Freedom Crossing CondominiumUnit Owner Policy Information

Under Pennsylvania law, a condominium association’sinsurance responsibilities are divided between theassociation and the unit owner. The law requires theassociation to purchase insurance for all common propertyat the associations and for the units themselves. The unitowner is responsible for purchasing insurance for anyimprovements made to the units at any time since it was firstbuilt and for the unit owner’s personal property.

Your board of directors has met the association’s insuranceobligations by purchasing a Master Policy underwritten bythe Travelers Insurance Company. It is this policy thatprovides coverage for your unit, including exterior andinterior walls, built-in appliances and cabinets, and anyother property that forms a part of the real estate.

But the Unit Owner is responsible to purchasecoverage for any improvements made to the unit,the unit owner’s personal property, and the unitowner’s personal liability. This responsibility is metby purchasing a Unit Owner’s Policy (commonlycalled a Form HO-6).

The association master policy is subject to a $5,000deductible. Under certain circumstances, the board maymake a resident responsible for the master policy deductible. If the deductible should become the unit owner’sresponsibility, it will be paid by either the BuildingCoverage or Loss Assessment Coverage portion of the unitowner’s policy, depending on the nature of the loss. Becertain your policy contains a minimum of $10,000 ofBuilding Coverage and $10,000 of Loss AssessmentCoverage to cover this exposure.

Most insurance agents have not been trained in the specialinsurance needs of association living and so may not knowhow to tailor your unit owners policy to match the coveragesprovided by the master policy.

Gallina and Sons specializes in association insurance andour personal insurance agents are specially trained in theunique insurance challenges of association living. Ouragents would be happy to assist you with all of yourpersonal insurance needs or to provide instructions to yourcurrent agent if he or she is not specially trained inassociation insurance.

Your Unit Owners Policy should includethe following coverages:

T At least $10,000 of Real Property coverage. This coversthe master policy deductible if the loss arises in yourunit and any improvements it is your responsibility toinsure. The limit should be increased to match the fullvalue of any improvements it is your responsibility toinsure.

T Personal Property coverage. This covers your personalbelongings, including furniture, clothing, electronics,and other movable property. Your limit should be highenough to replace all of your personal belongings. Claims should be paid on a Replacement Cost basis.

T Loss of Use coverage. This covers expenses you mayincur because of a loss suffered to your property,including the cost to secure other lodgings while repairsare made to your home.

T Personal Liability coverage. This coverage protects youif you are responsible for an injury to another person ordamage to someone else’s property. You shouldpurchase at least as much liability coverage as you haveassets to protect.

T At least $10,000 of Loss Assessment coverage.

Because you live in an association, you mayoccasionally be required to pay your share of anuncovered loss, sometimes including your share of themaster policy deductible. Loss assessment coveragewill pay this amount on your behalf.

T Personal Injury coverage. Because you are a memberof an association, you may be upon to vote atmeetings, give your opinion about associationgovernance, or enforce association rules. Theseactivities can give rise to defamation or invasion ofprivacy claims against you not covered by ahomeowners policy without Personal Injury coverage.

T Volunteer Acts coverage. A necessary companion toPersonal Injury coverage and the association’sDirectors and Officers Liability coverage, VolunteerActs coverage provides legal defense andindemnification for suits brought against you forwrongful acts you may commit when volunteeringyour time at the association.
