe calendar month following the withhol-ding of salary with deadline on the 15. inthe settling-month. If the last day for pay-ment falls on a Saturday, Sunday or a holi-day, the deadline is extended to the firstordinary weekday.

(2) Upon payment the person in chargeof the withholding of salary must providewritten information about debtor’s personal registration number, name and address,the size of the amount withheld and the

size of the amount of income which is thebasis for the calculation of the withhol-ding.

§ 19. The person in charge of thewithholding of salary must, if the debtor isnot or has ceased to be employed at thesame place, or he is no longer on the pay-roll, within 5 days inform the CommonRegister for Withholding of Salary in wri-ting about this.

(2) Upon request the person in charge ofthe withholding of salary must provide theCommon Register for Withholding of Sala-ry with information about the debtor’s con-ditions of work and financial conditionsrelevant to the withholding. Answer mustbe provided within 14 days after the receiptof the request.

§ 20. Anyone violating § 15 (3) and§§ 18 and 19 will be fined.

(2) Companies etc. (legal persons) maybe enjoined criminal liability according tothe regulation in part 5 of the penal code.

etc.

§ 21. The Ministerial Order comes intoforce on 15. November 2000.
