Sub: Request for Extension of validity of TOR & Public Hearing Exemption for our proposed expansion of asbestos cement manufacturing unit from 78,000 TPA to 1,20,000 TPA at Village Velemala, Mandal R.C.Puram, District Medak, Telangana –– Reg.
Ref: TOR letter issued by honourable Ministry vide No- J-11011/215/2012-IA II (I) dated 18th March
2013. Sir, We have proposed for expansion of asbestos cement manufacturing unit from 78,000 TPA to 120000 TPA at Village Velemala, Mandal R.C.Puram, District Medak, Telangana. Form-1 & Prefeasibility report along with proposed TOR have been submitted vide the letter dated 20-11-2012 and accordingly the project was considered by EAC (Industry) in its 5th Meeting held during 31st January to 1st February 2013 and subsequently TOR letter (enclosed as ANNEXURE - 1) was issued vide reference cited above with a direction to get the Public Consultation conducted by State Pollution Control Board (SPCB). Accordingly we have submitted the Draft EIA report to Telangana State Pollution Control Board, requested for conducting Public Consultation vide letter dated 21-10-2014 (received by the PCB on 31-10-2014) (enclosed as ANNEXURE - 2). Subsequently TSPCB is obligated to conduct public Hearing as Board has issued show-cause notice dated 08-11-2014, in compliance of the orders issued by the Honourable High Court, dated 13-10-2014 in WP No. 3367 of 2006 wr.t. the relocation of Industries located within 10 Km. Radius of Osman Sagar & Himayat Sagar Lakes. As per this our Industry is also falling within 10 Kms. radius of Osman sagar & Himayat Sagar lakes. Subsequently TSPCB has written a letter to the Honourable Ministry requesting the clarification on conducting Public Hearing for the expansion project vide letter dated 19-11-2014 ( Copy of the letter is enclosed as ANNEXURE - 3). We have submitted our proposal (Form- 1 & PFR) to the MoEF due to the Following:

1. The state Govt. Vide G.O. No. 111 dated 08-03-1996 issued orders for total prohibition of polluting
industries within 10 Km. radius of Osman Sagar & Himayat Sagar lakes (both upstream & downstream
side of the lakes). Our plant is situated within 10 km. radius of these lakes.
2. Subsequently we have filed an appeal No.6 of 2010 in Hon'ble Appellate Authority against the directions
issued by the Board. The Hon'ble Appellate Authority vide order dt. 25.03.2011 passed orders setting
aside the order dt. 31.12.2010 stating that "The directions of the Supreme Court with regard to
relocation of the industries located within 10 Kms radius of the two lakes are not applicable to the
Appellant industry".
3. The Board approached Hon'ble High Court in W.P.No.19006 of 2012 against the orders of Hon'ble
Appellate Authority dt. 25.03.2011. The Hon'ble High Court vide order dt. 15.11.2012 transferred the
petition to National Green Tribunal at Chennai. The Hon'ble NGT vide order dt. 26.11.2013 disposed off
the case stating that "the tribunal is unable to find any reason or circumstances to interfere with the
reasoned judgment of the Appellate Authority made in Appeal No. 6/2010".
REQUEST -1: We invite your kind attention to the Office Memorandum issued by MoEF vide dated 10th December, 2014 stating that the exemption from Public Consultation, as provided for under para 7 (i) III. Stage (3) (i) (b) of EIA Notification, 2006 is available to the projects or activities or units located within the Industrial Estates or Parks, which were notified prior to EIA Notification dated 14-09-2006, coming in to force. A copy of the O.M. is enclosed as Annexure- 4 for your kind perusal. We would like to bring to your kind notice that Our plant is situated in the Industrial Area namely Industrial Development Area (IDA) Yelumala which has been Notified by the Government of Andhra Pradesh vide G.O. no. 109 dated 9th March 1998 issued. A copy of G.O. is enclosed as ANNEXURE – 5 for your reference. REQUEST -2: The TOR letter has been issued by the Ministry vide letter dated 18th March, 2013. We would like to bring to your kind notice that due to state bifurcation issue and SPCB clarification to the Ministry on conducting Public hearing for the expansion project, we could not be able to submit the Final EIA report to MOEF before 17th March, 2015. Hence we request your goodselves to kindly extend the validity of Terms of Reference by one more year to enable us to submit the Final EIA report.
