The first was written about 2,300 years ago. The second started about 800 years ago. And the third is quite recent, legislated in 2002. In Arthashastra, Acharya Chanakya deals with a common problem: a king who’s running out of money. His advice? Frame rich people for crimes, so the king can seize all their property, and use it to refill the treasury. During medieval times, Inquisitors faced a similar problem: how to pay for the running expenses of the Holy Office of Inquisition? Eventually a lawful solution emerged: appropriate the property of any rich people accused of heresy, and use it to pay for Tribunal’s overheads. The modern State has its own financial challenges. And here again, the law comes to its rescue. PMLA allows the State to attach the property of any person accused of a ‘predicate offence’. The offence can be anything — ranging from real money laundering to that of accepting foreign donations unlawfully. The property can then be confiscated.
