A REPORI' <XMfiSSlOOED BY THE WAITANGI TRIBUNAL

This report is prepared by Brian HerlilJ,y of Wanganui, whose working life

. covers an early career in teaching (including service in Maori Schools) as

\\ell as twenty years with the Deparbnent of Maori Affairs.

Prior to his retirement he was, for several years, Deputy Registrar of the

Maori Land Court, and upon' retiring established a consultancy business

covering the many and varied problems encountered when dealing with Maori

Estates, shareholding in Maori Land, usage of Maori Land and all aspects of

Maori Land Court work.

The scope of this report is to examine Maori Land Court files to see how the

Court originally detennined ownership of land in the Pakakohi/Ngati Ruanui

rohe, and the basis of that detennination.

INVESTIGATICN REPORT

This is a broadly based instruction and one where it is difficult to get

down to specifics.

The map supplied by the Tribunal staff indicates an area stretching from

about the Whenuakura River to just south of Oeo. The greater part of the

area is within the confiscation line, and the great majority of Maori Land

holdings follow on from Crown Grants.

The ownership lists in the Maori Land Court have their genesis in these

Grants, most of which list only the name(s) of the grantee(s), with the

addition in some cases, of the hapu.

This is in sharp contrast to most other areas in the Aotea District where

the beneficial ownership of a block was, in most cases, settled following an

"Investigation of Title". If a researcher is lucky, the application file

and/or Minute Book will contain lists of claimants who were often members of

a particular family or hapu.

The Maori Land Court has, in its records, a volune containing West Coast

Commissioners' Reports, West Coast Royal Commission 1981, 1982, 1983, 1984

and 1984 Final Report. An extract from this namely, an appendix "List of

All Crown Grants Recomnended for Issue to 7 June 1883" is at folios 3 to 11

of the Rep::>rt by Janine Ford dated November 1991 and the first three

sections namely

Section 1 Native Reserves Waitotara to Patea

Section 2 Native Reserves Waingongoro to Patea

Section 3 Native Reserves Waingongoro to Taungataa

are relevant to this exercise.

I have checked: a good cross-section of the Grants listed - see Schedule B

attached - and in nearly every case Maori Land Court records accord with the

information given in the appendix.

sections 1 and 2 of the appendix give in most cases, the name of the Reserve

which generally accords with the Maori Land Court indices. However,

section 3 names only tw::J Reserves Te K.aue and otunatua but the Maori Land

Court title(s) involved can, in many cases, be picked up fran the name of

the hapu(s) listed under Grantees.

One exception fran the above is Rotarangi which is· in the· upper reaches of

the Patea River. The Investigation of Title hearing was in 1897 and is

recorded in Jud.ge Ward's Minute Book 16. The decision was based largely on

lists hancled in. However, the only reference I was able to locate dealing

with tribal affiliations was at Folio 155 which records the handing in of a

list for the Ngati Tananehe people.

Another record of the Court which deals specifically with tribal claims is

the claim in respect of Waiotur:e near the mouth of the Pi:ltea River. I have

already dealt with this in Section 8 of my sutmission to the Waitangi

Tribunal at Patea on 17 February 1992.

In his decision at 48 Taranaki Minute Book 382 Judge Jack found the block

was held in Trust by the grantee Tauraa for the Pakakohi Tribe.

J anine Ford's report (F26) page 18 also shows under the subheading _ Pate a

District Grant No. 3581 dated 27 August 1883 31 acres 1 rood 22 perches

awarded to Matin Rangibaeata and Tutaki in trust for the waiha:roto and

Ngau:ruahi.ne hapus of the Pakakohi tribe (I think the correct Grant number is

3940, the Grant number and Index number being reversed in the Report).

Note: The West Coast Carmissioners' Reports also contain a 1884 Appendix

which is an update-of the 1883 Appendix but unfortunately some of the

pages are damaged.

The next step in the chain of title for Crown Grants was the making of what

were termed "Freehold Orders" which were really Partition Orders under

Section 15 of the West Coast Settlement Reserves Amendment Act 1913. A

large number of such orders were made iri 1915 and where no further

partitions were made, these are still the title to a number of blocks of

Maori Freehold land.

The object of the exercise is to provide the Tribunal and its staff with the

information it is seeking, and I am not completely satisfied that the above

report does this.

I am aware that in the larger Ngati:ruanui District, the Pakakohi and

Tangahoe and possibly other claimants, are endeavouring to estabiish

themselves as tribes in their oWIi right. It would appear to me that the

identification of tribal and hapu areas, as they were at the allocation of

land holdings, could perhaps best be achieved. by using an older Cadastral

(which is more likely to contain the original section numbers) and the

information in the Maori Land Court records, plus that in the 1883 and 1884

appendices of the Royal Carmission Report to compile a colour or numerically

coded map.
