Dear Wayne Shores:
We have considered your request for disposal of thirteen hundred (1300) tons of petroleum contaminated soil from former Heidenreich Liquors Site, 102 West Main St. , GARDNER, KS. (Analysis provided).
Based solely on the analysis provided, the waste is not a characteristic hazardous waste with respect to the constituents tested. As stated in K.A.R.28-31-261, it is the responsibility of the generator to determine whether or not a waste is a hazardous waste by either knowledge of process or by proper testing by a Kansas Department of Health and Environment (KDHE) certified lab. If there are questions as to the status of this waste, please contact me at 785-296-0681. If Kansas CVS Pharmacy LLC is confident the material for disposal is not a hazardous waste for any characteristic or listed constituent not included in the testing, the following applies.
Approval is given to dispose of this waste at the Johnson County Landfill (Permit 0263), provided the following conditions are met:
1. Approval to deliver the waste must be obtained from the landfill operator prior to transporting the waste to the landfill The final decision on whether to accept or reject the waste rests with the landfill operator. Please contact the Special Waste Department, at 800-963-4776, to obtain approval. If the landfill operator refuses to accept this waste, you should contact us to determine alternate disposal options.
2. The waste must be transported separately to the landfill and be identified to the operator upon delivery.
3. Kansas Administrative Regulation 28-29-108(r) (12) and (13) requires solid waste disposal facilities to maintain a log of commercial or industrial wastes received such as sludges, barreled wastes, and special wastes. The log must indicate the source and quantity of waste and the disposal location thereof. The special waste authorization number should be used as identification when entering the shipment into the log.

4. This approval is valid for disposal of the waste described and in the amount shown above. If additional shipments are required, you must contact us to receive another disposal authorization.
5. Operating standards as defined by K.A.R. 28-29-108(k) prohibit the disposal of liquid waste. "Liquid waste" means any waste material that is determined to contain "free liquids" as defined by method 9095A, revision 1, paint filter liquids test, as described in "Test Methods for Evaluating Solid Waste, Physical/Chemical Methods," EPA Pub. No. SW-846 dated December 1996. For purposes of this disposal authorization, all waste for disposal must be able to pass the "paint filter test".
6. Any change in the process producing this waste, any change in the materials used in producing this waste or any other change to this waste stream requires that a new Special Waste Disposal Authorization be obtained prior to disposal.

Good afternoon,
Based on our review of available information, the soil appears to meet the criteria to be considered "Uncontaminated Soil" under KAR 28-29-501 and clean rubble as defined by KSA 65-3402(w); however, please note that it is the property owner/consultant's responsibility to verify that the material meets the criteria. Please also note that if the soil being moved offsite presents an odor or visually indicates that it is contaminated (staining), then the material does not meet the criteria and would be considered to be solid waste, regardless of previous analytical data.
See below for reference on KAR 28 - 29 - 501. Thank you.
28-29-501. Uncontaminated soil. For the purposes of K.S.A. 65-3402 and amendments thereto, "uncontaminated soil" shall mean soil that meets all the following
conditions: (a) The soil meets the definition of "construction and demolition waste" in K.S.A. 65-3402, and amendments 130 thereto. (b) The soil has not been generated at a facility that is under state or federal oversight for the investigation or cleanup of contamination, unless the state or federal project manager who is providing the oversight approves the use of the soil as clean rubble, as defined in K.S.A. 65-3402 and amendments thereto. (c) The soil exhibits no characteristic that would be expected to create either of the following if the soil is managed as clean rubble: (1) An odor or other nuisance that would be offensive to a reasonable person; or (2) an obvious risk to human health or safety or the environment, due to any physical or chemical property of the soil. (d) The soil is determined to be suitable for use as clean rubble by one of the following methods: (1) The generator of the soil determines that there is no indication of contamination in the soil. Indication of contamination shall be based on information readily available to the generator of the soil, including the following: (A) The visual appearance of the soil; (B) the odor of the soil; and (C) all known past activities at the site from which the soil is being removed. (2) The generator of the soil obtains analytical data from representative soil samples according to the requirements in subsection (e) and all of the following criteria are met:
(A) The soil is not a hazardous waste. (B) Total nitrate plus ammonia is less than 40 mg/kg. (C) The level of total petroleum hydrocarbons is less than N=1, as described in section 5.0 of "risk- based standards for Kansas" ("RSK manual"), published in June 2007 by the department and hereby adopted by reference, including all appendices. The GRO tier 2 value shall be 39 mg/kg and the DRO tier 2 value shall be 2000 mg/kg. (D) If the analyte is a chemical other than nitrate, ammonia, or a petroleum hydrocarbon, all of the following criteria are met: (i) There is no more than one anthropogenic analyte present in the soil. For the purposes of this regulation, the term "anthropogenic analyte" shall mean a chemical or substance present in the environment due to human activity. (ii) The anthropogenic analyte is listed in the KDHE tier 2 risk-based summary table in appendix A of the RSK manual. (iii) The concentration of the anthropogenic analyte is less than the level listed in the KDHE tier 2 risk-based summary table for residential scenarios for the soil pathway or for the soil to ground water protection pathway, whichever is lower. (3) The secretary determines that if the soil is used as clean rubble, the soil will not present a risk to human health or safety or the environment, based on information provided by the generator of the soil. The generator of the soil shall submit the following information to the department: (A) Analytical reports from representative soil samples; and (B) the following information, if requested by the department: (i) Analytical reports indicating naturally occurring background concentrations at the site from which the soil is being removed; (ii) the cumulative cancer risk level of all analytes; (iii) the hazard index value, as defined in K.A.R. 28-71-1, of all analytes; and (iv) any other information required by the department to evaluate the potential risk to human health or safety or the environment. (e) If analytical data is used to meet the conditions of this regulation, the following requirements are met: (1) At least one representative sample shall be collected and analyzed for each 500 cubic yards of soil. (2) Each analysis shall be performed and reported by a laboratory that has departmental certification, if this certification is available, for that analysis. (3) Each analytical report shall include the following information: (A) The results of each analysis; 131 (B) quality control data; (C) a copy of the chain of custody for each sample; and (D) a statement signed by the generator that the analytical results are representative of the soil. (4) The generator shall maintain each analytical report on file for at least three years after the report is received and shall make the report available to the department upon request. Hi Dean. We really appreciate everyone's efforts on this. Per your request, attached is the lab report for the attached data table and figure sent July 19. For your record, I have also attached the lab reports for the other test pit sampling completed at the site. For ease of review, I have also attached a brief graphical presentation of the data from the excavated stormwater retention areas sent earlier to Deanna. As noted, the soil has been stockpiled adjoining each area and excavation activities in the stormwater retention areas were generally to a depth of 9 to 10 feet. At this point, the soil would be going to a future redevelopment site in Overland Park which is owned by People's Bank. The soil would be used on proposed commercial development parcels. As noted, we believe the proposed export soil meets the criteria for this proposed reuse. Would it be possible to get the determination by the end of business today? The general contractor has informed us that logistically this stockpiled soil needs to be removed to adequately continue with the CVS site construction work. Best. - Dana

Hi Dean. Per my voicemail, we received the confirmation analytical results for the test pits: LP-4A ,TP- 6A, TP-7A, TP-12A (Stepout 1)- and TP-13 (75' feet west of TP-12) in the un-impacted proposed stormwater retention areas of the Gardner site. No evidence of staining, odors or organic vapors were identified in any of the test pits. The prior lab data indicated lab VOC artifacts and low level TPH-HRH believed associate with natural organic content in the soil. The recent confirmation lab results
indicated that all samples were non detect for VOCs and TPH with the exception of one low level detection of TPH- MRH in the test pit TP-7A. Prior results from adjoining TP-7 indicated ND for TPH- MRH. Based upon the results we would like to reuse this soil (between 2000 to 3,000 cy) at a nearby future subdivision in Gardner as unrestricted general fill. While there is no evidence of a release in these soils, we want to double check our proposed handling with KDHE. Of course, the developer/ contractor would like to keep moving on this as soon as practicable as the soil management is key to their schedule. The Kansas Department of Health and Environment (KDHE) has completed its review of the document titled "Plans & Specifications for Vapor Mitigation System, Proposed CVS Pharmacy #10862, NWC W. Main and N. Center Streets, Gardner, Johnson County, Kansas." The document was submitted by Terracon, on behalf of Kansas CVS Pharmacy LLC, and received by KDHE via email on September 15, 2017. Preparation and submittal of the document were in response to requirements contained in the Voluntary Cleanup and Property Redevelopment Program Agreement 17VCP0008, which was executed on June 21, 2017.
KDHE hereby provides approval of the vapor mitigation system plans and specifications document and requests the following:
1. In the vapor mitigation system (VMS) installation report to follow, KDHE requests a discussion and/or work plan/manual be provided related to the operations, maintenance and monitoring of the VMS and its effectiveness in treating any potential vapor intrusion (VI) and indoor air issues at the site.

The VMS plans that we submitted require a slight modification (with the weather, we are completing the install this week, and I am on site now inspecting the initial phase of this installation). The CVS calls for a 4 (four) inch concrete slab over the VMS membrane, but the plans detail a 6 (six) inch concrete slab (please see detail 7 (seven) in page 2 (two) of the
approved plans). This is the only ammendment to these plans. The engineer is writing this up. and we will have this in writing today, but I wanted to inform you first.
Do you forsee this modification (going from a 6 (six) inch slab to a 4 (four) inch slab) being an issue?

APPENDIX J VAPOR MITIGATION SYSTEM INSTALLATION
CHRONOLOGY
9/25/2017: Initial VMS inspection site visit to verify the sub-floor soil. It was noted that the soil type was not the correct specification (see photo) which required removal and replacement with the specified sub-floor gravel.
10/09/2017: Returned to verify correct installation of sub-floor gravel, inspect and verify installation of VMS components into the sub-floor gravel are correctly installed and correctly connected to the riser pipes as specified in the plans approved by KDHE.
10/11/2017: Inspected the installation of the first membrane layer to specification including the
seals around the penetrations, ample overspray, and the correct overlap.
10/12/2017: Inspected the completion of the initial membrane layer installation including taking multiple coupons, smoke testing, and sealing the bottom membrane layer. Top layer of membrane was installed according to specification, and sealed according to the specified plans.
10/17/2017: Arrived to inspect the concrete pour over sub-floor VMS membrane and components. Holes were made in the western portion of the sealed membrane layers when spikes were driven through the VMS membrane and into the subfloor. The VMS membrane installation contractors returned to seal the holes created in the membrane, and the membrane was smoked tested again, and sealed according to specifications. This allows the VMS membrane contractors to warranty the membrane layer. The concrete was poured over the eastern half of the membrane that was not compromised, and remained sealed, tested, and inspected.
10/18/2017: Inspected the final concrete pour over the western half of the re-sealed and re-tested VMS membrane system. Documented the overspray and correct installation and thickness of the system as specified in the approved plans.
12/1/2017: Inspected the riser pipe components including the correct valve installation, connections and riser equipment.

1/26/2018: Inspected the final components of the VMS installation including the placards, vents, and access boxes as per the specifications set forth in the approved KDHE design plans. The Vapor Mitigation System at the CVS Gardner site has been installed according to the submitted specifications.
