Electronic Logging Devices UPDATE (ELD)

– ELD’s and Supporting Documents

– Many carriers continue to adopt early in advance of anticipated industry wide mandate

– FMCSA using carrier’s ratings to encourage early adoption

• Holds others in the Supply Chain Responsible for Violations

• Unknown how the agency will define of “Coercion” in final rule

• MOU between FMCSA and OSHA – recently signed

Compliance Safety Accountability (CSA) in 2014/15

• SMS Currently Under Attack– Problems with current carrier ratings on the SMS– Recent Industry letter to Secretary Foxx to remove the

scores from public view– FMCSA now using “focused reviews” instead of full

“compliance reviews” – thus do not issue ratings

• SFD Delayed Pending Outcome of Reviews– Uncertain timeline for this rule – continues to slip– Issues for Brokers and Shippers - unknown if any

action to be taken on HR4727
