Variances between budgeted and actual expenditure including the required Material Variances (10% with a minimum value of $10,000 are included in the variance report. SHIRE OF CORRIGIN ANIMALS, ENVIRONMENT AND NUISANCE LOCAL LAW 2014 Applicant: Shire of Corrigin Location: Shire of Corrigin Date: 6 February 2014 Reporting Officer: Heather Talbot, Manager Governance and Compliance Disclosure of Interest: No interest to disclose File Number: LE 0002 BACKGROUND In accordance with section 3.16 of the Local Government Act 1995 a local government is required to review its local laws at least every 8 years to determine if a local law should be repealed or amended. At its October 2009 Ordinary meeting Council resolved to repeal the current Shire of Corrigin Health Local Law and make a new local law relating to health. The Shire’s Environmental Health Officer has commenced the process of reviewing the Shire of Corrigin Health Local Law 1998 with a view to removing certain provisions and including these in the proposed Shire of Corrigin Animals, Environment and Nuisance Local Laws. This approach has been adopted by other Local Governments as the new local laws enable better management of activities within the Shire. Dividing the local laws creates laws that would be better applied utilising the enforcement provisions of the Local Government Act 1995 rather than the Health Act 1911. Principally this applies to the issue of infringement notices (i.e. on the spot fines) which currently cannot be issued due to the Health Act not having the appropriate sections in place to enable this to occur. The Local Government Act 1995 does have provisions to allow authorised officers to issue infringements, therefore adding another enforcement option. The proposed Shire of Corrigin Animals, Environment and Nuisance Local Laws 2014 were based on those adopted by the Shire of Roebourne which was gazetted in 2012. By removing certain provisions from the Health Local Laws, and applying them within the proposed Animals, Environment and Nuisance Local Laws (promulgated under the Local Government Act 1995), authorised officers will be able to better enforce the legislation. COMMENT The Environmental Health Officer has had input into the local laws with assistance from James Trail Consulting. The community will be provided opportunity to comment on the proposed local laws. These comments must be considered by Council. Where alterations will make a local law significantly different to what was proposed the procedure for making the local law must be recommenced. The process for adopting local laws is set out in Section 3.12 of the Local Government Act 1995 and includes:-

1. At the council meeting the person presiding is to give notice to the council meeting of the purpose and effect of the proposed local law;

2. State-wide and local public notice is to be given stating that the Shire intends to make a local law. Advertising is to remain open for at least 6 weeks;

3. As soon as the notice is given, a copy of the proposed local law, together with the public notice and National Competition Policy form are to be provided to the Minister for Local Government and any other relevant ministers;

4. A copy of the proposed local law is to be provided to any person requesting it;

3. As soon as the notice is given, a copy of the proposed local law, together with the public notice and National Competition Policy form are to be provided to the Minister for Local Government and Minister for Health(C/- Director, Environmental Health Directorate);

4. A copy of the proposed local law is to be provided to any person requesting it; 5. After the last day of submissions, the local government is to consider any submissions and

The office of Justice of the Peace is a statutory position that involves a range of duties and responsibilities - most commonly including witnessing of documents such as Affidavits, Statutory Declarations, Enduring Powers of Attorney and Wills. An applicant must satisfy the following criteria for appointment:

1. Australian citizen with a minimum of 12 months residence in Western Australia. 2. Enrolled on the State electoral roll. 3. Of good character and reputation, including (preferably) a record of community service. 4. Demonstrate a willingness and capacity to fulfil all the duties of a justice of the peace when

called upon. 5. Not insolvent under administration. 6. Over 18 and under 65 years of age.

Nominations must be submitted through a State member of Parliament (or a local magistrate for regional areas). Appointees must complete a justices of the peace training course before appointment and ongoing training is required. COMMENT Mrs Manton is an active participant in the Bullaring/Yealering communities and has demonstrated that she is of good character and reputation. She is employed by the Shire of Wickepin and has acted in the role of CEO at the Shire of Wickepin when required. It is recommended that Council supports the application by Natalie Manton for appointment as a Justice of the Peace. 10.1.10. CORRIGIN SENIOR CITIZENS CENTRE – LEASE

Applicant: Shire of Corrigin Location: Reserve 33585, Lynch Street, Corrigin Date: 4 February 2014 Reporting Officer: Heather Talbot, Manager Governance & Compliance Disclosure of Interest: No interest to disclose File Number: A550 BACKGROUND In May 2012 Council was approached by the Corrigin Senior Citizen’s Centre committee to formalise the arrangements the Shire has with them in regards to the Crown Reserve land the Senior Citizen’s retirement village is located on. The land (Reserve 33585) is vested in the Shire of Corrigin and designated for Aged Housing or similar. There are 14 accommodation units and a Community Hall on the land that the committee has built and run, independent of Council over the past 40 years. There has however, never been any formalised lease agreement in place. With the Senior Citizen’s Centre Committee looking to build further units and with an aging committee and Shire staff constantly changing over the years it was agreed that now would be a good time to formalise the arrangement. This will protect the interests of all parties and ensure continuity of the service into the future. COMMENT A draft lease has been prepared by the Shire’s lawyers for approval by the Senior Citizen’s Committee and Council. Once the Lease has been approved by both parties, the lawyers will send the draft Lease to the Minister for Lands for in principle approval. If this is granted the formal lease document will be prepared for signing by both parties, approval by the Minister and registration. The Lawyers are also liaising with the Department of Housing to arrange for the withdrawal and replacement of the absolute caveat that the Department has over the land with regards the Joint venture units. As well the lawyers are in the process of preparing a Management Agreement between the Shire and Corrigin Senior Citizen’s Centre which covers the more of the day to day management over the land. Advice has also been provided to the Senior Citizen’s Committee on the need for individual Residential Tenancy Agreements as prescribed under section 27A of the Residential Tenancies Act 1987(RT Regulations). The proposed subdivision is to realign boundaries of the lots to facilitate the sale of the proposed Lot A on the attached plan. COMMENT The proposal is straight forward and involves the realignment of existing lot boundaries to better reflect landform and to account for the location of the existing buildings on the land which currently traverse the common boundary between the two lots. The subdivision proposal is consistent with the WAPC’s current Rural Subdivision Policy DC3.4 as this applies specifically to lot boundary rationalisation. As such there is no reason why Council can’t support the application. It is therefore recommending that Council unconditionally support the application and authorise the Shire Administration to advise the WAPC accordingly. There is no need for the Shire to request the WAPC to impose any conditions on any approval it decides to grant as vehicle access, drainage, bush fire safety and essential service arrangements are all currently suitable. Main Roads may request a condition requiring approval to the location of a new crossover for Lot B to Brookton-Corrigin Road. Applicant: Neowest Building Pty Ltd on behalf of Co-operative Bulk Handling Ltd (CBH) (Landowner) Location: Lot 500 Walton Street, Corrigin Date: 12 February 2014 Reporting Officer: Messrs Joe Douglas & Steve Pandevski – Consultant Town Planners (Urban & Rural Perspectives) Disclosure of Interest: No interest to disclose File Number: A2012 BACKGROUND This report recommends that a planning application submitted by Neowest Building Pty Ltd on behalf of Co-Operative Bulk Handling Limited (CBH) (Landowner) to construct a 128m2 extension to an existing storage shed at CBH’s grain handling and storage facility on Lot 500 Walton Street, Corrigin be approved subject to conditions. The applicant is seeking Council’s planning approval to construct a 128m2 extension to an existing storage shed at CBH’s grain handling and storage facility on Lot 500 Walton Street, Corrigin. Lot 500 is located in the south-western part of the Corrigin townsite immediately adjacent to the southern boundary of the existing railway reserve (see Plans 1 to 3). Lot 500 is irregular in shape, comprises a total area of approximately 6.599 hectares and has frontage to Walton Street along a portion of its eastern boundary. The land has been extensively developed for ‘rural industry’ purposes and contains a number of structures associated with CBH’s existing grain handling and storage facilities on the land (i.e. sheds, a weighbridge and grain storage bins). Under the terms of the information and plans submitted in support of the application the proposed development will comprise the following key elements:

i) Construction of a 128m2 storage shed extension comprising a width of 9.15 metres and a length of 14 metres (see Plans 4 to 7);

ii) The shed extension is proposed to be used for the storage of sundry equipment and hardware;

iii) The shed extension will be constructed of steel framing and zincalume external wall and roof cladding to match the materials used to construct the existing storage shed;

iv) The shed extension with will comprise a wall height of 4.4 metres and an overall ridge height of 5.1 metres;

v) The shed extension will maintain a setback of approximately 31 metres from the land’s nearest boundary (i.e. its south-western side boundary and over 100 metres from Walton Street);

vi) The area surrounding the shed extension will be retained as bitumen and gravel to enable its continued use by vehicles for access, loading and unloading as required; and

vii) The stormwater drainage to be generated by the additional shed roof catchment is proposed to be discharged to the existing drain and culvert previously constructed to capture and manage stormwater from the existing shed.

COMMENT Town Planning Scheme No.2 (TPS No.2) Lot 500 is classified ‘Industrial’ zone under the Shire of Corrigin’s current operative Town Planning Scheme No.2 (TPS No.2). The key purpose and intent of the land’s current ‘Industrial’ zoning classification is to contain land for the industrial uses in the Shire’s towns. Council’s stated objectives for the development and use of any land classified ‘Industrial’ zone are as follows:

(a) Encourage the consolidation and improvement of industrial development into an area which has been appropriately located and serviced for that purpose.

(b) Protect the amenity of the zone abutting the industrial zone via the establishment of landscaping buffers and the imposition of landscaping and setback land use conditions on any planning approval issued for industrial development, in conformity with the provisions of Schedule No.7 of TPS No.2.

(c) Ensure that no person erects a building in this zone unless the facade of the building is constructed of and/or clad in a building material to a design and specification approved by Council.

The current use of the land for grain handling and storage purposes is most appropriately defined in Schedule 1 of TPS No.2 as a ‘ rural industry’ which is a use class considered to be consistent with the objectives of the land’s current ‘Industrial’ zoning classification in TPS No.2. Under the terms of TPS No.2 the development and use of any land classified ‘Industrial’ zone for the purposes of a ‘rural industry’, including any incidental equipment or hardware storage use as proposed by this application, is classified as being a ‘P’ (permitted) use. As such Council has scope to exercise its discretion and grant the planning approval sought in this particular instance. Compliance with TPS No.2 Development Standards TPS No.2 does not contain any standards specific to the development and/or use of land classified ‘Industrial’ zone for ‘rural industry’ purposes. As such the application has been assessed with due regard for objectives of the land’s current ‘Industrial’ zoning classification and the general development standards prescribed in TPS No.2 for ‘general industry’ uses. Having regard for the information submitted in support of the application, including the setback of the proposed shed extension from all lot boundaries, the design of the proposed extension and materials to be used, the proposed use of the shed extension and future vehicle access and stormwater management arrangements, the reporting officers’ have concluded that the proposal satisfies the various general development standards prescribed in TPS No.2 and may therefore be supported by Council. CONCLUSION It is concluded from a detailed assessment of the application that the proposal to construct a new storage shed extension to support CBH’s existing grain handling and storage facility on Lot 500 Walton Street, Corrigin is consistent with the requirements of the Shire’s current Town Planning Scheme No.2, is unlikely to have a negative impact on the general amenity, character, functionality and safety of the immediate locality and may therefore be approved by Council subject to the imposition of a number of conditions to ensure that the development proceeds in a proper and orderly manner.

13. CHIEF EXECUTIVE OFFICER’S REPORT Country Local Government Reform Policy Forum The CEO attended the Country Local Government reform forum on 18 February 2014. The future of country local government was considered including discussions on reform, amalgamation, function, representation, size and shape. An information paper will be prepared by WALGA later this year and released to the public. There is a need within local government to accept that there will be changes and amalgamations in the rural areas. Enterprise Agreement The CEO advised that discussions with staff have commenced on the new enterprise agreement, with the first meeting held last week. Discussions and negotiations are progressing, with the first draft of the new agreement provided to staff for their feedback. Staff The CEO informed Council of new staff members commencing at the end of February. Deb Whitehead has been employed as a Customer Service Officer and Greg Whitehead as a Plant Operator, who will be responsible for town maintenance. Katherine Weguelin has advised that she is pregnant; Anita Stone and Pippa Davies will soon be leaving to take up parenting duties. Tanya Ludlow, who is currently on parental leave, has advised that she will not be returning and will be resigning from her position.

14. PRESIDENT’S REPORT The Shire President advised that she had attended the following meetings and events

Cr Pridham gave an update of the evening which was well attended and a great success. Cr Pridham informed Council that he and Emily Hewett attended the Roe Tourism meeting on 18 February 2014 and provided a brief overview of the discussions held at the meeting. Cr Hickey advised that Shelly Crombie has passed her JP Course and would soon be commissioned.
